The agenda for the meeting was posted in the Owasso City
Hall, 207 S. Cedar, on November 7, 1988.
1. CALL TO ORDER - Chairman Ray Haynes called the meeting to
order at 7:00 p. m.
2. ROLL CALL - Chairman Haynes declared that all members, except
Scott Butler, were present.
3. MINUTES OF OCTOBER 13, 1988 - The Commission reviewed the
Minutes of October 13, 1988. Motion was made by Elwood Henry and
seconded by Pat Imbriano to approve those Minutes as written. A
vote on the motion was recorded as follows:

ZONING PUBLIC HEARING
4. OPUD - B L014) - Pittman, Poe and Associates - Northwest
Corner of 86th St. No. and 129th E. Ave.
Chairman Haynes introduced the proposal and explained the
location of the subject property. Richard Hall discussed the
nature of Planned Unit Development zoning. Applicant Bland Pitt-
man spoke for the application and presented the development
concept of the project. The Commission, applicant and staff
discussed the proposal at length. Motion was made by Charles
Willey and seconded by Pat Imbriano to recommend that the City
Council approve OPUD-8, the design concept and general construc-
tion standards as proposed by the applicant but subject to de-
tailed site plan reviews by the Planning Commission of each
building constructed on the property, and subject to the condi-
tions recommended by staff:

SUBDIVISION REVIEW
5. Owasso Medical Center L20141 - Sisemore, Sack, Sisemore -
South of the Southwest Corner of 96th St. No. and 129 E. Ave.,
Preliminary and Conditional Final plat.
Chairman Haynes introduced the proposed subdivision plat and
explained the location of the subject property. Plat engineer
Jerry Emanuel and Richard Hall discussed the proposal and an-
swered questions of the Planning Commission. Pastor Clarence
Lambert represented the Owasso Assembly of God Church east of the
subject tract but he had no comment on the development. Motion
was made by Elwood Henry and seconded by Charles Willey to recom-
mend preliminary approval of the proposed Owasso Medical Center
subdivision plat subject to the following Technical Advisory
Committee and staff recommendations:
1 Utility easements shall meet the approval of the utility
companies. Coordination will be required, particularly if an
underground facility is planned. Show additional easements as
required.

2. A Paving and drainage plans shall be approved by the
City of Owasso.
A Drainage system study, including the boundaries of

5 A Sewage disposal, the method and plans therefore,
shall be approved by the Tulsa City- County Health Depart-

on a copy of the 'final plat prior to recording the plat.
Said copy shall be submitted to the Cit.v F.nainaor

8 A Sidewalks shall be provided along both sides of all
streets in all zoning categories except industrial in ac-
cordance with Ordinance number 182, Article III, Section 3.

14 C All Subdivision Regulations shall be met, including
provisions of Appendix A and Ordinances 182 and 233, and all
other amendments prior to release of final plat.
15 D Subdivison must meet the requirements of the Owasso
Fire Marshal. Show fire hydrants as specified by the Fire
Marshall.
16 C Other Conditions:
a. Show access points and Limits of No Access along
129th E. Ave. at locations that will not adversely affect
existing curb cuts along the street and in a location that
will allow good visibility of oncoming traffic for cars
entering or leaving the subject property.
b. Show an easement to serve the property to the north
of the subject property with sewer and other utilities. A
contract to dedicate such a future easement is not enforce-
able or acceptable.

c. Show a 17.5' easement along 129th E. Ave. inside the
GRDA easement and move the East Building Line outside of the
GRDA easement.
d. Show a 17.5'easement to the west along the North
property line.

6. Owasso Nursing Romp _(_29141 - Philip Green - South of the
Southeast corner of 86th St. No. and 123rd E. Ave.
Chairman Haynes introduced the proposal and described the
location of the property. Richard Hall explained the land use
situation of the subject tract. Bob Horinek, the general contrac-
tor of the construction of the project, was present and discussed
the development with the Commission. Richard Hall discussed the
recommendations of the Technical Advisory Committee and staff.
Motion was made by Pat Imbriano and seconded by Elwood Henry to
approve the site plan with the following requirements:
(1) That the turning radii of the drives be adequate to
accommodate fire trucks and that the building plans meet the
requirements of the Fire Marshall and Building Inspector,
(2) that the development meet the requirements of the City
Engineer regarding storm water detention on the property and
reconstruction of utilities,
(3) that no portion of the building be constructed over any
public utility line,
(4) that a screening fence be built between the nursing home
and the residentially zoned neighborhood to the south,
(5) that one parking space per 500 sq. ft. be provided for a
total of 62 spaces at a size of 10' x 20' instead of the
proposed 58 spaces which are 9' x 18' and
(6) that sidewalks be provided on the east side of 123rd E.
Ave.

AMENDMENT OF OWASSO PLANNING COMMISSION BYLAWS
7. Commission Action on an amendment of the By-Laws, Owasso P an-
ning Commissions. Owasso Oklahoma Article VII. Section l y Time
and Place to read "meetings shall be held at 7:00 p.m."
Elwood Henry informed the Commission about the proposal to
amend the By -Laws to officially change the meeting time of the
Commission. Motion was made by Elwood Henry and seconded by
Charles Willey to amend the By= Laws ,Owasso Planning Commission,
Owasso Oklahoma, Article VII_ Section 1_,_ Time and Place to read
"meetings shall be held at 7:00 p.m."
A vote on the motion was recorded as follows:

the motion carried.
Richard Hall was directed by Elwood Henry to place the item
on the next Planning Commission agenda for final action.
8. NEW BUSINESS - R. J. Ray informed the Commission that he
would visit with Scott Butler to determine if Scott wanted to
remain on the Commission since Scott had missed some Commission
meetings. The Commission took no vote on the matter.
9. ADJOURN - Motion was made by Elwood Henry and seconded by
Charles Willey to adjourn the meeting. A vote on the motion was
recorded as follows:

CONDITIONS OF APPROVAL
This subdivision checklist, or a revised list, shall accompany a
Plat proposed for final release by the City Council of the City
of Owasso. Ail conditions noted shall be fulfilled before the
plat shall be considered for approval by the Owasso City Council.
it is the responsibility of the subdivider, developer and plat
engineer that all Owasso Subdivision regulations and the condi-
tions listed below are satisfied. Only the numbered conditions
pertain to this particular subdivision. Once the conditions are
satisfied, those that are noted with an "A" shall be initialed by
the City Engineer, those noted with a "B" shall be initialed by
the Building Inspector, those noted with a "C" shall be initialed
by the City Planner, and those noted with a "D" shall be ini-
tialed by other authorities as shown.

MEMORANDUM
TO: Owasso Planning Commission

SUBJECT: Proposed amendment to the Deed of Dedication Platted
Restrictions for the Elm Creek Condominiums Amended Plat concern-
ing permitted land uses
DATE: December 9, 1988
On May 25, 1988 the Owasso Board of Adjustment approved a
proposal to build a nursing home on Lot 1 of Block two of the Elm
Creek Condominiums Amended Addition (application OBOA-106). A lot
split was approved by the Planning Commission in June of 1988 to
accommodate the development. A site plan of the project was
endorsed by both the Planning Commission and Board of Adjustment
in November of 1988. The title attorney from the development has
now discovered that the original subdivision plat had specified
that only residential uses were permitted in the subdivision. He
has submitted the attached papers to amend the plat restrictions
to include the nursing home use as well as offices and other
light commercial uses. Since his proposal is actually an amend-
ment to the plat, I required him to come before the Planning
Commission and City Council to change the deed restrictions.
I have no objection to amending the deed restrictions to
include the nursing home use which has received the approval of
the Board of Adjustment and which site plan has been reviewed by
the Board and Planning Commission. The language of the covenant
change includes more than and the nursing home tract, however.
The proposed covenants say that the nursing home property AND the
row of duplex lots on the west side of 122nd East Avenue may ALSO
be used for offices and light commercial even though the zoning
has not been approved for those uses. The present zoning remains
RM -1 apartment zoning for the nursing home property and RD Duplex
zoning for the row of lots west of 122nd E. Avenue. it appears to
me that the proposed deed restrictions may also conflict with
other covenants that refer to the duplex row of lots.
I recommend that the covenants be amended to only refer to
the nursing home property and only to add the nursing home use.

shown on the said plat, both for the furnishing of water and/or sewer services to
the area included in said plat and to any other areas.
The "Owners" for the purposes of insuring adequate covenants and restrictions for
e mutual benefit of the "Owners ", its successors and assigns, and the City of Owasso,
lahoma, do hereby impose upon the property within "ELM CREEK CONDOMINIUMS AMENDED"
as hereinabove described, the following covenants and restrictions which shall run with the
land and which shall be enforceable by the "Owners" or owners of any property within
"ELM CREEK CONDOMINIUMS AMENDED ", or part thereof and by the City of Owasso, Oklahoma
a Municipal Corporation, to wit:
1. Within "ELM CREEK CONDOMINIUMS AMENDED" 4
standards and restrictions shall apply the following development
a) No parking will be allowed in any area other than the designated
resident and guest parking areas. Areas not reserved for parking
shall be utilized for driveway and fire zone use.
b) Lots 1 through 6, Block 1, shall be reserved for duplex residential
purposes, not to exceed six duplex units.
h) Roofing materials on all dwellings constructed within the Addition
shall be restricted. Composition shingle roof will be allowed on any
structure erected on any lot. Certain now existing and future types
of synthetic or natural roofing materials may be used upon written
approval pursuant to Paragraph "w" below.
i) Exterior wall materials shall be brick, pressed board, wood, stucco or
other approved materials. Metal, vinyl or asbestos type siding will not
be approved.
PNo animals, livestock or poultry of any kind shall be raised, bred or
kept on any lot therein, except that dogs, cats or other household
pets may be kept, provided that they are not kept, bred or main-
tained for commercial purposes and that physically do not exceed
eighteen (18) pounds in weight.
The exterior of all structures located on Lots 1 through 6, Block 1;
shall be constructed with at least twenty -five percent (25 %) stone,
brick, or
masonry veneer.
All lots in the Addition shall be known and described as residential
lots
and no structure shall be erected, altered, placed or permitted
remain on any residential building plot, the exceeds two stories
in height.
All residents in Lots 1 through 6, Block 1, must have a private
garage, for not less than two cars, attached to the residence.
No residential structure shall be erected or placed in Lots 1 through
6, Block
1, which individual residence has an area of less than nine
hundred fifty (950)
square feet, exclusive of garage and porches.
No residence shall be located on any lot nearer to the front property
line or nearer to the side street property line than the minimum
building set back line shown 'on the recorded Plat, or ten (10) feet,
whichever is greater. Buildings in Lots 1 through 6, Block 1, may
be constructed to have zero side yard on one side only; however,
there shall be a minimum separation between dwelling unit structures
of ten (10) feet.
h) Roofing materials on all dwellings constructed within the Addition
shall be restricted. Composition shingle roof will be allowed on any
structure erected on any lot. Certain now existing and future types

amended as follows:
Paragraph d) on page 3 of said Deed of Dedi-
cation currently reads as follows:

ARTICLE VII. MEETINGS, Section 1. Time and Place of the
Owasso Planning Commission By -laws now reads:
The meetings of the Commission shall be held in the City
Council meeting room at the Owasso City Hall, unless other-
wise provided by the Commission for particular meetings. The
meetings shall be held at 7:30 p.m. on the third Thursday of
each month unless otherwise set by the Commission. Special
meetings may be held on call of the chairman at such time
and place as may be designated.
At our November 17, 1988 meeting, motion was made and ap-
proved to consider an amendment of ARTICLE VII. MEETINGS, Sec-
tion 1. Time and Place of the Owasso Planning Commission By -laws
to read:
The meetings of the Commission shall be held in the City
Council meeting room at the Owasso City Hall, unless other-
wise provided by the Commission for particular meetings. The
meetings shall be held at 7:00 p.m. on the third Thursday of
each month unless otherwise set by the Commission. Special
meetings may be held on call of the chairman at such time
and place as may be designated.
I recommend approval of the proposed amendment. The proposed
amendment shall require an affirmative vote of at least three
members to be adopted.

SUBJECT: Animal Shelter location

Section 45-104 of the Oklahoma Municipal Code gives Munici-
nal Planning Commissions the authority to review the locations of
building's and other public improvements. While you have already
reviewed many facilities in the approval of the Comprehensive
Plan, a proposed animal shelter was not on the plan and its
constriction must have your approval. The funds for the improve-
ment were approved by city voters on October 4, 1988. After
considering several sites, the City Manager and I propose to
build the structure on publicly owned land immediately north of
the new waste water treatment plant south of Main Street and
Fourth Avenue. The City Manager has informed the City Council of
the site and the proposal will be sent to the Owasso Board of
Adjustment on January 11, 1989 as required by the Zoning Code.
The building will be built above the 100 year floodplain and it
will be a fully enclosed, state of the art facility. The nearest
home is about 600 feet away on Birch Street. A sign marks the
location of the site if you want to visit the property.
I recommend approval of the location of the animal shelter
on the proposed site south of Fourth Avenue and Main Street.
