CONSIDER APPROVAL OF THE MINUTES OF AUGUST 20, 1992 - The Commission reviewed the minutes of August 20, 1992. Pat Imbriano moved, seconded by Dewey Brown, to approve the minutes as written. The subject tract is vacant, approximately 2.8 acres in size and is located north and east of the northeast comer of the intersection of Highway 169 Service Road and 80th Street North. Currently zoned Commercial Shopping (CS) District, it is abutted on the north by manufacturing uses zoned Industrial Light (IL), on the east by an apartment complex zoned Residential Multi- Family Medium Intensity (P.-NI-2) District, on the south by vacant land zoned CS, on the southwest by the Mazzio's Restaurant zoned CS, and on the west by vacant land zoned CS. Before any development occurs on the tract, platting and proper access from 80th Street North will be required. Following discussion, Ray Haynes moved to approve the requested zoning subject to proper access being provided to the tract. Because that type of condition may not be placed on a zoning request, the motion was withdrawn. Gary Wells moved, seconded by Pat Imbriano, to recommend to the City Council that the zoning request be approved. A vote on the motion was recorded as follows: Gary Wells - Yes Pat Imbriano - Yes Dewey Brown - No Ray Haynes - No The vote resulted in a split decision 2 -2. The request will now go to the City Council. 4. OLS -79 D M SOKOLOSKY (1914) - A REQUEST FOR A LOT -SPLIT ON LOT 3, BLOCK 9 OF ATOR HEIGHTS THIRD ADDITION, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA, LOCATED AT THE NORTHEAST CORNER OF 86TH STREET NORTH AND NORTH CEDAR STREET - The Chair introduced the case and the staff review was given by Steve Compton. The subject tract is approximately .87 acres in size. The southwest portion of the lot contains the Kentucky Fried Chicken Restaurant and the remainder of the track is vacant. The Kentucky Fried Chicken portion of the lot has existed for some time at a size of 80 feet by 120 feet. The applicant has now acquired the lot and wants to increase the size of the Kentucky Fried Chicken portion to 98 feet by 134 feet and split the lot. Both lots created by this lot split would meet the minimum bulk and area requirements of the zoning code. Following discussion, Ray Haynes moved to approve the lot split, seconded by Gary Wells. The proposed - Owasso Planning Commission Minutes of October 15, 1992 Page 3 final plat area is generally located south and east of the southeast corner of 96th Street North and 129th East Avenue. It is abutted on the north by Windsor Lake -and Pleasant View Estates Additions zoned RS -2 and RE, on the east and south by vacant land zoned RS -2 and on the west by vacant land and church property zoned RS -2 and AG. The subject tract is located west of the northwest corner of 86th Street North and 129th East Avenue. The plat area is zoned RS -2, with lot areas of 12,500 square feet and greater and an average frontage of 95 feet. Water service for this area has been released by Rogers Rural Water District No 3 and it will now be served by the City of Owasso.. Staff recommends approval of the final plat with the condition that the additional drainage information requested receive final approval from the City Engineer before the plat is forwarded to the City Council for action. FINAL PLAT - BRENTWOOD ESTATES (2114) - A REQUEST FOR A REVIEW OF THE FINAL PLAT FOR BRENTWOOD ESTATES, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA, GENERALLY LOCATED 1/2 MILE WEST OF THE NORTHWEST CORNER OF 86TH STREET NORTH AND 145TH EAST AVENUE - The Chair introduced the case and the staff review was given by Mike Augustine. The proposed final plat is located approximately 1/2 mile west of the northwest corner of 86th Street North and 145th E Ave. The tract is abutted by vacant land on the north and east which is zoned RS- 2, on the south by vacant land which is zoned Tulsa County AG and on the west by Owasso Junior High School which is zoned AG. The plat area is zoned RS -2 and has lot areas of 10,000 square feet and greater and the average frontage is 90 feet. Water service for the area has not been released by Rogers Rural Water District No 3. Negotiations are in process and must be completed by December 31, 1992. Staff recommends approval of the final plat with the condition that the storm water drainage be approved by the City Engineer before the plat is submitted to the City Council for action. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 6:00 p.m. and declared a quorum present. 2. AMENDMENT OF PLAT - BUFORD WILLIAMS (2914) - A REQUEST TO AMEND THE NORTH BUILDING LINE OF LOT 3, BLOCK 1, DOUBLE OAKS, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA - The Chair introduced the case and the staff review was given by Steve Compton. The applicant is requesting an amendment to the building setbacks required for Lot 3, Block 1 of the Double Oaks subdivision plat. He is requesting that the building setback from East 76th Circle be amended to 20 feet, the minimum allowed by code, as opposed to the 25 feet now shown on the plat map, which is greater than the code requires. A building permit for a residence on the lot has been approved; however, an error on the plot plan submitted was discovered when a footing inspection was performed at the site, revealing placement of the footing within an 11 foot utility easement along the south side of the lot which was not shown on the plot plan. The builder is required to move the footing out of the easement along the south side, but because the width of the house can no longer meet the 25 foot building setbacks platted along the north side of the lot, the developer is requesting a reduction from 25 feet to 20 feet. In order to amend the plat, the applicant was required to obtain 100% ownership approval of all lot owners in the subdivision and must file those signatures with the County Clerk as an amendment to the Plat Map private covenants. All necessary signatures were presented at the Public Hearing. The amendment must also be approved by the City Council following action by the Planning Commission. Following the staff review, a lengthy discussion ensued. The applicant's engineer, Bill Lewis, and the builder, Jerry Gordon, were present. The Commission admonished the builders to take more care in the submission of their plot plans and the placement of structures on the lots and to avoid further requests of this nature. Following further discussion, Charles Willey moved Owasso Planning Commission Minutes of October 30, 1992 Page 2 to approve the request to amend the building setback line on Lot 3, Block 1, Double Oaks. ROONEY, CITY PLANNER SUBJECT: SITE PLAN REVIEW FOR MEDICAL OFFICE LOCATED AT ELM CREEK COMMERCIAL CORNER, AMENDED; LOT 10; BLOCK 1 DATE: October 28, 1992 BACKGROUND Mr. Bill Heffner of Architecture Unlimited has submitted a proposed site plan for the medical offices of Dr. Mark Argo located on the northwest corner of East 85th Street North and North 129th East Avenue. The Owasso Zoning Code requires all Commercial Site Plans to be submitted to the Planning Commission for approval providing the subject tract is greater than 18,000 square feet in area. The proposed medical offices of Dr. Argo will be located on a commercial tract containing approximately 30,870 square feet in area. Review of the site plan by staff indicated that all necessary building setbacks have been met by the applicant, and all necessary off -street parking provisions have been established and provided by the applicant. Entrance into the parking area provided by the applicant is only slightly more than 20 feet away from the corner of the property and may not be appropriate considering vehicle reaction time that may be necessary when cornering the intersection. Staff would recommend that this distance be increased to a minimum of thirty (30) feet.. A "shifting" of the entire site plan to accommodate this recommendation 10 feet to the west would not impact any setback requirements and should not pose any development hardship to the applicant. In addition to the location of the access driveway, the access driveway itself should be increased to a width of at least 24 feet from the curb cut to the central access area of the parking lot. Currently, the width shown for the access isle is only 20 feet. Again, this should pose no development hardship to the client. The applicant has shown the incorporation of a landscaped berm area north of the office building and a "green area with plantings" near the entrance of the office. Staff would also encourage the use of creative landscaping along both East 85th Street North and North 129th East Avenue, comparable to that found with the commercial development north of this parcel, to shield and buffer the required parking areas from those thoroughfares. _ The applicant has shown a proposed location of an identification sign within a 17 foot easement running parallel to North 129th East Avenue. The applicant should understand that this sign will need to be relocated as no structures may be placed within this easement. All other facets of the proposed site plan appear to be in conformance with the City of Owasso's requirements. RECONMENDATION Staff would recommend approval of the proposed site plan conditioned upon the following: (1) Relocation of the access isle of the parking area a minimum of 30' from the property line. (2) Widening of the access isle to a minimum of 24' as opposed to its current 20' width. (3) Relocation of the sign. MEMORANDUM TO: PLANNING COMMISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: SITE PLAN REVIEW FOR KENTUCKY FRIED CHICKEN ON 117TH STREET, JUST SOUTH OF TEXACO AT 117TH AND 86TH STREETS DATE: November 9, 1992 Herrera Companies, Inc., of Loveland, Colorado has submitted a proposed site plan for a Kentucky Fried Chicken Restaurant located on 117th Street, just south of Texaco at 117th and 86th Streets (See Attached Legal Description). The Owasso Zoning Code requires all Commercial Site Plans to be submitted to the Planning Commission for approval providing the subject tract is larger than 18,000 square feet in area. The proposed Kentucky Fried Chicken will be located on a commercial tract containing approximately 54,639.59 square feet in area. Review of the site plan by staff indicated that all necessary parking requirements have been met by the applicant as 22 parking spaces would be the minimum required in order to be in compliance with the Owasso Zoning Code. Staff would recommend the elimination of three parking stalls (2 on the north side of the site plan and 2 on the south) in order to have no parking within the front utility easement and better maneuverability. These parking areas should be eliminated with landscaping being incorporated within this area. In addition, all signs proposed by the applicant within this easement should also be relocated. The applicant has maintained all required setbacks for development within a CS district. When reviewing traffic movement on the subject site, staff would recommend that all traffic movement on the site be circular, one -way in nature rather than the two -way proposed on the south side of the structure. Both access points should be clearly labeled as "Entrance Only" and "Exit Only" by means of paint on the access surface because directional signs will be located at least 17.5 feet behind the initial curb cut. Comments were received from the City Engineering department regarding storm water drainage and how it would be maintained on the site. It was recommended that drainage should be directed toward the proposed landscape areas creating a natural detention facility. The applicant has shown the incorporation of landscaping within the interior areas of the site plan. The Staff would also strongly encourage the use of creative landscaping along the south and east perimeters of the subject site to buffer the parking mass. All other facets of the proposed site plan appear to be in conformance with the City of Owasso's requirements. Staff has forwarded copies of the site plan to the Technical Advisory Committee for comments /input, and any recommendations from this Commission will be presented to you at the Planning Commission Meeting. RECOMMENDATION Staff would recommend approval of the proposed site plan conditioned upon the following: (1) The elimination of the three (4) parking spaces within the front easement, those parking spaces labeled as numbers 1, 2, 17, and 18 on the site plan. (2) Relocation of all signs out of the front utility easement of 17.5 feet. (3) Adjustment of traffic pattern to a circular, one -way only movement throughout the site. (4) Storm water runoff shall be contained within the project site, preferably within the landscaped areas in the front setback. CITY OF OWASSO Planning Department OZ -91 Staff Report Timothy D. Rooney - City Planner BACKGROUND APPLICANT AND STATUS OF APPLICANT: Mr. James F. Kane, owner. REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from RS -3 (Residential: Single - Family) to CS (Commercial Shopping) to allow for Commercial Shopping Land Uses in conjunction with a proposed PUD. (See OPUD -10) LOCATION AND. SIZE: The general location of the property is between 86th and 96th Street North, just north of Smith Elementary and contains approximately 12.69 acres, more or less. The legal description of the subject site is attached for your review. EXISTING LAND USE: Subject property is undeveloped. SURROUNDING LAND USE: Property immediately south and east of the subject property is zoned RS -3 and contains Smith Elementary School and the proposed "Central Park" subdivision. The subject property is bordered on the west and north by undeveloped land zoned AG and Highway 169. COMPREHENSIVE PLAN: The Comprehensive Plan identifies the subject area as being appropriate for Low Density Residential development. However, the 1978 Comprehensive Plan may no longer be an appropriate measure for potential development within this area as both OL ( Office Low Intensity District) and OM (Office Medium Intensity District) exist east of the subject property. APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments ", Chapter 6 "Commercial District Provisions ", and Chapter 5 "Office District Provisions." SITE INFORMATION: Both sewer and water are available to the subject site. Currently, there exists no paved access of any nature to the subject property. A form of secondary access will be created to the parcel via the development of "Central Park." Primary access to the subject site would be most probable to occur via an extension of the Highway 169 service road from 86th Street or 96th Street. No unusual development hardships are anticipated. ANALYSIS The proposed rezoning, if approved, would create a 12.69 acre area of CS (Commercial Shopping) Zoning District permitting all uses cited within the CS portion of Commercial District Provisions by right. The applicant is proposing that -all Commercial development within this area, in conjunction with the PUD, would consist of both internal and perimeter landscape areas with a minimum landscaped open space of 10 (ten) percent. Lighting used in parking areas will consist of a decorative flood lighting, with "up" lighting on buildings, signs, and various landscape elements while "low" lighting will be featured within certain landscaped areas, courtyards, and pedestrian areas. Concerns regarding the applicants request center around two significant issues, vehicular access and possible intensity of use in relation to the proposed "Central Park" residential development immediately abutting the subject property. Access to this area, as discussed early within this report, is limited and access to any developed commercial area should consist of a primary, direct access. If development were to occur on this parcel upon approval of the PUD, the only access to this area would be through the subdivision itself, an undesirable characteristic in any residential area. Staff would recommend that any development within this area be contingent upon the development of a primary access to this area. Again, most likely this would occur via an extension of the service road. Maintaining the residential integrity and characteristics found within a subdivision is always a matter of importance to both the developer and the Planning Commission. The appropriateness of a CS (Commercial Shopping) District abutting an RS -3 (Residential Single Family) District is the issue that needs to be addressed. Certainly, one not need look further than the commercial properties abutting Lakeridge Subdivision for the reasons why this would be of concern to Planning Staff. The site chosen by the applicant, however, is not necessarily a poor one. Upon development of the proposed service road abutting Highway 169 and development of the Commercial and Office Zoning Districts to the east, the inclusion of this property as a commercial/office service area is appropriate. However, with the proximity of a large residential development to the east, a potential for conflict exists. Staff would recommend the incorporation of a 150 foot wide buffer district along the southeast property line shared by the subject property and the residential area to the southeast, the zoning classification of which would be an OL (Low Intensity Office) District. 50 feet of this recommended 150 feet would include part of the easement for the power lines (there would also be a 50 foot portion of the easement for the power lines contained within the residential property) while the remaining 100 feet would permit development of Low Intensity Office uses. Staff feels the incorporation of this OL zoning district within the - applicants request would lend itself to a more harmonious transition from Commercial development to Low Intensity Office development to Residential development rather than Commercial to Residential. It should also be noted that upon an approval of OPUD -10, the ability for the applicant to vary slightly from the 150 foot buffer district is available. If the developer wants to encroach that area by 25 feet, for instance, the ability may be there dependant upon an alternate form of buffer offered. Any and all site plans within this area will require the approval of the Planning Commission, and thus will be reviewed on a case by case basis. RECOMMENDATION Staff would recommend that the above referenced rezoning request be approved providing the incorporation of a 150 foot wide buffer zone of OL (Office Low Intensity) along the southeast property line shared by the subject site and the residential development to the southeast. subjecty boundaries for oz-91
