Stephenson City Planner CASE: OBOA 11 -02 DATE: August 23, 2011 BACKGROUND: The City of Owasso received a request for a Special Exception to allow for the construction of a carport over an existing driveway within the front -yard setback. The property is a single family residence located at] 1236 N. 941h East Avenue. SIZE OF LOT: 23,223 sq. ft. EXISTING LAND USE: Residential - Single - Family SURROUNDING LAND USE: North: Residential, RS -3 zoning South: Agriculture, AG East: Residential, RS -3 zoning West: Residential, RS -3 zoning PRESENT ZONING: RS -3 (Single - Family Residential High Density) APPROVAL PROCESS "The Board of Adjustment shall hold the public hearing and, upon the concurring vote of three members, may grant the Special Exception after finding that the Special Exception will be in harmony with the spirit and intent of the code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Provided that the Board in granting a Special Exception shall prescribe appropriate conditions and safeguards, and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached." - Section 1480.4 Owasso Zoning Code. ANALYSIS The applicant desires to construct a carport over an existing driveway that abuts N 94th East Avenue, a street that currently stubs out to the property to the south. According to section 3.2.16 of the Owasso Subdivision Regulations streets shall be integrated with existing platted rights -of -way. Considering this, 94th East Avenue could connect to future development when the tract of land located to the south develops. The proposed carport would be located only a few feet from the platted right -of -way potentially creating a safety concern. No structures of any type are allowed in any front setback in any zoning classification within the City of Owasso, without a special exception approved by the Board of Adjustment. The proposed carport would be constructed within the required front yard setback, but may create a dangerous precedent if approved. The Board should consider this information in its deliberations and evaluation of the request. Letters were mailed to all property owners within three - hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. Staff received no objections concerning OBOA 11 -02. Staff has concluded that the carport if approved has the potential to impact the public safety and general welfare of the community.
