MONDAY, MARCH 13, 2023
The Owasso Planning Commission met in regular session on Monday, March 13, 2023, in the Council
Chambers at Old Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting filed
Friday, December 9, 2022; and the Agenda filed in the office of the City Clerk and posted at City Hall, 200
South Main Street, at 12:00 am on Wednesday, March 8, 2023.
1. Call to Order- Tim Miller called the meeting to order at 6:00 p.m.
2. Flag Salute -Tim Miller led the flag salute.
3. Roll Call - A quorum was declared present.

5. Consideration and appropriate action relating to the minutes of the February 13, 2023, Regular Meeting
Dr. Loving moved, seconded by Mr. Miller to approve the Minutes, as presented.

6. Consideration and appropriate action relating to a planned unit development (OPUD 23 -02) and rezoning
(OZ 23 -02) request for The Reserves at Owasso; to add Office (0) and additional Commercial Shopping
(CS) zoning to the current Commercial Shopping (CS) and Residential Multi - Family (RM) zoning, with an
OPUD overlay. The property is approximately 50.53 acres + / -, located on the northwest corner of the
intersection at North 145th East Avenue and East 106th Street North
Alexa Beemer presented the item, recommending approval. There were no comments from the
audience. After discussion, Mr. Vines moved, seconded by Dr. Loving to recommend approval of the
planned unit development and rezoning to the City Council, as recommended, subject to the following
Technical Advisory Committee (TAC) comments:
• Add OPUD 23 -02 to the title page
• Change all references of N. 140th E. Ave. to N. 137th E. Ave.
• Page 4, Section III - permitted uses, add "by right" after "Automotive Repair and Maintenance uses are
also allowed"
• Page 4, Section III - freestanding signage - only allowed one sign on development A; can be either on E.
106th St. N. or N. 137th E. Ave, but not on both
• Page 5, Section IV - maximum height without a Specific Use Permit (SUP) is 36'; anything over will need an
SUP; height will be capped at 70'
• Page 5, Section IV - building signage - state that all signs will follow Owasso Zoning /Sign Code
Chapter(Ch.) 10 and Chapter(Ch.) 18 signage requirements; delete everything after first sentence
• Page 8, Section VII - minimum lot frontage - clarify width of the stub roads
• Page 8, Section VII - freestanding signage - no pole signs allowed for RM section; limited to monument
sign 8' tall; need to change to RM zoning district, not CS zoning
• All Signage - a Unified Sign Plan is required for any additional /larger signs desired outside Owasso
Zoning /Sign Code Ch. 10 and Ch. 18 signage requirements
• Page 10, Section VII - add language that all screening must adhere to Ch. 19 of Owasso Zoning Code;
this includes a 6' fence along the exterior of Dev. Area E
• Page 10, Section VIII - minimum lot frontage - clarify the location of the lot frontage (if frontage is off N.
145th E. Ave., clarify whether or not the frontage will serve as an access point to Dev. Area F.)

• At platting, right of way (ROW) is required to be dedicated; add language to the Planned Unit
Development (PUD) document stating such
• Page 2 - access points - add language that all access points will be approved at platting. Add that
Development A is allowed one access point on 137'"; other development areas along 106'" can have
four accesses to share between all development areas. Separate from Dev. A, remaining development
areas can share two accesses on 137'" and two on 145'". All access points will have to conform to
Owasso Zoning Code and Engineering Criteria. Shared accesses are highly encouraged
• At preliminary plat stage, an Oil and Gas letter will be required from the Oklahoma Corporation
Commission (OCC)
• Add language that if Dev F is platted on its own, a retail or office component will be required within Dev.
F if the use is warehousing /ministorage
• Add language that ministorage is being allowed within the US -169 Overlay, only because it is functioning
as a secondary use within Dev. Area F
• Provide a conceptual landscape plan
• Page 12, Section XV - add language for required amenities; and show approximate location on Exhibit A
and reference section 9.1 of the Owasso Zoning Code
• Page 12, Section XV - add "and after site plan approval" to the final statement
• If multi - family is gated, add reference to Ch. 21 of the Owasso Zoning Code
• Sections III, IV, V, VI, VII, VIII - add note that all set -backs along streets are allowed to be 10' if parking is
located in rear of building; if not, setbacks along streets will conform to applicable Owasso Zoning Code
sections
• Sections III, IV, V, VI, VII, VIII - add "and per Ch. 10 of the Owasso Zoning Code" where "as permitted
within the CS zoning code" is referenced

7. Consideration and appropriate action relating to a planned unit development (OPUD 23 -03) request for The
Vintage at Redbud. The property is approximately 0.481 acres + / -, zoned Residential Multi - Family (RM),
within the Downtown Overlay District, and located near 206 West 2nd Street North
Wendy Kramer presented the item, recommending approval. One citizen addressed the Commission.
After discussion, Mr. Vines moved to amend the parking requirements in OPUD 23 -03 to one (1.0) parking
spaces required per unit, in addition to required street parking, seconded by Dr. Loving.

Mr. Vines moved, seconded by Dr. Loving to recommend approval of the planned unit development, as
amended to the City Council, subject to the following TAC comments:
• Change every reference of name "Greenlees Addition" to "The Vintage at Redbud"
• Add OPUD 23 -03 to the title page
• Page 4, Screening & Buffering - remove "and" in the first sentence
• Page 4, Screening & Buffering - privacy fence will be required adjacent to all single - family uses
• Page 4 - delete reference to "two required parking spaces" (no minimum in downtown district)
• Page 9 - add reference to Ch. 10 of Owasso Zoning Code when listing landscaping requirements
• Page 10, Platting Requirements - in the first sentence, change "units" to "until"

located at 9581 North Garnett Road, zoned Commercial Shopping (CS), with an OPUD 21 -02 overlay, and
within the US -169 Overlay District

audience. After discussion, Dr. Loving moved, seconded by Mr. Miller to approve the lot split, subject to the
following TAC comment:

Consideration and appropriate action relating to a preliminary and final plat request for Villas at

audience. After discussion, Mr. Vines moved, seconded by Dr. Loving to approve the preliminary plat.

• Add language to the Deeds and Dedication (DoD) page dedicating the overland drainage easement
as a public easement; also, add language regarding the long -term maintenance of the drainage
easement
• Show the document number /plat number associated with all offsite easements that are adjacent to the
perimeter utility easements shown on the plat face
• In the DoD, change any reference from "Washington County RWD #3" to "Rogers County Rural Water

BACKGROUND:
The Community Development Department received a request for the annexation and rezoning
of property located at 11428 North 129th East Avenue. The subject property is approximately 2.49
acres in size and is currently zoned Agricultural - Residential (AG -R) within Tulsa County. Upon
annexation, the applicant is requesting the property be brought into Owasso City Limits as
Commercial Shopping (CS) via accompanying rezoning request (OZ 23 -03).

• The subject property is contiguous with City limits on the northern boundary of the
property.
• Typically, property is assigned a zoning of Agriculture (AG) by default upon annexation.
The applicant can also request the property retain the County's corresponding zoning
designation under the Owasso Zoning Code, or seek a concurrent rezoning based on
what the GrOwasso 2035 Land Use Master Plan prescribes.
o In this case, the applicant is requesting that the subject property be annexed and
assigned a zoning of CS, via an accompanying rezoning request.
• The GrOwasso 2035 Land Use Master Plan identifies the subject property for future
"Commercial" uses.
o As such, assigning a zoning of CS to the subject property upon annexation is
consistent with the long -range vision for the property laid out in the Master Plan.
• The subject property is currently unplatted; the applicant does intend to the develop the
property as an ambulatory health care office for Mercy EMS.

The Technical Advisory Committee (TAC) reviewed this item at their regular meeting on March
15, 2023. Comments from that meeting are included in this Planning Commission agenda
packet.
RECOMMENDATION:
In developing a recommendation, staff evaluated Oklahoma State Statue, Title 11, Chapter 1,
Part 1, Article XXI, Section 21 -101 and Section 1.4.3 of the Owasso Zoning Code. Following this
evaluation, staff concluded that the subject annexation and rezoning request meets all of the
legal requirements for approval.
As such, staff recommends approval of annexation request OA 23 -01 and concurrent rezoning
request OZ 23 -03, annexing the subject property into Owasso City Limits with an assigned zoning
of Commercial Shopping (CS).

BACKGROUND
The Community Development Department received an application for review and approval of
a Final Plat for Cypress Crossing Apartments, a proposed multi - family residential subdivision. The
subject property is located east of North Owasso Expressway and northeast of East 99th Street
North. The property is approximately 20.79 acres in size and is zoned Residential Multifamily (RM),
Commercial General (CG) and Office (0) with a PUD Overlay (OPUD 22 -03).

• The Preliminary Plat for this property was approved by the Owasso Planning Commission
in February of 2023.
The proposed Final Plat for Cypress Crossing Apartments consists of one (1) Lot on one (1)
Block on approximately 20.79 acres. With a proposed maximum of three hundred and
seventy -four (374) dwelling units within Lot 1, it yields a gross density of approximately 18
dwelling units per acre (DU /AC).
The proposed lot as depicted on this Plat meets the bulk and area requirements
stipulated in the Owasso Zoning Code for RM -zoned property and the OPUD 22-
03 document.

Final Plat- Cypress Crossing Apartments
• Detention will be provided for via the Stormwater Detention & Drainage Easement
depicted on this final plat. This easement is located on the east portion of the subject
property.
• Perimeter and interior utility easements are shown on the plat allowing utility companies
adequate access to service the subdivision.
• Two points of access are depicted on the plat face, both of which are proposed to be
contained within reserve areas as private drives.
o One point of access is proposed off of North Owasso Expressway, cutting through
the vacant property to the west of the subject property. This is noted as Reserve
Area "A."
o The other point of access is proposed to connect into East 99th Street North, along
the southern portion of the subject property. This is noted as Reserve Area "B."

RECOMMENDATION
In developing a recommendation, staff evaluated the final plat on the criteria outlined in
Section 2.4 of the Owasso Subdivision Regulations. Following this evaluation, staff concluded that
the subject plat meets all of the legal requirements for approval.
As such, staff recommends approval of the Final Plat for Cypress Crossing Apartments, subject to
TAC comments.

Community Development, Planning Commissioner Rep., Public Works (PW):
• At platting, right of way (ROW) along N. 129th E. Ave. is required to be dedicated per city standards

2. Final Plat -The Villas at Cypress Crossina -
Community Development, Planning Commissioner Rep., Public Works (PW):
• In the Deed of Dedication (DoD):
• Section I. B.3 and B.4 - add "and water services/ lines"
• Section II C.2 - remove detailed language concerning abatement process and replace with
"if not maintained, the city will follow their legal abatement process"
• Section 11.3 - add "via mutual access easements dedicated herein" to the end of the sentence
• Section III.B.1 -add language that provisions detailed in the approved OPUD 22 -03 document,
and any amendments to said document, will supersede any restrictions placed in the DoD
• Include book /page or document number for all off -site easements depicted on the plat face
• Change roadway callout to "North Owasso Expressway" on the plat face
• Based on civil plan review, additional easements may be required; continue to work with Public
Works on civil review process

3. Site Plan - Take 5 Oil Change-
AT&T:
■ Provide conduit to Right of Way, so AT &T can provide service
Community Development, Planning Commission Rep., & Public Works (PW):
• City staff will provide the property address; label on the site plan
• Add sight triangles off of private access to site and landscape plan
• Add site data table to site plan sheet - it's currently on the Alta Overlay page
• Label specific species of plantings on the landscape plan
• Page B201 - correct the fapade labels that denote incorrect direction /orientation
• All signage reviewed via a separate sign permit - refer to chapter 18 of Owasso Zoning Code - directional
signage does not need a sign permit
• Add note to site plan that all HVAC /mechanical equipment will be fully screened
• Provide photometric plan
• Add callout to the site plan that the sidewalk is "existing"
• Add callout to the site plan that the existing curb -cut off of N. 129th E. Ave. will be closed prior to issuance
of Certificate of Occupancy
• Consider removing or moving the existing speedbump on the access road to the east of the property
(where take 5 Oil Change will get access)
• Dumpster enclosure's color needs to be compatible with the main building
• Submit civil plans to Public Works
