rezone a tract of land from CS (Commercial Shopping Center) to RS -3
(Residential Single- Family High Density), generally located North
of the Northeast Corner of 129th East Avenue and 76th Street North.
4. OLS -73 - Mingo Manufacturing Inc (2914) - A request for a Lot -
Split on Lot 15, Block 1 of Three Lakes Industrial Park Phase II,
an Addition to the City of Owasso, Tulsa County, Oklahoma.
5. Site Plan Review - Vine's Mini - Storage (714) - A request for
a site plan review and approval, Lots 4 -7, Block 1, Hale Acres

The agenda for the meeting was posted in the Owasso City Hall,
207 S Cedar, on March 14, 1990.
1. CALL TO ORDER AND ROLL CALL - Chairman Ray Haynes called the
meeting to order at 7:02 p.m. and declared a quorum present.
2. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 15, 1990 - The
Commission reviewed the minutes of February 15, 1990. Gary Wells
moved, seconded by Charles Willey, to approve the minutes as
written. A vote on the motion was recorded as follows:

The motion carried 5 -0.
3. OZ -80 - Owasso Properties One Inc (2014) - A request to Rezone
a Tract of Land from AG (Agricultural) and OL (Office Low - Density)
to CG (Commercial General), Generally Located at the Northeast and
Northwest Corners of 123rd East Avenue and 86th Street North, City
of Owasso, Tulsa County, Oklahoma.
Chairman Haynes introduced the case. Steve Compton reviewed
the case background, also referring the Commission to the case map
and staff case report. Staff recommended denial of CG zoning, but
approval of CS (Commercial Shopping Center), a lesser zoning
classification.
The applicant is proposing to locate a car wash on the tract.
A car wash would be allowed in CS zoning by Special Exception
granted by the Board of Adjustment. Jerry Cole, representing Mark
Enterline, a partner in Owasso Properties One Inc, was present and
presented a case for rezoning to CG. Drew Wilson, the prospective
buyer of the property, was also present to answer questions.
Several neighborhood residents were present speaking against any
change in zoning or for the staff recommendation. Questions were
raised concerning noise from car radios, horns. etc and also
concerning air pollution.

The Commission discussed that fact that the traditional zoning
pattern had been broken in the past by allowing CG zoning of the
tract directly across 86th Street.
Rick Johnson moved, seconded by Gary Wells, to deny the zoning
request and to leave the zoning as it currently is (OL & AG).
A vote on the motion was recorded as follows:

The motion carried 5-0.
4_ Consider Amending the Procedures for Annexation to Reduce the
Notification Requirement in Certain Cases.
Staff recommended amending the Procedures for Annexation by
adding a note to state the following:
NOTE: Annexation application that are by request or
consent (not Petition) shall give notice by publishing
the description and map of the proposed annexation in the
Owasso Reporter and sending written notice to all
property owners within 300 feet of the annexation seven
calendar days prior to a hearing before the Planning
Commission.
As it currently stands the Procedures require three notice
publications, which is a lengthy and costly process_
Commission members expressed concern that proper notice would
not be given with only one publication.
Charles Willey moved, seconded by Pat Imbriano, that the
Procedures for Annexation remain as they are. A vote on the motion
was recorded as follows:

5. Consider Waiving the Notification Requirements for the Mingo
Valley Expressway Right -of -Way and Church of the Nazarene Cases.
Because the expressway annexation has a single property owner
(State of Oklahoma) and they have consented to the annexation; and
the Owasso Church of the Nazarene property is a small area surround
on three sides by the City; staff is recommending that the Planning
Commission recommend to the City Council that the notification
requirements be waived.
Charles Willey moved, seconded by Pat Imbriano, moved that the
Planning Commission recommend to the City Council that the
notification requirements on the Church of the Nazarene property be
waived and that the notification requirements on the expressway
property be left intact. A vote on the motion was recorded as
follows:

6. State of Oklahoma (19-21-14) (20-21-14) (29-21-14) - The Mingo
Valley Expressway (US Highway 169) Right -of -Way Between 76th Street
North and 96th Street North Annexation Review.
Item 6 could not be discussed since the Commission did not
amend the Procedures for Annexation in Item 4 and notification had
not been given as required by law.
7. Owasso Church of the Nazarene (21-21-14) - A Tract of Land
Located North of the Northwest Corner of 86th Street North and
145th East Avenue.
Item 7 was covered under the motion in Item 4.
8. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Steve Compton
discussed current building activity and some proposed activity. He
requested that the Commission allow staff to conduct site plan
reviews of existing structures with parking in place. By
consensus, the Commission allowed the request and instructed staff
to report on any such reviews.
9. ADJOURN - Gary Wells moved, Pat Imbriano seconded, to adjourn
the meeting. A vote on the motion was recorded as follows:

MEMORANDUM

SUBJECT: Staff Case Report for OZ -81 (2814)
DATE: April 3, 1990
BACKGROUND:
The subject tract is located north of the northeast corner of the
intersection of 76th Street North and 129th East Avenue. It is
approximately 3.10 acres in size and zoned Commercial Shopping (CS)
District. The tract is vacant and has not been platted and has
immediate access to 129th East Avenue. It is abutted on the north
by vacant land zoned RS -3, on the east by vacant land zoned RS -3,
on the south by existing single - family dwellings zoned RE, and on
the west by vacant land zoned a combination of RM -2 and RS -3.
Zoning Case OZ-69 identified the subject tract CS and the abutting
land north and east of the tract RS -3. The applicant is now
requesting to rezone the CS portion to Residential Single-Family
High Density (RS-3) District zoning for a proposed single-family
use.
STAFF RECOMMENDATION:
When Zoning Case OZ -69 was approved it set a zoning pattern for
allowing commercial zoning to occur away from the intersection of
129th East Avenue and 76th Street. This type of zoning pattern is
inconsistent with the intent of the Comprehensive Plan and would
most likely lead to additional commercial designations on the west
side of 129th, beyond the intersection. The applicant's request to
down zone the subject tract gives the City the opportunity to
correct a zoning pattern that could lead to significant future
conflicts between commercial and residential development along both
sides of 129th between 76th Street and 86th Street. I, therefore
recommend approval of the requested RS-3 zoning.

SUBJECT: OLS -73 - Mingo Manufacturing Inc (2914) - A request
for a Lot -Split on Lot 15, Block 1, Three Lakes
Industrial Park Phase II, an Addition to the City of
Owasso, Tulsa County, Oklahoma.
DATE: April 12, 1990
BACKGROUND:
The applicant is requesting to be allowed to split the East ten
(10) feet off of Lot 15 and attach it to Lot 14. The remainder of
Lot 15 will be attached to Lots 16 and 17. There is an existing
fifteen (15) foot easement between Lots 14 and 15, seven and one
half (7.5) feet either side of their common property line. If this
split is approved, this entire easement would be a part of one
tract and used for additional parking.
This item was reviewed by the Technical Advisory Committee at their
April 11th meeting and they recommended approval, subject to the
guy wires and stakes used for pole support at the south end of the
easement be protected from automobile damage. It was noted that a
telephone cable may be located in this easement. I will have the
final determination by the meeting date.
RECOMMENDATION:
Given the above review, I would recommend approval of the requested
Lot -Split OLS-73, subject to the guy wires and stakes being
protected from damage and no major problem being identified
concerning the telephone cable. Also, the 10' strip of land split
from Lot 15 should be "tied" permanently to Lot 14 by filing a
special instrument at the County Clerk's Office.

SUBJECT: Site Plan Review - Vines Mini - Storage (714) - Lots
4 -7, Block 1, Hale Acres Second, an Addition to the
City of Owasso, Tulsa County , Oklahoma.
DATE: April 10, 1990
BACKGROUND:
The applicant is requesting a Site Plan Review for a proposed mini -
storage use on a vacant CG zoned tract of land located West of the
Northwest corner of 114th Street North and Garnett Road. The tract
is approximately .6 acres in size and abutted on the North by a
vacant tract of land zoned CS, on the East by a vacant office
building zoned CG, on the South by mini - storage zoned CG, and on
the West by a mobile home zoned RMH.
RECOMMENDATION:
Staff has reviewed the applicant's submitted Site Plan and compared
it to the Subdivision Regulations and Zoning Code requirements and
find that he has met the majority of these requirements.
Therefore, staff recommends approval of the submitted Site Plan,
subject to the following conditions or changes:
1. That spacing between buildings be adjusted to provide for the
required 10' setback from the RMH zoning district abutting the
subject tract on the West. For fire control purposes a minimum of
25' separation is recommended.
2. That a screening fence be erected from the front and back
corners of the westerly most building to the north and south
property lines to provide for the required screening from a
residential zoning district.
3. That no building have a north /south length greater than 79',
which will allow it to be placed on the tract without encroachment
into either the platted easement along the north property line or
the building setback along the south property line.
4. That a finished curb will be constructed along 114th Street
JNorth (all existing cuts in the curb be replaced with new curb
where appropriate) with concrete aprons constructed to the property
for each approved drive.

SUBJECT: Replat - Copper Meadows I, Lots 3 - 6, Block 5 (2814)
DATE: April 12, 1990
BACKGROUND:
The applicant is requesting approval of a Replat of Lots 3 -6,
Block 5, Copper Meadows I, an Addition to the City of Owasso, Tulsa
County, Oklahoma. This request is made to make corrections to
property lines at the Southeast corner of Phase I (see map). Some
easements have been changed from the original plat.
The Technical Advisory Committee reviewed this request at their
April 11th meeting. They recommended approval, subject to the
following conditions:
1. That all bearings and dimensions on the plat map match all
bearings and dimensions in the Deed of Dedication and Restrictive
Covenants.
2. That the Deed of Dedication and Restrictive Covenants for the
amended lots make reference to the Deed of Dedication and
Restrictive Covenants for the original Copper Meadows Plat.
3. That lot ownership be shown on the plat map.
4. That the land North of the Graceland addition be shown as
unplatted.
5. That the 10' easement along the West side of the Graceland
addition be shown.
6. That the existing easement along the East side of Lot 2, Block
5 be shown.
7. That a width be shown for North 132nd East Avenue.
e. That a date, seal, and signature be shown.
RECOMMENDATION
Based upon the above review, I recommend approval of the requested
Replat of Lots 3 to 6, Block 5, Copper Meadows Amended, subject to
the Technical Advisory Committee's conditions.
It was noted at the meeting that the City is not in possession of
any "As— Built" drawings of this addition. There were field changes
made during construction in this area of the addition that may
affect the drainage within both Copper Meadows and the proposed
Copper Meadows II. The applicant has agreed to furnish the City
with copies of these drawings.
