HomeMy WebLinkAbout2005.12.27_Board of Adjustment AgendaMEMORANDUM TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: CBIP MCCULLEY CITY PLANNER SUBJECT: OBOA - 05-14, A REQUEST FOR A VARIANCE TO ALLOW THE ENCROACEDIENT OF A BUILDING LINE ON A PROPERTY ZONED RS-3 DATE: December 19, 2005 BACKGROUND: The City of Owasso has received an application for a variance to allow the encroachment of a building line on a property .zoned RS -3 (Residential - Single Family), located at 11201 East 121" Court North in the Country Estates VI additions. LOCATION The property is located at 11201 East 1214 Court North. A general area map is attached. EXISTING LAND USE Single Family Residence SURROUNDING LAND USE North: Residential South: Residential East: Garnett Rd West: Residential PRESENT ZONING RS -3 (Residential Single- Family) APPLICABLE REGULATIONS Owasso Zoning Code, Section 630 — Bulk and Area Requirements in Commercial Districts. ANALYSIS: The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the construction of a residence that encroaches 5' into the 25' Building Setback Line. As shown in the site drawing, the structure was constructed 5' over the eastern building line. The subject property contains a 1,800 sq R building, currently in the final phases of construction. It is the intent of Heritage Construction to complete the project and sell the residence. The staff has evaluated the request; and finds that approval of the variance will not result in any detrimental impact on the surrounding area. It is the opinion of the staff that the character of the neighborhood will not be adversely affected by granting the variance. Letters were mailed to all property owners within three - hundred (300) feet of the subject property on and the request was advertised in the Owasso Reporter. LOCATION The property is located in The Fairways III Addition at 9203 North 103`d East Avenue. A general area map is attached. EXISTING LAND USE Undeveloped SURROUNDING LAND USE North: Residential South: Residential East: Residential Nest: Residential PRESENT ZONING RS -3 (Residential Single - Family) APPLICABLE REGULATIONS Owasso Zoning Code, Section 630 — Bulk and Area Requirements in Commercial Districts. ANALYSIS The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the construction of the Single Family Residence, in The Fairways III Addition at 9203 North 103x4 East Avenue. A site map is included with you packets. The City of Owasso is requesting a variance to reduce the required 25 feet front yard setback to 20 feet in order to accommodate the structure. The City of Owasso has a 12' water transmission line that dissects the rear yard of 9203 North 103r4 East Avenue that considerably reduces the building opportunities. It is the intent of the builder to construct a structure that would fit the character of the area. Staff believes that all criteria have been met relative to the variance language in the Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the zoning; code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Letters were.mailed to all property owners within three- hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter, RECOMMENDATION Staff recommends approval of OBOA- 05 -13.
