Main (west side) at 2:00 pm on July 2, 2019. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 pm. ITEM 2. Flag Salute ITEM 3. Presentation of the Character Trait of the Month - Responsibility ITEM S. Approval of Minutes from May 13, 2019 Regular Meeting. The Commission reviewed the minutes. Mr. Vines moved, seconded by Mr. Horton, to approve the minutes from the May 13, 2019 Regular Meeting. Election of Planning Commission Chairperson The by -laws of the Owasso Planning Commission state that the Commission shall have a chairperson and vice- chairperson, and the election of said officers shall be held annually at the first meeting of the Commission after July 1 of each year. The Chair opened the floor for nominations for Chairperson. Mr. Vines nominated Dr. Loving, with the nomination being seconded by Mr. Balthrop. Hearing no further nominations, a vote on the motion was recorded as follows: YEA: Dr. Loving, Mr. Balthrop, Mr. Horton, Mr. Vines NAY: None Motion carried 4 -0. Election of Planning Commission Vice Chairperson The Chair opened the floor for nominations for Vice Chairperson, Dr. Loving nominated Mr. Miller, with the nomination being seconded by Mr. Horton. Hearing no further nominations, a vote on the motion was recorded as follows: YEA: Dr. Loving, Mr. Baithrop, Mr. Horton, Mr. Vines NAY: None Motion carried 4 -0. ITEM 8. Public Hearing - Discussion on the Proposed Zoning Code Amendment to the US- 169 Overlay District Karl Fritschen presented the staff report. No official action will be taken on this item by the Planning Commission. The public hearing was opened at 6:09 pm. The following comments /concerns were expressed by attendees Allen Robinson - He and his family have been in Owasso for over 50 years. They are landowners in the US -169 Overlay District and they are opposed to the proposed zoning code amendment. If it where not for the donations from our family there would be no Tulsa Technical Campus. We don't see the Glover automotive center as an eye sore. The value of the land in this overlay district will be used for high end companies that can afford the property. Vote this proposed amendment down. We are in opposition. Steven Puckett - He lives close to the US -169 Overlay District. He doesn't like to see restrictions on companies. He likes the idea of easier access for car shopping. He is opposed to the proposed amendment. The public hearing was closed at 6:13 pm ITEM 9. OA 19 -03 /OZ 19 -03 - Annexation /Rezoning - Consideration and appropriate action relating to a request for the review of an annexation and rezoning request. The property is located at 11707 E 106 St N and is approximately 2.5 acres in size. If approved the subject property will be brought into the City Limits of Owasso as RS -3 (Residential Single - Family High Density). Morgan Pemberton presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the June 19, 2019 meeting. Staff recommends approval of the annexation /rezoning request for 11707 E 106 St N. The applicant had a representative present to answer any questions. Mr. Vines moved, seconded by Mr. Horton, to approve the annexation /rezoning request for OA 19 -03 /OZ 19 -03, rezoning the entire property to RS -3 (Residential Single - Family High Density), subject to the any Staff and TAC recommendations, A vote on the motion was recorded as follows: YEA: Loving, Vines, Balthrop, Horton NAY: None Motion carried 4-0 OWASSO PLANNING COMMISSION July 8, 2019 Page No, 3 ITEM 10. OLS 19 -02 - Lot Line Adjustment - Willows of Silvercreek Consideration and appropriate action relating to a request for the review of a lot line adjustment to correct an error made when the neighborhood pool was installed on Lot 16. A portion of Lot 15 (Tract 2) will be combined with Lot 16 (Tract 1) to ensure that the pool decking and fencing is correctly located. The location of the subject property is N 141 si E Ave and E 901h St N (Lots 16 and 15, Block 6, The Willows of Silver Creek), Owasso, OK. The property is zoned RS -3 (Residential Single- Family High Density). Karl Fritschen presented the staff report. The location was described. OLS 19 -03 - Lot Split - Metro Heights II Consideration and appropriate action relating to a request for the review of a lot split. The Public Works Department indicated that they would like to expand the stormwater detention area onto Lot 31, Block 2, Metro Heights Ii, Owasso, OK. The boundary line between the drainage reserve and the commercial lot is proposed to move south 35 feet. The property is zoned RS -3 (Residential Single - Family High Density) and CG (Commercial General). Karl Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the June 19, 2019 meeting. Staff recommends approval of the Lot Split. LOmmunpy TO: Owasso Planning Commission FROM: Karl Fritschen RLA, AICP Planning Manager SUBJECT: Proposed Zoning Code Amendment to the US -169 Overlay DATE: August 8, 2019 BACKGROUND: The Owasso Zoning Code is a document that requires amending periodically to address new situations or unforeseen circumstances. In 2012, the City Council approved the US -169 Overlay District under Ordinance 1004, which established a special set of regulations governing development along this corridor from East 861h Street North to East 1261h Street North. The goal of the US -169 Overlay District is to ensure that this highly visible and important corridor would- be developed In a- consistent and attractive manner. The Overlay District -was also established to protect the investment of the Tulsa Technology Center campus. To accomplish these goals, the Overlay District prohibits or restricts certain land uses by requiring the approval of a Specific Use Permit (SUP) by City Council in order to locate within the Overlay. Certain uses that require large areas of land for sales inventory (i.e. auto sales, camper sales, boat sales, etc.) can create a negative impact along the corridor if they are located adjacent to each other. The visual effect that results from these types of land uses being grouped together along highway frontage is contradictory to the original intent of the US -169 Overlay District. The current language in the Zoning Code does not stipulate where or how these types of uses could locate, resulting in the potential for a significant stretch of land in the US -169 Overlay District being utilized primarily for vehicle inventory. The existing language also does not specify if other types of vehicle sales, such as boat or RV sales, are included in the restrictions placed on auto sales. Staff believes that these gaps in the current Overlay District language could be a potential issue countering the purpose of the US -169 Overlay as shown below: 10.2 Purpose of the US -169 Overlay District The purpose of the US -169 Overlay District is to: a. Encourage sustainable development that will become a long term asset to Owasso; b. Protect an area that represents a significant opportunity for business and corporate investment, which is important to the long term economic health of Owasso; c. Establish uses and regulations that promote the development of this area as a corridor that promotes an environment of business, learning, and growth; d. Protect the area around Tulsa Technology Center from uses that may have a detrimental impact on the facility and the City's ability to attract quality development; e. Establish regulations that protect the investment of existing and new businesses and corporations from unattractive, non - compatible uses; I. Ensure the area is visually pleasing, sustainable, and developed in a coordinated fashion; g. Ensure a high quality of development that will ultimately generate an economically- enhanced and pedestrian - friendly area for Owasso; and h. Follow the principals of the Quality of Life Initiative. PROPOSED AMENDMENT TO THE ZONING CODE: Staff is proposing the following amendment to Chapter 10, Section 10.4 of the Owasso Zoning Code. 10.4.7 Separation Requirement. In order to protect the integrity and purpose of the US -169 Overlay as described in Section 10.2 the uses listed below, taken from Table 10.2, shall have the additional requirement that they be separated by a distance of 2,640 linear feet. The distance shall be measured from property line to property line. In the event the measurement bisects a parcel, then the greater amount of area that is inside or outside of this distance shall be used to determine the applicability of this section. Additionally, the following uses shall not be located on any parcel of land that abuts the Tulsa Technology Center Campus property. • Aircraft Sales • Auto Sales • Boat and Recreational Vehicle Sales • Camper Sales • Construction Equipment Sales • Motorcycle Sales • Truck Rental (as a single use) • Agricultural Implements Sales Additionally this Section shall apply to any uses identified in Section 53241 of the North American Industry Classification System (NAICS), titled "Construction, Transportation, Mining, and Forestry Machinery and Equipment Rental and Leasing" or uses that operate in a similar manner. PUBLIC HEARINGS: On July 8, 2019 the Planning Commission held a Public Hearing regarding this item, and two citizens spoke In opposition to the item. On July 16, 2019 the City Council held a Public Hearing on this item, and one citizen spoke in opposition to the item, RECOMMENDATION: Staff recommends approval of the text amendment to Chapter 10, Section 10.4 of the Owasso Zoning Code as outlined in this memo. The subject property is currently zoned OPUD 01 -02 with an underlying zoning of CS (Commercial Shopping) and O (Office). The plat shows right -of -way (ROW) to be dedicated to the City at the time the plat is filed with the County. The ROW is set at 60' at the intersection of East 961h Street North and North Mingo Road. It then tapers to 50' along the remainder of the arterials. This provides adequate ROW for the arterial streets to be widened in the future if necessary. The plat shows limits of no access (LNA) extending 350' east and 200' north from the intersection. At this time, it is unknown what type of development would occur on the subject property. Limits of access (LOA) will be required to be set for the property at the time development occurs. The City of Owasso would provide water, sanitary sewer, Fire, Police, and EMS services to the property at such time it is developed. Any development on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso. RECOMMENDATION: Staff recommends approval of the final plat for Bailey Creek.
