Ray The agenda for the meeting was posted in the Owasso City Hall, 207 S. Cedar, on January 30, 1989. 1. CALL TO ORDER - Chairman Ray Haynes called the meeting to order at 7:00 p.m. 2. ROLL CALL - Chairman Haynes declared a quorum present. 3. MINUTES OF JANUARY 26, 1989 - The Commission reviewed the minutes of January 26, 1989. Charles Willey moved, seconded by Pat Imbriano, to approve those minutes as written. A vote on the motion was recorded as follows: Ray Haynes - Yes Pat Imbriano - Yes Charles Willey - Yes The motion carried. SUBDIVISION REVIEW 4. Recommendation on the approval of the final plat of the Hillcrest Medical Park, located South of the Southwest Corner of 96th St. N. and 129th E. Ave. Chairman Haynes introduced the item. Jerry Emanuel, the subdivision engineer of Sisemore, Sack, & Sisemore discussed the plat with the Commission. Richard Hall discussed the following list of Technical Advisory Committee and Staff Recommendations: 1 Utility easements shall meet the approval of the utility companies. Coordination will be required, particularly if an underground facility is planned. Show additional easements as required. D Oklahoma Natural Gas Company D Public Service Company D Southwestern Bell Telephone Owasso Planning Commission Minutes of February 16, 1989 Page 2 D City of Owasso D Tulsa Cable Television D Grand River Dam Authority 2 A Paving and drainage plans shall be approved by the City of Owasso. 3 A Drainage system study, including the boundaries of the 100 year flood calculated on the basis of 100% or full up stream urbanization, shall be approved by the City of Owasso. 4 A Water and sewer plans shall be approved by the City of Owasso. 5 A Sewage disposal, the method and plans therefore, shall be approved by the Tulsa City- County Health Department. 6 A Building pad elevations shall be placed on each lot on a copy of the final plat prior to recording the plat. Said copy shall be submitted to the City Engineer. 7 A Sidewalks shall be provided along both sides of all streets in all zoning categories except industrial in accordance with Ordinance number 182, Article III, Section 3. 8 A & C Access points (or access to the tract) shall be approved by the City of Owasso and shown on the plat accordingly in an appropriate location. 9 C Complete dimensions shall be shown on all lots, streets, building lines, easements, etc. 10 C All Subdivision Regulations shall be met, including provisions of Appendix A and Ordinances 182 and 233, and all other amendments prior to release of final plat. 11 D Subdivision must meet the requirements of the Owasso Fire Marshal. Show fire hydrants as specified by the Fire Marshall. 12 C Show a name other than the Owasso Medical Center on the plat face and in the Restrictive Covenants. 13 C Remove Section 1.4 STORM SEWER from the Restrictive Covenants. UTILITY EASEMENTS the following: NO PERMANENT FENCE, WALL, BUILDING, SUBSTANTIAL VEGETATION OR RESTRICTIVE STRUCTURES, OTHER THAN UTILITY APPURTENANCES, SHALL BE PLACED OR MAINTAINED WITHIN A UTILITY EASEMENT. THE OWNER SHALL BE RESPONSIBLE FOR THE REPAIR AND REPLACEMENT OF ANY LANDSCAPING AND PAVING LOCATED WITHIN THE UTILITY EASEMENTS IN THE EVENT IT IS NECESSARY TO REPAIR ANY UNDERGROUND WATER OR SEWER MAINS, ELECTRIC, NATURAL GAS, COMMUNICATIONS OR TELEPHONE SERVICE. Motion was made by Pat Imbriano and seconded by Charles Willey to approved the final plat of the Hillcrest Medical Park subject to the above conditions recommended by the T.A.C. and Staff. A vote on the motion was recorded as follows: Ray Haynes - Yes Pat Imbriano - Yes Charles Willey - Yes The motion carried. 5. NEW BUSINESS - Richard Hall informed the Commission that some changes were necessary in the Subdivision Regulations. He said that unless there were objections, he would schedule on upcoming Planning Commission agendas a series of work sessions to review the regulations. 9. ADJOURN - Motion was made by Pat Imbriano and seconded by Charles Willey to adjourn the meeting. A vote on the motion was recorded as follows: Ray Haynes - Yes Pat Imbriano - Yes Charles Willey - Yes The meeting was adjourned at 7:44 p.m. Chairman Secretary Date SUBDIVISION REGULATIONS CITY OF OWASSO, OKLAHOMA Adopted by the Owasso City Council by Ordinance No. on 1989 ACKNOWLEDGMENTS OWASSO CITY COUNCIL Stacy Lamb Patricia Marlar John Phillips Von Stockler Mark Thompson OWASSO PLANNING COMMISSION Ray Haynes Charles Willey Pat Imbriano OWASSO CITY STAFF Rodney Ray, City Manager Jane Buchanan, City Clerk Kirby Crowe, Owasso Public Works Manager Richard Hall, City Planner INCOG Mapping and Graphics Department CITY OF OWASSO SUBDIVISION REGULATIONS CHAPTER 1, GENERAL PROVISIONS Section 1.1 TITLE These Regulations shall hereafter be known, cited and referred to as the Subdivision Regulations of the City of Owasso, Oklahoma. Section 1.2 PURPOSE AND INTENTIONS 1.2.1 Purpose: The arrangement of parcels of land in Owasso for residential, office, commercial and industrial uses and for public needs, such as streets and easements, will to a large degree determine the health, safety, economy and quality of life in the city. Such amenities are a public concern. These Regulations and standards for the subdivision of land are intended to insure the development and maintenance of a safe, healthy, attractive and efficient community and provide for the conservation of its human and physical resources. 1.2.2 Intentions: These Regulations are specifically intended to: A. Establish a subdivision process that is as expeditious and efficient as possible while providing for public health, safety and general welfare. B. Provide neighborhood conservation and prevent the development of slums and blight. C. Harmoniously relate development of the various tracts of land to the existing community and facilitate the future development of adjoining tracts. D. Provide that the cost of improvements which primarily benefit the tract of land being developed be borne by the owners or developers of the tract, and that cost of improvements which primarily benefit the whole community be borne by the whole community. E. Provide the best possible design for the tract. F. Provide a proper arrangement of streets and assure the adequacy of open spaces for traffic and access of emergency vehicles commensurate with the intensification of land use customarily incident to a change of zoning. 1 G. Reconcile any differences of interest. H. Ensure proper legal descriptions, monumenting of land and adequate and accurate platting and records of land sub- division. I. Ensure that public facilities and utilities are available that will have sufficient capacity to serve the proposed subdivision and the general community_ Section 1.3 AUTHORITY These Regulations and Minimum Standards for land development are adopted under the authority granted by Oklahoma Statutes. Section 1.4 JURISDICTION These Regulations shall apply to all subdivision of land located within the corporate limits of the City of Owasso, Oklahoma. Section 1.5 SUBDIVISION PLAT REQUIREMENT AND WAIVER For any land which has been rezoned upon application of a private party, no building permit shall be issued until that portion of the tract on which the permit is sought has been included within a subdivision plan or replat, as the case may be, submitted to and approved by the Planning Commission and City Council and filed of record in the office of the County Clerk where the property is situated. The City Council, upon a showing that the purposes of these regulations have already been achieved by previous platting, or could not be achieved by a plat or replat, may waive the subdivision plat requirement. Section 1.6 PLAT VACATION AND ALTERATIONS No vacation of a plat or any parts thereof, except by action of the District Court, shall be valid or impart notice until after the consent of all of the owners of such platted area is presented to the City Council and the approval of the Council is entered thereon. All vacations or alterations of a final approved filed plat shall require the approval of the Planning Commission and City Council and the filing of a corrected plat, approved deed or accepted easement. Alterations of a plat without approval shall constitute a violation of these Regulations. E Section 1.7 VARIANCE OF REGULATIONS Whenever the tract to be subdivided is of such unusual size or shape or is surrounded by such development or unusual conditions that the strict application of the requirements contained in these Regulations result in substantial hardship or inequity, the Planning Commission may vary or modify, except as otherwise indicated, such requirements of design, but not of procedure or improvements, so that the subdivider may develop his property in a reasonable manner, but so that, at the same the public welfare and interests of the City are protected and the general intent and spirit of these regulations are preserved. Such modification may be granted upon written request of the subdivider stating the reason for each modification and may be waived by three - fourths (3/4) vote of the regular membership of the Planning Commission, subject to the acceptance of the plat and the dedications thereon by the City Council. Variance of the Zoning Code must be granted by the Owasso Board of Adjustment. Section 1.8 AMENDMENT OF REGULATIONS The City Council may, from time to time, adopt, amend and make public rules and regulations for the administration of these Regulations to the end that the public is informed and that approval of plats is expedited. These Regulations may be enlarged or amended by the City Council after public hearing, due notice of which shall be given as required by law. Section 1.9 SEPARABILITY OF PROVISIONS If any section, clause, paragraph, provision or portion of these regulations shall be held invalid or unconstitutional by any court of competent jurisdiction, such holding shall not affect any other section, clause, paragraph, provision or portion of these Regulations. Section 1.10 PENALTY Any person or persons, firm, or corporation, who shall violate any of the provisions of these Regulations, or shall fail to comply therewith, or with any of the requirements thereof, shall be deemed guilty of an offense and shall be liable for a fine as provided by City Ordinance. Each day such violation shall be permitted to exist shall constitute a separate offense. In addition to the other remedies provided herein, the City may institute any proper action or proceedings to enforce these Regulations. 3 Section 1.11 TECHNICAL ADVISORY COMMITTEE ON PLATS - CREATED AND COMPOSITION There is hereby created a Technical plats, the membership of which shall representative of each of the following and such other public officials as designate: A. The City Manager B. The City Engineer C. The Tulsa County Engineer D. The Fire Chief E. The Director of Public Works F. The School Superintendent G. The Tulsa County Health Department H. The natural gas company I. The electric company J. The telephone company K. The cable television company Advisory Committee on be made up of one agencies and companies the City Manager may Section 1.12 TECHNICAL ADVISORY COMMITTEE ON PLATS - DUTIES It shall be the responsibility of the Technical Advisory Committee to meet together on the call of the City Planner, who shall serve as chairman, to review and study all sketch plats, preliminary plats, final plats and lot splits and to submit its findings and recommendations to the Planning Commission. 4
