1. CALL TO ORDER - Chairman Ray Haynes called the meeting to
order at 7:02 P. m.
2. ROLL CALL - Chairman Haynes declared that all members, except
Scott Butler, were present.
3. MINUTES OF APRIL 21, 1933 - The Commission reviewed the
Minutes of April 21, 1958. Motion was made.by Elwood Henry and
seconded by Pat Imbriano to approve those Minutes as written. A
vote on the motion was recorded as follows:

PRELIMINARY PLAT SUBDIVISION REVIEW
4. Conoer Meadows Addition (2524) Buford Williams and D. M.

CC"hairman Haynes introduced the item. Bill Lewis, the plat
engineer, and Richard Hall discussed the history of the
development. Richard Hall discussed with the Commission and Mr.
Lewis the staff and Technical Advisory Committee (T.A.C.)
recommendations of plat revisions. Motion was made by Elwood
Henry and seconded by Charles Willey to recommend that the
following conditions be required of the Copper Meadows
preliminary subdivision plat:
1. Utility easements shall meet the approval of the utility
companies.
Paving and 'braira,ge plans shall be ,approved by the City of
Owasso.

The Commission informed Mr. Lewis that it was particularly
concerned about the design of the plat in regard to conditions
.I-" and "f" of the conditions listed above.

Richard Hall discussed with the Commission and Mr. Lewis the

of plat revisions. Motion was made by Charles Willey and seconded
by Pat Imbriano to recommend that the following conditions be

The adopted policies for land to be annexed into the city
limits are as follows except the City Council changed the word
"facilities" in policy four to "infrastructure ":
1. While there is no minimum tract size, properties of
larger than 20 acres are preferable.
2. All properties should be contiguous to existing city
limits.
3. All properties should be annexed into the city limits as
the lowest zoning classification, that is, AG, agricultural.
Land owners may then petition for rezoning if they desire
further development of their property. All legal uses
annexed into the city will be legal but non - conforming which
means that they may continue but cannot be expanded without
proper zoning.
4. All public facilities infrastructure that do(es) not meet
city standards will not be improved by the city until
brought to the city standard and accepted by the City
Council. Such public facilities must be improved at owners
expense by the establishment of a special assessment
district or some other financing method.
5. Where a city limit boundary ends at a dedicated street,
the boundary will not include the street right -of -way. This
policy will establish consistency and allow city employees
and citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation for a six month period after
rejection by the City Council.
PROPOSED ANNEXATION
I have had several discussions with a local realtor about
annexing the 20 acre tract west of Meadowcrest into the city
limits. The property could be developed outside of the city
limits to Tulsa County zoning and building codes standards. The
realtor and a local developer have instead chosen to propose
annexation and to develop the property to more strict, and
expensive, Owasso standards. City water and sewer utilities are
available to the property but it could be developed on septic
sewer systems if it is developed under the county jurisdiction
and if the lots meet septic sewer standards.
I have also had several conversations with residents of the
Meadowcrest Addition located east of the tract. Some of the
residents have been concerned that a small -lot development on the
20 acre property may have a detrimental affect on their
neighborhood. One specific concern that they have voiced is that
there is only orre public street to the 20 acre tract and all
traffic generated by the development of the tract will have to
come and go through the Meadowcrest Addition.
The Annexation Committee has met twice to make a
recommendation to the Planning Commission and City Council about
the proposed annexation. The Committee determined at its May 31,
1988 meeting that the property can be served by city utilities
and emergency services. Both the police and fire chiefs have
expressed concern, however, that an accident at the entrance to
the Meadowcrest Addition at Garnett and 109th Street North could
hinder emergency vehicles from getting to a lot in the
Meadowcrest Addition or the proposed 20 acre development to the
West. At the June 6, 1988 meeting recommendation was made by the
the committee to annex the 20 acre tract in question.
RECOMMENDATION
I recommend approval of the proposed addition for the
following reasons:
1. The proposed annexation meets the criteria established by the
Annexation Committee and the City Council.
2. The twenty acre property could be developed either inside or
outside of the Owasso City Limits. The City can have more control
of the development if it is developed in Owasso rather that in
the County standards. The street access situation will also not
be different if the property is in or out of the city.
3. The density of the development of the twenty acre tract is
appropriate at the zoning and platting stages rather than the
annexation phase of development. I suggest that the focus at
this time should be on whether the property should be inside or
outside of the city limits rather than on the character of the 20
acre development which has yet to be determined.

The undersigned, constituting not less than three - fourths of
the registered voters and being owners of not less than three -
fourths (in value) of the hereinafter described real- estate
situated in Tulsa County, Oklahoma, to -wit:
The West Half (W /2) of the Northwest Quarter (NW /4) of the
Southeast Quarter (SE /4) of Section 7, Township 21 North,
Range 14 East, of the Indian Base and Meridian, Tulsa
County, consisting of approximately Twenty (20) acres, more
or less to the west side of the Meadowerest Addition,
being territory adjacent and contiguous to the incorporated City
of Owasso, Oklahoma, and not presently embraced within the Limits
thereof, hereby petition the City Council of the City of Owasso,
Oklahoma, to annex the aforementioned real estate into the City
Limits of said City.

BACKGROUND
This is the first citizen - sponsored annexation request since
the Annexation Committee was established by the City Council on
September 15, 1987. The Annexation Committee proposed procedures
and criteria for annexation on February 15, 1988 which were
approved by the City Council, with a minor amendment, on March 1,
1988.
The adopted procedures for a citizen sponsored annexation are:
1. Submission to the City Planner of an application and
petition and a administrative fee as proscribed by
ordinance,
2. Review by a S

SUBJECT: OLS -69 First Bank of Owasso (2014) - A request for a Lot
Split on a portion of Lot 1 of Block 2 of the Elm Creek
Condominiums Amended Addition to Owasso located South of the
Southeast corner of 86th Street North and 123rd East Avenue
DATE: June 10, 1988
The bank has repossessed the subject property that was
originally platted for condominiums. The housing project was only
partially completed, however. The bank recently approached me
with a proposal to locate a nursing home on a portion of the
property. As required by the Zoning Code, the bank made
application to the Owasso Board of Adjustment to allow a Special
Exception of the code to allow the nursing home on the
undeveloped portion of the property which is zoned RM -1,
multifamily. The Board of Adjustment heard the case on May 25,
1988. The Board approved the use but required a Board review of
the site plan of the proposed nursing home. Some neighbors of the
property were present and were concerned mostly about property
values and traffic to the proposed nursing home.
The Bank has now requested a lot split to split the nursing
home site from the rest of its property. I have scheduled a
T.A.C. meeting on the matter and I have already had one phone
call from P.S.O. company about an easement problem. Evidently
electric cables were buried on the lot in anticipation of the
property being used for condominiums. The cables were placed in
easements that were given to P.S.O. after the property was
platted so I have no record of the location of the lines. Those
easements will need to be,closed and new electric lines placed
properly because neighboring apartments are connected to the
lines.
From a planning perspective, one of the lots to be created
has no frontage on a dedicated street. I have discussed this
problem with the bank representatives who propose to have the
land- locked tract served with access easements. There is a
possibility, however, that the bank may sell that land- locked
tract to a neighboring owner whose property already has street
frontage. In that case a lot split may be approved with the
stipulation that the two tracts be considered as one and not be
sold separately.
I will bring more information and the comments of the T.A.C.
to the June 16, 1988 Planning Commission meeting.

Scott Butler and Charles Willey present.

Lynn Freeman, real estate salesman of the property,
represented the Birks and spoke for the annexation request. Andy
Howe, Roberta Smith, Terri Howe, Ron Detherow, Larry Perry, Bill
Hayes, B.L. Bowen and John Hay asked questions and spoke in
opposition to the annexation or the development of the subject
tract. Motion was made by Scott Butler and seconded by Charles
Willey to recommend approval of the proposed annexation of the 20
acre property owned by Elden and Dorothy Birks. A vote on the
motion was recorded as follows:

Condominiums Amended Addition to Owasso located South of the
Southeast corner of 86th Street North and 123rd E. Avenue.
Chairman Henry introduced the case. Alan Anderson and Bill
Bond spoke for the lot split request and answered questions of
the Commission. There was discussion between the applicants and
the Commission about access to one of the proposed lots. Motion
was made by Charles Willey and seconded by Scott Butler to
approve OLS -69 with the condition that the northern and eastern
lots be connected with a 30 feet wide strip under one ownership
so that the eastern lot would not be denied access from a
dedicated street. A vote on the motion was recorded as follows:

SURROUNDING AREA BACKGROUND:
The Hale Acres Addition immediately north of the Meadowcrest
Addition was platted in 1966. It was annexed into the city
limits by ordinance 197 in September of 1976. Further to the
north, the Hale Acres 2nd Addition was platted in July of 1972.
It was annexed into the city limits by Ordinance 196 in September
of 1976. The residential portions of both Hale Acres additions
were zoned RS-1 by Ordinance 246 in February of 1979, Owasso
zoning case OZ-36. Commercial and Duplex zoning was .granted in
both Hale Acres additions by a City of Owasso sponsored zoning
reauest, OZ-38, in August of 1978 by Ordinance 236. Most of the
commercial lots of both Hale Acre Additions are still vacant
while the majority of the residential lots now contain homes. The
remainder of the area to the south, east and west of the
Meadowcrest Addition is vacant and zoned AG, agricultural. One
home on unplatted property is located north of the Meadowcrest on
Garnett, however, and another home on an acreage is located to
the east across Garnett from the entrance to the addition.
SUBJECT PROPERTY BACKGROUND:
The Meadowcrest Addition was platted under the auspices of
TMAFC in Tulsa County. The plat was begun in April of 1975 and
filed of record in June of the same year. The whole addition was
annexed into the city limits of Owasso by Ordinance 198 in
October of 1976. The addition contains 36 lots, one of which is a
homeowner's park. The addition is fully developed. The
subdivision was zoned RS-1 in April of 1977 by Ordinance 208, OZ-
29. The subdivision streets were not built to Owasso standards
and since its annexation, all subdivision streets have been
repaved at city expense.
ZONING BACKGROUND:
OZ-29 A request by Bill Rhees to rezone the 50 acre Meadowcrest
Addition from AG to RS -1 in February of 1977. The Staff, Planning
Commission and City Council concurred in approval of RS -1 zoning
(Ordinance 208).
OZ-36 A request by the City of Owasso to rezone residential
portions of the Hale Acres and the Hale Acres 2nd Additions from
AG to RS -1, RS -3 and RMH for single family residential and mobile
home uses in May of 1978. The City Council approved a modified
version of the proposal recommended by the Staff and Planning
Commission (Ordinance 246).
OZ -38 A request by the City of Owasso to rezone portions of the
Hale Acres and the Hale Acres 2nd Additions from AG to RD and CG
in August of 1978. The Staff recommended a modified approval that
included apartment zoning instead of commercial zoning along the
Garnett frontage. The Planning Commission and City Council
concurred in approval of the zoning request as submitted with the
CG commercial zoning along Garnett (Ordinance 236).
STAFF ANAL':SIS:
Someone from every household in the addition has signed
ei.her a rezoning petition or a letter expressing approval of the
proposed rezoning. Property owner approval of a zoning change is
not necessary but it is an indication of the feeling in the
neighborhood.
The Zoning Code requires that lots zoned RE must have a
minimum area of 24,000 square feet and a lot width of 150 feet.
The Code further specifies that the frontage can be 125 feet
measured at the building line if the lot meets the other size
specifications. Two of the lots in the addition cannot meet the
125 foot lot width specification: Lot 9 of Block 1 and Lot 8 of
Block 3. If the subdivision is zoned RE, those lots will become
non - conforming, as defined by the Zoning Code. Since the
neighborhood is already fully developed, the RE zoning of the
substandard lots will have no practical effect. The lots exceed
Zoning Code area standards. The smallest lot appears to be 34,596
square feet in area which is a third larger than the 24,000
square feet requirement of the Code.
STAFF RECOMMENDATION:
I recommend approval of Addition. The RE zoning of the Meadowcrest
Addition. The RE zoning of the subdivision will, however, create
two lots do not meet lot width standards, but all lots exceed
other zoning code requirements. I recommend that the platting
requirement be waived since the addition is alreay platted and
fully developed.
