Main (west side) at 11:00 am on January 2, 2019. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 pm. ITEM 2. Flag Salute ITEM 3. OA 18-05 - Deannexation, Solkollosky Property - Consideration and appropriate action relating to the request for the review of a cleannexation request. The request is comprised of two (2) tracts. One is a 132.07 acre tract on the south side of E 106th St N and the other 160 acre tract is on the north side of E 106th St N between Mingo Rd and Memorial Drive. Morgan Pemberton presented the staff report. The location was described. Staff recommends approval of the deannexation case. A brief discussion was held regarding some development-related issues. Mr. Vines suggested to look into creating a City policy for future deannexafions requests. Mr. Miller moved, seconded by Mr. Balfhrop, to approve the cleannexation request (OA 18-05) . A vote on the motion was recorded as follows: YEA: Loving, Vines, Miller, Balthrop, Horton NAY: None Motion carried 5-0 ITEM 7. OA 18-06 - Annexation, Hutchinson Property - Consideration and appropriate action relating to the request for the review of an annexation request. The location of the property is 12429 N 1351h E Ave and is approximately 1.68 acres. The subject property will be brought into the City Limits of Owasso as AG (Agriculture). Morgan Pemberton presented the staff report. The location was described. Staff recommends approval off he annexation request. Mr. Vines stated that the agenda showed the property to be annexed with CS (Commercial Shopping) zoning, but the applicant requested it to continue with AG (Agriculture) zoning upon annexation. Mr. Vines moved, seconded by Mr. Miller, to approve the annexation request (OA 18-06) and to be brought into the City Limits of Owasso as AG (Agriculture) zoning. The location of the property is near the northeast corner of N 145th E Ave and Hwy 20 and is approximately 7.05 acres. The property location was described. Discussion was held regarding the retention of the hard corner under Rogers County jurisdiction. The owner has submitted a letter of intent to City staff stating he will request annexation within a five year period. Staff recommends approval of the annexation request. Mr. Vines stated that the agenda showed the property to be annexed with AG (Agriculture) zoning, but the applicant requested it to continue with CS (Commercial Shopping) zoning upon annexation. Mr. Vines moved, seconded by Mr. Miller, to approve the annexation request (OA 18-07) and to be brought into the City Limits of Owasso as CS (Commercial Shopping) zoning. Block l ofAtorCenter U. /\ lot split was recently approved by the Planning Commission, creating Lots 3a and 3b from the parent tract. The current plot for Lots 3a and 3b shows o W0^\ limit of access (LOA) on N Garnett Road on Lot 3u. The change ofaccess proposes closing the existing forty foot /40'> LOA that is shown on Lot 3a and creating a new forty-foot (40') access point on the common property line between Lots 3qand 3b. The proposed LOA would act oso mutual access point for both Lots 3a and 3b. By allowing just one access point onto N Garnett Road for Lots 3a and 3b' the number ofcurb cuts is reduced along this busy arterial road. The City Engineer has expressed support for this change ofaccess, There are two main reasons why the applicant |srequesting this change of access, First, the currentfortv400t (40') LOA on Lot 3owould interfere with on existing storm inlet along the curb of Garnett Rood. If the developer attempted to build a driveway in this location where the platted access currently exists' it would require a considerable amount of utility redesign and construction costs. Second, while there is a proposed restaurant for Lot 3b' there is no development yet planned for Lot 3a, Therefore, in order to provide adequate access 10 Lot 3b and to o||ovv flexibility for future development on Lot 3o, if is preferred that the two lots shore one, centrally-located access point onto N Garnett Road. There is o hotel currently under construction on the lot immediately to the north of Lot 3a. In order for the hotel to meet the access requirements of the Fire Code, a secondary access point on the property line between Lot 3o and the hotel property was established with o h\u|Uo| Access Agreement in 20l7. This 1vveDfy-fourfoot /24'\ mutual ocuenn point is identified on the attached exhibit. Uisunderstood bv the hotel developer and the City that the hotel will complete on access drive (constructed of a drivable-surface material) from the hotel property line to N Garnett Road, The responsibility of constructing said access drive falls on the hotel developer as, at this time, there are no specific development plans for Lot 3a. If this change of access is approved, the hotel developer would construct the required access drive across Lot 3a from the hotel property line to the driveway stub shown on the proposed restaurant Site Plan, Whenever Lot 3a develops if will be the responsibility of the future developer and the hotel owner to ensure that the mutual access drive remains open and unobstructed, allowing the Fire Department full and complete access to the proposed new access point referred |oin this case. Staff recommends approval of the change of access request for Lots 3a and 3b' Block |of Ator Center 11. Within CS (Commercial Shopping) Zoning, an SUP is required for automobile so|es, which is the request of this permit Additionally, this project site lies within the US-(69 Overlay District, which not only requires a Specific Use Permit for a car dealership, but also caps the maximum size at five (5) acres. An automobile sales use requires an SUP because they are often associated with increased traffic, noise, and lighting compared to other uses typically found in CS zoning. The SUP approval process is discretionary and allows City staff, the Planning Commission, and the City Council to require additional conditions on the project to help mitigate any issues that ohiUhe+in1enxi|y use can cause. An existing Glover Dealership b adjacent to the subject property tm the south. That dealership currently sells Dodge' Chrysler, Jeep' Ram, and Fiat vehicles. It is located on o J ocna tract of land within the US- l89 Overlay District that is zoned CS. The existing dealership was approved by City CVwnd| with SUP (16-03) in 2016. The applicant is requesting this SUP /18'01\ to accommodate a new stand-alone Jeep dealership that will be under the Glover name, but for all intents and purposes, will be o separate entity from the existing dem|eohip. The existing dealership will cnntlnvefo sell Dodge, Chrysler, Ram, and Fiat vehicles. The proposed new Jeep dealership would utilize the existing dealership property for office space and servicing. The building currently being utilized by the existing dealership would be expanded, and a proposed Site Plan for this expansion is attached to this memo. The Jeep dealership would also use approximately 3.93 acres of the subject property in this SUP (18'01) for vehicle inventory. No new structures are proposed for the vehicle inventory area on the subject property. The remaining 2.29 acres of the subject property in this SUP (18-0 1) would be identified for retail and/or restaurant uses. ,4 requirement that this 2.29 acres be used for either retail or restaurant land uses is part of the staff recommendation for this SUP, as this would o||ov/ the City to retain important commercial property within the U3-169 Overlay District for high tax-generating commercial uses. Allowing the proposed new Jeep dealership to co-locate their administrative offices and servicing area on the property that the existing Glover Dealership is located on yields benefits to both the City and the applicant. The applicant can consolidate the offices and servicing areas for two dealerships into one building, creating more efficiency for their operations. Consolidation of the vehicle brands into one structure vvoo|d help to ovoid other potentially intrusive site or building elements associated with another new separate dealership building. Expanding on existing building where utilities and infrastructure are already in place results in significant savings in construction costs. Finally, the City ensures 2.29 acres of highly visible, commercial property for o future retail or restaurant use. The applicant has submitted oset of drawings and renderings for the proposed development that provide on indication of building architecture and layout of the expanded facility. The proposed building architecture utilizes o mhdona of glass, urchdeoYonz| metal, and stucco that complements the existing facility. The proposed facility houses a showroom, offices, and oparts and repair area. Site development of the subject property in this SUP /18-01> as well as the proposed expansion of the existing building must meet all p|o>fing' Slgnoge' and landscaping requirements of the US- 169 Overlay District as well as other Zoning Code, Subdivision Regulations, Engineering Standards, and Building Codes utilized by the City. The requirements set forth by SUP (16-03) would remain in effect for the existing dealership property. Staff recommends the following conditions be applied to the subject property for SUP (lO-Ol), * One sign shall be allowed for the new Jeep Dealership (in addition to the existing Glover Dodge Dealership sign) and one sign for the ou porce| on the subject property. All sign |ocotion», dimensions, and details shall require permit approval and are subject io1he requirements of the US-l69 Overlay District. 0 No digital signage shall be used on the property. No banners, flags, balloons, inflatables, temporary signs, streamers or other advertising methods shall be allowed to be used on the site or attached to any vehicles. We understand this will require the approval of a Specific Use Permit (SUP) per the Owasso Zoning Code. Only part of the 5,685 acres is required for inventory; the balance we Intend to preserve for future commercial development. At our direction, Tanner Consulting, LLC, has prepared an application for SUP on the 5.685-acre tract, which SUP application has been signed by the seller, Owasso Land Trust, LLC. Per our discussion Friday, November 9, 2018, this letter will serve to express our agreement to the following conditions of approval being Imposed on the SUP: 1. SUP approval shall be limited to 3.393 acres. 2. The balance of the site, 2.292 acres, shall only be used for uses permitted by existing zoning, CS and/or CG commercial with US-169 Overlay District and PUD-18, or as it may be subsequently rezoned. 3. The boundary between the two (2) development areas shall be established by lot lines created by plat or Lot-Split, subject to City of Owasso approval.
