CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting to order at 7 :00 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF JULY 16, 1992 - The Commission reviewed the minutes of July 16, 1992. Gary Wells moved, seconded by Pat Imbriano, to approve the minutes as written. A vote on the motion was recorded as follows: Gary Wells - Yes Pat Imbriano - Yes Charles Willey - Yes Dewey Brown - Yes Ray Haynes - Yes The motion carried 5 -0. 3. OZ -89 - PETE KOURTIS (2114) - A REQUEST TO REZONE A TRACT OF LAND FROM RS -2 TO RS -3 AND RD, LOCATED APPROXIMATELY 1/4 MILE NORTH OF THE NORTHEAST CORNER OF 129TH EAST AVENUE AND 86TH STREET NORTH - The Chair introduced the case and the staff review was given by Steve Compton. The subject tract is vacant, 40 acres in size and is located north of the Owasso High School complex with 1320 feet of frontage on 129th East Avenue. Currently zoned RS -2, it is abutted on the north and east by vacant land zoned RS -2, on the south by the high school zoned AG, and on the west by 129th E Ave and vacant land zoned RS -3. The applicant is requesting that the tract be rezoned to a combination of RS -3 and RD. Staff recommended approval of RD zoning on the south 300' of the tract, and that the remainder of the tract remain RS -2. The applicant was present. Owasso Planning Commission Minutes of August 20, 1992 Page 2 Following discussion, Charles Willey moved, seconded by Pat Imbriano, to recommend to the City Council that the south 300' of the tract be rezoned from RS -2 to RD, and that the remainder of the tract remain RS -2. A vote on the motion was recorded as follows: Charles Willey - Yes Pat Imbriano - Yes Dewey Brown - No Gary Wells - Yes Ray Haynes - Yes The motion carried 4 -1. 4. OLS -78 GEORGE YOUNG (3114) - A REQUEST FOR A LOT -SPLIT ON LOT 1, BLOCK 34 OF ORIGINAL TOWN OF OWASSO, TULSA COUNTY, OKLAHOMA, LOCATED AT THE SOUTHWEST CORNER OF SOUTH MAIN AND FOURTH AVENUE - The Chair introduced the case and the staff review was given by Steve Compton. The subject tract consists of one large vacant lot zoned IL. It is abutted on the east by an abandoned single - family structure zoned RS -3, on the north and west by industrial lots zoned IL, and on the south by the city's garage facility zoned AG. The applicant is requesting that it be split into two lots. There is a concrete drainage ditch located along the west side of Main Street. Staff had a concern about access from Main Street to the created lots. If access from Main is anticipated, staff would require that piping be installed along the entire length of each lot as they are developed. The applicant was present and expressed concern about installing the piping. Following discussion, Gary Wells moved to approve the lot split with the condition that drainage pipe be installed along the entire length of each newly created lot as it is developed if access to the lot is from Main Street. Motion was seconded by Dewey Brown and a vote on the motion was recorded as follows: Gary Wells - Yes Dewey Brown - Yes Pat Imbriano - Yes Charles Willey - Yes Ray Haynes - Yes The motion carried 5 -0. 5. A vote on the motion was recorded as follows: Charles Willey - Yes Pat Imbriano - Yes Gary Wells - Yes Dewey Brown - Yes Ray Haynes - Yes The motion carried 5-0 and the meeting was adjourned at 8:20 p.m. Chairperson Secretary Date MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER SUBJECT: STAFF CASE REPORT OZ -90 (2914) DATE: October 7, 1992 BACKGROUND: The subject tract is located north and east of the northeast corner of the intersection of Highway 169 Service Road and 80th Street North. It is vacant, approximately 2.8 acres in size, and zoned Commercial Shopping (CS) District. It is abutted on the north by manufacturing uses zoned Industrial Light (IL) District, on the east by an apartment complex zoned Residential Multi- Family Medium Intensity (RM -2) District, on the south by vacant land zoned CS, on the southwest by the Mazzio's Restaurant zoned CS, and on the west by vacant land zoned CS. The applicant (Mingo Manufacturing) is requesting that the tract be rezoned to IL in order to provide additional space for the expansion of their existing business. The Owasso Comprehensive Plan designates the subject tract to be appropriate for either medium intensity commercial or medium intensity residential uses. In a typical location the requested IL zoning district would not be appropriate; however, in this case high intensity zoning districts IL and RM -2 exist on two sides of the subject tract. The other two sides are abutted by medium intensity districts (CS) that will provide a transitional buffer between this area and adjacent streets. In addition, if there are concerns about the appropriateness of the IL abutting the apartments it should be recognized that the Zoning Code does consider such land use relationships. It would require that all buildings be set -back from any residential property lines a minimum of 75'. The code also require that all manufacturing uses be conducted within enclosed buildings and a screening wall or fence would be required to be erected along any property line adjacent to a residential district. On the other hand, if the tract remains commercial, set -backs are 10' and outside sale activities could occur. The requirement for a screening fence or wall between commercial and residential uses is the same as would be required for a manufacturing use. It is important to note at this point that prior to any development occurring, platting and proper access from 80th Street North would be required even though it is anticipated that internal circulation will occur between the current business location and the facility expansion that is proposed on the subject tract. Finally, when this area is fully developed, the subject tract will be completely isolated. It will be an interior tract that has industrial, apartment, and commercial uses abutting it on all four sides and will be a better neighbor to adjacent residential uses than the existing commercial zoning might allow (i.e. Price -Rite and Three Lakes Subdivision). RECOMMENDATION. Based upon the physical facts outlined above and the existing zoning patterns in the area, I recommend approval of the requested Industrial Light (IL) District. MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER SUBJECT: STAFF REPORT ON OLS -79 DATE: October 9, 1992 BACKGROUND: The subject lot (Lot 3 - Block 9 of Ator Heights Third Addition) is located at the northeast corner of 86th Street North and Cedar Street and is approximately .87 acres in size. The southwest portion of the lot contains the Kentucky Fried Chicken Restaurant and the remainder of the track is vacant. The Kentucky Fried Chicken part of the lot has existed for some time at a size of 80 feet by 120 feet (no lot -split action was taken when this originally occurred). Since that time the applicant has acquired the lot and now wants to increase the size of the Kentucky Fried Chicken part to 98 feet by 134 feet and formally split the lot (see Plat Of Survey map). Both lots that would be created would meet the minimum bulk and area requirements of the zoning code. This case was presented to the Technical Advisory Committee at their October 7th meeting and they recommended approval of the requested lot- split. However, they noted that the survey presented by the applicant did not show a 15' utility easement along the south and east sides of the lot. Both water and sewer lines are located within this easement and in addition ONG has a private easement in the same general location (Book 2979, Page 379 for specific location) for a 4" gas line. RECOMMENDATION: Based upon the above staff review and the review conducted by the members of the TAC, I recommend approval of OLS -79. SECONDARY ISSUE: For your information the applicant has submitted a request to the Oklahoma Department of Transportation to acquire a small piece of surplus highway right -of -way that will add approximately .22 acres to the remainder of Lot 3 (see attached right -of -way survey). Access to this new enlarged lot from either 86th Street and /or Garnett would be restricted to the northeast or southwest corners of the lot by ODOT. This is not a vart of the lot -split request. MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: MIKE AUGUSTINE, OPWA DIRECTOR SUBJECT: WINDSOR LAKE II - FINAL PLAT DATE: October 9, 1992 BACKGROUND: The final plat of Windsor Lake II Addition is generally located south and east of the Southeast corner of 96th Street North and 129th East Avenue. The tract is abutted on the north by Windsor Lake and Pleasant View Estates Additions zoned RS -2 and RE, on the east and south by vacant land zoned RS -2 and on the west by vacant land and church property zoned RS -2 and AG. The proposed final plat area is zoned RS -2 (Residential Single - Family Medium Density) which has a requirement of 75' of frontage and 9,000 square feet of lot area. The proposed plat has lot areas of 12,500 square feet and greater and the average frontage is 95 feet. The Technical Advisory Committee reviewed the proposed final plat at their October 7, 1992 meeting and the following items are from this meeting and staff review. 1. Radii for the cul -de -sacs reverse curves need to be noted. 2. A bearing on the perimeter of the plat does not match the legal description in "Deed of Dedication ". 3. Need off -site easements for PSO overhead power lines and for sewer lines. 4. Section 15 of "Conditions and Restrictions" needs PSO's statement added as it relates to overhead power lines. 5. Section 16 of "Conditions and Restrictions" needs to have verbiage added to cover storm sewers. 6. ONG asked that a "Landscaping" statement be added to the "Conditions and Restrictions ". WINDSOR LAKE II Page 2 These above listed items have been corrected on the final plat. The water sewer plans have been approved by the Oklahoma State Department of Health and the approval letter and plans have been returned to the city. The remaining construction plans have been reviewed by staff and staff has asked for additional information as it relates to storm water detention. Water service for this area is still under consideration for release by Rogers Rural Water District No. 3. There is the possibility that this area may not be served by the City of Owasso. The final plat will not be taken to the City Council until this issue is resolved. RECOMMENDATION: The final plat and covenants meets the requirements of the City of Owasso and staff recommends approval of the final plat of Windsor Lake II with the condition that the drainage information receive final approval from the City Engineer before the plat is forwarded to the City Council for action. MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: MIKE AUGUSTINE, OPWA DIRECTOR SUBJECT: BRENTWOOD ESTATES - FINAL PLAT DATE: October 9, 1992 BACKGROUND: The final plat of Brentwood Estates Addition is located approximately 1/2 mile west of the Northwest corner of 86th Street North and 145th East Avenue. The tract is abutted by vacant land on the north and east which is zoned RS -2, on the south by vacant land which is zoned Tulsa County AG and on the west by Owasso Junior High School which is zoned AG. The proposed plat area is zoned RS -2 (Residential Single - Family Medium Density) which has a requirement of 75' of frontage and 9,000 square feet of lot area. The proposed plat has lot areas of 10,000 square feet and greater and the average frontage is 90 feet. The Technical Advisory Committee reviewed the proposed preliminary plat at their October 7, 1992 meeting and the following items are from this meeting and staff review. 1. Right -of -way widths need to be shown for each street. 2. Remove extended easement lines from Lots 6, 7, 10 and 11, Block 1. 3. Per ONG's requirement a "Landscaping" statement needs to be added to the "Covenants and Restrictions ". Staff has reviewed the construction plans and have asked for additional information relating to the sanitary sewer lift station and storm drainage calculations. Staff will be receiving the plans for the lift station and force main on October 13, 1992 and will be reviewed before the Commission meeting and then presented to the Commission. Water service for this area is still under consideration for release by Rogers Rural Water District No. 3. There is the possibility that this area may not be served by the City of Owasso. The final plat will not be taken to the City Council until this issue is resolved. BRENTWOOD ESTATES Page 2 RECOMMENDATION: The staff feels that the above listed items from the Technical Advisory meeting are very minor in nature and can be corrected before the plat is presented to the City Council. The plat in all other areas meets the requirements of the City of Owasso. If the sanitary lift station meets the requirements, city staff recommends approval of the requested final plat with the condition that the storm water drainage be approved by the City Engineer before the plat is submitted to the City Council for action. Should the sanitary lift station not meet the requirements of the city, staff will recommend that this item be continued to the next Commission meeting.
