Adjournment MEMORANDUM TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: ERIC WILES COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: OBOA - 06-01, A REQUEST FOR A VARIANCE FROM THE FRONT YARD SETBACK REQUIREMENTS TO ALLOW FOR A COMMERCIAL BUILDING IN A COMMERCIAL SHOPPING DISTRICT DATE: March 22, 2006 BACKGROUND: The City of Owasso has received a request from Tyann Development for a Variance of the Owasso Zoning Code, Section 630, Front Yard Setback Requirements, to allow for a commercial building in a Commercial Shopping Center District. The request is for approval. of a 30' building line instead of a 50' building line. The property is the subject of a recently approved a final plat for Tyann Plaza IV, a proposed one- lot commercial subdivision containing 39,319 square feet. The property is located on the south side of East 960' Street North, just north of the Home Depot. The final plat and a general development plan for the entire Tyann Plaza development are attached with. this memorandum. PROPERTY CHARACTERISTICS: The property is approximately 0.9 acres in size and is zoned CS (Commercial Shopping). The subject property is undeveloped. East 9e Street North and the Owasso Expressway occupy the land north of the site. Property to the east and to the south is zoned CS and is developed for commercial purposes such as the Home Depot. The remainder of the Tyann Plazaa development and the Owasso Expressway are situated west and southwest of the property. SURROUNDING LAND USE North: Owasso School District Administration Offices South: Undeveloped and E. 86s' St. N. East: Brookwood Apartments West: Ator Elementary PRESENT ZONING CS (Commercial Shopping Center District) APPLICABLE REGULATIONS Owasso Zoning Code, Section 630 — Bulk and Area Requirements in Commercial Districts. ANALYSIS The reason for the variance request is the presence of a 100' wide electric utility easement running through a large portion of the property, rendering that portion of the property unbuildable. The staff believes that all criteria have been met relative to the variance language in the Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the zoning code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Letters were mailed to all property owners within three - hundred (3 00) feet of the subject property and the request was advertised in the Owasso Reporter.
