Adjournment !u 1 u I t : ►11 )u TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: CHIP MCCULLEY CITY PLANNER SUBJECT: OBOA- 07 -13, A REQUEST FOR A VARIANCE TO ALLOW THE REDUCTION OF THE REQUIRED 25' FRONT YARD SETBACK TO 20' AND THE REQUIRED 20' REAR YARD SETBACK TO 15'TO ALLOW FOR THE CONSTRUCTION OF A SINGLE FAMILY HOME DATE: August 20, 2007 The City of Owasso has received an application for a variance from Marion Homes, LLC to allow the reduction of the required 25' front yard setback to 20' and the required 20' rear yard setback to 15' to allow for the construction of a single family home on a property zoned RS -3 (Residential Single - Family), located at 9804 East 108 Court North. A general area map is attached. EXISTING LAND USE Undeveloped residential lot SURROUNDING LAND USE The subject property is located in the Metro Heights addition. RS -3 (Residential Single - Family) APPLICABLE REGULATIONS Owasso Zoning Code, Section 430 — Bulk and Area Requirements in Residential Districts. ANALYSIS The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the reduction of the required 25' front yard setback to 20' and the required 20' rear yard setback to 15' to allow for the construction of a single family home on a property zoned RS -3 (Residential Single - Family), located at 9804 East 108 Court North. As shown in the site drawing, it is clear that the unusual lot layout poses a hardship for the owner to properly construct a home on the property. Staffs opinion is due to the lots location on the cul -de -sac the structure must be brought forward on the lot to match the appearance of the rest of the addition. The staff has evaluated the request, and finds that approval of the variance will not result in any detrimental impact on the surrounding area. It is the opinion of the staff that the character of the development will not be adversely affected by granting the variance. Letters were mailed to all property owners within three- hundred (300) feet of the subject property on and the request was advertised in the Owasso Reporter. A similar development wide Board of Adjustment Variance was approved in May, 2000 for Camden Park II. If approved, the request will allow for larger homes and compliment Owasso's current housing market with a healthy mixture of development styles and prices. As shown in the site drawing, the RS -2 development consists of large lots with ample separation between structures. If approved the setbacks will be the same as those in existing RS -3 districts, such as Fairways, Southern Links , and Sawgrass Park. The staff has evaluated the request, and finds that approval of the variance will not result in any detrimental impact on the surrounding area. It is the opinion of the staff that the character of the development will not be adversely affected by granting the variance. Letters were mailed to all property owners within three - hundred (300) feet of the subject property on and the request was advertised in the Owasso Reporter. A general area map is attached. EXISTING LAND USE Residential SURROUNDING LAND USE The subject property is located in Fairways addition. APPLICABLE REGULATIONS Owasso Zoning Code, Section 240.2 — Permitted Yard Obstructions. ANALYSIS The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the reduction of 5' of the required 10' side yard setback to 5', to allow for the construction of a swimming pool, located at 9304 North 100'h East Avenue. As shown in the site drawing, the proposed structure is planned to be constructed 4' over the required 10' northern side yard setback. Upon initial site inspection by city staff is was found that the utility easement in the rear yard of the property causes a hardship in the location of a pool in the rear yard. By locating the pool off the utility easement it shifts the pools location to the side yard and thus encroaches into the 10' side yard setback. Further, it was the staffs finding that ample separation exists between the two properties and finds that approval of the variance will not result in any detrimental impact on the surrounding area. It is the opinion of the staff that the character of the neighborhood will not be adversely affected by granting the variance. Letters were mailed to all property owners within three- hundred (300) feet of the subject property on and the request was advertised in the Owasso Reporter.
