1. CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting
to order at 7:00 p.m. and declared a quorum present.
2. CONSIDER APPROVAL OF THE MINUTES OF MAY 20, 1993 - The Commission
reviewed the minutes of June 17,1993. Dewey Brown moved, seconded by Gary Wells,
to approve the minutes as written. A vote on the motion was recorded as follows:

FINAL PLAT - OWASSO COMMERCIAL CENTER lII (29- 21 -14) - A Request for
a Review of the Final Plat for Owasso Commercial Center III, an Addition to the City
of Owasso; Being a Replat of a Portion of Lot 1, Block 1, Owasso Commercial Center,
An Addition to the City of Owasso, Tulsa County, Oklahoma. Owasso Commercial
Center III is Generaly Located just West of the Owasso Cemetery on E. 76th St. North.
This plat, essentially, is the same plat that had received previous approval from the
Planning Commission and the Owasso City Council with the exception of a minor change
in one lot line. The lot line that has been changed involves the lot line shared by Lots
1 and 2 of Block 1 in the northern portion of the proposed plat. The final plat for Elm
Creek Commercial Center III complies with the Owasso Subdivision Regs; therefore, the
staff recommends approval of the final plat provided all TAC conditions are met

(including relocating of private sewer lines of righ -of -way is to be dedicated and
stormwater detention is addressed), prior to any council action.

4. FINAL PLAT - ELM CREEK CLINIC (29 -21 -14) - A Request for a Review
of the Final Plat for Elm Creek Clinic, an Addition to the City of Owasso; Being a
Resubdivision of a Portion of Lot 1, Block 19, Elm Creek Estates, Tulsa County,
Oklahoma. Elm Creek Clinic is Generally Located just North of Owasso Lumber on the
East Highway 169 Service Road.
Elm Creek Clinic is proposed one lot - one block subdivision, located just north of
Owasso Lumber on the East Highway 169 service road. The area contained within the
proposed plat was previously contained within Lot 1, block 19 of Elm Creek Estates.
The property contains approximately 30,046 square feet and is zoned CS (Commercial
Shopping Center District). Due to is simplified nature (one lot - one block), staff is
requesting that this be processed as a final plat.
The final plat for Elm Creek Clinic complies with the Owasso Subdivision Regulations;
therefore, the staff recommends approval of the final plat subject to the point of
beginning being indicated on the plat and "Communication Service" being added to the
Deed of Dedication, Section 1, Subsection B, Paragraph 2 prior to this item being
forwarded to the Owasso City Council for approval.

5. PROPOSED TEXT AMENDMENT - OWASSO ZONING CODE - A City Initiated
Request to Amend the Zoning Code of the City of Owasso, Oklahoma, Relating to
Chapter 12, Creating Section 1260, "Nonconforming Uses Limit Other Uses."
The Community Development Department recently received and approved two building
permits for auto related businesses within commercially zoned property located at 206
and 208 N. Main Street. One of the uses, an auto body shop, was required to be heard
by the Owasso Board of Adjustment, and a public hearing was held for that use in 1992.

The other use, an automotive business providing basic service and minor repair, and was
permitted by right and no Board of Adjustment action was required.
Mr. Rooney explained that one could reach the conclusion that automobile body shops
and repiar services are not compatible with single family housing. However, the Owasso
Zoning Code contained no prohibition of such "dual" use when one of the uses is a pre-
existing, non - conforming use, be it commercial, industrial, office, or residential zoning.
Responsible planning dictates that unrelated dual uses on one lot is not favorable and not
to be embraced by any community.
While the underlying zoning is commercial, this is an older portion of the community and
much of the surrounding development occurred quite some time ago and is residential
(single and multi- family) in nature despite its underlying zoning. While it is important
for a zoning code to not be perceived as anti- development with too many restrictions, it
is also a priority to preserve the integrity of previously developed areas as well.
Mr. Rooney recommended Planning Commission approval of the text amendment to
Chapter 12 of the Owasso Zoning Code, creating Section 1260, "Nonconforming Uses
Limit Other Uses ". Said amendment to read as follows:
1. Each existing and proposed use, including all accessory buildings and
uses, shall be located on a lot or a parcel of land having a required area
for each such use.
2. These uses shall be so located that the lot or parcel of land can be divided
into smaller lots or parcels of land, each of which will contain not less
than the required area, and on each of which the number and location of
structures will comply with the requirements of this Ordinance when
considered as a separate lot or parcel of land.

6. SITE PLAN REVIEW - CRISMOND PHYSICAL THERAPY A Request for a Review
the Site Plan for Crismond Physical Therapy will be located on the East Highway 169
service road, just north of Owasso Lumber.

Crismond Physical Therapy is a proposed physical therapy clinic to be located on
property contained within the Elm Creek Clinic final plat (See Item No. 4). The
applicant is proposing a 2400 square foot building for medical uses, accompanied by 18
parking spaces. In addition, a free - standing sign is also being requested by the applicant.
The zoning of the property, CS (Commercial Shopping Center District), does permit a
physical therapy office.
Staff recommends approval of the site plan conditioned upon the following:
1. A detailed landscaping plan be submitted and approved by the City
Planner prior to the issuance of any building permit.
2. A pre - construction meeting be held between the contractor and the
community development staff prior to any construction occurring.
3. An additional handicapped parking space to be located directly opposite
the entry of the proposed office.

7. SITE PLAN REVEIW - APOLLO CAR WASH (30- 21 -14) - A Request for a Review
of the Site Plan for Apollo Car Wash. The Car Wash will be located on E. 76th Street
North, East of Highway 169 Between Perry's Restaurant and the Owasso Veterinary
Hospital.
The applicant is proposing a 7080 square foot building which would house both a car
wash portion and a vacuum area. As you may remember, access to this property was
limited to one thirty -five foot access drive from E. 76th Street North. The approximate
locations of this access point have been added to the proposed site plan. The Planning
Commission noted that the site plan submitted was lacking key information. Therefore,
Gary Wells motioned to deny the site plan. Dewey Brown seconded the motion. A vote
on the motion was recorded as follows:

1. CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting
to order at 5:30 p.m. and declared a quorum present.
2. SITE PLAN REVIEW - APOLLO CAR WASH (30 -21 -141 - A request for a review
of the site plan for Apollo Car Wash. The car wash will be located on E. 76th Street
North, east of Highway 169, between Perry's Restaurant and the Owasso Veterinary
Hospital.
Mr. Rooney presented the site plan to the Planning Commission. Mr. Wells asked if the
drainage for the site plan had been looked at by the City staff, and wanted to make sure
that this property would not drain into the abutting development. Mr. Rooney explained
that drainage was looked at during the platting stages, and that the property currently
drains to the south and no additional volume of water would run -off this property when
it was developed.
Mr. Imbriano asked Mr. Rooney about the traffic in the area and whether this was or
was not a concern to staff. Mr. Rooney explained that traffic was indeed a problem in
this area and felt it would be a problem regardless of what type of development occurred
on this lot and that limiting this development to one access point only was recommended
by the staff.
Dewey Brown moved, seconded by Gary Wells, to approve the site plan with staff's
recommendations. A vote on the motion was recorded as follows:

SUBJECT: FINAL PLAT - BARRINGTON POINT
DATE: August 12, 1993
BACKGROUND:
The Owasso Planning Commission reviewed the preliminary plat for Barrington Point at its
June 15, 1993 meeting. At that meeting, the Owasso Planning Commission unanimously
recommended approval of the preliminary plat for Barrington Point subject to the conditions of
the Technical Advisory Committee being met prior to final plat submittal. A copy of the staff
memorandum from Barrington Point's preliminary plat review is enclosed for your information.
The developer, Mr. Kourtis, has requested that the area contained within the Barrington Point
preliminary plat be platted in three separate phases. Contained within your packet are plats for
Barrington Point, Barrington Point II, and Barrington Point III.
The final plats for Barrington Point was presented to the Technical Advisory Committee at its
August 4, 1993 meeting. At that time the following additional changes were recommended to
be made to the final plats:
Add an 11' u/e across Lots 24 & 25 of Block 2.
Add a 5' u/e to the south line of Lot 1, Block 1.
Add two 5' u/e on common lot line of Lots 5 & 6, Block 2.
Add two 5' u/e on common lot line of Lots 12 & 13, Block 2.
Add two 5' u/e on common lot line of Lots 18 & 19, Block 5.
Add a 5' u/e on the west line of Lot 12, Block 5.
Add two 5' u/e on common lot line of Lots 14 & 15, Block 4.
Add two 5' u/e on common lot line of Lots 21 & 22, Block 3.
Add two 5' u/e on common lot line of Lots 16 & 17, Block 3.
Add two 5' u/e on common lot line of Lots 12 & 13, Block 3.
Add two 5' u/e on common lot line of Lots 35 & 36, Block 3.
Add a 5' u/e on south line of Lot 12, Block 4.

Because the developer requested that the land area be platted into three separate groups, this did
require some changes to the construction plans above and beyond what was submitted for review
at the preliminary plat stage. Unfortunately, these amended plans were not available at the time
of the packet preparation. Construction plans for all three phases will be available the evening
of the 26th, as well as a staff recommendation from the Engineering Department. Please note
that if these construction plans are not ready or approved by the Engineering Department, staff
will request that no action be taken on the final plats.
RECOMMENDATION:
Based upon the review by the Technical Advisory Committee, staff recommends approval of the
final plats for Barrington Point, Barrington Point II, and Barrington Point III upon receiving a
favorable recommendation from the Engineering Department regarding the Construction Plans.

SUBJECT: PRELIMINARY PLAT - BARRINGTON POINT
DATE: June 7, 1993
BACKGROUND:
The City of Owasso initially received a preliminary plat for Barrington Point in May for review
at the Technical Advisory Committee and Planning Commission meetings. Due to several
"changes" recommended at the TAC meeting and due to staff s recommendation of the developer
providing access to unsubdivided land to the east, staff recommended that Mr. Kourtis resubmit
the preliminary plat for Barrington Point in order to address these concerns and to allow the
Planning Commission to view both Barrington Point and Windsor Lake III together as they are
abutting properties. The enclosed preliminary plat has addressed those changes previously
recommended by staff.
At the June 2, 1993 TAC meeting, the Barrington Point preliminary plat was reviewed again.
The following comments /recommendations are a direct result of that meeting:
PLAT
1. All rear, back to back easements a minimum of 11 feet.
2. Provide an access easement to cover a 38 foot radius cul -de -sac (pavement type to be the
same as remainder of street).
3. Provide an 8 inch PVC conduit at the entrance to the subdivision from 129th E. Avenue.
4. Provide a 3 inch PVC conduit across N. 130th E. Avenue, from Lot 3 of Block 2 to Lot
8 of Block 3.
5. Provide a 4 inch PVC conduit across N. 133rd E. Avenue, from Lot 8, Block 4 to Lot
11, Block 5.
6. Add 7.5 foot easements north and south of the property line shared by Lots 8 and 9 of
Block 4.
7. Eliminate Lots 19 through 23 of Block 2 as these have been determined to be needed by
the Project Engineer for drainage detention area.
8. Add a limits of no access to north and south side of entry road.
9. Street names to conform to staff copy.
10. If "Diainage Detention Area" is to be utilized as "Park Area" it needs to be designated
as such on the plat.
COVENANTS
1. Item No. 4, reference to Homeowners Association should be changed to "Barrington
Point Association" rather than "Windsor Lake Association."
2. Item No. 15, "Electric, Telephone, Cable Television Service" needs to be changed to
conform with that of recently recorded subdivision plats.
Construction plans were originally submitted and reviewed by staff for the first submittal.
Adjustments to these plans will need to be made and a copy of these plans are available in my
office for review at any time. In addition, the construction plans for Barrington Point will be
available at the meeting for any review.
RECOMMENDATION:
Based upon the review by the Technical Advisory Committee, staff recommends approval of the
preliminary plat for Barrington Point conditioned upon the above changes being made prior to
final plat submittal.

BACKGROUND•
The City of Owasso has received a lot split request from Mr. Ronnie Sink for property intended
to be used for a beauty salon located on 123rd East Avenue, just south of Dr. Russell Cox's
Chiropractic Office on 123rd East Avenue.
This lot split is unusual in nature due to the fact that only 1 foot is being requested to be split
from the subject property (Lot 2, Block 1, Elm Creek Condominiums ). Mr. Sink, upon
obtaining the required survey for purchase of the subject property was advised that the building
which houses Mr. Cox's Chiropractic Office located on Lot 1, Block 1, Elm Creek
Condominiums or 8434 N. 123rd East Avenue, was approximately .80 feet over the shared
property line. Previously, both lots were owned by Dr. Cox.
It is important to note that there is no side yard setback requirement for structures within an OM
zoning district and therefore Dr. Cox had intended to build at zero lot line. However, an error
must have occurred in the placement of the structure on the site, thus resulting in the .80 foot
error.
If the 1 foot lot split is granted from Lot 2 to Lot 1, it should have no adverse effects on Mr.
Sink's construction efforts on Lot 2, Block 1 as his building is intended to be 30.30 feet from
Dr. Cox's structure. In addition, the zoning code requires that OM zoned property should have
a minimum of 50 feet of street frontage. If the lot split is approved, the frontage on Mr. Sink's
lot would be 79.30 feet, well beyond that requirement.
RECOMMENDATION:
Staff recommends approval of the lot split request.
