MONDAY, DECEMBER 11, 2023
The Owasso Planning Commission met in regular session on Monday, December 11, 2023, in the Council
Chambers at Old Central, 109 North Birch Street, Owasso, Oklahoma per the Notice of Public Meeting filed
Friday, December 9, 2022, and the agenda filed in the office of the City Clerk and posted at City Hall, 200
South Main Street, at 2:30 pm on Thursday, December 7, 2023.
I. Call to Order- Mr. Miller called the meeting to order at 6:00 p.m.
2. Flag Salute- Mr. Miller led the flag salute.
3. Roll Call - A quorum was declared present.

6. Consideration and appropriate action relating to an annexation (OA 23 -02) and rezoning (OZ 23 -08) of
approximately 1.16 acres + / -, location described as the west 150 feet of 12025 East l l lth Street North,
from Tulsa County zoning of Agriculture (AG) to Residential Single - Family low Density (RS -1)
Wendy Kramer presented the item, recommending approval. There were no comments from the
audience. Mr. Vines moved to recommend approval of the annexation and rezoning to the City Council,
seconded by Mr. Miller, subject to the following Technical Advisory Committee comments:
• 25` of right -of -way is required to be dedicated to the City of Owasso along East 1 11th Street North,
on the south side of the subject property
• Coordinate with Public Works on the location of any required utility easements needed to service
the proposed house, and /or any required stormwater plans

7. Consideration and appropriate action relating to a combined preliminary and final plat request,
proposing a single- family residential subdivision, on approximately 2.22 acres + / -, located west of the
intersection of North 97th East Avenue and East 102nd Street North for Kelly Acres. The property is zoned
Residential Estate (RE)
Alexa Beemer presented the item, recommending approval. There were no comments from the
audience. Mr. Miller moved to approve the preliminary plat, seconded by Mr. Cook, subject to the
following Technical Advisory Committee comments:
• Add "City of Owasso" to title block on the plat face
• Change zoning designation on the plat face from "AG" to "RE"
• Label Point of Beginning and Point of Commencement on plat face
• Bold all property lines to make them more visible
• Add date of preparation on plat face
• Add total acreage figure at the top of the plat face
• Show required perimeter utility easements on plat face

BACKGROUND:
The Community Development Department received an application for review and approval of a
Preliminary Plat for Fairway Villas, a proposed single - family residential subdivision that is intended to be
owned by one owner and act as a rental community. The subject property is located at the southeast
corner of the intersection of North 97th East Avenue (North Mingo Road) and East 89th Street North
(Larkin Bailey Boulevard).

ANALYSIS:
The subject property was annexed into Owasso City Limits with Ordinance 425 in 1990.
• The proposed Preliminary Plat for Fairway Villas consists of thirty -seven (37) Lots on six (6) blocks
on approximately 7.76 acres, yielding a gross density of 4.77 dwelling units per acre (DU /AC).
o The proposed lot as depicted on this Plat meets the bulk and area requirements
stipulated in the Owasso Zoning Code for RNX -zoned property, the OPUD -9 document
and the 2023 Minor Amendment to OPUD -9.
o A Minor Amendment for OPUD -9 was issued on November 9, 2023 to adjust the
minimum lot frontage and the minimum depth of the required rear yards. The PUD
Minor Amendment is attached to this memo.
• There will be two (2) points of access for this subdivision, off of East 89th Street North (Larkin
Bailey Boulevard).
o The plat also depicts two (2) dead -end roads - East 88th Place North on the west end of
the subject property and North 98th East Avenue on the north end. The applicant has
clarified to staff that these streets will not connect through to North 97th East Avenue
(North Mingo Road) or East 89th Street North (Larkin Bailey Boulevard) in these locations
and will remain dead -ends.

• Perimeter and interior utility easements are shown on the Plat allowing utility companies
adequate access to service the subdivision.
• The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to

TECHNICAL ADVISORY COMMITTEE:
The Owasso Technical Advisory Committee (TAC) reviewed this item at their regular meeting on
December 20, 2023. Comments from that meeting have been included in this Planning Commission
agenda packet.
RECOMMENDATION:
In developing a recommendation, staff evaluated the preliminary plat on the criteria outlined in
Section 2.3 of the Owasso Subdivision Regulations. Following this evaluation, staff concluded that the
subject plat meets all of the legal requirements for approval.
As such, staff recommends approval of the Preliminary Plat for Fairway Villas, subject to TAC
comments.

SUBJECT: PUD Minor Amendment - OPUD 9 (Bailey Ranch- Fairway Villas)
DATE: November 9, 2023
BACKGROUND:
The Community Development Department received a request for a minor amendment to OPUD
9 (Bailey Ranch). OPUD 9 was approved by City Council in 1991, under Ordinance #429. The
subject property involved in this minor amendment request comprises a portion of the original
larger PUD. The subject property was rezoned to Residential Neighborhood Mixed (RNX) in 2018,
under Ordinance # 1127.
There was also a previous minor amendment to OPUD 9, approved in 2018, that permitted a
senior housing development on the subject property. Since OPUD 9 and the previous minor
amendment were approved, the property owner has decided to shift away from a senior
housing development and instead would like to construct a patio home development. Such a
use would be allowed under both the RNX base zoning and under the original OPUD 9
document.
Per Section 4.5.2 of the Owasso Zoning Code, RNX -zoned properties are required to have a
minimum rear yard of twenty (20) feet. The Owasso Zoning Codes does not prescribe a minimum
lot frontage requirement for RNX -zoned properties. The applicant has requested a minor
amendment to reduce the minimum lot frontage for RNX zoned property to forty (40) feet and
to reduce the rear setback to fifteen (15) feet, with additional allowances as detailed below.
Given this request does not add any new uses, does not add additional density in excess of ten
percent (10 %), does not alter the original intent of the approved PUD, and is not detrimental to
adjoining properties, staff supports and approves the minor amendment request. All other
provisions of the PUD shall remain in effect as previously approved under Ordinance #429.

may be needed
Police:
■ Requests that the main entrances be aligned with existing entrances across East 89th Street North for
safety and operational purposes

• All mechanical /HVAC equipment should be fully screened, show and note on the site plan
• Show location and label required bike rack on the site plan
■ Show location of all proposed signage, ensuring compliance with Owasso Zoning /Sign Code
Chapter 10 and Chapter 18 requirements; all signage is approved by a separate permit application
■ Add location map to the site plan
RWD #3:
• This item is in RWD #3 service area
• There has been no communications made with RWD #3 regarding water service at this time
• At such time as water service is requested, all requirements of the district must be met
• We reserve the right to comment until after RWD #3 engineering review
