MINUTES OF REGULAR SCHEDULED MEETING
JULY 21, 1988, 7:00 P. M.

The agenda for the meeting was posted in the Owasso City
Hail, 207 S. Cedar, on July 15, 1988.
1. CALL TO ORDER - Chairman Ray Haynes called the meeting to
order at 7:02 p. m.
2. ROLL CALL - Chairman Haynes declared that all members, except
Scott Butler, were present.
3. MINUTES OF JUNE 16, 1988 - The Commission reviewed the Minutes
of June 16, 1988. Motion was made by Elwood Henry and seconded
by Charles Willey to approve those Minutes as written. A vote on
the motion was recorded as follows:
Ray Haynes - Yes
Elwood Henry - Yes
Pat Imbriano - Yes
Charles Willey - Yes
the motion carried.
ZONING PUBLIC HEARING
4. John Moody (714) - request to rezone the 50 acre Meadowcrest
Addition to Tulsa County from RS -1 to RE (Residential Estate
District) located west of the intersection of 109th St. North and
Garnett (U.S. 169 Hwy.)
Chairman Haynes introduced the case and Richard Hall
explained the request. There was discussion among the
commissioners and the staff about two lots that do not meet the
frontage standard of the proposed RE zoning. The applicant of the
rezoning, attorney John Moody, spoke for the request and
explained the reasons for the proposed rezoning. The
commissioners and the applicant discussed the Zoning Code
requirements, the two potentially non - conforming lots and street
access to the 20 acre property west of Meadowcrest. Motion was
made by Elwood Henry and seconded by Charles Willey to recommend
that the City Council approve the requested RE zoning on the
subject property. The motion also recommended that the owners of
the two potentially non - conforming lots acknowledge in writing

that they are aware of possible future development difficulty
of their property because the lots may be substandard in the RE
zoning district.
A vote on the motion was recorded as follows:

the motion carried.
The lot owners of both potentially non - conforming lots were
present and, with the applicant, volunteered to submit letters
acknowledging that they approved of the zoning despite the
potential non - conformity of their lots. The applicant requested
that the City Council meeting on the rezoning be scheduled for
August 9, 1988.
6. NEW BUSINESS - There was no New Business but the commissioners
requested that the staff send all members a copy of the state
open meeting law. The commissioners and staff discussed the City
Attorney briefing the Commission about legal issues and state
laws at a future meeting.
7. ADJOURN - Motion was made by Elwood Henry and seconded by
Charles Willey to adjourn the meeting. A vote on the motion was
recorded as follows:

MEMORANDUM
TO: The Owasso Planning Commission

SUBJECT: Amended Plat of the Lakeridge Third Addition
DATE: October 6, 1988
The enclosed plat of Lakeridge Third Addition is scheduled
to be reviewed at your October 13, 1988 meeting. The original
plat of this property has already received approval from the
Techinical Advisory Committee, the Planning Commission and the
City Council. The plat was not filed of record with the Tulsa
County Clerk's office, but 123rd E. ave. and 91st Street shown on
the plat have been constructed. The new owner of the property now
seeks to build homes along those completed streets. I informed
the developer and the plat engineer that the property would have
to be replatted into phases if all of the public facilities were
not installed according to the oroginal Lakeridge Third plat and
construction plans. the plat engineer has therefore resubmitted
the revised plat showing only those lots along the completed
streets. That revised plat will be reviewed by the T.A.C. on
October 12th. I will bring any T.A.C. recommendations to the
Planning Commission meeting on October 13th. Attached is a list
of conditions required by the you and the City Council on the
original Lakridge Third plat.

responsibility of the subdivider /developer that all Owasso subdividion regulations
are complied with and that the subject plat is properly processed and reviewed by
Owasso City Staff.
Show additional fire hydrants as required by the Fire
Department near the N.W. /c L9 B3 and the N.W. /c L7 B4.

a. Show a tie to a section coordinate and P.O.H. of the
legal description.
b. Note Book. and Page numbers for separate instrument
easement in northeast corner of plat.

1. Note with arrow 10.04 ' in N.W. /c of plat,
2. Note measurement along east boundary of L12 B4.
e. Covenants:
1. In legal description the 102.96' dimension was
omitted along the east boundary of L12 B4.
2. In covenant 11 there is a typographical error.
3. In #14a add "north and west boundary."
4. In #14d add "pay for the damage."
f. Lot dimensions and notations:
1. Note scaled 35' building lines on L 2 -5 B4.
2. Show delta measurement in cul -de -sac.
3. Note lot line in L4 B3.
4. Show solid lot # for L12 B4.

SUBJECT: Discussion of legal issues pertaining to Planning Com-
mission Activities
DATE: October 5, 1988
I have invited Ron Cates, the Owasso City Attorney,to come
to a Special meeting of the Planning Commission on October 13th
to discuss legal issues pertaining to Planning Commission work in
Owasso according to Oklahoma law. He has told me that he will try
to answer easy questions at the meeting. More difficult ones will
have to be addressed by him by a memo to you later.
