1. CALL TO ORDER AND ROLL CALL - Chairman Ray Haynes called the
meeting to order at 7:00 p-m. and declared a quorum present.
2. CONSIDER APPROVAL OF THE MINUTES OF JULY 19, 1990 - The
Commission reviewed the minutes of July 19, 1990_ Rick Johnson
moved, seconded by Pat Imbriano, to approve the minutes as written_

3. TULSA COUNTY HEAD START (3014) - A Request for a Site Plan
Review for a Proposal to Remodel the Existing Structure and Parking
Lot to House a Head Start Program, Located at 209 N Main Street.
Chairman Haynes introduced the case. Steve Compton explained the
Case background_ The Technical Advisory Committee has reviewed the
case and recommended approval of the site plan. Staff has also
reviewed the case and is recommending approval_
Gary Wells moved to approve the site plan subject to all code
requirements (building, zoning, fire, health, etc.) being met, and
extending to 18 months the time allowed for paving the parking lot.
Motion seconded by Rick Johnson. A vote on the motion was recorded
as follows:

4. FIRST CHRISTIAN CHURCH OF OWASSO (2914) - A request for a Site
Plan Review for a Proposal for an Addition to the Existing
Structure and Parking Lot, Located at 12200 E 86th Street North.
Chairman Haynes introduced the case. Steve Compton explained the
Case background_ The Technical Advisory Committee has reviewed the
case and recommended approval of the site plan. Staff has also
reviewed the case and is recommending approval.
Pat Imbriano moved to approve the site plan, with a condition of
the building permit being a requirement that a survey by a
Registered Land Surveyor be completed at the stemwall stage of
construction to ensure that encroachment into any easements will
not occur. Motion seconded by Gary Wells. A vote on the motion
was recorded as follows:

5. General Discussion of and Work Session on Owasso Subdivision
Regulations.
Members looked briefly at the Subdivision Regulations.
Because all requested comments have not been received, this item
will be continued at another meeting.
6. General Discussion of and Work Session on Owasso Sign
Ordinance.
A brief work session on changes to the sign ordinance was
held. A public hearing will be set.
7. New Business - INCOG will be holding a training seminar for
Planning Commission, Board of Adjustment, and Planners on September
14 & 15. Members are encouraged to attend.
8. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Steve Compton
reviewed current and proposed building activity.

MEMORANDUM

SUBJECT: Staff Case Report - Mingo Valley Shopping Center
(20- 21 -14)
DATE: September 13, 1990
BACKGROUND:
The applicant is requesting a Preliminary Plat review for a tract
of land located Northeast and Northwest of the intersection of 86th
Street North and 117th East Avenue.
The subject tract is approximately 8.67 acres in size and zoned
Commercial Shopping (CS). It is abutted on the North by the new
Wal -Mart store zoned CS, on the East by the Three Lakes Subdivision
and the Price -Rite store zoned a combination of Residential Single -
family High Density (RS-3) and CS, on the South by 86th Street, and
on the West by the Liberty Bank zoned CS and the Mingo Valley
Expressway service road. The proposed plat consists of one block
and two lots, both of which have access to public utilities. Since
access to public utilities exists and improvements to those
utilities are not contemplated at this time, construction plans are
not necessary. The applicant expects to lot -split Lot 2, Block 1
in the future when specific uses and needs are identified.
The Technical Advisory Committee (TAC) discussed this case at their
September 12, 1990 meeting and recommended approval subject to the
following concerns:
1) The addition of a 17.5' general utility easement along the
North property, except the extreme West portion of Lot 2 where
it will follow along the North side of the entry road.
2) The addition of a 17.5' general utility easement along the
West side of Lot 1 and Lot 2. This easement should flare to
a 30' width where it crosses the entry road.
3) The addition of a 22' general utility easement 11' either
side of the North property line of Lot 1 and extending across
the 117th East Avenue entry road.
4) The addition of a 17.5' general utility easement along the
Southeast property line of Lot 2.
5) The dedication of the right -of -way for the end of 117th
East Avenue.
b) The addition to the Deed of Dedication, Section 1.3.1
reference to all public and private utilities.
7) The addition to the Deed of Dedication reference to Wal-
Mart's shared responsibility for the maintenance of the
detention facility and the mutual access roadways.
RECOMMENDATION:
Staff has reviewed the Preliminary Plat and the requirements of the
Subdivision Regulations and concur with the concerns of the TAC.
I recommend approval of the Preliminary Plat, subject to the
conditions outlined above.

SUBJECT: Site Plan Review - Christian Church Counseling Center
(29- 21 -14)

BACKGROUND:
The applicant is requesting a Site Plan Review for a church related
counseling and temporary housing center. The proposal would be to
locate three buildings on the site, fronting on 123rd East Avenue.
Each building would be approximately 3,000 square feet in size and
parking would be located behind each building with driveway access
to 123rd. The proposal would also include a bridge over the
drainage ditch West of the site to tie the new Center to the
existing church parking lot which is located on the West side of
the drainage ditch.
The subject tract is located South of the Southwest corner of Stith
Street North and 123rd East Avenue. It is zoned Residential Duplex
(RD) and is vacant. The tract is abutted on the North by a medical
office zoned Commercial General (CG), on the West by a nursing home
zoned Residential Multi- Family Low Intensity (RM -1), on the South
by a single - family residential neighborhood zoned Residential
Single - Family High Intensity (RS -3), and on the West by the First
Christian Church zoned RS -3.
The Technical Advisory Committee (TAC) reviewed this case at their
September 12, 1990 meeting and recommended approval subject to the
following concerns:
1) That there be no paving over the existing 15' utility
easement along the drainage ditch and that if a bridge is
constructed, special precautions be taken to protect the
existing gas and electric lines located in this easement.
2) That each of the three proposed buildings be no larger than
3,000 square feet in size and that one handicapped parking
space be provided for each building.
3) That a screening fence and /or landscape buffer be provided
1 along the South property line between the subject tract and
the abutting single - family zoned lot.
4) That any bridge constructed over the drainage ditch must be
designed in such a manner that it does not restrict the design
flow of the ditch. In addition, the bridge would have to be
designed and constructed so that it would pass the runoff from
a 100 -year frequency rainstorm under full urbanization.
RECOMMENDATION:
Staff has reviewed the Site Plan and compared it to the
requirements of the zoning code and the subdivision regulations and
concur with the recommendation of the TAC. I recommend approval of
the Site Plan for the Christian Church Counseling Center, subject
to the conditions stated above.

SUBJECT: Site Plan Review - Texaco 76th & Dogwood (31-21-14)
DATE: September 14, 1990
BACKGROUND:
The applicant is requesting a Site Plan Review for the addition to
their existing facilities of a stand alone quick -lube building.
The building would be approximately 24' x 29' in size and would
have a small basement for mechanical and storage needs. There
would be only one service bay, and it is estimated that a customer
can be handled in 15 to 20 minutes. They are also proposing to use
the old oil to provide some or all of the heating needs of the new
building.
The subject tract is located at the Southeast corner of 76th Street
North and South Dogwood Street. It is zoned Commercial Shopping
(CS) and contains an existing convenience service station building
with gas pumps and a car wash building. The tract is abutted on
the East by the McDonald's Restaurant zoned CS, on the South by
vacant land zoned CS, on the West by the Burger King Restaurant
zoned CS, and on the North across 76th Street by the Homeland Store
zoned CS.
The Technical Advisory Committee reviewed this case at their
September 12, 1990 meeting and recommended approval subject to the
following concerns:
1) That the five existing parking spaces, including one
handicapped space be relocated on the lot.
2) That all federal, state, and local health and safety
requirements be met.
3) That the proposed building be moved East approximately 3'
to avoid any encroachment into the existing driveway access
lanes.
4) That the exit drive out of the lube facility be redesigned
to provide, to the maximum extent possible, perpendicular
entry into the existing driveway lanes. That a stop sign be
located at the end of the exit drive from the lube facility.
5) That the existing sidewalk stubbed into the subject tract
from the abutting McDonald "s tract be extended to the East
curb of the East drive and that wheelchair access be provided
from the drive to the sidewalk.
6) That a landscape plan be submitted to and approved by the
city planner for the area East and North of the proposed
building.
RECOMMENDATION:
Staff has reviewed the site plan and compared it to the
requirements of the zoning code and subdivision regulations and
concur with the recommendation of the TAC. I recommend approval of
the Site Plan for the 76th Street Texaco, subject to the above
stated conditions.

SUBJECT: The Proposed Annexation of the
Owasso Church of the Nazarene
DATE: September 13, 1990
BACKGROUND:
The Subject tract is approximately five (5) acres in size and
located approximately 1/4 mile North of the Northwest corner of
145th East Avenue and 86th Street North. It is vacant and proposed
to be the location for the new Owasso Church of the Nazarene. It
is surrounded on three sides by the City of Owasso and the owners
have requested to be annexed. Upon annexation, the tract will be
zoned Agriculture (AG) District per Section 110.3 b., Annexed
Territory of the Owasso Zoning Code. Prior to the issuance of a
building permit, the applicant would be required to file an
application and receive approval from the Board of Adjustment for
a Special Exception to allow a church in an AG District.
It should be noted that the subject tract does not meet the
preferable size of 20 acres or larger as identified in the
Annexation Policy adopted by the City Council March 1, 1988.
However, the policy doesn't restrict the size to 20 acres or
greater; it simply identifies that this is the preferable size.
The Annexation Committee reviewed this case at their August 30,
1990 meeting and all present recommended that the tract be annexed.
RECOMMENDATION:
I recommend that the property be annexed as requested. It is
advisable to annex vacant tracts so that the City may have a direct
influence on how the properties are developed. The land in
question is now vacant and surrounded on three sides by city
limits.

SUBJECT: The Proposed Annexation of the Right -Of -Way of the
Mingo Valley Expressway (US 169 Highway) Between 76th
Street North and 96th Street North
DATE: September 13, 1990
BACKGROUND:
The Annexation Committee at their March 30, 1989 meeting
recommended that the City annex the Mingo Valley Expressway right -
of -way between 76th Street North and 86th Street North. Richard
Hall, in his review and recommendation of the proposed annexation,
noted that the City administration had an agreement with Tulsa
County to annex and maintain the service roads along the highway if
the County would repave those service roads. The County completed
the repaving project last Fall. Richard also noted that the City
will incur the responsibility to maintain the service roads in the
future, but since they are newly surfaced they should not need
repair for seven years. The Expressway pavement and shoulders will
continue to be maintained by the State Department of
Transportation. The City, however, will have to pay maintenance
and electricity cost of lights placed by the State along the
Expressway within the City Limits. Electricity costs will be about
$10,000 per year at current rates.
Since then, I have reviewed the proposed annexation and have
extended the annexation proposal to include those parts of the
Expressway and Old Hwy 169 between 86th Street North and 96th
Street North that have yet to be annexed. At this time,
approximately one -third of the 86th Street and US Highway 169
interchange is within the City's corporate limits. Also, the South
half of the 96th Street interchange and approximately one - quarter
mile of the Expressway are within the corporate limits (see map).
Adding the Expressway right -of -way land between 86th Street and
96th Street will necessitate a change in the annexation process.
The land between 76th Street and 86th Street is surrounded by
existing corporate limits, which allows the City to give notice of
its intent to annex the property and go through a public hearing
process. That land between 86th Street and 96th Street is not
abutted by corporate limits on at least three sides, which requires

the property owner (State of Oklahoma) to request or consent to be
annexed.
I have discussed the new proposal with Ray Jordon, Tulsa County
Engineer; Frank Chiles, ODOT Division Engineer; the INCOG
Transportation TAC; Mr. Ray; Chief Motto; Ron Cates; and some
members of the City Council. The general consensus has been
favorable. Questions that have been asked have centered around the
following concerns:
Mowing - The Expressway is now mowed maybe once or twice
a summer by ODOT, the remainder of the time the
City mows the area. If the land is annexed,
the City will loose this one -time mowing by the
State. This is not a significant loss given
the fact that we want to start presenting
Owasso to the public in a more favorable
manner.
Lighting - This concern has not changed from Richard's
analysis. The City would (at a minimum) have
to pay for maintenance and electricity cost.
This would most likely be the same whether the
Expressway was in the City or County. The City
can purchase the lights or have ODOT purchase
them. If ODOT purchases them, we would have to
wait until our need meets a State formula.
Drainage - The City will be responsible for drainage
problems and maintenance; however, all of the
facilities between 86th Street and 96th Street
are new and the area between 76th Street and
86th Street is mostly flat with little or no
drainage problems foreseen. The drainage ditch
South of Rayola park will need future
maintenance, but would most likely be handled
by the City regardless of City boundaries.
Fencing - The fencing between the service roads and the
Expressway paving is required for safety
reasons (controls access to the Expressway
lanes for animals, children, vehicles, etc.).
It is questionable how well the existing fence
accomplishes this concern; however, Frank
Chiles of ODOT has stated that because of money
constraints and the fact that fencing has a low
priority, he would see the State doing only
minimal repairs of the existing fence in the
future. If we want a new fence, it will have
to be purchased by the City and whether or not

the right -of -way is within the corporate limits
will not matter. If the State is responsible
for the fence, it will remain as a Hog -wire
fence for some time.
Pavement - The State will remain responsible for the
maintenance and snow removal of the Expressway
pavement and shoulders. As noted by Richard,
the City will take over maintenance of the
service roads from the County.
Police Services - At this time, since it is impossible for the
police to physically identify what areas are
within the City and because of the moral
obligation, they answer all emergency calls on
the Expressway. These actions often result in
our officers sitting at the scene 15 to 30
minutes waiting for State backup. We want
officers there, but at this point they are
loosing a significant amount of time on each
call. Also, officers are ticketing violators
on the service roads, which is questionable,
but can't be avoided.
Visual Image - There has been much discussion about
concentrating a significant effort into
improving the visual impression of Owasso and
that this effort could center around the
Expressway and the land use along both sides of
the Expressway between 76th Street and 86th
Street. In order for the City to accomplish
this goal, it will be necessary to have
regulatory control of this land.
The Annexation Committee reviewed this case at their August 30,
1990 meeting and all those present recommended the expressway
right -of way be annexed. It was also recommended by all present
that the petition be amended to include all of the State of
Oklahoma owned land that was Old Hwy 169 and is now a part of
Garnett Road between 86th Street North and 96th Street North.
RECOMMENDATION:
Given the above analysis, I would recommend approval of the
proposed annexation, including the addition of the Old Hwy 169
right -of -way. This annexation will include only public held land.

SUBJECT: The Proposed Annexation of the Owasso Sports -Plex
DATE: September 13, 1990
BACKGROUND:
The subject tract is approximately 78 acres in size and located 1/2
mile West of the intersection of Garnett Road and 116th Street
North. It is vacant, recently purchased by the City of Owasso, and
proposed to be the location of the new Owasso Sports -Plex. This
complex will be developed over the next 5 to 10 years and become
the primary home for all city sports programs. It is abutted on
the East by Hale's Acres, a single - family subdivision that is
within the city limits of the City of Owasso. It is abutted on the
South and West by mostly vacant land zoned Agriculture (AG) that is
outside of the city limits. On the North the subject tract is
abutted by 116th Street and the Westport Addition, a single - family
subdivision that is within the city limits.
The Annexation Committee reviewed this case at their August 30,
1990 meeting. After discussion, it was recommended by all members
present that the subject tract be annexed into the city.
RECOMMENDATION:
Since the tract is now city owned, proposed to be used as a city
facility, has city utilities available, and developed with city
funds, it would be advisable to annex the tract to ensure that
decisions affecting its development and long -term maintenance are
controlled by the city. I recommend approval of this annexation.
