ADJUSTMENTS OF THE CITY OF OWASSO,
OKLAHOMA.

Notice is hereby given that a public hearing will be held before the
Owasso Board of Adjustment at Old Central, 109 North Birch,
Owasso, Oklahoma at 6:00 PM on the 27`h day of October, 2009.
At that time and place the Owasso Board of Adjustment will
consider a request from Don Martin for a VARIANCE from the
Owasso Zoning Code, to allow for a 1.5 ft. rear yard encroachment
located at 9506 North 133 East Avenue.
All persons interested in the above mentioned matter are hereby
notified to be present at the above mentioned time and place in
order to present their arguments for or against same.
Information and maps showing the property location may be
inspected in the Community Development Department, 111 N.
Main Street, Owasso, Oklahoma, 74055, or by calling 376 -1500.

SUBJECT: OBOA- 09 -06, A REQUEST FOR A VARIANCE TO ALLOW FOR AN
ENCROACHMENT OF 1.5' INTO THE REAR YARD BUILDING

BACKGROUND
The City of Owasso has received a request from Mr. Don Martin, applicant, for a variance from
the Owasso Zoning Code, to allow for an encroachment of 1.5' in the rear yard building line,
located at 9506 North 133 East Avenue. A general area map is attached.
EXISTING LAND USE
Residential
SURROUNDING LAND USE
The subject property is located in Windsor Lake addition.
PRESENT ZONING
RS -3 (Residential Single - Family Medium Density District)
ANALYSIS
The applicant is requesting a variance from the Owasso Zoning Code Development Standards to
allow for the encroachment of 1.5' in the rear yard, located at 9506 North 133 East Avenue. As
shown in the site drawing, the porch cover is constructed 1.5' over the required 30' building
line.
The applicant has stated that the reasoning for the request was based on the need to create a clean
title. The staff evaluated the request, and finds that approval of the variance will not result in any
detrimental impact on the surrounding area. It is opinion of the staff that the character of the
neighborhood will not be adversely affected by granting the variance.
Letters were mailed to all property owners within three- hundred (300) feet of the subject property
on and the request was advertised in the Owasso Reporter. Staff received no inquiries
concerning OBOA 09 -06.
RECOMMENDATION
The staff recommends approval of OBOA 09 -06.
