CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting to order at 7:00 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF OCTOBER 17, 1991 - The Commission reviewed the minutes of October 17, 1991. Gary Wells moved, seconded by Dewey Brown, to approve the minutes as written. A vote on the motion was recorded as follows: Gary Wells - Yes Dewey Brown - Yes Charles Willey - Yes Ray Haynes - Yes The motion carried 4 -0. 3. SITE PLAN REVIEW - OWASSO MINI - STORAGE (2914) - A REQUEST FOR A REVIEW OF THE SITE PLAN FOR OWASSO MINI - STORAGE LOCATED ON LOT 5, BLOCK 2, ELM CREEK COMMERCIAL CORNER AMENDED, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA - The Chair introduced the case and the staff review was given by Mike Augustine. The subject tract is located west of the intersection of 128th East Avenue and 85th Street North. The site is presently zoned CG and is vacant. It is abutted on the north and east by CG zoning and on the south and west by RS -3 zoning. The applicant is requesting a site plan review for a proposed mini - storage. The Technical Advisory Committee reviewed the application at their November 14, 1991 meeting and recommended approval subject to the conditions presented in the staff memorandum. The developer, Mark Weir; the engineer, Dennis Hodo; and the landowner, D M Sokolosky; were present. Following discussion, Charles Willey moved, seconded by Dewey Brown, to approve the site plan subject to the following conditions: Owasso Planning Commission Minutes of November 21, 1991 Page 2 1. That Oklahoma Natural Gas Company be notified prior to the placement of pavement to correct the location of a gas line. Also, the southwest corner of Lot 12, Block 2 of the above Addition needs to be marked by a lath to permit the above correction. 2. Placement of a screening fence along the south and west sides of the subject tract (per Zoning Code). 3. Move paving approximately 7 feet west and 5 feet south to keep any pavement from being placed over the existing sewer line which runs along the north and east side of the tract. 4. The area of entrance will have a minimum of 6" of concrete with reinforcement to provide protection of the diagonal running sewer line. This area must be inspected by city inspectors for concrete thickness and steel placement. 5. The projects will be constructed in phases. During the first phase, grading of the site will be done to direct runoff water to the southeast to an existing 18" storm drain. The area around the storm drain will be graded to a gentle slope. During phase 2, a concrete apron shall be constructed of suitable size to collect the runoff and direct the water into the storm drain. 6. An updated site plan will be required to be submitted with the phase 2 building permit application to provide the staff with an opportunity for final review of the required concrete drainage apron, prior to additional construction. AMENDMENT OF PLAT - LOCAL AMERICA BANK OF TULSA (814) - A REQUEST TO AMEND THE SOUTH BUILDING LINE OF LOT 2, BLOCK 1, BURLINGAME CENTER, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA - The Chair introduced the case and the staff review was given by Mike Augustine. The subject tract is located south of the southeast corner of 116th Street North and Garnett Road and is presently zoned CG. There is a vacant building on the tract, which is abutted on the east and south by AG zoning, on the north by CG zoning and on the west by CS zoning. The applicant is requesting that the building setback from the south lot line be reduced from 20' to 6'. The existing building was constructed only 9.4' north of the south lot line, which is not in compliance with the plat but does meet the zoning requirement. Following discussion, Dewey Brown moved, seconded by Charles Willey, to recommend to the City Council approval of the requested amendment to the Burlingame Center plat. A vote on the motion was recorded as follows: Dewey Brown - Yes Charles Willey - Yes Gary Wells - Yes Ray Haynes - Yes The motion carried 4 -0. 5. EASEMENT VACATION - LOCAL AMERICA BANK OF TULSA (814) - A REQUEST TO VACATE A PORTION OF THE SOUTH UTILITY EASEMENT LOCATED ON LOT 2, BLOCK 1, BURLINGAME CENTER, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA - The Chair introduced the case and the staff review was given by Mike Augustine. The subject tract is located south of the southeast corner of 116th Street North and Garnett Road and is presently zoned CG. There is a vacant building on the tract, which is abutted on the east and south by AG zoning, on the north by CG zoning and on the west by CS zoning. The applicant is requesting to vacate approximately the north 6' of an existing utility easement located on the south 15 feet of the lot. The building on the lot was constructed over a portion of the easement a few years ago. The only utility in the easement is a gas service line serving the building; all other utilities are attached to the exterior of the building. The Technical Advisory Committee reviewed this proposal at their November 13, 1991 meeting and recommended approval. Following discussion, Charles Willey moved, seconded by Gary Wells, to recommend to the City Council approval of the closing of the north 6' feet on the utility easement, with the condition that the vacation be handled through the proper legal process in District Court. CHANGE OF ACCESS - LOCAL AMERICA BANK OF TULSA (814) - A REQUEST FOR A CHANGE OF ACCESS FOR LOT 2, BLOCK 1, BURLINGAME CENTER, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA - The Chair introduced the case and the staff review was given by Mike Augustine. The subject tract is located south of the southeast corner of 116th Street North and Garnett Road and is presently zoned CG. There is a vacant building on the tract. The applicant is requesting that a 35' driveway be located 15' south of the northwest comer of lot 2, permitting direct access to the lot. There is currently a mutual access driveway on lot 3 to serve both lots. The Technical Advisory Committee reviewed this proposal at their November 13, 1991 meeting and recommended approval. The Director of the City Street Department has also agreed to the requested change. Kevin Coutant, the applicant's attorney, was present to answer questions. He stated that they had been unable to obtain a mutual access agreement with the owner of lot 3, thereby necessitating that they obtain access to lot 2. Following discussion, Ray Haynes moved, seconded by Gary Wells, to recommend to the City Council approval of the requested change of access, with the condition that the proper legal steps be taken to ensure that the change of access becomes a part of the Burlingame Center Addition, and that adequate protection of the existing sewer line be provided at the time of the driveway construction. A vote on the motion was recorded as follows: Ray Haynes - Yes Gary Wells - Yes Dewey Brown - Yes Charles Willey - Yes The motion carried 4 -0. 7. REQUEST TO AMEND THE BY -LAWS OF THE OWASSO PLANNING COMMISSION REGARDING TIME AND PLACE OF MEETING (ARTICLE VII, SECTION 1) - Several changes in the Planning Commission's meeting time and location have occurred over the years and those changes have not been formally amended in the By -Laws. The staff is requesting that these changes, plus moving the meeting date from the third Thursday each month to the fourth Thursday of each month be considered. Following discussion, Charles Willey moved to amend the By -Laws to reflect that changes that have been made, but to not change the meeting date. Motion seconded by Gary Wells. A vote on the motion was recorded as follows: Charles Willey - Yes Gary Wells - Yes Dewey Brown - Yes Ray Haynes - Yes Owasso Planning Commission Minutes of November 21, 1991 Page 5 The motion carried 4 -0 and the By -Laws are amended as follows: ARTICLE VII. MEETINGS Section 1. Time and Place The meetings of the Commission shall be held in the City Council meeting room at the Owasso Community Center, unless otherwise provided by the Commission for particular meetings. The meetings shall be held at 7:00 p.m. on the third Thursday of each month unless otherwise set by the Commission. Special meetings may be held on call of the Chairperson at such time and place as may be designated. 8. NEW BUSINESS - Problems with the traffic signals at German Corner were discussed. Steve Compton will see what can be done about the situation. 9. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Staff discussed current development and construction in the Owasso area. 10. ADJOURNMENT - Charles Willey moved, Gary Wells seconded, to adjourn the meeting. A vote on the motion was recorded as follows: Charles Willey - Yes Gary Wells - Yes Dewey Brown - Yes Ray Haynes - Yes The motion carried 4 -0 and the meeting was adjourned at 8:15 p.m. Chairperson Secretary Date TO: Owasso Planning Commission FROM: Mike Augustine, City Planner SUBJECT: Change -of- Access - Native Oak Homes DATE: December 12, 1991 BACKGROUND The subject tract presently has a realtors office under construction, zoned Medium Intensity Office (OM), approximately .8 acre in size, and located at the southwest corner of 120th East Avenue and 86th Street North (see Case Map). It is abutted on the north by single - family residential uses zoned RS -3, on the east by a drainage ditch and single - family residential uses zoned a combination of AG and RS -3, on the south by a private park zoned AG, and on the west by an existing office building zoned OM. The applicant is requesting a Change of Access to be allowed to enter and exit his lot from 86th Street North. The subject tract was reviewed for a site plan request by the Technical Advisory Committee on October 9, 1991 meeting and it was determined to recommend approval, subject to (1) the applicant filing a separate 5' PSO service easement and (2) the possible field relocation of the driveway entrance because of a potential sight hazard with the bridge railing adjacent to the northeast corner of the tract. It was noted at the meeting that there is an existing 8" gas line located in the south ROW of 86th Street and with approximately 3 feet of cover and a 12" water line in the same ROW. Extreme care should be taken when constructing the driveway entry to avoid damaging these line. The site plan was reviewed at the October 17, 1991 meeting of the Planning Commission and it was approved, subject to (1) the applicant must file a separate 5' PSO service easement, (2) the applicant study the possible relocation of the driveway entrance because of a potential sight hazard with the bridge railing adjacent to the northeast corner of the tract, (3) all applicable building, fire, and health code requirements be met, and (4) a sign permit be obtained showing that the location and design of any proposed signs meet all regulations. Following the October 17 meeting it was determine that when the lot split establishing this lot was approved on February 22, 1979, there were no follow -up actions taken to amend the Limits - of-No- Access along 86th Street's frontage (see Site Map). This created a lot with no access and no mutual access agreements. The approval of this request simply cleans up past actions taken - by the Planning Commission. MEMORANDUM Change -of- Access Page 2 RECOMMENDATION I recommend approval of the requested Change -of- Access subject to the following conditions: 1. That proper legal steps be taken to ensure that the Change -of- Access becomes a part of Three Lakes Addition. 2. That the driveway be moved west so that it is not constructed over any part of the 15' utility easement to the east. 3. That the curb radius be changed from 15' to 20' to allow better ingress and egress. 4. That ONG be notified prior to construction of the driveway in order to protect the 8" gas line. 5. That the city be notified prior to construction of the driveway in order to protect the 12" water line.
