Oklahoma Baptist Retirement Center III (3214) - A Request for a Review of the Final Plat for Oklahoma Baptist Retirement Center III, Generally Located South of the Corner of 122nd East Avenue and 122nd East Place. Adjournment OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Thursday, May 16, 1991, 7:00 PM Owasso City Hall Conference Room 207 S Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Pat Imbriano Gary Wells Charles Willey MEMBERS ABSENT STAFF PRESENT Steve Compton Marcia Boutwell The agenda for the meeting was posted in the Owasso City Hall, 207 S Cedar, on May 10, 1991 and Addendum was posted on May 13, 1991. 1. CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting to order at 7:0 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF APRIL 18, 1991 - The Commission reviewed the minutes of April 18, 1991. Charles Willey moved, seconded by Pat Imbriano, to approve the minutes as written. A vote on the motion was recorded as follows: Charles Willey - Yes Pat Imbriano - Yes Gary Wells - Yes Ray Haynes - Yes The motion carried 4-0. TULSA COUNTY REFERRALS 3. TULSA COUNTY REFERRAL CZ-191 (814) - A Request to Rezone a Tract of Land from AG to CG, Generally Located South of the Southeast Corner of Garnett Road and 116th East Avenue. The Chair introduced the case and staff reviewed the background. County Referral Case CZ -191 has been filed with the Tulsa Metropolitan Area Planning Commission (TMAPC) and is located outside the corporate limits of the City of Owasso. However, it is located within the City's fenceline. The subject tract is approximately .5 acre in size, contains a flea market business, and is zoned AG, with 165 feet of frontage on Garnett Road. The County has determined the use on the land to be a flea market; however, the tract is in a complete state of disarray and is a major detraction to the surrounding area. Continued use of the tract in the manner that it is presently being used will have a negative impact on the entire German Corner area. Given the existing physical conditions in the area, the Comprehensive Plan designation, and the difference between the city and county zoning codes, staff recommended denial of the requested Owasso Planning Commission Minutes of May 16, 1991 Page 2 CG zoning classification, and approval of a CS classification. The property owners, Mr & Mrs Hatfield, were present to argue in favor of the CG zoning. Wayne Vines protested the CG zoning. Following discussion and questions, Gary Wells moved to recommend that TMAPC deny the requested CG zoning classification and approve a CS classification, and that the memorandum to the Planning Commission dated May 10, 1991 be forwarded to them. Motion seconded by Charles Willey. A vote on the motion was recorded as follows: Gary Wells - Yes Charles Willey - Yes Pat Imbriano - Yes Ray Haynes - Yes The motion carried 4-0. 4. TULSA COUNTY REFERRAL CZ -190 (814) - C W Helscel - A Request to Rezone a Tract of Land from IL and RE to IM and IL, Generally Located South of the Southeast Corner of 76th Street North and Highway 169. The Chair introduced the case and staff reviewed the background. County Referral Case CZ -190 has been filed with the Tulsa Metropolitan Area Planning Commission ( TMAPC) and is located outside the corporate limits of the City of Owasso. However, it is located within the City's fenceline. The subject tract is approximately 10 acres in size, vacant, and is zoned a combination of IL and RE. The applicant is requesting a combination of IM on the front of the tract and IL on the back portion. The zoning request appears to be in conformance with the intent of the Comprehensive Plan, and would also set a precedent for the use of transitional buffers. Staff recommended approval of the requested IM and IL zoning classifications. Following discussion and questions, Charles Willey moved to recommend that TMAPC approve the requested zoning classifications, and that the memorandum to the Planning Commission dated May 16, 1991 be forwarded to them. Motion seconded by Pat Imbriano. A vote on the motion was recorded as follows: Charles Willey - Yes Pat Imbriano - Yes Gary Wells - Yes Ray Haynes - Yes The motion carried 4-0. 5. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Staff discussed current development and construction, including the signalization on 86th street. 7. ADJOURNMENT - Pat Imbriano moved, Gary Wells seconded, to adjourn the meeting. A vote on the motion was recorded as follows: Pat Imbriano - Yes Gary Wells - Yes Charles Willey - Yes Ray Haynes - Yes The motion carried 4-0 and the meeting was adjourned at 8:00 p.m. Chairman Secretary Date MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT SUBJECT: SITE PLAN REVIEW - 76TH STREET TEXACO DATE: June 14, 1991 BACKGROUND: The subject tract is located at the Southeast corner of 76th Street North and Dogwood Street and zoned Commercial Shopping (CS). It contains an existing Texaco gas station with food mart, car wash, and quick -lube facilities. The most recent action taken on this tract by the TAC and Planning Commission was approval of a Site Plan for the addition of the quick -lube facility. The tract is abutted on the North by the Homeland and Anthony's stores zoned CS, on the East by the McDonald's Restaurant zoned CS, on the South by vacant land zoned CS, and on the West by the Burger King Restaurant zoned CS (see attached case map). The applicant is requesting a Site Plan Review for the addition of a Subway Sandwich business to their facility. The addition of this business will require that 150 square feet of floor area be enclosed along the North side of the existing structure (see attached plans). The applicant's plans show the necessary parking for this increased floor area. The Technical Advisory Committee (TAC) reviewed this case at their June 12, 1991 meeting and recommended approval, subject to the following conditions: 1) That plans be submitted to and approved by the City- County Health Department prior to the issuance of a building permit. 2) That all applicable building and fire code requirements be met prior to the issuance of a building permit. OWASSO PLANNING COMMISSION SITE PLAN - 76TH STREET TEXACO JUNE 14, 1991 3) That the existing signage display surface area not be increased. A sign for the sandwich shop can be erected as shown on the last page of the applicant's drawings; however, an equal amount of display surface area would have to be removed from the existing sign. RECOMMENDATION: The staff has also reviewed the Site Plan and compared it to the requirements of the zoning code. It was determined that all requirements of the code have been met with the exception of those identified by the TAC review. Therefore, I recommend approval of the Site Plan for a Subway Sandwich business at the 76th Street Texaco, subject to the TAC's conditions and the drawings submitted. MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT SUBJECT: FINAL PLAT - OKLAHOMA BAPTIST RETIREMENT CENTER III AT OWASSO (3214) DATE: June 14, 1991 BACKGROUND: The subject tract is located South of the intersection of 122nd East Avenue and 122nd East Place. It is vacant, approximately 1.3 acres in size, and zoned AG. It is abutted on the North and East by a duplex development zoned AG and allowed by a Board of Adjustment exception. On the South it is abutted by vacant land zoned RS -1 that is a part of the future expansion of the retirement center and on the West it is abutted by mostly vacant land with one single - family dwelling zoned AG (see Case Map). The applicant is requesting a Final Plat approval for a small one block, two lots subdivision. These lots will be used for the construction of two duplex buildings during the time the applicant is developing the larger tract of land Northwest of this tract that was reviewed by the TAC and Planning Commission under a previous application. Storm water detention is proposed to occur on the back portion of Lot 2. Water and sewer lines will be extended to the tract and easements for these and other utilities are shown on the plat map. The Technical Advisory Committee reviewed the Final Plat for this addition at their June 12, 1991 meeting and recommended approval, subject to the following conditions: 1) That the 20' utility easement shown along the West property line be extended to the South side of the East /West drainage and utility easement that is shown to be 15' either side of the South property line. 2) That the City of Tulsa standards and specifications be referenced. 3) That during and following construction all disturbed areas be protected from erosion until vegetation is reestablished. 4) That all State Health Department approvals are completed and the City has received notification of those approvals prior to acceptance of any water or sewer line into the City's systems. OWASSO PLANNING COMMISSION FINAL PLAT - OBRC III JUNE 14, 1991 5) That the proposed detention facility be constructed prior to construction of any structures on Lots 1 & 2. 6) That erosion protection be installed from the outlet of the storm sewer pipe to the Southwest corner of Lot 2 for all fill or disturbed soil areas. Of specific concern is the protection of the detention facility berm adjacent to the outflow ditch. If Mortared Rip -Rap is used, a specification should be included. 7) That sewer and water is available to both Lots 1 & 2 prior to the issuance of a building permit. RECOMMENDATION: Given the above review, I recommend approval of the Final Plat for the Oklahoma Baptist Retirement Center III At Owasso, subject to the conditions identified by the TAC. MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT SUBJECT: AMENDED WATER AND SEWER PLANS - OLS -75 OWASSO DEVELOPMENT COMPANY (2014) DATE: June 14, 1991 BACKGROUND: The subject tract is irregular shaped, approximately 7.8 acres in size, and zoned Commercial Shopping (CS). It is generally bounded on the North by the Wal -Mart store zoned CS, on the East by the Three Lakes Addition zoned RS -3, on the South by the Price -Rite store and the proposed Hardee's restaurant zoned CS, and on the West by the Liberty Bank zoned CS (see attached case map). At the April 18, 1991 Planning Commission meeting, action on the approval of this Lot -Split was taken. As a part of that approval, water and sewer plans were submitted, reviewed, and approved. Since that approval, the applicant has requested to be allowed to amend their water and sewer plans in order to better conform to the anticipated future use of the lots created by the approved Lot - Split. The amended water and sewer plans have been reviewed by the City Engineer, Fire Chief, and the Director of the Water and Wastewater Departments. Their review resulted in several changes to the initial set of plans; however, the attached plans have been corrected and have received approval from all appropriate parties. RECOMMENDATION: Given the review and approval by the City Engineer, Fire Chief, and Director of the Water and Wastewater Departments, I recommend approval of the Amended Water and Sewer Plans for OLS -75.
