Ray The agenda for the meeting was posted in the Owasso City Hall, 207 S. Cedar, on March 11, 1988. I. CALL TO ORDER - Chairman Ray Haynes called the meeting to order at 7:02 p. m. 2. ROLL CALL - Richard Hall called the roll. 3. MINUTES OF MARCH 10, 1988 - The Commission reviewed the Minutes of March 10, 1988. Motion was made by Elwood Henry and seconded by Scott Butler to approve those Minutes as written. A vote on the motion was recorded as follows: Scott Butler - Yes Ray Haynes - Yes Elwood Henry - Yes Pat Imbriano - Yes Charles Willey - Yes motion carried. SITE PLAN REVIEW 4. Kimball's Hardware (2914) - 8301 N. Mingo Valley Expressway, Lot 14 of Block 3 of the Three Lakes Addition to Owasso. Richard Hall briefed the Commission on the proposed development of the property in question. The Commission discussed the matter. Motion was made by Elwood Henry and seconded by Charles Willey to approve the site plan as proposed. A vote on the motion was recorded as follows: Scott Butler - Yes Ray Haynes - Yes Elwood Henry - Yes Pat Imbriano - Yes Charles Willey - Yes motion carried. Owasso Planning Commission Minutes of March 17, 1988, Page 2 ANNEXATION PUBLIC HEARING 5. Discussion of issues concerning the annexation of land bounded by 69th Street North, 126th Street North, 145th East Avenue and Sheridan Road into the Owasso City Limits, and vote on a recommendation to the City Council concerning that annexation. Richard Hall explained the annexation proposal to the Planning Commission and audience. He also addressed questions that he had received by letter and phone from citizens about the annexation. The following people spoke to the Planning Commission about the proposed annexation. Janet Newton Grover Campbell Owasso Planning Commission Minutes of March 17, 1988, Page 3 Chairman Haynes closed the meeting to discussion from the audience and the Planning Commission discussed the issue. The Commission heard comments from Councilwoman Pat Marlar, City Manager R. J. Ray and Alien Robinson. Motion was made by Elwood Henry to send the matter back to the Annexation Committee for further study. The motion was seconded by Scott Butler. A vote on the motion was recorded as follows: further. Richard Hall announced to the audience that the item would be on the April 5, 1988 City Council agenda as a Planning Commission recommendation. 6. New Business - There was no new business. 7. ADJOURN - Motion was made by Scott Butler and seconded by Elwood Henry to adjourn the meeting. R. : 30 -21 -14 Hearing Date : April 21, 1988 OWASSO PLANNING COMMISSION STAFF CASE REPORT APPLICANT: Donald Summers TRACT LOCATION: Northwest corner of 3rd and Main Streets EXISTING ZONING: RS -3 PROPOSED ZONING: CG AREA STREETS: Existing Right -of -Way Main Street 75' Third Street 75, TRACT SIZE: 63.6' x 150, EXISTING USE: Vacant House PROPOSED USE: Commercial Planned Right -of -Way 80 50' -60, SURROUNDING AREA: The property is located on the north edge of "downtown" Owasso. Businesses, four apartments, four churches as well as homes are Located south of Third Street in the vicinity. Three apartment developments, all lacking appropriate zoning, are located north of Third Street on the west side of Main Street. An insulation and air conditioning business is located east of the tract across Main Street. The remainder of the area north of Third Street in the area is residential. Two of the seven apartment developments in the area are vacant. ZONING BACKGROUND: The Zoning pattern of the area was established by adoption of or Ordinance 175 which amended the Zoning Code and Zoning Map. OZ -58 A request by Jerry Waymon to rezone a 75, x 140' tract located on the north side of Second between Main and Atlanta from RS -3 to RM -2 in March of 1981. The Staff, Planning Commission and City Council concurred in approval of RM -2 zoning. OZ -59 A request by Inex Odom to rezone a 63' x 150' tract located at the northeast corner of Third and Atlanta Streets from RS -3 to RM -1 in Marcia of 1981. The Staff recommended alternatives to the zoning, but the Planning Commission recommended denial of the zoning. The case was not appealed to the City Council. ANALYSIS: If rezoned, the property by itself will be difficult to aevelop because of its small size and structure setbacks required by the Zoning Code. STAFF RECOMMENDATION: I recommend DENIAL of CG :zoning and APPROVAL of CS (Commercial Shopping Center) zoning on the tract. The less intense CS zoning should be more compatible with the residential zoning north and west of the property and CS is more in keeping with the commercial zoning south and east of the tract. Both CS or CG zoning classifications are in accordance with the Owasso Comorehensive Plan which shows the area to be a Medium Intensity Commercial area. The property is required by the Zoning Code to be replatted unless that platting requirement is waived by the City Council. Case Number : OZ -77 S.T.R. : 30 -21 -14 Hearing Date : April 21, 1988 OWASSO PLANNING COMMISSION STAFF CASE REPORT APPLICANT: Carole Finnell TRACT LOCATION: 310 N. Main EXISTING ZONING: RS -3 PROPOSED ZONING: CG AREA STREETS: Existing Right -of -Way Main Street 75, TRACT SIZE: 80, x 209, EXISTING USE: Home PROPOSED USE: Gift Shop Planned Right -of -Way 80, SURROUNDING AREA: This unpiatted property is located north of "downtown" Owasso. Businesses, four apartments, four churches as well as homes are located south of Third Street in the vicinity. Three apartment developments, all lacking appropriate zoning, are located between Third and Fourth Streets on the west side of Main Street. The subject tract is located between two of the apartments but the one to the north is vacant. The remainder of the area north of Third Street is residential. ZONING BACKGROUND: The Zoning pattern of the area was established by adoption of or Ordinance 175 which amended the Zoning Code and Zoning Map. ANALYSIS: The property legal description is in a "meets and bounds" description which is an indication that the property has not been platted. The property description also includes the Main Street Right-of-way as shown on the attached case map. STAFF RECOMMENDATION: I recommend DENIAL of CG zoning on the tract. The rertuested CG zoning classification is not in accordance with the Owasso Comprehensive Plan which shows the area to be a Low Intensity Residential area that is more suited to the existing zoning. The requested CG zoning would be more compatible in an area that is designated Medium Intensity Commercial by the plan. The plan was updated in 1985 and it was not amended to recognize the subject tract, or the apartments north and south of the tract, as deserving a land uses other than low intensity residential. The zoning map revision of 1974 also did not rezone the area on the west side of Main to an apartment zoning classification. Finally, the commercial zoning of the tract would constitute harmful spot zoning and will have a adverse effect on the homes facing the tract on the east side of Main. If the property is rezoned, I recommend that it be platted as required by the Zoning Code of rezoned properties.
