SUBJECT: OBOA- 07 -16, A REQUEST FOR A VARIANCE FROM THE SIDE YARD
SETBACK REQUIREMENTS TO ALLOW FOR A SWIMMING POOL

BACKGROUND:
The City of Owasso has received a request to allow the reduction of the required 10' side yard
setback to 5' to allow for the construction of a swimming pool on a property zoned RS -3 located
at 9700 East 90'x' Court North. The property is located within Fairways V. A map of the
neighborhood showing the property is attached with this memorandum.
PROPERTY CHARACTERISTICS:
The property is approximately 6,329 square feet in size and is zoned RS -3 Residential Single - family.
The subject property is occupied by a single - family home. Other single- family homes surround the site.

Owasso Zoning Code, Section 430 — Bulk and Area Requirements in Residential Districts.
ANALYSIS
In the application for the variance, the applicant states that without the extra five feet, there is not
room to build the pool. The Board members may recall that the City Council changed the side
yard setbacks for all houses within RS -3 districts to five feet on each side in January, 2005.
However, it was the Council's decision to leave the setbacks for accessory structures (five feet)
and swimming pools (ten feet) unchanged, desiring that setback decisions be made by the Board
of Adjustment on a case by case basis so that any concerned neighbors would have the
opportunity to voice their opinions about the request at a public hearing.
The staff believes that all criteria have been met relative to the variance language in the Owasso
Zoning Code. The staff finds that the application is consistent with stated intent of the zoning
code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare.
Letters were mailed to all property owners within three- hundred (300) feet of the subject
property and the request was advertised in the Owasso Reporter.
The staff has received one phone call from a neighbor about the request, who stated a concern
that she would be able to see people in the pool from the upstairs portion of her home.
RECOMMENDATION
The staff recommends approval of OBOA -07 -16
