PLAT MAP TO MOVE THE BUILDING LINE AS SHOWN FOR LOT
3, BLOCK 1 FROM 25 FEET TO 20 FEET.

BACKGROUND
The City of Owasso has received a request from Buford Williams to vacate and amend a portion
of his Double Oaks Subdivision Plat, more specifically, the building setbacks required for Lot
3, Block 1. The applicant is requesting that the building setback from East 76th Circle be
amended to 20 feet, the minimum allowed by code, as opposed to the 25 feet now shown on the
plat map, which is greater than the code requires. (See Attached Site Plan).
When the staff reviewed the building permit application for a residence at the subject site, the
application was accompanied by an incomplete plot plan which failed to show an 11 foot utility
easement along the south side of the lot. This initial error was compounded when staff failed
to double check the plot plan submitted by cross referencing it with the recorded plat. Both
errors were discovered when a footing inspection was performed at the site, revealing placement
of the footing within the easement. The builder is required to move the footing out of the
easement along the south side, but because the width of the house can no longer meet the 25 foot
building setbacks platted along the north side of the lot, the developer is requesting a reduction
from 25 feet to 20 feet.
The residence, if the subdivision plat is amended, would front onto North 127th East Avenue,
with an attached garage fronting onto East 76th Circle. The front building line would be
maintained at 25 feet but the side entry garage would be located 20 feet back from the right -of-
way for East 76th Circle as opposed to 25 feet. (See Attached Plat Map)
Several facts should be considered when rendering a decision on this request:
A. The orientation of this lot is such that the rear yard would abut the
side yard of the lot to the east. This situation does not occur on
any of the remaining corner lots in this area.
B. None of the other lots on the cul -de -sac are developed and are
currently under the applicant's ownership. Purchasers of these lots
would be aware of the residence location on the subject lot prior
to purchasing their lot.
C. The building line originally submitted by the applicant and shown
on the approved plat is 5 feet greater than required by the code
(25' instead of 20'). This would allow the building line to be
amended prior to any significant development and remains
consistent with the minimum code requirements.
D. Two of the requirements in amending the subdivision plat would
be amending the subdivisions private covenants and amending the
plat through the Planning Commission and City Council. The
applicant is required and has submitted 100% of the lot owners
signatures endorsing the amendment to the subdivision plat and
covenants.
RECOMMENDATION
Given the above facts, (1) lot orientation, (2) the predominately undeveloped nature of the
subdivision, (3) platted at a greater setback than required by code, varying the setback from 25
feet to 20 feet in this specific case, would not appear to have a detrimental impact on
surrounding properties or endanger the public health, safety, and welfare. Therefore, I
recommend approval of the request. It should be noted to completely clear title to this lot,
action to amend the private covenant will also be necessary.
