Consideration and appropriate action relating to the review of an annexation and rezoning
request on property zoned AG (Agriculture) in Tulsa County. Upon annexation, the subject
property would be brought into the City Limits of Owasso as CS (Commercial Shopping).
The general location of the property is north and east of the northeast corner of US 169 and
East 1161h Street North and is approximately 11.48 acres.

Consideration and appropriate action relating to the request for the review of a change of
access request which would create a 41.87' Limits of Access where an existing drive is
located on property known as Rafts Auto Sales. The property is located at 11302 East 116th
Street North and is 0.47 acres.

Consideration and appropriate action relating to the request for the review of a preliminary
plat proposing sixty- nine'(69) lots on approximately 19.73 acres. The property is located on

The Owasso Planning Commission met in regular session on Monday, September 9, 2019 at Old
Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side)

ITEM 6, OZ 19 -04 - Rezoning - 202 East 3rd Avenue
Consideration and appropriate action relating to a request for the review of a
rezoning application. To be considered is a rezoning from RS -3 (Residential Single -
Family High Density) to DM (Downtown Mixed). The subject property contains .24
acres and is located at 202 E 3rd Ave.
Morgan Pemberton presented the staff report. The location was described. The Technical
Advisory Committee reviewed this request at the August 12, 2019 meeting. Staff recommends
approval of the rezoning of 202 East 3m Avenue.
Dr. Loving moved, seconded by Mr. Balthrop to approve the rezoning request OZ 19 -04, rezoning
request, rezoning from RS-3 to DM, subject to any TAC and /or Staff recommendations.

ITEM 7. SUP 19 -01 - Specific Use Permit -11515 East 96 Street North
Consideration and appropriate action relating to the request for the review of a
Specific Use Permit to allow a car wash facility on property zoned CS
(Commercial Shopping) and that also lies within the US -169 Overlay District. The
property is located at 11515 E 96 St N and is approximately 4.09 acres.
Karl Fritschen presented the staff report. The location was described. The Technical
Advisory Committee reviewed this request at the August 12, 2019 meeting. Staff recommends
approval of the Specific Use Permit SUP 19 -01, Time to Shine Car Wash, with the following
conditions:
• The entire property shall be platted at one time, delineating all access points and any
mutual access easements.
• Additional screening around site dumpster.
There were two citizens that requested to speak regarding their concerns.
Mr. Sid Schuler- 9800 North 1191h East Avenue, owner of Owasso Auto Spa - My business is a stone's
throw away. It seems way too close to my business.
Mr. Tracy Pipkin - 7211 East 106th Street North - He feels like there are too many car washes in the
area. City staff restricted amount of car lots in the overlay district and it was approved by City
Council, now you are allowing multiple car washes. He also feels as if these new car washes will
end up out of business and then Owasso will have large empty buildings.
The applicant had a representative present to answer any questions.
Mr. Horton moved, seconded by Mr. Balthrop, to approve the Specific Use Permit SUP 19 -01,
subject to the any Staff and /or TAC recommendations and the above conditions.

ITEM 8, OPUD 17 -01 A /OZ 19 -05 - Planned Unit Development Amendment - Parker Village
Consideration and appropriate action relating to the request for the review of an
amendment to the Planned Unit Development (OPUD 17 -01). The property is
composed of several parcels of land generally located north and east of the
northeast corner of East 106th Street North and North Garnett Road. The PUD
Amendment would rezone all the RNX (Residential Neighborhood Mixed) to RS -3
(Residential Single - Family High Density) and transfer some current CS (Commercial
Shopping) to RM (Residential Multi - Family). The site is approximately 57.536 acres.
Morgan Pemberton presented the staff report. The location was described. The Technical
Advisory Committee reviewed this request at the August 12, 2019 meeting. Staff recommends
approval of the Planned Unit Development Amendment for Parker Village.

Ms. Holly Orr -King (10819 North Garnett Road) requested to speak regarding her concerns. She has
concerns regarding the drainage, grading of the property and the fencing. She would like to see
these plans prior to the engineer's approval. Also, does not want to see the ground level raised
because screening has no affect when the ground level is raised. She would like to be notified
before any approvals regarding the drainage, grading and the screen fencing.
Mr. Dempster explained to Ms. Orr -King that the city will not allow more water to run off of the
property than it already does. Staff will get your phone number and we will have the engineers
keep in touch with you during the process.
Ms. Pemberton stated that everything in the green area will not be touched. City engineers are
very diligent when reviewing plans. Mr. Balthrop suggested the possibility of a third engineer
reviewing the hydrology report.

Amendment, subject to the any Staff and TAC recommendations.

ANALYSIS
The applicant is requesting a rezoning from- RS -3 -to DM -for property located in -the Downtown -
Overlay District. The DM zoning category was created with the approval of the new Owasso
Zoning Code in 2018. The intention of the DM zoning district is to allow for a mix of uses, such as
commercial and residential, to be located on a single lot. The DM zoning district Is specific only
to the Downtown District,
The subject property falls under the Downtown Development District on the GrOwasso 2030 Land
Use Master Plan. The Downtown Development District does not call for any specific land uses on
the Master Plan. Rather, it identifies the District as an area of targeted investment with a mixture
of land uses, including single - family homes, multi - family housing, office, and commercial uses.
The DM zoning district allows the variety of land uses described above for the Downtown
Development District.
Staff supports the rezoning request based on its conformity with the Land Use Master Plan and
the stated Intent of the Downtown Overlay District. Additionally, the DM- zoning designation
encourages development on this property that would be in keeping with the mixed -use
development trends occurring in the area. Any development that occurs on the subject
property must adhere to all subdivision, zoning, and engineering requirements of the City of
Owasso.
RECOMMENDATION
Staff recommends approval of the rezoning request (OZ 19 -07), rezoning the subject property
from RS -3 (Residential Single - Family High Density) to DM (Downtown Mixed).

ANALYSIS
This request involves both annexation and rezoning. Typically, property annexed into the Owasso
City limits is assigned an AG zoning designation or is annexed with the existing County zoning.
However, an applicant can request a rezoning of the property if the requested zoning conforms to
the GrOwasso 2030 Land Use Master Plan and proper legal notice is provided. In this case, the
applicant is requesting that the property be assigned CS zoning upon annexation. Proper legal
notice was completed by City staff for the annexation and rezoning.
The subject property is identified for commercial land uses per the GrOwasso 2030 Land Use Master
Plan. The commercial use category consists mostly of retail commercial and office type
developments. This particular location in the community is an emerging corridor, with high growth
potential. The surrounding adjacent property is still relatively undeveloped, with the exception of a
church that is located immediately to the east. However, there are several commercial businesses
to the south. Development of this properly will likely serve as a catalyst for future development to
the north along the highway frontage all the way to the northern Owasso fenceline boundary.
Considering the above, staff has determined that the request for CS zoning at this location is
appropriate.
The City of Owasso would provide sanitary sewer, Fire, Police, and EMS services to the subject
property at such time as it is developed. Water service would be provided by Washington County
Rural Water District #3. Any future development on the subject property shall adhere to all
subdivision, zoning, and engineering requirements of the City of Owasso.
TECHNICAL ADVISORY COMMITTEE (TAC)
The Technical Advisory Committee (TAC) reviewed this item at their meeting on October 16,
2019. No comments were made at the meeting.
RECOMMENDATION
Staff recommends approval of the annexation (OA 19 -04) and rezoning (OZ 19 -06) requests to
annex the subject property into the corporate limits of the City of Owasso with an assigned
zoning of CS (Commercial Shopping),

BACKGROUND
The Community Development Department received a request for a change of access for Lot 1,
Block 1 of Burlingame Center. The final plat for this property was approved in 1978. Rafts Auto
Sales is currently operating on the subject property. A change of access has been requested for
the subject property as the limits of access identified along East 116th Street North are in conflict
with the current placement of the drive providing access to the property.

APPROVAL PROCESS
A change of access to a filed plat requires Planning Commission approval and a favorable
recommendation by the City Engineer. An instrument signed by the City Engineer and Planning
Commission Chairman is recorded with the Tulsa County Clerk, officially amending the platted
limits of access for the subject property.
ANALYSIS
During the design for the widening project on East 1161h Street North, it came to the City
engineers' attention that the driveway on Lot 1, Block 1 of Burlingame Center does not line up
with the limits of access identified for the property. After coordinating with the property owner, it
was determined that the best course of action would be to apply limits of access where the
property's driveway is currently located in order to bring it into compliance. When 116th Street
North is eventually widened, the drive will remain in its current location.
The two mutual access easements (MAEs) that are shown for the property on 1161h Street will
remain. The sole purpose of the MAEs will be to provide access to lots to the south of the
property or potentially as cross access to future developments to the east or west. The City
Engineer has expressed support for this change of access.
TECHNICAL ADVISORY COMMITTEE (TAC)
The Technical Advisory Committee reviewed this item at their meeting on October 16, 2019. No
comments were made an this item at that meeting.
RECOMMENDATION
Staff recommends approval of the change of access request for Lot 1, Block 1 of Burlingame
Center with the following recommendation.
• No additional curb cuts shall be allowed on the subject property

ANALYSIS
Hawk's Landing is a proposed single - family residential subdivision. The preliminary plat for Hawk's
Landing proposes 69 lots in 3 blocks. The proposed development would not be under a planned
unit development (PUD), and is therefore only required to meet the minimum bulk and area
standards established for the RS -3 zoning district in the Owasso Zoning Code. Staff has
determined that the proposed preliminary plat meets the minimum dimensional standards for
residential lots in an RS -3 district. These minimum standards include, but are not limited to:
• Lot width of 65 feet
• Lot area of 7,000 square feet
• Front yard setback of 25 feet
• Rear yard setback of 20 feet
• Side yard setbacks of 5 feet
There are two public access points proposed to the development, both on East 761h Street North.
These access points are separated by a distance of 322.84 feet, which exceeds the minimum
allowable of 150 feet as set forth in the Owasso Zoning Code.
Staff has determined that the preliminary plat for Stone Creek of Owasso provides adequate
right -of -way on the arterial and proposed internal streets, which would be dedicated to the City
with the recording of the final plat. Adequate perimeter and interior utility easements are shown
on the preliminary plat, allowing utility providers to supply and maintain service to the proposed
development. There is one reserve area identified on the preliminary plat which would primarily
be used for open green space and storm water detention.
The deed of dedication and restrictive covenants page of the preliminary plat calls for the
establishment of the Hawk's Landing Homeowners' Association (HOA). The HOA would be
responsible for the maintenance of all reserve areas, open spaces, landscaping and fencing
along the frontage of 76th Street, and stormwater detention areas.
Sanitary sewer service would be provided by the City of Owasso, and water service would be
provided by Rogers County Rural Water District #3. Any development that occurs on the subject
property shall adhere to all subdivision, zoning, and engineering requirements of the City of
Owasso.

• On the final plat note the entryway displays.
• There will be a payback fee for the 761h Street Interceptor.
• Note the 25' drainage easement.

• The 20' can be reduced to 17.5' around the perimeter.
• Submitted the spelling corrections on Deed of Dedications to the
applicant.
• Submit the street tests results to Public Works.
• Show a 15' u/e every 4 or 5 lots down the sides.
• Depict as a continued track, close the line off. Should match the
legal description.
• There is a 4' difference on the legal description. Make sure it

Preliminary Plat m Hawk's Landing
• Need an engineer seal on the preliminary plat
• Make sure all zoning references have been updated to reflect the current City zoning of
RS -3 (Residential Single - Family High Density)
• Remove all references to the PUD that was approved in Rogers County
o The PUD was replaced by straight RS -3 zoning when it was annexed into Owasso
City limits
• Update bulk and area requirements on plat to Owasso Zoning Code standards for RS -3
districts:
• Lot width minimum- 65'
• Lot area minimum- 7,000 sq it
• Arterial setback -35'
• Non - arterial setback -25'
• Rear yard setback -20'
• Side yard setbacks -5'/5'
• Correct the number of lots
• Street names and addresses will be provided by the Community Development
Department
• Label the surrounding property owners and all surrounding property zonings
• Show topographic information on the subject property as well as 100' it off the property
lines

o The covenants refer to private streets
• If the streets are to be private, then the community will need to be gated and the
