CALL TO ORDER AND ROLL CALL - Chairman Ray Haynes called the meeting to order at 7:05 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF OCTOBER 18, 1990 - The Commission reviewed the minutes of October 18, 1990. Pat Imbriano moved, seconded by Charles Willey, to approve the minutes as written. A vote on the motion was recorded as follows: The motion carried 3-0. Pat Imbriano - Yes Charles Willey - Yes Ray Haynes - Yes ANNEXATION REVIEW 3. LARKIN BAILEY (19 -21- 14)(30- 21 -14) - A Tract of Land Located West of the Owasso City Limits Bordered Roughly by Fourth Street on the South, the AT &SF Railroad Tracks and Mingo Road on the West, and 96th Street on the North. Chairman Haynes introduced the case and staff reviewed the back- ground. The subject tract is approximately 450 acres in size, mostly vacant and zoned AG District. It will be the first phase of a major recreational /residential development that, when completed, will be 1500 acres in size. The recreational portion of the development includes a proposal for a new Owasso Public Golf Course. The annexation of the land will be followed by a zoning and PUD application presented to the Planning Commission in January, specifically identifying how Phase I will be developed. The Annexation Committee reviewed this petition at their November 8th meeting and recommended approval of the requested annexation. It was also recommended that the public right -of -way for 86th Street North be included in the annexation petition, but that the rights -of -way for Mingo Road (97th East Ave) and 96th Street North be excluded. Staff recommends approval of the Larkin Bailey annexation. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Steve Compton reviewed current and proposed building activity, including the relocation of the Scoreboard Sports Center to the old Johnson Furniture building. 6. A vote on the motion was recorded as follows: Charles Willey - Yes Pat Imbriano - Yes Ray Haynes - Yes The meeting was adjourned at 7:25 p.m. Chairman Secretary Date MEMORANDUM TO: Owasso Planning Commission FROM: Steve Compton Assistant City Manager for Community Development SUBJECT: Staff Case Report OZ-82 (29- 21 -14) DATE: December 13, 1990 BACKGROUND The subject tract is located South of the Southwest corner of 86th Street North and 123rd East Avenue. It is zoned Residential Duplex (RD) and is vacant. The tract is abutted on the North by a medical office zoned Commercial General (CG), on the West by a nursing home zoned Residential Multi - Family Low Intensity (RM -1), on the South by a single - family residential neighborhood zoned Residential Single - Family High Intensity (RS -3), and on the West by a large drainage ditch and the First Christian Church zoned RS -3. The applicant is requesting (OM) Medium Intensity Office zoning on a tract presently zoned Residential Duplex (RD). The request would result in a proposal to locate three buildings on the site, fronting 123rd East Avenue. Each building would be approximately 3000 square feet in size and parking would be located behind each building with driveway access to 123rd. The proposal would also include a bridge over the drainage ditch West of the site to tie the proposed development to an existing church parking lot, which is located on the West side of the drainage ditch (Site Plan approved by Planning Commission September 20, 1990. STAFF ANALYSIS The Comprehensive Plan calls for the subject tract to be developed as Low Intensity Residential; however, the plan has not been amended to reflect the General Commercial (CG) District zoning classification which was approved for the abutting tracts of land North of the subject tract. The CG zoning classification approved on these tracts is inconsistent with the Comprehensive Plan and its approval affected the future zoning and land use patterns on all surrounding tracts of land. Many land use conflicts can occur when commercial zoning districts directly abut residential zoning districts; therefore the goals and objectives of the Comprehensive Plan and sound planning principles call for the use of office and /or multi - family type zoning districts as buffering between such uses. An example of this type of zoning pattern exists at the Southeast corner of 117th East Avenue and 86th Street North (see Case Map). In this situation, single - family uses located away from the intersection are buffered by a Medium - Intensity Office (OM) District zoning classification from the commercial zoning and land uses located immediately at the intersection. Since commercial zoning was allowed on the tracts North of the subject tract, it appears that office zoning abutting the commercial zoning is appropriate and could reduce future conflicts that will most likely occur between the existing commercial and residential duplex zoning classifications. However, the applicant's request for OM zoning on the entire tract would extend medium - intensity uses further South than would seem to be necessary for a smooth transition from commercial use to residential use. An appropriate zoning pattern would seem to be a transition from the existing CG District down to an OM District, then down to an OL District abutting the existing RS -3 District. This type of transional zoning pattern would be consistent with the goals and objectives of the Comprehensive Plan and consistent with existing zoning patterns allowed in similar location within the community. STAFF RECOMMENDATION Given the above analysis, I recommend approval of the requested OM zoning on Lots 1 -4, Block 1, Elm Creek Condominiums Amended (northerly four lots) and denial of OM on Lots 5 & 6, Block 1 (southerly two lots). Notice regulations, stated in the code, allow the Planning Commission to consider a less intense office zoning classification than the OM that was requested and notice was provided. Therefore, I also recommend approval of OL zoning on Lots 5 & 6, Block 1, Elm Creek Condominiums Amended.
