SUBJECT: OBOA -05-03, A REQUEST FOR A VARIANCE TO ALLOW THE
ENCROACHMENT OF A BUILDING LINE ON A PROPERTY ZONED
RS-3
DATE: February 14, 2005
The municipal staff has received an application for a variance to allow the encroachment of a building
line on a property zoned RS -3 (Residential- Single Family), located at 11410 N. 131" E Ave. in the
Garrett Creek Subdivision.
As stated above, the subject property is located at 11410 N 131 E Ave, Lot 16 Block 1 Garrett Creek
Estates. The legal description of the property is attached with this memorandum. The property is
currently zoned RS -3 (Residential- Single Family) and unoccupied. The site is bordered to the north,
south, east and west by RS-3 (Residential- Single Family) zoning.
ANALYSIS:
The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow
for the construction of a residence that encroaches 3' into the 25' Building Setback Line. As shown in
the site drawing, the north corner of the structures garage encroaches into the building line.
The subject property contains a 1,750 sq ft building, currently in the final phases of construction. It is
the intent of R C. Construction to complete the project and sell the residence.
The staff has evaluated the request, and finds that approval of the variance will not result in any
detrimental impact on the surrounding area. It is the opinion of the staff that the character of the
neighborhood will not be adversely affected by granting the variance.
Letters were mailed to all property owners within three- hundred (300) feet of the subject property on
February 11, 2005 and the request was advertised in the Owasso Reporter on February 14, 2005.
RECOMMENDATION:
The staff recommends approval of OBOA 05 -03

Notice is hereby given that a public hearing will be held before the
Owasso Board of Adjustment in the Owasso Old Central, 109 North
Birch, Owasso, Oklahoma at 6:00 PM on the 22nd day of February,
2005. At that time and place the Owasso Board of Adjustment will
consider a request for a variance from R C. Construction to ALLOW
THE ENCROACHWNT OF A BUILDING LINE on a property
zoned RS -3 (Residential Single - Family), located at 11410 N. 131" E.
Ave.
All persons interested in the above mentioned matter are hereby

Please submit the completed application form and application fee of $75 along with a Certified 300' Radius
Report (available from an abstract company) and other supplemental documents to the City Planner on or before
the first day of the month in which the request is to be heard by the Board. This is a quasi - judicial proceeding.
