ty, promote good character, and provide leadership to their peers.
Jack began his scouting career within the Bear rank in Cub Scouts, Pack 888. Jack is currently a Junior at
Owasso High School and is part of Troop 2002. Service to others is an important part of the Scout Oath: "... to
help other people at all times." and each year tens of thousands of Scouts strive to achieve the coveted Ea-
gle Scout rank by applying character, citizenship, and Scouting values in their daily lives. One of the rank re-
quirements is to plan, develop, and give leadership to others in a service project helpful to a community. For
his Eagle project, Jack completed the build -out of a concrete block retaining wall on the west side of the
Owasso City Hall in an effort to decrease the amount of debris runoff into the parking lot and further eroding
of the grass embankment. This project provided both a functional and an aesthetic improvement, as well as
a savings in Owasso fax dollars.
The City Council wishes to congratulate Jack on his outstanding achievements and express their apprecia-
tion for his commitment and dedicated service to the Owasso Community.

The City of Owasso is proud to recognize persons who actively contribute to the betterment of the communi-
ty, promote good character, and provide leadership to their peers.
Trent began his scouting career with the Cub Scouts in Pack 888 at age 7. Trent is currently a Life Scout and
has completed many merit badges as well as held several leadership roles. To earn the rank of Eagle Scout,
Trent had to plan, develop, and provide leadership in a service project to help the community.
After visiting with City Staff, Trent learned that the Owasso Dog Park lacked shaded space for patrons to sit,
while visiting the park. Trent gathered his fellow troop members and completed the construction of a pergo-
la at the Owasso Dog Park. This project required clearing the land area and preparing the space for a con-
crete pad, followed by building the structure. The project took 63 hours to complete with a total of 21 peo-
ple participating.
The City Council wishes to congratulate Trent on his outstanding achievements and express their apprecia-
tion for his commitment and dedicated service to the Owasso Community.

PROCLAMATION
WHEREAS. the City of Owasso continues to explore ways to manage residential consumption of water, and to
inspire its residents to care far our natural resources; and
WHEREAS., cities can engage in efforts to inspire their own communities, as well as their neighboring cities, to
become better environmental stewards; and
WHEREAS. the 12th annual National Mayor's Challenge for Water Conservation presented by the Ryland
Foundation, with support from the US EPA WaterSense, The Toro Company, and the National
League of Cities, is a non-profit challenge to residents to encourage pollution reduction and smart
water use; and
WHEREAS. with the encouragement of their mayors, residents may register their participation in their city's
Challenge, online, by making simple pledges to decrease their water use and to reduce pollution
for the period of one year, thereby assisting their cities to apply State and Federal water
conservation strategies; and
WHEREAS. from April 1- 30, 2023, the City of Owasso wishes to inspire its residents and its neighboring
communities to take the "Wyland Mayor's Challenge for Water Conservation" by making a series
of online pledges at rnywateepledgacom to reduce their impact on the environment and,' Residents
will further be provided with tools to take specific measurable actions throughout the year to
improve the sustainable use of natural resources.
NOW, THEREFORE, THE MAYOR AND CITY COUNCIL MEMBERS OF THE CITY OF OWASSO,
OKLAHOMA, DO HEREBYPROCLAiMAS FOLLOWS.
SECTION 1. That the City of Owasso agrees with and supports the "Wyland Mayor's Challenge for Water
Conservation" emphasis; and,
SECTION 2. That the program is to be iniplemented from April 1- 30, 2023, through a series of communication and
outreach strategies to encourage Owasso residents to take the conservation "Challenge. "

The Owasso City Council met in regular session on Tuesday, March 7, 2023, in the Council Chambers at Old
Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting filed Friday, December 9,
2022; and the Agenda filed in the office of the City Clerk and posted at City Hall, 200 South Main Street, at
1:00 pm on Friday, March 3, 2023.
1. Call to Order - Mayor Kelly Lewis called the meeting to order at 6:30pm.
2. Invocation - The Invocation was offered by Pastor Scott French of Discovery Church.
3. Flag Salute - Vice Mayor Alvin Fruga led the flag salute.

8. PUBLIC HEARING - The City Council will conduct a public hearing for the purpose of receiving citizen

Juliann M. Stevens presented the item. At 6:38 pm, the Mayor opened the Public Hearing for comment.
There were no comments from the audience. At 6:39 pm, the Mayor closed the Public Hearing.
PUBLIC HEARING - The City Council will conduct a public hearing for the purpose of receiving citizen
input on a proposed amendment to the list of Capital Improvement Projects eligible for funding from
the Capital Improvements Fund to include East 86th Street North Widening from North 145th East Avenue
to North 161th East Avenue
Chris Garrett presented the item. At 6:43 pm, the Mayor opened the Public Hearing for comment. There
were no comments from the audience. At 6:44 pm, the Mayor closed the Public Hearing.

10. Consideration and appropriate action relating to the 2021 Annual Street Rehabilitation Program
Earl Farris presented the item, recommending acceptance of the project and authorization for final
payment to Becco Contractors Inc. of Tulsa, Oklahoma, in the amount of $143,523.39. There were no
comments from the audience. After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to
accept the project and authorize final payment, as recommended.

BACKGROUND:
The City Council minutes of the February 21, 2023, meeting were approved by the City Council
on March 7, 2023. An error in the minutes was recently discovered and the corrected minutes
are being submitted for City Council consideration and action.
The February 21st consent agenda included item C: Approve a budget amendment in the
Capital Improvements Grant Fund, increasing the estimated revenues and the appropriation for
expenditures by $9,894.62 for the 2022 Community Development Block Grant Hale Acres
Waterline Replacement Project.
The February 21st meeting minutes did not include the consent item C.
RECOMMENDATION:
Staff recommends approval of the amended February 21, 2023, City Council meeting minutes.

Door Replacement Project
Jason Woodruff presented the item, recommending award of the base bid to Overhead Door Company
of Tulsa, Oklahoma, in the amount of $68,500.00 and authorization to execute the agreement. There were
no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to award
the bid and authorize execution of the agreement, as recommended.

Consideration and appropriate action relating to bids received for the East 116th Street North Roadway
Improvements from Mingo Road to Garnett Road
Daniel Dearing presented the item, recommending award of the construction contract to Crossland Heavy
Contractors, Inc., of Tulsa, Oklahoma, in the amount of $17,387,000.00, and authorization to execute all
necessary documents. There were no comments from the audience. After discussion, Mr. Bush moved,
seconded by Mr. Bonebrake to award the construction contract and authorize the execution of
documents, as recommended.

10. Consideration and appropriate action relating to the agreement for the purpose of leasing various City fleet
vehicles
Chris Garrett presented the item, recommending approval of an Open -End (Equity) Lease from Enterprise
Fleet Management, Inc., of Clayton, Missouri, for a lease period of forty -eight months, contingent upon
annual appropriations by the City Council, and authorization to execute the necessary documents to lease
two (2) 2023 GMC Siena 250OHD pickup trucks at a lease rate of $1,026.75 per month, per vehicle. There
were no comments from the audience. After discussion, Mr. Dunn moved, seconded by Mr. Bonebrake to
approve the lease and authorize the execution of documents, as recommended.

BACKGROUND:
On January 5, 2010, the City Council adopted Ordinance 960, approving annexation request
OA 09 -06 of approximately five (5) acres located at the southeast corner of East 106th Street
North and North 145th East Avenue. A scrivener's error has been discovered within the
document, describing the property as being located within Tulsa County. The appropriate
location should read Rogers County.
AMENDED ORDINANCE:
This type of error is corrected by adoption of a Nunc Pro Tunc ordinance which is literally
translated from Latin as "now for then." Staff has drafted an amended ordinance to correct the
property location to read Rogers County.
Upon City Council adoption, the corrected ordinance will be filed with the Rogers County
Clerk's office, thereby replacing Ordinance 960.
RECOMMENDATION:
Staff recommends adoption of the Ordinance 960 Nunc Pro Tunc.

SECTION 15, TOWNSHIP 21 NORTH, RANGE 14 EAST OF THE I.B. & M,
ROGERS COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE U.S.
GOVERNMENT SURVEY THEREOF, PROVIDED THAT FROM AND
AFTER THE PASSAGE AND PUBLICATION OF THIS ORDINANCE THAT
ALL OF THE REAL PROPERTY WITHIN SAID TERRITORY HEREIN
DESCRIBED SHALL BE A PART OF THE CITY OF OWASSO,
OKLAHOMA, AND FURTHER DECLARING THAT ALL PERSONS

than three- fourths (in value) of the property hereinafter described, the same being contiguous to
the corporate limits of the City of Owasso, requesting that said property be annexed and added to
the City of Owasso is submitted; and,
WHEREAS, notice of the presentation of said Petition was given by the Petitioner by
publication in the Owasso Reporter, a newspaper of general circulation published in the City of
Owasso, Oklahoma, and notice was given that said Petition would be considered by the City
Council of the City of Owasso, at a meeting to be held on December 15, 2009 at 6:30 PM at Old
Central, Owasso, Oklahoma; and,
WHEREAS, on the 15'h day of December, 2009, said Petition was duly considered by the
City Council and was determined to have complied with the provisions of Title 11, Section 21-
103, et seq., of the Oklahoma Statutes, and further, that proper legal notice of presentation of
said petition had been given.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA,
Section 1. That the following described territory lying in Rogers County, Oklahoma
which is contiguous to the present corporate limits of the City of Owasso and described in the
petition presented to the City Council in accordance with the provisions of Title 11, Section 21-
103, et seq., of the Oklahoma Statutes, and more particularly described as follows, to -wit:

thereon, shall be and are hereby declared to be subject to the jurisdiction, control, laws, and
ordinances of the City of Owasso, Oklahoma, in all respects and particulars.
Section 3. All ordinances, or parts of ordinances, in conflict with this ordinance are
hereby repealed to the extent of the conflict only.
Section 4. If any part or parts of this ordinance are deemed unconstitutional, invalid
or ineffective, the remaining portion shall not be affected but shall remain in full force and effect.
Section 5. The provisions of this ordinance shall become effective thirty (30) days
from the date of final passage as provided by state law.
Section 6. That there be filed in the office of the County Clerk of Rogers County,
Oklahoma, a true and correct copy of this Ordinance, together with an accurate map of the
territory hereby annexed.

infrastructure improvements consist of concrete approaches and sidewalks.
FINAL INSPECTIONS:
Final inspections for the infrastructure components were completed in March 2023, by the Public
Works Department. All standards for acceptance have been met. Additionally, the construction
contractor has supplied the necessary two-year maintenance bond.
RECOMMENDATION:
Staff recommends acceptance of the public infrastructure improvements located at 11610 North

BACKGROUND:
Oklahoma Municipal Retirement Fund (OkMRF), the retirement plan for employees who do not
participate in the State Police or State Fire pension plans, requires the City Council acting as the
OkMRF Retirement Committee to approve applications for retirement.
To be eligible for retirement benefits through OkMRF an employee must have a minimum of five
years of employment. Once an employee has five years of service the employee is considered
vested and upon leaving employment with the City has three options depending upon age.
1. Normal Retirement is available to a vested employee age 65 or older, or age 62 with
thirty years of service.
2. Early Retirement is available to a vested employee between ages 55 and 65.
3. Deferred Retirement is available to a vested employee under the age of 65. Deferred
Retirement allows an employee to "defer" retirement benefits until a future date, at
which time the employee would begin receiving monthly retirement benefits.
March 10, 2023, was the last day of employment for Ronald Vaughan, Public Works Water
Division. Mr. Vaughan was a participant in the OkMRF retirement plan while employed with the
City since June 2006. Mr. Vaughan is vested and has applied for, and meets the prerequisites for
Early Retirement.
RECOMMENDATION:
Staff recommends approval of Early Retirement benefits for Ronald Vaughan.

BACKGROUND:
During the March 2023 Worksession meeting, the City Council discussed renewing a contractual
agreement to provide professional services to execute the City's Economic Development
Strategic Plan in exchange for a fee. The proposed agreement contains a clear set of contracted
services directly drawn from the Economic Development Strategic Plan.
COMPENSATION FOR SERVICES:
The proposed renewal term would start on April 1, 2023, and expire on March 31, 2023. The
compensation for services would remain at $230,000.00.

OWASSO CHAMBER OF COMMERCE ( "Chamber "), a non - profit business organization
incorporated under the laws of the State of Oklahoma, with its principle office within the limits
of the City of Owasso, Oklahoma.
AGREEMENTPREAMBLE
WHEREAS, the City of Owasso and its citizens benefit from the existence of retail
business, industry, commerce, and the positive impact on the economy of the City and its citizens;
and,
WHEREAS, the preservation and expansion of existing industry, commerce and
businesses is in the best interest of the economic well -being of the City of Owasso, its business
community, and its citizens; and,
WHEREAS, workforce education and development; support of all local businesses; and
legislative advocacy efforts serve to enhance the business and economic development
environment of Owasso; and,
WHEREAS, the attraction of new industry, commerce and businesses is important to the
economic well -being and economic development of the City of Owasso and its citizens; and,
WHEREAS, the economic well -being of the City of Owasso is essential to increase the
revenue of the City of Owasso for the benefit of its citizens; and,
WHEREAS, the preservation and stimulation of economic development is a proper public
purpose for which public funds may be expended to promote the general health, safety and welfare
of the citizens of the City of Owasso; and,
WHEREAS, the Owasso Chamber of Commerce is a non - profit organization of Owasso
businesses, people, and concerned citizens of Owasso, working cooperatively to promote an
environment that attracts, creates, and enhances business and economic growth and development
for the City of Owasso and its citizens; and,
WHEREAS, both the City of Owasso and Chamber recognize the opportunity for a
consolidated, pro- active approach to promote economic development in the City of Owasso; and,
WHEREAS, the City is desirous of contracting with the Chamber to promote and execute
the City of Owasso's Economic Development Strategic Plan to create enhanced value and
opportunity for the City and its citizens.
NOW, THEREFORE, in consideration of the covenants and mutual promises stated in this
Agreement, and in furtherance of the above recitals, the City and Chamber agree as follows:
TERMS OF THE AGREEMENT
1. VALID CONSIDERATION. The City contracts with Chamber to perform certain
economic development services for the benefit of the City, and the Chamber accepts such
engagement, pursuant to the Terms of the Agreement. Both the City and Chamber acknowledge
and agree that mutual valid consideration is provided by each party to the other under this
Agreement.
2. SCOPE OF SERVICES. The scope of services to be provided by the Chamber under
this Agreement includes, but is not limited to, the following:
A. Partnering with the City to make the most efficient use of the City and
Chamber's combined economic development resources and abilities;
B. Executing the City of Owasso Economic Development Strategic Plan to
strengthen Owasso's value proposition, grow and recruit businesses to
Owasso, and to market Owasso to promote, stimulate, and encourage the
growth and development of the retail, commercial and industrial resources
within the City of Owasso;
C. Regularly reviewing and recommending updates to the City of Owasso
Economic Development Strategic Plan for comprehensive economic
development within and near City of Owasso fence -line;
D. Developing plans, when necessary, to help preserve jobs for the citizens of
Owasso, and to promote and create new jobs and new employment
opportunities;
E. Promoting advocacy by providing education and information about issues,
policy, and legislation affecting the City of Owasso;
F. Expanding the economic base of Owasso by seeking diversification of
employment opportunities;
G. Encouraging and assisting existing industry to maintain or expand
employment opportunities;
H. Implementing an aggressive marketing program, as funds permit, to attract
new investment to Owasso;
I. Providing marketing materials as appropriate, commensurate with funding,
to those individuals and entities evaluating Owasso for future and further
investment and resulting economic impact;
Developing, programming, coordinating, and hosting Owasso's annual
Economic Summit;
K. Administering the Redbud District website and coordinating marketing and
development efforts within the Redbud District;
L. Performing such other economic development duties as are necessary to the
benefit of Owasso and the market area.
3. PROPER STAFFING. The Chamber shall provide all necessary administrative
support to carry out the duties set forth in above Paragraph 2 and its sub -parts, including but not
limited to adequate staff, office space, and equipment within the context of its funding and budget.
4. SEPARATE F+NTITY ACKNOWLEDGEMENT. The City and Chamber acknowledge
that the Chamber is its own separate legal entity which operates independently, and is governed
by its own Board of Directors and corporate by -laws. The Chamber is not an extension or advisory
board of the City of Owasso, and it is expressly understood and agreed that in the performance of
its duties under this Agreement, the Chamber is acting as an independent contractor of the City,
and not as an agent of the City.
5. COMPENSATION FOR SERVICES. In exchange for the economic development
services provided under this Agreement by the Chamber, the City agrees to compensate and
provide the Chamber as follows:
A. The City shall pay the Chamber an annual amount of Two Hundred Thirty
Thousand Dollars ($230,000), payable monthly in equal 1/12 installments,
dependent upon the continued employment of Chelsea Levo Feary as the
President -Chief Executive Officer of the Chamber. If, for any reason,
Chelsea Levo Feary ceases to hold this position with the Chamber prior to
the expiration of the one -year term of this Agreement, this Agreement shall
immediately terminate. Notwithstanding the above, the City shall pay the
monthly amount described herein for a full two (2) month period following
any such termination. In addition, the City and Chamber may enter into a
new agreement subsequent to the hiring of a new Chamber President -Chief
Executive Officer, if both parties are desirous of continuing the contractual
relationship contemplated in the Agreement.
B. It is understood that prospects for commercial or industrial development
projects may request information of the Chamber about development
guidelines or possible incentives. The Chamber President -Chief Executive
Officer will accommodate all such requests by directing potential
developers /investors to the appropriate City of Owasso contacts and/or will
guide all such prospects to file application for any incentives through the
City's incentive application process. The Chamber may use its own cash
reserve balance to provide incentives with no direction from the Owasso
City Council.
C. The City and Chamber may consider jointly participating together in the
pursuit and funding of economic development infrastructure grants and
developments, at the discretion of Chamber and the City. For grants in
which the allocated funding is limited to design or engineering costs, the
Chamber shall bear sole responsibility for any matching portion required
under the terms of the grant and shall receive the full amount of the grant.
D. The Chamber shall be responsible for providing requested information or
documentation regarding any grant or incentive involving the City.
E. The City may allow the Chamber to use available City Hall space, when
necessary and available, to host meetings or gatherings in furtherance of
the Chamber's economic development efforts on behalf of Owasso and its
citizens.
F. As additional compensation, the City will:
1. lease the building currently leased by the Chamber, at the below
market rate of Six Hundred Fifty -Eight Dollars and Thirty -Three Cents
($658.33) per month; and,
2. financially contribute (in lieu of Chamber membership dues)
towards the City and Chamber's joint participation in the Tulsa Home and
Garden Show in the amount of $1,500.00.
6. FINANCIAL DISCLOSURE. The Chamber shall continue to be solely responsible for
the maintenance of its full books of accounts with correct entries of all expenditures in the
administration of this Agreement and its normal business operations. The Chamber's books of
accounts shall remain the property of the Chamber. The Chamber shall continue its practice of
engaging an independent accountant to perform an annual financial audit and prepare a written
report of the same, which report shall be open to the inspection of the City upon reasonable notice.
7. STATUS UPDATES. The Chamber President -Chief Executive Officer shall provide
monthly updates to the City Manager or his/her designee and quarterly presentations to the
Owasso Economic Development Authority regarding economic development activities and the
Chamber's progress in meeting the goals and objectives identified in Paragraph 2 of this
Agreement. The Chamber President -Chief Executive Officer shall make an annual presentation
to the City Council. The Chamber President -Chief Executive Officer may also be called upon and
will make additional presentation(s) to the City Council, only if deemed necessary by the City
Manager.
8. ANNUAL WRITTEN REPORT. The Chamber shall furnish an annual detailed written
report ( "Annual Report") to the City which states accurately the progress made in implementing
the goals and objectives outlined under this Agreement. The President -Chief Executive Officer of
the Chamber shall present the Annual Report to the City Council as deemed necessary by the City
Manager, and will be prepared to discuss the Report with the City Council, to explain the
Chamber's economic development activities under this Agreement.
9. HOLD HARMLESS. The Chamber assumes full and complete liability for the
actions of its officers, employees, and agents, and agrees to hold the City harmless from any claim
for damages resulting from the actions of Chamber, its officers, employees, and agents.
10. CHAMBER BOARD OF DIRECTORS. The Mayor of the City may appoint himself or
herself, or a fellow member of the City Council of the City, to serve as a voting member of the
Board of Directors of the Chamber for a term comprising the length of this Agreement. The City
Manager of the City shall continue to serve as a non - voting, ex- officio member of the Board of
Directors of the Chamber, in a representative capacity on behalf of the City and the Owasso
Economic Development Authority. The City Manager shall not cast any vote, but shall serve in
an advisory capacity and as a full participant in Board discussions.
11. LEGAL. COMPLIANCE, The Chamber agrees to take any steps necessary to amend
its by -laws, if necessary, to comply with its duties and obligations under this Agreement. The City
enters into this Agreement under authority of OKLA. STAT. tit. 11, §22 -101.
12. TERM. The term of this Agreement is for one year ( "Agreement Term "). At least
90 days prior to the expiration of the Agreement Term, designated representatives of the City and
Chamber shall meet and confer regarding the desirability of entering into a new one -year
agreement, and, if necessary, will review and consider any proposed or necessary substantive
changes to effectuate the official consideration and adoption of a new one -year agreement in a
timely fashion.
13. AMENDMENTS. The Agreement may be amended from time to time by the mutual
agreement of the City and Chamber, in writing. Any amendment shall become effective when
approved and executed by the governing bodies of the City and Chamber.
14. OFFICIAL. NOTICE. Written notices required or authorized by this Agreement shall
be deemed properly given or served on the City if mailed via certified mail, return receipt
requested, to the City at the following address, City of Owasso, ATTN: City Manager, 200 South
Main Street, Owasso, OK 74055, and to the Chamber at the following address, Owasso Chamber
of Commerce, ATTN: Chamber President, 315 South Cedar Street, Owasso, OK 74055.
15. NON - DISCRIMINATION. The City and Chamber covenant and agree that (1) no
person on the ground of race, color, sex, religion, national origin, age (40 +), or disability shall be
excluded from participation in, denied the benefit of, or otherwise be subjected to discrimination
under the terns of this Agreement; and (2) that in carrying out the terms and conditions of this
Agreement, no person shall be subjected to discrimination on the basis of their inclusion in one
of the aforementioned classes protected under federal law.
16. LEGAL, COMPLIANCE. The Chamber agrees to conduct its business under this
Agreement in compliance with federal, state, or local laws, ordinances, or regulations applicable
to the conduct of its operations under the terms of this Agreement.
17. CONTRACT INTERPRETATION. The City and Chamber acknowledge that they have
mutually participated in drafting this Agreement; have reviewed the terms of this Agreement with
their respective legal counsel; and, accordingly, agree that the rule of contract interpretation (that
contracts shall be construed against the drafter) does not and shall not apply in the event of any
dispute requiring the interpretation and enforcement of this Agreement.
18. SURVIVAL CLAUSE. In the event any provision or portion of a provision of this
Agreement is found by a court of competent jurisdiction to be void, voidable, or for any reason

unenforceable, the City and Chamber agree that the remaining portions shall remain in full force
and effect.
19. MULTIPLE SIGNATURE PAGES. This Agreement may be executed in duplicate
counterparts, each of which shall be deemed an original.
20. CHOICE OF LAW AND VENUE. This Agreement is governed by the laws of the State
of Oklahoma. The City and Chamber agree that jurisdiction and venue for any dispute between
the parties or arising under this Agreement shall be exclusively in the state or federal courts
serving Tulsa County, Oklahoma.
21. NON - ASSIGNABILITY. This Agreement is non - assignable.

The Community Development Department received a Planned Unit Development (PUD)
application (OPUD 23 -03) for The Vintage at Redbud, a proposed multifamily development
located near the southwestern corner of West 2nd Street and North Atlanta Street. The subject
property is approximately 0.48 acres in size, and is currently zoned Residential Multifamily (RM)
and is within the Downtown Overlay District.

CONCEPT OF A PUD:
• A PUD is a development concept that allows for greater creativity and flexibility than
typically allowed under traditional zoning and planning practices.
For example, PUDs often allow developers to place different zonings and land
uses in close proximity to each other.
Developers may also have more flexibility in certain aspects of development,
such as building setback requirements and building height limitations, which can
be more restrictive in standard zoning districts.
A PUD should not be considered as a tool to circumvent the City's Zoning Code and
Subdivision Regulations. All aspects of the PUD application are subject to public
comment as well as consideration and approval from the Community Development
Department, the Owasso Technical Advisory Committee, the Owasso Planning
Commission, and the Owasso City Council.
PUD applications presented to the Planning Commission and City Council are for
approval of the uses and the overall conceptual development plan as it relates to the
context of the surrounding area.
GROWASSO 2035 LAND USE MASTER PLAN CONSISTENCY:
• The GrOwasso 2035 Land Use Master Plan is a document that acts as a moderately flexible
tool for evaluating development proposals.

• The GrOwasso 2035 Land Use Master Plan identifies the property as within the Redbud
District which represents an area targeted for future higher density housing uses,
including multifamily uses, so the proposed development is in keeping with the uses
called out for this location.
ANALYSIS:
• The conceptual development plan submitted for OPUD 23 -03 states that the applicant
intends to construct seven (7) duplex apartment buildings, for a total of fourteen (14)
dwelling units. However, the OPUD 23 -03 document proposes a maximum of sixteen (16)
dwelling units, offering a small amount of flexibility in the final design and density of the
property.
• Per Section 10.12.17 of the Owasso Zoning Code, a PUD overlay is required for all
multifamily developments in excess of six (6) dwelling units within the Downtown Overlay
District.
• The conceptual development plan limits the proposed development to one (1) curb cut
off of East 2nd Street. The applicant is considering rear access and additional street
parking.
o All portions of the subject property are currently platted, but will be required to be
replotted to reflect this new multifamily use. The exact location of said access
point will be determined at the replotting phase.
• A screening fence will be required to be located adjacent to any single - family uses, in
order to adequately screen the subject property from said residential uses.
• The conceptual site layout shows street parking along East 2nd Street as well as an
internal parking lot.
• A fully detailed landscape plan will be required to be submitted for City staff approval at
the time of site plan review for the development. All landscaping and off - street parking
will be required to meet the requirements identified in the Owasso Zoning Code.
• The City of Owasso will provide police, fire, ambulance, water and sanitary sewer
services to the subject property.
• Pending rezoning of the property, the applicant will need to submit both a replat and site
plans for the development on the property.
• Any development that occurs on the subject property shall adhere to all subdivision,
zoning, and engineering requirements of the City of Owasso.

PLANNING COMMISSION:
At their regular meeting on March 13, 2023, the Owasso Planning Commission voted 3 -0 to
recommend amending the parking requirements within OPUD 23 -03 to one (1) parking space
required per dwelling unit, in addition to the required on- street parking.
After approval of the aforementioned amendment, the Owasso Planning Commission voted 3 -0
to recommend approval of Planned Unit Development proposal OPUD 23 -03, with the amended
parking requirements.
RECOMMENDATION:
In developing a recommendation, staff evaluated the PUD's ability to accomplish the following,
as described in Section 9.1.2 of the Owasso Zoning Code:
• Maintain and enhance the quality of life in Owasso;
• Provide opportunities for urban infill;
• Maintain and promote a sense of community;
• Encourage development that otherwise could not occur on the site;
• Preserve and provide meaningful open space;
• Promote connectivity and compatibility with surrounding development;
• Inspire unique and thoughtful development;
• Support the development of strong neighborhoods;
• Provide amenities beyond conventional development; and
• Preserve the physical characteristics of the land.
Following this evaluation, staff concluded that the subject PUD meets all legal requirements for
approval.
As such, staff recommends adoption of Ordinance 1205.

DEVELOPMENT CONCEPT
The Vintage at Redbud is a proposed Planned Unit Development (PUD) consisting of 0.48 acres
in Owasso, Oklahoma. The property is located 250 feet west of intersection of W. 2nd Street and
N. Atlanta St. The site is generally characterized by relatively flat terrain sloping north to south.
There is currently no floodplain located onsite according to the FEMA Floodplain Maps. The site
will be control with localized drainage structures to control the storm water onsite in the post
developed conditions. Soil types found on -site are typical for the area and create no unusual
development problems that are not commonly encountered in most other area developments.
Overall, this site has excellent development possibilities due to its gentle terrain.
The Vintage at Redbud will feature Duplex Apartments Buildings within the lotted area. These
apartment buildings will be spaced throughout the site appropriately, maximizing green space
and parking. The development is consistent with the surrounding properties, with apartment
buildings in the north, east, and south adjoining properties. This PUD will help the subject
property be feasible for this development allowing for densities but protecting the neighborhood
feel within the area.

Architectural:
Design shall evoke a modern architectural and landscape expression while providing users
with a variety of activities and opportunities. The geometry, composition, and final
articulation is to be based on a simple elegance of architectural details and style, but with
the utilization of a limited number of textures and material palettes. The overall goal is to
balance the use of buildings, paths, and parking areas with natural landscaping and water
features in an ecological and natural systems sensitivity while providing users with an
environment that provides the best design principles of simplicity, balance, unity, scale,
variety, and convenience.
LANDSCAPE REQUIREMENTS
The Landscaping concept is intended to achieve unity throughout the PUD as well as provide
an attractive view of the project from surrounding streets and neighborhoods. To achieve
continuity throughout the PUD, reference Chapter 10 and 19 of the City of Owasso Zoning Code.
Prior to the issuance of an occupancy permit for a development area, plant materials and any
required screening fences shall be installed in conformity with a detailed landscape plan which
will have been submitted to and approved by the City of Owasso.

SIGNAGE
The Development proposes one 6 -foot monument sign shall be allowed internally in the
development and its location and placement will be determined at the time of platting and site
plan review. Except as noted herein, all signs shall conform to the current Owasso Sign
Ordinance of the Owasso Zoning Code (Chapter 18).
Signage must be back lit or have lights pointing directly at the sign. No video signage will be
allowed. All signage must be set in a landscape base
PLATTING REQUIREMENTS
No Building permit shall be issued until the property has been included within a subdivision plat
submitted to and approved by the Owasso Planning Commission and the Owasso City Council
and duty filed of record, provided, however, that development areas may be platted
separately. Restrictive covenants shall be established implementing of record the
Development Concept and Development Standards, and the City of Owasso shall be made a

BACKGROUND:
The Community Development Department received a Planned Unit Development (PUD)
application (OPUD 23 -02) for The Reserves at Owasso, a proposed mixed-use development
located at the northwestern corner of the intersection of East 106th Street North and North 145th
East Avenue. The subject property is approximately 51.66 acres in size, and is currently zoned
Residential Multifamily (RM) and Commercial Shopping (CS). A separate rezoning request (OZ
23-02) has been concurrently filed with this PUD request, requesting that additional CS zoning
and the Office (0) zoning designation be added to the property.

CONCEPT OF A PUD:
A PUD is a development concept that allows for greater creativity and flexibility than
typically allowed under traditional zoning and planning practices.
o For example, PUDs often allow developers to place different zonings and land
uses in close proximity to each other.
o Developers may also have more flexibility in certain aspects of development,
such as building setback requirements and building height limitations, which can
be more restrictive in standard zoning districts.
A PUD should not be considered as a tool to circumvent the City's Zoning Code and
Subdivision Regulations. All aspects of the PUD application are subject to public
comment, as well as consideration and approval from the Community Development
Department, the Owasso Technical Advisory Committee, the Owasso Planning
Commission, and the Owasso City Council.
PUD applications presented to the Planning Commission and City Council are for
approval of the uses and the overall conceptual development plan as it relates to the
context of the surrounding area.

GROWASSO 2035 LAND USE MASTER PLAN CONSISTENCY:
The GrOwasso 2035 Land Use Master Plan is a document that acts as a moderately flexible
tool for evaluating development proposals.
The GrOwasso 2035 Land Use Master Plan identifies the property for future commercial
land uses. As such, the proposed mixed -use development is in keeping with the long -
range vision for this location, as commercial, office, and multifamily zonings are all
considered allowed within a "commercial" designation in the GrOwasso 2035 Land Use
Master Plan.
ANALYSIS:
• The subject property was annexed into Owasso City Limits with Ordinance 961 in 2010,
and was zoned Residential Multifamily (RM) in 2021 with Ordinance 1188.
• The conceptual development plan submitted for OPUD 23 -02 states that the applicant
intends to construct a true mixed -use development, comprised of six (6) distinct
development areas and one (1) common area.
• Development Area "A ", adjacent to US -169, is proposed to be a standalone
commercial tract. The zoning of this area will remain CS.
• Development Area "B ", located off of North 137th East Avenue, is proposed to be
general office or commercial, specifically hospitality - related; it is proposed to be
rezoned CS under OZ 23 -02.
• Development Areas "C" and "D ", located along East 1061h Street North, are both
proposed to be general office or commercial. These areas are proposed to be
rezoned O and CS, respectively, under OZ 23 -02.
• Development Area "E ", located on the northern portion of the property, is
proposed to be developed into apartments, with a gross density of 18.8 dwelling
units per acre. The zoning of this area will remain RM.
• Development Area "F", located on the interior of the property, is proposed to be
developed as a storage facility. This area is proposed to be rezoned CS under OZ
23 -02.
In order to accommodate the proposed use outlined in this PUD proposal, the base
zoning must be changed to a designation that allows for additional commercial and
office uses.
o As such, the applicant is requesting that portions of the property be assigned a
zoning designation of either CS and O, in addition to keeping portions of the
property zoned RM.
• The OPUD 23 -02 document lists several anticipated amenity features for the development,
including a sports field, basketball court, corn hole / bag toss, open green space,
clubhouse, BBQ area, swimming pool, and playground.
Additionally, the OPUD 23 -02 document also states that all applicable landscaping and
screening requirements from Ch. 10 and Ch. 19 of the Owasso Zoning Code will be met.
o This includes minimum 6' privacy fences and adequate buffer yards along the
boundaries of the proposed storage use in Development Area "F".
o A fully detailed landscape plan will be required to be submitted for City staff
approval at the time of site plan reviews for each development. All landscaping
and screening will be required to meet the requirements identified in the Owasso
Zoning Code.

Nine (9) total points of access are depicted on the OPUD 23 -02 conceptual development
plan. The exact location of each access point will be determined at the platting stage.
o Development Area "A" will be allowed one (1) access point off of North 137th East
Avenue.
o Development Areas "C ", "D ", and "E" will be allowed a total of four (4) access
points off of East 106th Street North, to be shared amongst the various parcels within
the three development areas.
o Development Areas "B" and "C" will be allowed a total of two (2) access points off
of North 137th East Avenue, to be shared amongst the various parcels within the two
development areas.
o Development Areas "D" and "F" will be allowed a total of two (2) access points off
of North 145th East Avenue, to be shared amongst the various parcels within the two
development areas.
The City of Owasso will provide police, fire, ambulance, and sanitary sewer services to
the subject property. Washington County Rural Water District #3 will provide water
services to the subject property.
• Pending rezoning of the property, the applicant would need to submit preliminary and
final plats, as well as site plans, for all of the property.
Any development that occurs on the subject property shall adhere to all subdivision,
zoning, and engineering requirements of the City of Owasso.

PLANNING COMMISSION:
The Owasso Planning Commission voted 3 -0 to recommend approval of Planned Unit
Development proposal OPUD 23 -02 and subsequent rezoning request OZ 23 -02.
RECOMMENDATION:
In developing a recommendation, staff evaluated the PUD's ability to accomplish the following,
as described in Section 9.1.2 of the Owasso Zoning Code:
• Maintain and enhance the quality of life in Owasso;
• Provide opportunities for urban infill;
• Maintain and promote a sense of community;
• Encourage development that otherwise could not occur on the site;
• Preserve and provide meaningful open space;
• Promote connectivity and compatibility with surrounding development;
• Inspire unique and thoughtful development;

• Preserve the physical characteristics of the land.
Following this evaluation, staff concluded that the subject PUD meets all legal requirements for
approval.

I. Development Concept
The Reserves at Owasso (the "Development ") is a proposed 150.53 acre mixed use
development located on the northwest corner of the intersection of North 145th East Avenue
and East 106th Street North (the "Subject Propert y "). The Subject Property has (a)
approximately 340 LF of frontage along North 145th East Avenue and (b) approximately
2,300 LF of frontage along East 106th Street North.
The Subject Property is abutted:
(a) on the north by the Owasso campuses of Tulsa Tech and Tulsa Community
College which are zoned O (Office);
(b) on the east (adjacent tract) by an undeveloped tract zoned RM (Residential
Multi - Family) / OPUD-16-06;
(c) on the east (across North 145th East Avenue) by an undeveloped tract zoned
CG (Commercial General);
(d) on the south (across East 106th Street North) by (i) a gas station and bank
zoned CS (Commercial Shopping), (ii) a church zoned RS -3 (Residential
Single Family), and (iii) a multifamily facility zoned RM (Residential
Multi - Family); and
(e) on the west by the US -169 right of way zoned AG (Agriculture).
The Subject Property is characterized by fairly flat terrain, with drainage generally flowing
from the southwest to the northeast (See Exhibit "E" — Existing Conditions Plan). There
is no on -site FEMA 100 -year floodplain or USACE jurisdictional wetlands.
The size and layout of the Subject Property (as partially constrained by certain easements)
and variety of anticipated uses lends itself to the creation of a multi - parcel development
which would best be developed under the umbrella of a PUD.
The soil types found on the Subject Property site are typical for the area and should pose
no unusual developmental problems. The location of the PUD has very favorable
accessibility, location and visibility from surrounding roadways.
The Development will feature six (6) distinct land uses and development areas including
(i) a standalone commercial tract near the US -169 frontage that will likely be developed as
a bank, gas station, or automotive repair / service facility, (ii) commercial shopping, general
office or medical, and / or hotel tracts along North 137111 East Avenue, (iii) two commercial
shopping and/or general office or medical tracts along East 106th Street North, (iv) a multi-
family tract located to the interior and north side of the Subject Property, and (v) a
commercial / office / storage facility tract located on the interior of the Subject Property
with access from North 145th East Avenue. The Development will feature also contain one
"common area" which shall serve as a green belt and storm water detention / retention areas
as well as other "open space" type uses.

Access into the Subject Property will be from North 145th East Avenue, East 106th Street
North, or the frontage road that runs parallel to US -169. The access points into the
commercial ( office tracts are conceptually as shown on Exhibit "A "' — Conceptual Site
Plan) and will finalized during the plat approval process. All internal drives will be
privately owned and maintained.
The plat of the Development East will include internal mutual access easements across and
between Development Areas B, C, and D and across the entrance drive on East 106th Street
North in Development Area E.
It is anticipated that the Development may be developed in multiple phases, with
development commencing as soon as the appropriate approvals have been received.

Districts, US -169 Overlay District" of the City of Owasso Zoning Ordinance.
Prior to final permitting approval for a particular lot, the owner shall submit a landscape
plan along with its proposed site plan for review and approval by the City of Owasso in
accordance with "Chapter 19 — Landscaping, Screening and Fencing Requirements" and
"Chapter 10 — Overlay Districts, US -169 Overlay District" of the City of Owasso Zoning
Ordinance.
XI. US -169 Overlay District
The PUD site is located in the US -169 Overlay District and shall meet all requirements of
"Chapter 10 — Overlay Districts, US -169 Overlay District" of the City of Owasso Zoning
Ordinance.
XII. Sidewalks
All sidewalks will meet the City of Owasso Zoning Ordinance and Subdivision
Regulations.
XIII. Sign Standards
Unless otherwise noted, signs shall be installed in accordance with "Section 10.6 14
Signage" of the Owasso Zoning Ordinance and the US -169 Overlay District.
For any sgnage other than as identified herein or allowed by Chapters 10 and 18 of the
Owasso Zoning Code, a Unified Sign Plan shall be required for any such additional / larger
signs without need of amendment to OPUD- 23 -02.
XIV. Schedule of Development
The initial development of The Reserves at Owasso is expected to commence after final
approval of the PUD, the platting of the property, and site plan approval.

XV. Right of Way Dedication
It is anticipated that additional right -of -way may need to be dedicated along public ways.
Such dedication shall be accomplished by way of the plat of the development.
XVI. Access Points
All access points within the development shall be shown on and approved as part of the
plat process and must conform to Owasso Zoning Code and City of Owasso engineering
criteria. In furtherance thereof.
Development Area "A" shall be limited to one (1) access point on North 137"' East
Avenue.
Development Area `B ", Development Area "C ", and Development Area "E" shall
be together allocated a total of two (2) access points on North 137th East Avenue.
Development Area "C ", Development Area "D ", and Development Area `B" shall

SUBJECT: Resolution 2023 -02, Project Application Community Development Block Grant
(CDBG 2023)

BACKGROUND:
The primary objective of the national Community Development Block Grant (CDBG) Program, is the
"development of viable urban communities by providing decent housing and a suitable living
environment, particularly for persons of low and moderate incomes." All project proposals submitted
for funding through the CDBG Program must document the achievement of at least one (1) of the
following national objectives:
Provide benefit to low- and moderate - income persons;
Aid in the prevention or elimination of slums or blight; and
Meet other community development needs having particular urgency or posing a serious or
immediate threat to the health or welfare of a community.
ANTICIPATED FUNDING:
On February 6, 2023, the Indian Nation Council of Governments (INCOG) provided information
regarding the 2023 CDBG application. The completed application is due no later than April 10, 2023.
Owasso is a part of an Urban County and as such does not compete for the funding through the
State Department of Commerce. According to INCOG, Owasso will receive an estimated allocation
of $159,894.62 for the FY 2023 CDBG funding cycle. The grant does not require a local match.
HISTORY:
In the past, the City of Owasso has utilized CDBG monies for sidewalk, sanitary sewer, street, and park
improvements. In 2014, Housing of Urban Development (HUD) changed the income limits that
determined if individuals and families qualified as a low to moderate income household. HUD's
formula used Census Tracts as the geography to determine if an area qualifies or does not. As a
result, Owasso lost most of its qualifying Census Tracts, with the exception of the Baptist Village area.
Due to the income limit change, communities were left to conduct door to door surveys to qualify
smaller geographic areas within the larger Census tracts.
In 2016, staff conducted a door to door survey in the Hale Acres neighborhood near North Garnett
Road and East 116th Street North. The data collected from this survey met the income requirement
thresholds and allowed the neighborhood to qualify for CDBG funds. The surveys are only good for
5 -year periods, and therefore in the late winter of 2021, staff performed a second door to door survey
in the Hale Acres neighborhood. The survey results again met the income limit thresholds allowing
the area to be re- qualified for another 5 -year period. Since 2017, the City has used its CDBG
allocation to replace most of the sanitary sewer lines in this neighborhood.
With this allocation of funds, staff proposes to install a new 6" PVC water line along North 106th East
Avenue and a new 6" PVC water line along North 112th East Avenue. The project begins at the
western boundary of the subdivision and ends at North Garnett Road to the east and will improve
water pressure and fire flow in this area.

PUBLIC HEARING:
Staff consulted with INCOG regarding the requirement of holding a separate Public Hearing and was
informed that "since the project is a continuation of the some activity that the City has been doing
for several years in the some location, then no separate Public Hearing is required ".
PROPOSED FY 2023 PROJECT:
In the second half of 2022, the City plans to begin work on replacing the first of many water lines
within said neighborhood, along East 112th Street North. With this 2023 allocation of funds, staff
proposes to install one thousand three hundred (1,300) linear feet of new 6" PVC water line along
North 106th East Avenue and eight hundred (800) linear feet of new 6" PVC water line along North
112th East Avenue. The project will involve the eastern -most and western -most streets within the
boundaries of the subdivision. These two new water lines will improve water pressure and fire flow in
the area.
RECOMMENDATION:
Staff recommends approval of Resolution 2023 -02, requesting assistance from the Tulsa County CDBG
Urban County Program, approving an application identifying the installation of new water lines in the
Hale Acres subdivision as the preferred project for the FY 2023 funding cycle, and authorization to
execute all related documents.

FY2023 APPLICATION GUIDANCE
Due date for this Application is April 10, 2023
The CDBG program is authorized under Title I of the Housing and Community
Development Act of 1974, as amended.
The purpose of this Application Guidance is to provide assistance in preparing a
Community Development Block Grant application for the FY2023 Tulsa County
CDBG Urban County Program.
Eligible Entities
Entities included for FY2023 funding, the funding allocation to the entity, and the
percentage of low and moderate income population for each is listed below:

Threshold Requirements for FY2023 Metro City Applications
Due to HUD'S desire for all Entitlements to dramatically increase their
expenditure rates and failure of select Entities to expend funds in a timely
manner, the following expenditure criteria have been established for the FY2023
Application cycle. To submit an application for FY2023, communities with open
Metro Entities contracts must comply with the following Threshold Requirements:
100% of 2020 grant expended;
50% of 2021 grant expended and reimbursement request submitted;
2022 obligated through bid award or design process underway (documentation
required).
If the above expenditure requirements have not been met by April 1, 2023, the
community will not be eligible to submit an application. Staff will determine re-

Threshold Requirements for FY2023 Metro City Applications
Due to HUD'S desire for all Entitlements to dramatically increase their
expenditure rates and failure of select Entities to expend funds in a timely
manner, the following expenditure criteria have been established for the FY2023
Application cycle. To submit an application for FY2023, communities with open
Metro Entities contracts must comply with the following Threshold Requirements:
100% of 2020 grant expended;
50% of 2021 grant expended and reimbursement request submitted;
2022 obligated through bid award or design process underway (documentation
required).
If the above expenditure requirements have not been met by April 1, 2023, the
community will not be eligible to submit an application. Staff will determine re-
allocation of funds.

National Objective
The primary National Objective of the Community Development Block Grant
(CDBG) Program is the "development of viable urban communities by providing
decent housing and a suitable living environment, particularly for persons of low
and moderate incomes." All project proposals submitted for funding through the
CDBG Program must document the achievement of at least one of the following
National objectives:
• Provide benefit to low and moderate income persons.
• Aid in the prevention or elimination of slums or blight.
• Meet other community development needs having particular urgency,
posing a serious or immediate threat to the health or welfare of a
community.
Most CDBG applicants qualify their project activities under the National Objective
of benefit to low and moderate income persons. Applicants are cautioned that
qualifying a project under slum or blight or urgent need is a difficult process that
has very limited application and can only be used under special conditions and
circumstances. Therefore, you are urged to qualify your proposal under benefit to
low and moderate income persons. Applicants who qualify a proposal using slum
and blight or urgent need must receive guidance and approval from INCOG.
To qualify for CDBG funding under the National Objective of benefit to low and
moderate income persons, the proposed project activities must show a positive
or general improvement of living condition in a definable geographic target area
where at least 51% of the occupied households /homes are of low and moderate
income families. Low and moderate income families have an income equal to or
less than the current Section 8 low income limits established by the United
States Department of Housing and Urban Development (HUD). Each activity
proposed for funding with Community Development Block Grant(CDBG) dollars
claiming the National Objective of benefit to low and moderate income persons,
must provide data indicating the percentage of low and moderate income
beneficiaries.

2. No administration expenses will be funded with CDBG funds.
3. When planning projects for FY2023, be aware that accumulating more than 2
years of grant funding is not permitted.
4. Engineering is a permissible use of CDBG funds but competitive procurement
requirements must be followed
5. Income surveys of the project target area must be conducted. The use of
Census Tract or Block Group data to document the percentage of low and
moderate income beneficiaries for any CDBG funded activity should receive prior
INCOG review and approval.
6. Applicants must hold an application phase Public Hearing informing citizens of
the proposed project and submit documentation of the Public Hearing with this
application. Notice must be given at least 15 days prior to the public hearing by
publication in jurisdiction newspapers; or by posting at city halls. Acceptable
documentation consists of the affidavit of publication or a copy of the newspaper
article announcing the public hearing, or copy of certified posted notice. Tulsa
County has prepared a Citizen Participation Plan on behalf of the Urban County
communities; therefore, the individual community does not need to prepare a full
Citizen Participation plan.
7. Specific projects identified in the application must have cost estimates derived
from professional sources. Water and wastewater projects that require
Oklahoma Department of Environmental Quality construction permitting must
have certified cost estimates from a professional engineer licensed to work in
Oklahoma. For other types of projects, professional cost estimates may be
derived from architects, engineers, vendors, construction companies, or
appropriate personnel qualified to make such estimates.
Use of Funds
The CDBG Program funds a broad array of projects and activities including but
not limited to the following:
• Water and wastewater system improvements
• Solid waste
• Fire protection
• Streets
Neighborhood Parks
• Housing activities including construction, emergency repair, rehabilitation
• Acquisition of real property for eligible public purposes
• Clearance, demolition and removal of buildings and improvements
Senior citizen centers
• Gas and electrical system improvements
• Removal of architectural barriers associated with handicapped areas
• Storm water drainage improvements
• Economic Development

Social services- (City of Broken Arrow only)
Construction of ADA Sidewalks in non -low /mod census tracts is not an
eligible project.

Section Two
Required Application Documents
1. Application Summary
This form contains information about the specific project and includes a
certification from the local government attesting to the accuracy and
completeness of the application. The certification form must be completed and
signed by the chief elected official of the local government.
2. Line Item Budget (Application Form Attachment A)
The description of project activities along with a budget (form provided as
Attachment A) should be as specific as possible as they will form the basis of
your contract. This Budget should match Professional Cost Estimates submitted
with the application.
3. Direct Project Beneficiary Income Survey (Survey Summary
Form Attachment B)
Income surveys for each proposed CDBG funded activity are a requirement
unless using census tract or block group data.
Determination of project beneficiaries:
City -wide- An activity which will serve the entire city (such as wastewater
treatment), provided that the city has a low and moderate income percentage at
or above 51 %. If the LMI percentage is below 51%, an income survey with a
75% response rate must be provided.
Area benefit- An activity which benefits all the residents in a particular area
where at least 51 percent of the residents are low and moderate income
persons. Examples would include resurfacing of a collector street or
construction of a fire department substation.
Direct benefit- An activity which requires information on household size and
income so that it is evident that at least 51 percent of the clientele are persons
whose household income does not exceed the low and moderate income limit; or
an activity which has income eligibility requirements which limit the activity
exclusively to low and moderate income persons.
Presumed benefit- Benefit a clientele that is generally presumed to be
principally low and moderate income persons. Activities that exclusively serve a
group of persons in any one or a combination of the following categories may be
presumed to benefit 51 percent low- and moderate - income persons: abused
children, battered spouses, elderly persons, adults meeting the Bureau of the
Census' Current Population Reports definition of "severely disabled," homeless
persons, illiterate adults, persons living with AIDS, and migrant farm workers.

Guidelines to identify specific beneficiaries for various activities:
• Water or Wastewater Line Replacement or Rehabilitation. Those
households directly tapped to or receiving improved service from the lines.
Generally, beneficiaries are considered those persons residing in houses who
receive their water through new, replaced or upgraded lines, or houses that
discharge sewage into or through an improved collection line or main en route to
the treatment plant.
• New Wastewater or Water Extensions to Previously Un -served Areas. The
households /homes that will actually be connected to the wastewater or water line
extensions. Service to newly- constructed subdivisions will not be funded due to
environmental review requirements.
• Flood and Drainage Improvements. Households /homes within the recognized
drainage basin.
• Fire Protection. Households /homes (buildings, vehicles and equipment)
residing within the response area of the fire station; or using actual residential
calls made by a fire station over the prior 12 month period, conduct a survey of
those residences obtaining no less than 75% response rate.
• Senior Citizen Centers and Community Centers. Households /homes within
the designated service area of the proposed center. If there is only one center in
the community, the service area can be considered to be the entire community. If
there is more than one center, then the Applicant must delineate the service area
of each center. Senior Citizen Centers are presumed to benefit low and
moderate income persons.
• Demolition /Clearance /Removal of Junk and Debris and /or Abandoned
Inoperative Vehicles. Households /homes within the geographic area
designated to receive the focus of the demolition, clearance and /or removal
activities. Typically, the properties located within the geographic area designated
to receive the demolition /removal activities are considered to be beneficiaries.
• Provision of Accessibility for the Handicapped to Public Buildings.
The households /homes within the geographic area that receive services from the
assisted public building(s). Providing handicapped access to a city hall would
provide benefit to the households /homes in the entire city. Proposed
handicapped access activities in connection with limited clientele facilities are
presumed to benefit low and moderate income persons.
• Street Improvements /Sidewalk Improvements. The households /homes that
have at least one property line abutting the improvement.

Match and leverage are not required for the grant, but should be identified if
applicable to the project.

Water and wastewater projects that require Oklahoma Department of
Environmental Quality construction permitting must have certified cost estimates

RESOLUTION 2023 -02
WHEREAS, the Housing and Community Development Act of 1974, as amended (24 U.S.C. 93-
383 et seq.), (the "Act'), provides that Community Development Block Grant, ( "CDBG'), funds may
be used for the support of activities that provide decent housing and suitable living environments
and expanded economic opportunities principally for persons of low- and moderate - income; and,
WHEREAS, CDBG Regulations 24 CFR 570.307(a) allow counties having a total combined
population of 200,000 or more from the unincorporated areas and participating incorporated areas
to qualify as an urban county; and,
WHEREAS, Title I of the Housing and Community Development Act of 1974, Public Law 93 -383, as
amended, authorized the Secretary of Housing and Urban Development, as a representative of the
United States of America, to grant to Tulsa County funds and administrative responsibility for the
Tulsa County CDBG Urban County program; and
WHEREAS, a Cooperation Agreement between Tulsa County and the City has been executed for the
purpose of participation in the Tulsa County Urban County Community Development Block Grant
Program for Federal Fiscal Years 2023 -2025; and,
NOW THEREFORE, BE IT RESOLVED by the Owasso City Council that the City of Owasso desires
to obtain assistance in addressing community development needs and hereby requests the Tulsa
County CDBG Urban County program to provide assistance.
NOW THEREFORE, BE IT FURTHER RESOLVED by the Owasso City Council that the City of
Owasso affirms its commitment to take all action within its power to facilitate the receipt of the
assistance of community development funds, and upon receipt to administer said grant by the rules
and regulations established by the United States of America, the State of Oklahoma, Tulsa County
and all empowered agencies thereof.

a final plat for Villas at Stonebridge II. The subject property is located near the southeast corner
of the intersection of North 129th East Avenue and East 76th Street North and comprises a total of
4.98 acres. The property was annexed and zoned Residential Multifamily (RM) under Ordinance
1198 in October 2022. It was then placed within a Planned Unit Development (OPUD 22 -02)
overlay in December 2022 with Ordinance 1201.

PLANNING COMMISSION:
The Owasso Planning Commission voted 3 -0 to recommend approval of the final plat for Villas at
Stonebridge II.
RECOMMENDATION:
In developing a recommendation, staff evaluated the final plat on the criteria outlined in

BACKGROUND:
On September 20, 2022, City Council awarded a construction contract to R&L Construction in the
amount of $1,049,982.00. With the impact of the new and improved Funtastic Island and
continued popularity and demand of the sports fields, it became necessary to develop and
improve the parking lots at the Sports Park.
The base scope of work for the project included the overlay of existing soccer gravel parking lots,
new bus parking area, and new paved parking addition with drop -off area at Funtastic Island
parking lot.
FINAL INSPECTION:
In January 2023, R&L Construction completed all required work identified within the construction
contract. The final inspection of construction was completed, and it was determined that all
standards for acceptance had been met.
FUNDING:
Funding for the construction of Sports Park Parking Lots in the amount of $846,621.01 is included in
the Vision 2025 Fund, and $203,360.99 is included in the Capital Improvements Fund.
RECOMMENDATION:
Staff recommends acceptance of the Sports Park Parking Lots project and authorization for final
payment to R&L Construction, of Tulsa, Oklahoma, in the amount of $104,998.20, resulting in a final
contract amount of $1,049,982.00.

EXECUTIVE SUMMARY:
The purpose of this memorandum is to recommend amending the list of projects eligible for the
Capital Improvement Fund to include:
East 86th Street North Widening from North 145th East Avenue to North 161st East Avenue
BACKGROUND:
The Capital Improvements Committee conducted a public meeting on March 7, 2023, to consider
a proposed amendment to the list of eligible Capital Improvement Fund projects.
As per the resolution defined procedures, the City Council conducts a public hearing to receive
and consider citizen input relevant to the recommendation made by the Capital Improvements
Committee. Notice of the public hearing must be made no less than five calendar days prior to
the public hearing. At the conclusion of the public hearing, which was held on March 7, 2023, the
City Council must continue the matter for at least two weeks before taking any action to amend
the listing of projects. Any action taken by the City Council to amend the current list of projects
must be made by approving a resolution.
PROJECT INFORMATION:
East 86th Street North from North 145th East Avenue to North 161st East Avenue is a 2 -lane secondary
arterial roadway which is a heavily trafficked area that conveys residential and commercial traffic
as well as commuter traffic to and from Owasso. Currently, the roadway has approximately 9,000
vehicles per day traveling east /westbound. The Transportation Master Plan forecasted this section
of East 861h Street North to be improved by Fiscal Year 2020. The proposed roadway improvements
include four lanes, bridge replacement, traffic signals, sidewalk, multi -use trail, bike - lanes,
curb /gutter, and underground storm drain systems along the one -mile section. The estimated
project cost is $20.5 million, which includes, engineering, land acquisition, utility relocation, and
construction costs.

BACKGROUND:
At the OPWA meeting of March 21, 2023, the Trustees will consider a Development and Financing
Agreement with SAHO Properties, LLC, for the SAHO Animal Hospital Wellness Center and Pet
Resort project in the Owasso Redbud Tax Increment Financing (TIF) District, Increment District
No. 1.
If approved, the obligation for the payments would extend into future fiscal years, making the
agreement a debt of the OPWA. In Oklahoma, any indebtedness or obligation of a public trust
requires the approval of two - thirds (2/3) of the membership of the governing body of the
beneficiary (60 O.S. 176). Therefore, any debt of the OPWA requires the approval of four members
of the City Council.
RECOMMENDATION:
Contingent upon OPWA approval of the Development and Financing Agreement, Staff
recommends approval of the indebtedness of the OPWA as outlined in the Development and
Financing Agreement with SAHO Properties, LLC.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso is hereby granted this Tier I Permit to construct 6,333
linear feet of twelve (12) inch PVC, 462 linear feet of eight (8) inch PVC, 39 linear feet of six (6) inch PVC
potable water line and all appurtenances to serve the Waterline to serve East 116th Street North and
Roadway Improvements North Mingo Road to North Garnett Road, located in Sections 6 and 7, T -21 -N, R-
14-E, Tulsa County, Oklahoma, in accordance with the plans approved February 27, 2023.
By acceptance of this permit, the permittee agrees to operate and maintain the facility in accordance with
the Public Water Supply Operation rules (OAC 252:631) and to comply with the State Certification laws,
Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted thereunder regarding the
requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) This water line does not provide fire flow.
2) That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
3) That construction of all phases of the project will be started within one year of the date of approval
or the phases not under construction will be resubmitted for approval as a new project.
4) That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
5) That the Oklahoma Department of Environmental Quality shall be kept informed on occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.
6) That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with Public Water Supply Construction Standards [OAC
252:626- 19 -2].
7) That before placing this facility into service, at least two samples of the water, taken on different
days, shall be tested for bacteria to show that it is safe for drinking purposes.
8) That any deviations from approved plans or specifications affecting capacity, flow or operation of
units must be approved by the Department before any such deviations are made in the construction
of this project.

facilities in accordance with rules and regulations adopted by the Environmental Quality Board, and
that this Department will be notified in writing of any sale or transfer of ownership of these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
11) That the permittee is required to inform the developer /builder that a DEQ Storm Water Construction
Permit is required for a construction site that will disturb one (1) acre or more in accordance with
OPDES, 27A O.S. Section 2 -6 -201 et seq. For information or a copy of the GENERAL PERMIT
(OKR10) FOR STORM WATER DISCHARGES FROM CONSTRUCTION ACTIVITIES, Notice of
Intent (NO]) form, Notice of Termination (NOT) form, or guidance on preparation of a Pollution
Prevention Plan, contact the Storm Water Unit of the Water Quality Division at P.O. Box 1677,
Oklahoma City, OK 73101 -1677 or by phone at (405) 702 -8100.
12) That any notations or changes recorded on the official set of plans and specifications in the
Oklahoma Department of Environmental Quality files shall be part of the plans as approved.
13) That water lines shall be located at least fifteen (15) feet from all parts of septic tanks and absorption
fields, or other sewage treatment and disposal systems.
14) That whenever plastic pipe is approved and used for potable water, it shall bear the seal of the
National Sanitation Foundation and meet the appropriate commercial standards.
15) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in Public
Water Supply Construction Standards OAC 252:626- 19- 2(h)(1) and OAC 252:626- 19- 2(h)(2),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested to the highest pressure obtainable under the most severe head conditions of the
collection system prior to backfilling.
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will constitute
acceptance of the permit and all conditions and provisions.
