Call to Order- Dr. Paul Loving called the meeting to order at 6:00 pm. 2. Flag Salute - Dr. Paul Loving led the flag salute. 3. Roll Call - A quorum was declared present. Consideration and appropriation action relating to an annexation (OA 22 -02) and rezoning (OZ 22 -08) of approximately 4.99 acres located at 12924 East 76th Street North from Agriculture (AG) to Residential Multi - Family (RM) Alexa Beemer presented the item, recommending approval of the annexation. Mr. Vines moved, seconded by Mr. Smith to recommend approval of the annexation and rezoning to the City Council, as recommended. YEA: Loving, Balthrop, Smith, Vines NAY: None Motion carried: 4 -0 7. Consideration and appropriation action relating to a combined preliminary/final plat for Bailey Ranch Commercial Phase I, approximately 28.45 acres located at the southwestern corner of the intersection of East 106th Street North and North Garnett Road This item was removed from the agenda at the request of the applicant. 8. Consideration and appropriation action relating to a final plat for 5th Avenue Business Park, approximately 10.48 acres located at the southwestern corner of the intersection of East Sth Avenue and North Owasso Expressway Karl Fritschen presented the item, recommending approval of the final plat. Dr. Loving moved, seconded by Mr. Smith to recommend approval of the final plat to the City Council, as recommended, subject to the following TAC comments: • Add a note to the DoD page, that sidewalks will be provided along 51h Avenue and N Owasso Expressway and the sidewalks along N Owasso Expressway may be escrowed • Show all access points to be 60' wide, rather than 40' • Add a subsection to Section II of the DOD, detailing that the developer will be responsible for the maintenance of shared area (s) prior to the Property Owners Association being formed • Remove the word "blanket" from Section LF of the DoD page and reference that there will be unobstructed lot -to -lot access. Dr. Balthrop moved, seconded by Mr. Smith to approve the lot split, as recommended. YEA: Loving, Balthrop, Smith, Vines NAY: None Motion carried: 4 -0 10. Consideration and appropriation action relating to a lot split (OLS 22 -11), approximately 0.20 acres located at 105 North Atlanta Street, is zoned Downtown Mixed (DM) and within the Downtown Overlay District Alexa Beemer presented the item, recommending approval of the lot split. The subject property is located at the northeastern corner of the intersection of East 96th Street North and North 97th East Avenue. The purpose of the partial plat vacation is to allow for the clean transfer of the subject property to two adjacent property owners. I No Water Provider I City of Owasso Applicable Pa backs I N/A ANALYSIS: • The final plat of the subject property was approved by the Owasso City Council in August of 2019. o Construction on the multi - family development situated within the platted area (Twill at Bailey Creek) began in January of 2022. The subject property has historically been used as backyard space by two adjacent property owners, as their fence lines encroach into the subject property by approximately twenty feet (20'). o This encroachment was not discovered until the owners of the subject property commenced construction on their multi - family development. Pending approval of this partial plat vacation request, the applicant intends to deed the subject property over to the two neighboring property owners, so that they may marry it to their lots and continue to use it for additional backyard space. o This vacation process ensures a clean title for the subject property, to ensure the property can be transferred smoothly. Page 2 Partial Plat Vacation- Bailey Creek • Oklahoma State Statue allows for partial plat vacations, so long as the owner of the property consents to the partial vacation. o There is only one owner involved in this vacation request; they have approved and signed the application, allowing the vacation process to move forward. • State Statute further cites that "the vacation shall operate to destroy the force and effect of the recording of the plat so vacated, and to divest all public rights in the public ways, commons, and public grounds laid out as described in the plat ". • State Statute also requires that the vacation of the plat or portion thereof in which the property is situated be approved by the local municipal body in which the plat is located. o As such, this partial plat vacation request is being brought forth for consideration by the Owasso City Council. • Any future development that occurs on the subject property must adhere to all Owasso subdivision, zoning, and engineering requirements. The subject property is located near the northeastern corner of the intersection of North 116th Street North and North 129th East Avenue. The property is approximately 6.704 acres in size and is zoned Commercial Shopping (CS) under OPUD 05 -02A. (Similar to what the MAE easement callout does). With so many lines, it's not clear what extent each text label goes to. • Should the MAE and U/E between the western jog of lots 1 & 2 touch extend south to touch lot 1 ? • Seems it sets up that legal means of access to the drive and utilities doesn't occur until east of the jog. • Does the applicant plan to close the existing drainage easements (with open channel drainage) to closed pipe with better fitting easements? • Lots 3 & 5 will need minimum FF listed since they are adjacent to FEMA floodplain. Community Development: • The zoning on the property is CS, not CG. Please change this note on the plat face. • Please show the Limits of Access to be 60', rather than 50' wide. Water Facilities: The owner of each lot shall be responsible for the protection of the public water mains located on such owner's lot and shall prevent the alteration of grade from the original contours or from any construction activity, which may interfere with said facilities. Said alteration of grade restrictions shall be limited to the easement areas. Washington County Rural Water District (RWD) No. 3 shall be responsible for ordinary maintenance of its facilities, but the owner of each lot will pay for damage or relocation of such facilities caused or necessitated by acts of the owner or his agents or contractors. RWD No. 3 shall have the right to access with its equipment to all easement ways shown on the plot for installing, maintaining, removing or replacing any portion of its underground water facilities. The foregoing covenants concerning water facilities shall be enforceable by Washington County RWD No. 3 and the owner of each lot agrees to be bound hereby. 2. Landscape and Paving Repair: The owner of each lot shall be responsible for the repair and replacement of any landscaping and paving located within the utility easements in the event it is necessary to repair any underground water mains. No lot owner shall plant any trees or shrubbery in dedicated utility easements or right -of -way which would potentially endanger, threaten or harm any water utilities located within said easements or rights -of- way. If it is determined that any trees or shrubbery located within said easements or rights -of- way are damaging or endangering utilities in said easements or rights -of -way, the District shall have the right to remove said trees or shrubbery upon five (5) days notice thereof at the lot owners expense, or within such time the lot owner may remove same.
