CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting to order at 7:00 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF August 22, 1991 - The Commission reviewed the minutes of August 22, 1991. Pat Imbriano moved, seconded by Dewey Brown, to approve the minutes as written. A vote on the motion was recorded as follows: Pat Imbriano - Yes Dewey Brown - Yes Gary Wells - Yes Charles Willey - Yes Ray Haynes - Yes The motion carried 5 -0. 3. CONSIDER REQUEST TO RESTUDY COMPREHENSIVE PLAN IN THE AREA SOUTH OF 76TH STREET NORTH AND EAST OF HIGHWAY 169 - Because of two recent County rezoning cases where the applicants have requested industrial zoning, several residents of the area bounded on the north by 76th Street North, on the west by the Mingo Valley Expressway service road, on the south by 68th Street North, and on the east by 119th East Avenue have requested that the Planning Commission prepare a study of this area to determine the need for amending the Comprehensive Plan. Owasso Planning Commission Minutes of September 19, 1991 Page 2 A large contingent of residents of the area were present. Steve Compton gave the background and staff report. The two principle planning issues that need to be addressed in this area are the establishment of transitional buffers and the separation of residential and non - residential traffic. Staff also suggests that a comprehensive code enforcement study be conducted by the county building inspector's office for the entire area. Three residents of the area —Jan Gaylord, Robert Barnes, and Dave Reeder —spoke on the issue, reinforcing the residents' desire to amend the Comprehensive Plan. Following discussion, Mr. Haynes suggested that a sub - committee comprised of staff, two Commission members, and two citizens, be formed to study the Comprehensive Plan and produce a draft document to be presented to the total Commission at a public hearing. Agreement was by consensus, and the Chair appointed Steve Compton and /or the City Planner (staff) and Pat Imbriano and Dewey Brown (Planning Commission). The area residents will decide which two citizens will represent them on the committee. The Chair directed staff to begin the process necessary to study and amend the Comprehensive Plan. 4. ELECTION OF SECRETARY TO FILL THE UNEXPIRED TERM OF RICK JOHNSON. TERM EXPIRES 6/30/92 - At the last regular election of officers for the Planning Commission, Rick Johnson was elected to fill the office of secretary. Mr. Johnson has since moved from the area and resigned from the Commission, leaving the office of secretary vacant. The Chair opened the floor for nominations for Secretary to complete the unexpired term of Mr. Johnson. Gary Wells nominated Dewey Brown; the nomination was seconded by Charles Willey. Hearing no further nominations, the nominations were declared closed and Ray Haynes moved that Mr. Brown be elected by acclamation; seconded by Charles Willey. A vote on the motion was recorded as follows: Ray Haynes- Yes Charles Willey - Yes Pat Imbriano - Yes Gary Wells - Yes Dewey Brown - Yes The motion carried 5 -0 and Mr. Brown was elected secretary to the term expiring June 30, 1992. 5. NEW BUSINESS - None 6. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Staff discussed current development and construction in the Owasso area. Mentioned were Hardee's, a new restaurant on South Altanta, a real estate office on 86th Street North, the golf course, and some potential development at 86th Street North and 129th E Ave. Owasso Planning Commission Minutes of September 19, 1991 Page 3 7. A vote on the motion was recorded as follows: Charles Willey - Yes Gary Wells - Yes Dewey Brown - Yes Pat Imbriano - Yes Ray Haynes - Yes The motion carried 5 -0 and the meeting was adjourned at 7:55 p.m. Chairperson Secretary Date MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT SUBJECT: SITE PLAN REVIEW - NATIVE OAK HOMES (29- 21 -14) DATE: October 11, 1991 BACKGROUND The subject tract is vacant, zoned Medium Intensity Office (OM), approximately .8 acre in size, and located at the southwest corner of 120th East Avenue and 86th Street North (see Case Map). It is abutted on the north by 86th Street and single - family residential uses zoned RS -3, on the east by a drainage ditch and single - family residential uses zoned a combination of AG and RS -3, on the south by a private park zoned AG, and on the west by an existing office building zoned OM. The applicant is requesting a Site Plan Review for a proposal to develop a Real Estate /Home Builders office and parking lot on the subject tract (see Site Plan). The Technical Advisory Committee reviewed this proposal at their October 9, 1991 meeting and it was determined to recommend approval, subject to (1) the applicant filing a separate 5' PSO service easement and (2) the possible field relocation of the driveway entrance because of a potential sight hazard with the bridge railing adjacent to the northeast corner of the tract. It was noted at the meeting that there is an existing 8" gas line located in the south ROW, 41 feet from the centerline of 86th Street and with approximately 3 feet of cover. There is also a 12" water line in the same ROW. Extreme care should be taken when constructing the driveway entry to avoid damaging these lines. RECOMMENDATION I recommend approval of the Site Plan Review for the Native Oak Homes, Inc. office building subject to the two conditions required by the Technical Advisory Committee and the following: (1) That all applicable building, fire, and health code requirements be met. (2) That a sign permit be obtained showing that the location and design of any proposed signs meet all regulations. NATIVE OAK HOMES, INC. PROPOSED OFFICE BUILDING SITE PLAN MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT SUBJECT: SITE PLAN - ALBIN'S FAMILY RESTAURANT (30- 21 -14) DATE: October 11, 1991 BACKGROUND The subject tract is approximately 1.5 acres in size, zoned Commercial High Intensity (CH), and located at the northwest corner of 76th Street North and Atlanta Street (see Case Map). The tract contains the old Hughes Lumber retail /office building and a large lumber storage building. It is abutted on the north by a residential dwelling and the Budget Industries complex zoned CH, on the east by an auto repair building zoned CH, on the south by the First Bank of Owasso building and parking lot zoned CH, and on the west by railroad tracks zoned AG. The applicant is requesting a Site Plan Review of a proposal to develop the tract by remodeling the old retail /office building into a restaurant (see Site Plan). The Technical Advisory Committee reviewed this proposal at their October 9, 1991 meeting and it was determined to recommend approval, subject to the edge of the proposed parking lot and sign not conflicting with the 76th Street ROW. RECOMMENDATION I recommend approval of the Site Plan Review for Albin's Family Restaurant subject to the one condition required by the Technical Advisory Committee and the following: (1) That all applicable building, fire, and health code requirements be met. (2) That a sign permit be obtained showing that the location and design of any proposed signs meet all regulations. MEMORANDUM TO: OWASSO PLANNING COMMISSION FROM: STEVE COMPTON ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT SUBJECT: STAFF REPORT - COUNTY REFERRAL TCPUD -475 DATE: October 11, 1991 BACKGROUND The concept behind a Planned Unit Development (PUD) is that it provides an alternative to conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public review. The PUD allows for greater flexibility than could be achieved by traditional zoning when planning for the development of a single tract of land that has multiple zoning districts or is located in a sensitive area. In this matter, the PUD gives the Tulsa Metropolitan Area Planning Commission (TMAPC) and the County Commissioners the flexibility to consider the appropriateness of permitting controlled moderate industrial uses on a portion of the tract without intensifying the underlying zoning. The subject tract is approximately 11 acres in size, vacant, and currently zoned a combination of Light Industrial (IL) and Residential Estate (RE). There is a pending rezoning case (CZ -190) requesting a combination of IL and IM. The tract is abutted on the north by vacant land zoned IL and RE, on the east by large -lot residential dwellings zoned RE, on the south by large -lot residential dwellings and industrial uses zoned RE and IL, and on the west by the Mingo Valley Expressway service road (see Case Map). The applicant is requesting PUD zoning on the tract to develop an industrial park complex consisting of two different use - intensity areas. STAFF ANALYSIS The proposal generally divides the property in half, creating an east development area (5.75 Acres) and a west development area (5.14 Acres). The east development area, which is adjacent to the existing single - family areas, would have uses that would be restricted to light manufacturing (Use Unit #25). It is also proposed that the uses MEMORANDUM TCPUD -475 Page 2 occurring in this area would be conducted only inside enclosed buildings, that screening would be provided along the property line, and that more restrictive setbacks, lighting, and signage requirements would be followed. The west development area, which is adjacent to the expressway service road would be allowed to have both light manufacturing and commercial uses. In addition, this area would be allowed to have "moderate manufacturing and industrial uses incidental to or related to the manufacture of heat exchangers...." This area will also have specific lighting, signage, and landscaping requirements to be followed. During the process of reviewing this proposal the staff has met with the developer, the developer's attorney, representatives of the adjacent single - family neighborhood, and some individual members of the Planning Commission. Each have had their own opinions concerning this matter; however, all have been will to compromise. The PUD proposal included as a part of this report is the second proposal submitted by the developer's attorney and includes many revisions that have been requested by various parties. In general, it appears to be a reasonable proposal. RECOMMENDATION Given the above analysis, it is the staff's opinion that TCPUD -475 is consistent with the intent of the Planned Unit Development Chapter of the Tulsa County Zoning Code and, therefore, staff recommends approval subject to the following conditions: (1) That the applicant's Development Text, Development Area Map, and Illustrative Site Plan be incorporated as a condition of approval, unless modified herein (see attached Helscel Industrial Center - PUD Text and Plans). (2) That the underlying zoning be IL, and that unless specifically set out in the PUD Text and /or conditions of approval, development on the subject tract shall meet the requirements of a typical IL district per the zoning code. (3) That Section IV. Frontage Landscaoing be modified to read as follows: To the extent permitted by Tulsa County, unsurfaced service road right -of -way shall be maintained as a grass /lawn area. In addition, there shall be planted and maintained along the frontage property line a series of ornamental '(flowering) trees spaced 25 feet apart. (4) That Section VII. Screening be modified to read as follows: Prior to the occupancy of any buildings or the commencement of any open air storage or other open air industrial activity within Development Area B a screening fence MEMORANDUM TCPUD -475 Page 3 and a series of deciduous shade trees spaced 35 feet apart shall be erected, planted and maintained along the south and east boundary of Development Area B. Screening along the east 200 feet of the north boundary of Development Area B will not be required until the area north of this boundary is developed as residential. (5) That Section VIII. Sign Standards, Subsection Ground Signs be modified to read as follows: Within Development Area A and Development Area B, ground signs shall be limited to one sign identifying and located on the west side of each principal building, not exceeding 25 feet in height and not exceeding a display surface area of 128 square feet for each principal building user, provided however, the aggregate display surface area shall not exceed 330 square feet. (6) That Section VIII. Sion Standards, Subsection Wall or Canoov Signs be modified to read as follows: Wall or canopy signs shall be limited to one sign for each principal building user and shall not exceed a display surface area of 2 square feet for each lineal foot of the wall or canopy to which affixed and shall be limited to the west and north walls of each building. Open air storage of materials and inventory shall be permitted, but within 100 feet of the East and South boundary of Development Area B, the materials or inventory stored shall not exceed 8 feet in height. VI. LIGHTING Within Development Area B, exterior lighting shall be directed down and away from abutting residential properties and light standards shall not exceed 20 feet in height. VII. SCREE -I GG Prior to the occupancy of any buildings or the commencement of any open air storage or other open air industrial activity within Development Area B a screening fence shall be erected and maintained along the East boundary of Development Area B, the South boundary of Development Area B, and the East 200 feet of the North boundary of Development Area B. VIII. PLATTING REQUIREMENT No building permit shall issue until the development has been included within a subdivision plat submitted to and approved by the Tulsa Metropolitan Area Planning Commission and the Board of County Commissioners, and duly filed of record. Covenants shall be established of record which implement and assure compliance with the approved development standards.
