Other Business Adjournment 10i0110 �1 C a ►11 4�1 TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: CHIP MCCULLEY CITY PLANNER SUBJECT: OBOA - 06-09, A REQUEST FOR A VARIANCE TO ALLOW THE REDUCTION OF THE REQUIRED 10' SIDE YARD SETBACK TO 8' TO ALLOW FOR THE CONSTRUCTION OF A SWEMMING POOL DATE: October 16, 2006 The City of Owasso has received an application for a variance to allow the reduction of 2' of the required 10' side yard setback to 8'to allow for the construction of a swimming pool, located at 13804 East 92 Court North. A general area map is attached. EXISTING LAND USE Residential SURROUNDING LAND USE The subject property is located in Nottingham Estates II addition. PRESENT ZONING Residential APPLICABLE REGULATIONS Owasso Zoning Code, Section 240.2 — Permitted Yard Obstructions. ANALYSIS The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the reduction of 2' of the required 10' side yard setback to 8', to allow for the construction of a swimming pool, located at 13804 East 92 Court North. As shown in the site drawing, the proposed structure was constructed 2' over the required 10' northern side yard setback. Upon initial site inspection of the swimming pool located at 13804 East 92 Court North by the City of Owasso building inspector, the 10' setback requirement was properly maintained on the north side of the property. During the excavation of the pool, the pool's location was inadvertently moved 2' from its original location. The applicant informed staff that the original forms are sometimes taken down to allow for pre - grading to take place, and may be what caused the misplacement of the forms. The staff has evaluated the request, and finds that approval of the variance will not result in any detrimental impact on the surrounding area. It is the opinion of the staff that the character of the neighborhood will not be adversely affected by granting the variance. Letters were mailed to all property owners within three- hundred (300) feet of the subject property on and the request was advertised in the Owasso Reporter. To this date the staff has not received any comments concerning the request. RECOMMENDATION The staff recommends approval of OBOA 06 -09. ATTACHMENTS 1. Case map 2.
