OWASSO PLANNING COMMISSION
Thursday, September 6, 1979, 7:00 p.m.

1. Secretary Hinkle called the meeting to order at 7:10 p.m.,
2. and declared a quorum present.
ZONING PUBLIC HEARING
3. OZ -47 Charles Williams
Staff presented case history of the parcel, and indicated that the existing
zoning was CG (Commercial General) for the south portion of the tract; and
RM -1 (Residential Multi - Family) for the north portion. The applicant,
Charles Williams, was present and spoke in favor of rezoning the total
parcel to CH (Commercial Heavy). M. Hinkle asked why Mr. Williams was
wanting CH instead of CG. Mr. Williams showed the Commission a site plan
of the parcel and indicated that'he wanted to build 20' closer to 76th St.
N. which would not be allowed under CG zoning, and that a less restrictive
building floor area ratio was needed so he could build proposed future
buildings as noted on the site plan. (Staff notes that CG zoning would
easily allow the proposed future structures, provided applicant meets the
parking requirements for addition floor area).
(C. Carr entered the meeting).
E. Stevens inquired as to the north part of the parcel which encompassed
the road along the south of Barnes Elementary School. Charles Williams
noted that the land was leased to the school for 20 years, and after lease
was up he planned on utilizing it. Staff noted that commerical type
zoning should not affect a lease contract, but that staff would contact
the school as to its position on.the matter, and their plans for the area.
M. Hinkle noted her desirability in preventing access to the subject parcel
via First Street, due to the location of the elementary school.
E. Stevens asked staff the difference between CG and CH. Staff noted that
major differences were that CG required a 50' building setback from the
property line and a building floor area to land ratio of .75; while under
CH the building setback line is 30' from property line with no limits on
building coverage.
Chairman asked for Staff Recommendation which was as follows:
In November 1976, the City of Owasso initiated a zoning change
from RM -1 to CH for this area. At that time the Staff and Planning
Commission recommended CG zoning rather than CH for only the south
half. The City Council approved the rezoning with the recommended
modification.
Staff recommends that the subject parcel be rezoned to CG
rather than CH. This would provide for a logical transitional
zoning between CG to the west and CS to the east. Also, it,
would limit the floor area ratio to .75 instead of being un-
restricted and would insure compatible building setbacks with
existing development.
M. Hinkle made a motion to zone the total parcel CG. J. Simmons seconded
the motion.
For: C. Carr, M. Hinkle, J. Simmons and E. Stevens.
Against: None.
Motion passed 4 -0.
4. Staff explained to the Commission that a modification in lot -split standards
and procedures would be forthcoming via staff request and City Council
motion to better define lot -split procedures.
5. E. Stevens motioned for adjournment, J. Simmons seconded the motion. Motion
passed 4 -0 and meeting was adjourned at 8:00 p.m.
