Gregory Sherman (2914) - A request to close an unplatted 30 feet wide easement on the north and east sides of the Southwest Quarter of the Southwest Quarter of the Southwest Quarter of Section Twenty-nine (29), Township Twenty -One (21) North, Range Fourteen (14) East, containing ten (10) acres, more or less according to the Government Survey thereof. The property is also located in Lot 1, Block 1 of the Owasso Commercial Center which is north of 76th Street North and east of the Mingo Valley Expressway (U. S. 169 Hwy.) SITE PLAN REVIEW 5. CALL TO ORDER - Chairman Ray Haynes called the meeting to order at 7:01 p. m. and welcomed a new Planning Commissioner, Pat Imbriano. 2. ROLL CALL - Richard Hall called the roll. 3. MINUTES OF AUGUST 20, 1987 - The Commission reviewed the Minutes of August 20, 1987. Motion was made by Elwood Henry and seconded by Scott Butler to approve those Minutes as written. A roll call vote on the motion was recorded as follows: Scott Butler - Yes Ray Haynes - Yes Elwood Henry - Yes Pat Imbriano - Yes Charles Willey - Yes motion carried. 4. LOT SPLIT REVIEW - OL-68 Mark Enterline (2014), Lots 22 and 23 of Block 3 of the Lakeridge 1st Addition, located at the northeast corner of 89th St. N. and E. 89th Court North Chairman Haynes introduced the lot split proposal and Richard Hall explained the situation. The Planning Commission, Richard Hall and R. J. Ray discussed the item. Motion was made by Charles Willey and seconded by Elwood Henry to deny lot split application OL -68. A vote on the motion was recorded as follows: Scott Butler - Yes Ray Haynes - Yes Elwood Henry - Yes Pat Imbriano - Yes Charles Willey - Yes The motion carried. COMPREHENSIVE PLAN AMENDMENT - Review of a proposal to amend the Owasso Major Street and Highway Plan, which is a part of the Owasso Comprehensive Plan, to show 116th Street North as a 6 -lane Primary Arterial Street between Memorial Dr. and Garnett Rd. Chairman Haynes introduced the item and Richard Hall informed the Commission about the proposal to designate 116th St. North as a Primary Arterial and discussed the function of the Comprehensive Plan. The Commission discussed the issue. Motion was made by Scott Butler and seconded by Charles Willey to recommend that the City Council upgrade 116th St. North between Memorial Dr. and Garnett Rd. to a Primary Arterial classification on the Owasso Major Street and Highway Plan. A vote on the motion was recorded as follows: Scott Butler - Yes Ray Haynes - Yes Elwood Henry - Yes Pat Imbriano - Yes Charles Willey - Yes The Motion carried. 6. NEW BUSINESS - Chairman Haynes briefed the Commission of the activity of the Annexation Committee. The Commission discussed new building construction in the city. 7. ADJOURN - Motion was made by Elwood Henry and seconded by Charles Willey to adjourn the meeting. A vote on the motion was recorded as follows: Scott Butler - Yes Ray Haynes - Yes Elwood Henry - Yes Pat Imbriano - Yes Charles Willey - Yes The meeting was adjourned at 8:22 p.m. Chairman Secretary Date MEMORANDUM TO: Owasso Planning Commission FROM: Richard Hall, Owasso City Planner SUBJECT: A request by Gregory Sherman to close an easement in the Owasso Commercial Center DATE: February 12, 1988 I received the attached letter early this month requesting that the City Council close an unplatted street easement in the Owasso Commercial Center as shown on the attached map. As it states on the abstract page, the easement was granted in 1927 evidently to grant someone access to adjacent property. I cannot find reference to the easement in the Owasso Commercial Center plat file. It appears that no one knew that the easement existed until a title check of the property was conducted. I have sent notices to local utility companies of the proposal and I took the matter to the Technical Advisory Committee on February 12, 1988. The T.A.C. had no objection to closing the easement but they asked that the five foot wide utility easement on the north boundary of the tract not inadvertently be closed with the street easement. There are some utility lines in that utility easement (see the attached map). I recommend that the Planning Commission recommend that the street easement be closed, but that the ordinance be drawn so that the five foot wide utility easement on the north boundary of the Owasso Commercial Center not be closed. Golden Corral Corporation has recently purchased a tract of land in Lot 1, Block 1, Owasso Commercial Center, an Addition to the City of Owasso. In order to clear title, Golden Corral Corporation needs to vacate a certain Easement created in that Warranty Deed recorded in Book 624, Page 436. A survey reveals that this Easement affects the tract of land in question. A copy of the abstracter's summary of this Warranty Deed is attached to this letter as Exhibit "A ". The Easement is perpetual and is dedicated to the public as a highway or street. It is this Easement which we would ask you to close by ordinance. I am informed that there is no evidence that this easement has ever been used for public purposes. G031 Gwranl shutComoan MEMORANDUM TO: Owasso Planning Commission FROM: Richard Hall, Owasso City Planner SUBJECT: Site Plan for the former Garrett /Johnson furniture store DATE: February 12, 1988 Bill Latting of Mid - America Properties has submitted the attached site plan for our review. He proposes to locate a billiards and pool recreation center /office /warehouse in the former Johnson - Garrett furniture store at 8101 North Mingo Valley Expressway. According to our conversations, customers will be able to play pool in the front, and buy from the company the tables that they use. Offices for the company will be located in the middle of the building and a warehouse for the pool tables and supplies will be located in the rear (east end) of the existing structure. This site plan request basically concerns the paving of the vacant area around the building for additional parking. The proposal was reviewed by the Technical Advisory Committee on February 10, 1988 and we had a lengthy discussion. The Fire Marshal said that interior work would be extensive and expensive to separate the uses and comply with fire ordinances. Pertinent T.A.C. recommendations are as follows: (1) The P.S.O. representative said that the electric service line should be placed in conduit if it is paved. He also asked that the grade of the line not be changed. (2) O.N.G. and P.S.O. representatives requested that the city require the owner to replace at his cost any paving or landscaping that is located over any easement and harmed when the utility lines are replaced or serviced. (3) The City Engineer requested that drainage plans be submitted if the grades of the borrow or drainage ditches are altered by grading or pavement. (4) The Building Inspector asked that handicapped parking spaces be designated and that water and sewer lines be inspected if altered. The metal building on the property, it appears, will be difficult to use for commercial purposes. The property is zoned IL, light industrial, as are most of the lots along the service road. The structure covers much of the lot, leaving little room for additional parking,. A drainage easement is located on the north which complicates the use of the lot. As the applicant has submitted the site plan, I calculate that 42 parking spaces will be necessary to serve the use: 25 for the game room, 13 for the offices and 4 for the warehouse. I feel that the uses are allowed 1 by the Zoning Code since the predominant use of the building is for offices and a warehouse,. which are allowed uses in the IL zoning district. I have visited with the City Attorney about who should replace pavement or landscaping that is damaged when easements are disturbed. He informed me that the City of Owasso could not now require the land owner to pay for any damage if the subdivision plat easement dedication language does not require such costs. We may need to address the issue, in the platting of future subdivisions, however. Since the building is existing, many aspects of the Zoning Code do not apply. However, I recommend the following in the Planning Commission approval of this site plan: (1) that no area be paved for parking that is on street right -of- way and that no part of the drainage easement be paved without the approval of the City Engineer, C2) that 42 parking spaces be provided that are 10'x20' for conventional cars and two parking spaces that are 121x22' be provided in an appropriate location for handicapped parking, (3) that driving lanes between parking spaces be 25' wide for perpendicular parking or somewhat less for angled parking, (4) that no more curb cuts be allowed, (5) that sign size conform to Owasso ordinances, C6) that recommendations 1, 3 and 4 of the T.A.C. be required. 2 CITY OF OWASSO SITE PLAN APPLICATION TYPE OF DEVELOPMENT Retail Commercial Office Industrial O.S.P.# PLAN DATED ZONING $25 FEE PD.
