BACKGROUND
The City of Owasso has received an application for a variance to allow the reduction of 250' of the
required 75' building line to 46' on property zoned IM (Industrial Medium Density), located at 8091
North 115'h East Avenue. A general area map is attached.

APPLICABLE REGULATIONS
Owasso Zoning Code, Section 730 — Bulk and Area Requirements in Industrial Districts.
ANALYSIS
The applicant is requesting a variance from the Owasso Zoning Code Development Standards to
allow for the reduction of the northern 250' of the required 75' building line to 46' to allow for the
construction of a manufacturing facility on property zoned IM (Industrial Medium Density), located
at 8091 North 115'' East Avenue. As shown on the site drawing, the proposed structure is to be
constructed 29' over the eastern building line.
The staff has evaluated the request, and finds that approval of the variance will not result in any
detrimental impact on the surrounding area. It is the opinion of the staff that the character of the
neighborhood will not be adversely affected by granting the variance.
Letters were mailed to all property owners within three-hundred (300) feet of the subject property
on and the request was advertised in the Owasso Reporter.
RECOMMENDATION
The staff recommends approval of OBOA 06-04.

TATE TIRE COMPANY TO BE LOCATED IN A COMMERCIAL

BACKGROUND
The City of Owasso has received a request from Craig Tate for a Special Exception of the
Owasso Zoning Code, Section 610, Principle uses permitted in commercial districts, TO
ALLOW TATE TIRE COMPANY TO BE LOCATED IN A COMMERCIAL SHOPPING
DISTRICT on property zoned CS (Commercial Shopping Center District). The proposed use of
the property is as an Automotive Services Center,

The subject property is located at the northeast comer of North 119'h East Avenue and East 96s'
Street North, immediately west of Fuddruckers.

APPLICABLE REGULATIONS
Owasso Zoning Code, Section 610 — Principle uses permitted in commercial districts, Table 1 -
Board of Adjustment.
ANALYSIS
According to the Owasso Zoning Code, the Board of Adjustment may grant a special exception
after finding that the special exception will be in harmony with the spirit and intent of the code,
and will not be injurious to the neighborhood or otherwise detrimental to the public welfare.
Provided that the Board in granting a special exception shall prescribe appropriate conditions
and safeguards, and may require such evidence and guarantee or bonds as it may deem necessary
to enforce compliance with the conditions attached.
The applicant is requesting a special exception from the Owasso Zoning Code to allow for a Tate
Tire Company to be located in a commercial shopping district. The proposed use of the property
is as an automotive service center and is permitted by special exception in a commercial
shopping district. A site map is included with your packets.
Staff believes that all criteria have been met relative to the special exception language in the
Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the
zoning code and will not be detrimental to the public welfare. However,. it is staff's
recommendation that the board prescribe appropriate measures to insure that the development
will not be injurious to the surrounding development as the subject property does lie within what
is becoming the City of Owasso's commercial corridor. A site plan for the proposed
development must be approved by the Owasso Planning Commission prior to issuance of a
building permit.
All property owners within three - hundred (300) feet of the subject property were notified and the
request was advertised in the Owasso Reporter.
SITE PICTURES
The assistant city manager recently traveled to both Tate Tire Boys locations in Skiatook and
Bartlesville where he observed tires being stored outside of a screening fence. The city staff is
very concerned that such outdoor displays at the Owasso location would have a substantial
detrimental impact on the growing 96s' street corridor.
RECOMMENDATION
Staff recommends approval of OBOA -06 -05 subject to the following conditions:
1. The applicant may not store tires outdoors.
2. No outdoor display of tires.
