Main (west side) at 11:30 am on November 6, 2019. ITEM 1. CALL TO ORDER Mr. Miller called the meeting to order at 6:00 pm. ITEM 2. Flag Salute ITEM 3. OZ 19 -07 - Rezoning -103 West 3rd Street Consideration and appropriate action relating to a request for the review of a rezoning request. To be considered is a rezoning from RS -3 (Residential Single - Family High Density) to DM (Downtown Mixed). The subject property contains .22 acres and is located at 103 West 31d Street. Mr. Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the October 16, 2019 meeting. The owner of the property was present to address any questions. Staff recommends approval of the rezoning of 103 West 31d Street from RS -3 (Residential Single - Family High Density) to DM (Downtown Mixed). Mr. Miller moved, seconded by Mr. Horton to approve the rezoning request OZ 19 -07, rezoning from RS -3 to DM, subject to any TAC and /or Staff recommendations. OA 19 -04 & OZ 19 -06 - Annexation & Rezoning Consideration and appropriate action relating to the review of an annexation and rezoning request on property zoned AG (Agriculture) in Tulsa County. Upon annexation, the subject property would be brought into the City Limits of Owasso as CS (Commercial Shopping). The general location of the property is north and east of the northeast corner of US 169 and East 1 I 61 Street North and is approximately 11.48 acres. Mr. Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the October 16, 2019 meeting. A representative for the applicant was present to address any questions. Staff recommends approval of the annexation (OA 19- 04) and the rezoning (OT 19 -06) requests to annex the subject property into the corporate limits of the City of Owasso with an assigned zoning of CS (Commercial Shopping). Mr. Balthrop moved, seconded by Mr. Miller, to approve the annexation and rezoning requests, subject to the any Staff and /or TAC recommendations. Change of Access - 11302 E 1161h Street North Consideration and appropriate action relating to the request for the review of a change of access request which would create a 41.87' Limits of Access where an existing drive is located on property known as Rafts Auto Sales. The property is located at 11302 East 116th Street North and is 0.47 acres. Mr. Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the October 16, 2019 meeting. Staff recommends approval of the change of access request for Lot 1, Block 1 of Burlingame Center with the following recommendation: No additional curb cuts shall be allowed on the subject property. Mr. Vines moved to approve the change of access subject to Staff and /or TAC recommendations and also subject to the following recommendation: The actual curb cut be limited to 36 feet. The motion was seconded by Mr. Miller, to approve the change of access, subject to the above recommendations. Fritschen RLA, AICP Planning Manger SUBJECT: Final Plat —The Villages at a New Leaf DATE: December 6, 2019 BACKGROUND: The Community Development Department received a Final Plat from Wallace Engineering for The Villages at a New Leaf, a proposed development offering vocation training centered on agricultural and horticultural principals for individuals with developmental disabilities. The subject property is located south and east of the southeast corner of E 86th St N and N Memorial Dr and is approximately 49.82 acres in size. The subject property was annexed into the City Limits of Owasso on November 21, 2017 under Ordinance 1115 (OA 17 -07) and PUD 17 -03 was approved for the property in December, 2017. ANALYSIS: The property is situated just south and east of the intersection of East 86th Street North and North Memorial Drive. The proposed development will take access from both East 861h Street North and North Memorial Drive. The facility will have two gated entrances and an internal circular private road that will provide access to the living units and development areas. The plat indicates the project will have private streets, and the owner vAill assume responsibility for their long -term maintenance. Access points have been identified along both Memorial Drive and East 86th Street North and both meet the zoning code spacing requirements for driveway entries. Limits of access and no access along East 861h Street North and Memorial Drive have been delineated on the plat.. Right -of -way is being dedicated along Memorial Drive. Utility easements have been shown which will allow utility providers to serve the site. There is one stormwater detention area identified that will detain water produced from the development and release at a pre - development rate. Language has also been provided in the Deed of Dedication page that specifies who maintains the landscaping, fencing, and stormwater facilities. The City of Owasso will provide sanitary sewer, Fire, Police, and EMS services to the proposed multi- family residential development. Washington County Rural Water District #3 will provide water service to the property. Sanitary sewer service needs to be extended to the property with an off - site easement by separate instrument. Any development on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso as well as those approved under OPUD 17 -03. The subject property is approximately 40 acres in size and is located on the southwest corner of East 761h Street North and North 161s' East Avenue. The property was rezoned in November 2018 with Ordinance 1140 to RS -3 (Residential Single - Family High Density) and the Planning Commission reviewed the preliminary plat in April 2019. The final plat for Stone Creek of Owasso proposes 100 lots in 6 blocks, The proposed development is not under a planned unit development (PUD), and is therefore only required to meet the minimum bulk and area standards established for the RS -3 zoning district in the Owasso Zoning Code. Staff has determined that the proposed final plat meets the minimum dimensional standards for residential lots in the RS -3 district. There are two public access points proposed to the development. One is on East 761h Street North and the other is on North 161s' East Avenue. Currently, 161s' is not a paved public street as there has not been sufficient development in the area to necessitate its construction. Because the proposed residential subdivision will require two access points to meet the Fire Code, the developer would be required to construct 161st from the intersection of 761h and 1615, south to the proposed East 751h Place North. The remainder of North 161st East Avenue would remain unpaved at this time. The length of North 161s' East Avenue to be constructed by the developer would be required to be dedicated to the City with the filing of the final plat for Stone Creek of Owasso, and it must be built to City standards. The developer would also be required to construct sidewalks along the arterial streets except for the portion of 161st that will remain unpaved. However, the developer may choose to escrow the sidewalks along the length of 161s, East Avenue and East 76th Street North as there are presently no adjacent sidewalks connection points. Staff has determined that the final plat for Stone Creek of Owasso provides adequate right -of- way on the arterial and proposed internal streets, which would be dedicated to the City with the recording of the final plat. A deceleration lane will be required as part of the development and the Public Works Department Will work the developer on the design. Adequate perimeter and interior utility easements are shown on the final plat, allowing utility providers to supply and maintain service to the proposed development. There are two reserve areas identified on the final plat and they would primarily be used for open green space and storm water detention. The deed of dedication and restrictive covenants of the final plat calls for the establishment of the Stone Creek of Owasso Homeowners' Association that would be responsible for the maintenance of all reserve areas, open spaces, and stormwater detention areas. The HOA for Stone Creek of Owasso would also be responsible for maintaining a 6 foot screening fence along 761h and 161x'. A fence and landscape easement (F /E) has been shown that delineates maintenance responsibilities. Sanitary sewer service would be provided by the City of Owasso, and water service would be provided by Rogers County Rural Water District #3. Any development that occurs on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso. TECHNICAL ADVISORY COMMITTEE (TAC) The Technical Advisory Committee reviewed the final plat for Stone Creek of Owasso at their meeting on November 20, 2019. Comments from that meeting are attached to this memo. RECOMMENDATION Staff recommends approval of the final plat for Stone Creek of Owasso.
