MONDAY, May 13, 2024
The Owasso Planning Commission met in regular session on Monday, May 13, 2024, in the Council Chambers
at Old Central, 109 North Birch Street, Owasso, Oklahoma per the Notice of Public Meeting filed Friday,
December 8, 2023; and the agenda filed in the office of the City Clerk and posted at City Hall, 200 South
Main Street, at 2:30 pm on Thursday, May 9, 2024.
1. Call to Order- Mr. Miller called the meeting to order at 6:00 p.m.
2. Flag Salute - Mr. Miller led the flag salute.

5. Consideration and appropriate action relating to the minutes of the April 8, 2024 Regular Meeting

Consideration and appropriate action relating to a combined preliminary and final plat request for
JDH Properties, a proposed mixed -use commercial subdivision on approximately 4.588 acres + / -,
located at 11105 East 1161h Street North and 11111 East 116th Street North, zoned Commercial General
(CG), under Planned Unit Development OPUD 23 -07
Alexa Beemer presented the item, recommending approval. There were no comments from the
audience. Mr. Miller moved to approve the preliminary plat, seconded by Dr. Balthrop, subject to the
following Technical Advisory Committee comments:
Preliminary Plat Face:
■ Show all landscape and fence easements with maintenance responsibilities, including a 10 -foot
landscape easement abutting residential areas
Preliminary/Final Plat Face:
• Label lot addresses as provided by City staff

7. Consideration and appropriate action relating to a final plat request for Fairway Villas, a proposed
single - family residential subdivision on approximately 7.76 acres + / -, located at the southeast corner
of the intersection of North 971h East Avenue (North Mingo Road) and East 89th Street North (Larkin Bailey
Boulevard), zoned Residential Neighborhood Mixed (RNX), under Planned Unit Development OPUD -9
Wendy Kramer presented the item, recommending approval. There were no comments from the
audience. Mr. Miller moved, seconded by Mr. Cook, to recommend approval of the final plat to the
City Council, subject to the following Technical Advisory Committee comments:
Preliminary/Final Plat Face:
• Label house numbers for each lot as provided by City Staff
• Repeat Section, Township, Range, City, County, and State information on second page of plat
• Add names and addresses of the owner(s) of record and the subdivider(s) of the plat
• Add date of preparation of the plat
• On the location map, show all subdivisions within the mile section and revise "left main street" to
"North 97th East Avenue (North Mingo Road)"
• Add total acreage and total number of lots /blocks within the subdivision near the location map
• Show names of all subdivisions and the names, locations, and widths of all existing streets,
easements, drainage ways, and other public ways adjacent to the property
• Label surrounding roads as 'North 97th East Avenue (North Mingo Road)' and 'East 89th Street North
(Larkin Bailey Boulevard)'
• Add limits of access and limits of no access from nearest street intersection
• Show the location of all items in the right -of -way that are within the limits of access widths, as well as
opposite drives, that may conflict with limits of access (specifically the existing medians along East
89th Street North)

SUBJECT: Specific Use Permit (SUP 24 -01) - 7659 N 129th E Ave

BACKGROUND:
The Community Development Department received an application for review and approval of
a Specific Use Permit (SUP) to allow an automotive repair and maintenance use (for a proposed
car wash facility) in a Commercial Shopping (CS) zoning district. The subject property is located
at 7659 N 129th E Ave and is comprised of the north 300 feet of Lot 1, Block 1 of the Replat of Lots
7 and 8, Block 4 Graceland Acres.

ANALYSIS:
• The subject property was annexed into Owasso City Limits in June of 2020 (Ordinance
1 167)
• A SUP is required in certain zoning districts for uses or structures that may be considered
more intense than what is allowed by right, through the City of Owasso's Zoning Code.
• A carwash facility falls under the "automotive repair and maintenance" use category
outlined in Table 6.1 of the Owasso Zoning Code. In the CS zoning district, any
"automotive repair and maintenance" facility is allowed with an SUP.
o Thus, an SUP is needed for a carwash on this property, as it is zoned CS.
• The GrOwasso 2035 Land Use Master Plan identifies the subject property for future
commercial uses.
o The subject property is surrounded by existing residential single - family
neighborhoods to the north and west, residential estate property to the east and
vacant commercial property to the south.

The applicant has worked with staff to design the site and new structure in an
appropriate manner that conforms to the design requirements of the Zoning Code and
minimizes the impacts on the neighborhood to the north as well as buffering to the
residential lot to the east.
• The proposed car wash will be a 6 -bay structure, composed of EIFS and
concrete masonry block, thus meeting the fapade requirements for commercial
structures seen within Chapter 11 of the Owasso Zoning Code.
■ Phase 1 will construct 4 bays. Phase 2 will be comprised of the remaining 2
bays.
• According to the conceptual site plan, there is an eight- foot -tall wooden privacy
fence proposed along the subject property's northern property line and a six -
foot -tall wooden privacy fence proposed along the subject property's eastern
property line. These will help buffer the proposed carwash from the existing
neighborhood to the north and the residential property to the east.
• The proposed structure is proposed to be set back over seventy -five feet (75')
from the northern property line and ninety -two feet (92') from the eastern
property line. This separation offers a generous boundary between the proposed
carwash and existing homes, far exceeding the setbacks required of
commercial -zoned property per base Code. As such, the single - family homes are
further buffered from the more - intense use.
• The applicant proposed a dense landscape edge along the northern and
eastern property lines. The required plantings will have to meet the Landscape
Minimums described in Chapter 19 of the Owasso Zoning Code. Additionally, all
trees will be evergreen in nature and reach at least eight feet (8') tall at maturity
and be at least four feet (4') tall at planting. This landscaping will further buffer
the residential uses from the proposed structure.
• As indicated on the conceptual site plan, the applicant is intending not to install
any lighting along the northern edge of the property line. This proposed lighting
will be further reviewed by Staff when a photometric plan is submitted during the
Site Plan review of this property. All lighting will have to comply with Chapter 20 of
the Owasso Zoning Code.
• The applicant has indicated that the noise levels put out by the carwash will not
exceed the allowed decibels per the adopted Owasso Noise Ordinance.
■ While the car wash will be operational twenty -four (24) hours per day, the
applicant has indicated that cars remain stationary within the bays while
in use. Therefore, the doors will remain closed during the night operation
hours of 9:OOpm to 7:OOam, to further dampen any noise from the blowers.
• The applicant has also limited the number of vacuum stations on the property to
eight (8) and they will all be located on the south side of the carwash, which
abuts vacant commercial property. By pushing the proposed vacuum stalls to the
far southern portion of the property, the applicant further increases the setback
distance between the vacuum stalls and the neighboring residential
neighborhood to the north of the property.
• The dumpsters for the site will be located on the southeastern corner of the
property and will be fully screened, per Chapter 19 of the Owasso Zoning Code.
The main purpose of the SUP requirement is to ensure the development does not impose
any negative direct impacts to adjoining residential areas and that the proposed use
works in harmony within the context of the area.
o Considering this, the applicant has indicated via their conceptual site plan that
they intend to install adequate buffering between their site and the neighboring
single - family homes.

o The design of the site and proposed structure will serve to reduce and minimize
any negative impacts on the single - family neighborhood and residential property
to the north and east of the site.
• Any further development that occurs on the subject property shall adhere to all
development, zoning, and engineering requirements of the City of Owasso.

TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed SUP 24 -01 at their regularly scheduled
meeting on May 15, 2024. Comments from that meeting have been including in this agenda
packet.
RECOMMENDATION:
In developing a recommendation, staff evaluated the SUP on the criteria outlined in Section
16.1.7 of the Owasso Zoning Code. Following this evaluation, staff concluded that the SUP
request meets all of the legal requirements for approval.
As such, staff recommends approval of SUP 24 -01, subject to TAC Comments.

BACKGROUND:
The Community Development Department received an application for review and approval of
a Final Plat for Owasso 7, a proposed commercial subdivision. The subject property is located at
the northeastern corner of the intersection of East 96th Street North and North Garnett Road.

ANALYSIS:
• The subject property was annexed into Owasso City Limits in February of 2001 (Ord. 637).
• The Preliminary Plat for this property was approved by the Owasso Planning Commission
in October of 2023.
• The proposed Final Plat for Owasso 7 consists of two (2) Lots on one (1) Block.
o All of the proposed lots as depicted on this Plat meet the bulk and area
requirements stipulated in the Owasso Zoning Code for CG -zoned property.
• There will be one (1) point of access platted through this final plat, off of North Garnett
Road.
o This newly - established limit of access will serve as a mutual access for both lots
depicted on the subject plat.
o Additionally, a second point of access for the property exists off -site, just east of
the southeast corner of the plat, through a platted mutual access easement
(MAE).

• Detention will be provided for via the Garnett Regional Detention Facility, located
southwest of the subject property. The property owners of each lot will be responsible for
constructing the stormwater infrastructure necessary to convey water to this Regional
Detention Facility downstream prior to the issuance of any Certificates of Occupancy.
o As there are no additional detention ponds proposed on the subject property,
this Final Plat does not depict any Reserve Areas.
• Perimeter and interior utility easements are shown on the Plat, and will allow utility
companies adequate access to service the subdivision.
• The City of Owasso will provide police, fire, ambulance, water services, and sanitary
sewer services to the property.
• Any further development that occurs on the subject property shall adhere to all
development, zoning, and engineering requirements of the City of Owasso.

plat for Silo at Smith Farm, a proposed single - family subdivision. The subject property is located near
the southeastern corner of the intersection of East 96th Street North and North Garnett Road.

ANALYSIS:
• The subject property was annexed into Owasso City Limits with Ordinance 495 in 1995.
• A preliminary plat for the subject property was approved by the Owasso Planning Commission
in October 2021.
• This is a sixty -two (62) lot, six (6) block final plat for a single - family residential development
yielding a gross density of 4.60 dwelling units per acre (DU /Ac).
o The proposed lots as depicted on this plat meet the bulk and area requirements
stipulated in both the Owasso Zoning Code for RNX -zoned property and the OPUD 21-
02 document.
• There will be two (2) point of access for this subdivision; one point of access will be situated off
of North Garnett Road, while the other will be off of East 96th Street North. Both access points
will be gated, and will provide adequate stacking distances.
o These two access points do meet the separation requirements outlined in the Owasso
Zoning Code.
o The access point off of East 96th Street North will also serve as access for the adjacent
commercial lots situated to the north of the subject property.

• Detention will be provided for via the Garnett Regional Detention Facility, to the west of the
subject property. The property owners of each lot will be responsible for constructing the
stormwater infrastructure necessary to convey water to this Regional Detention Facility
downstream prior to the issuance of any Certificates of Occupancy.
o The wetland area immediately to the north of the subject property will remain
unplatted and undeveloped, but will be maintained by the Homeowners' Association
(HOA) associated with this subject plat.
• The subject plat depicts a total of eight (8) Reserve Areas.
o Reserve Area "A" will encompass the private streets seen within this proposed
development.
o Reserve Areas "B ", "C," "D ", "E", "F", "G ", and "H" will function as blanket utility and
drainage easements, as well as serve to provide open space, park space, space for
signage, and space for decorative landscaping.
• Perimeter and interior utility easements are shown on the plat, allowing utility companies
adequate access to service the subdivision.
• The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to

RECOMMENDATION:
In developing a recommendation, staff evaluated the final plat on the criteria outlined in Section 2.4
of the Owasso Subdivision Regulations. Following this evaluation, staff concluded that the subject plat
meets all legal requirements for approval.

Conceptual Site Plan:
• Label address as provided by City Staff
• Add note confirming adherence to the Owasso Noise Ordinance regarding acceptable decibel levels
• Label total northern setback distance from property line to building edge

Community Development (CD) & Planning Commissioner Rep.:
• Use addresses as provided by City Staff for new lots created
• The lot split line appears to intersect the platted access point; a 20- foot -wide Mutual Access
Easement (MAE) will need to be dedicated along this proposed lot split line

Public Works:
Lot Split approval will be contingent upon the filing of the following separate instruments being filed
with the County of Record:
• A drainage easement that conveys the stormwater generated on the proposed northern
lot to the proposed detention pond on the proposed southern lot
• Restrictive Covenants, covering both proposed lots, that states the owners of both lots will
have the right to use the proposed detention pond and both owners will be responsible
for the maintenance of said pond
Replatting the parent tract, rather than seeking a lot split, is also an option. This would allow the two
proposed lots to be created, allow for the dedication of the additional required drainage easement,
and allow for the inclusion of use and maintenance language for the detention pond. If the
applicant prefers to replat, staff strongly suggests placing the proposed detention pond within a
Reserve Area.
There were no comments from PSO /AEP or RWD #3.

Deed of Dedication (DoD):
• Add certificate of final plat approval signature section, for City approval signatures
• Section 11 -change `planning' to `planting'
• Section 11 - add standard landscape language "No alteration to approved landscape plans shall
be permitted without approval from the Community Development Department."
• Paragraph B.5 - for clarity, remove the reference to maintaining detention /retention
• Paragraph K - specify that detention is provided by the "Garnett Regional Detention Facility"
• Paragraph J - reword to encompass future adjacent lots as well; suggested language: "All lots
(including future adjoining lots under separate plat) shall have..."
Other Requirements:
• Provide Oklahoma Corporation Commission letter regarding oil, gas, or dry hole wells on the property
• Coordinate with Public Works on timing of infrastructure installation
• The fee for Garnett Regional Detention, instead of detention, is payable at the time of platting

4. Final Plat - Silo at Smith Farm -

Final Plat Face:
• Label distance from the access point off of North Garnett Road to the nearest intersection
• Show opposite drives that are within the limits of access width
• Identify and add callout for US Army Corps of Engineers designated Blue Line Stream in the wetlands
area to the northwest of the plat
• Show floodplain boundaries and FEMA Flood Insurance Rate Map with which the site is associated;
label property as outside floodplain if applicable
• Revise addresses as provided by City Staff
• Fencing, bollards or barricades of some form must be positioned next to Reserve Areas E & G, where
the private road dead ends
Deed of Dedication (DoD):
• Remove Sections 2.2.2 and 2.2.3
• Add standard HOA language from the Final Plat checklist to section 3.6
• Add language concerning the use and maintenance of the adjacent wetland area
Landscape Plan:
■ Specify the location(s) of the proposed mailbox(es)

• No mechanical equipment allowed in required side setbacks
• All signage is handled via a separate permit application

Site Plan:
• Location map - correct `106st' to `106th' and replace `N Mingo Rd' with `North 97th East Avenue'
• Show FEMA Flood Insurance Rate Map with which the site is associated
• Label 10 -foot rear setback on the east side of the property
• Label zoning and land uses of adjacent properties (including PUDs if applicable)
• Show location and dimension of all existing and proposed curb lines, driveways, and neighboring
street intersections within 150 feet of the project
• Label limits of no access and limits of access dimensions as depicted on approved final plat
• Revise label for sidewalk on the northern side of the site plan from `Existing Sidewalk' to `Sidewalk to
be Installed with City Roadway Widening Project'
• Revise western street name label to `North 97th East Avenue (N. Mingo Rd.)'
• Show and label screening /buffering yards required adjacent to residential uses
• Label building heights
• Label square footage on proposed building east of the open -air covered storage
• Show proposed building finished floor elevations (FFE) for all structures
• Label each building with the proposed use
• Label addresses for buildings as provided by City Staff
• Label height and material of existing fences on the western and southern sides of the property
• Label right -of -way and pavement widths for adjacent streets to development

• Label /Add the following landscaping notes on plan:
• Schedule of installation of required landscaping and appurtenances, which specify installation of
all required materials except trees, prior to the issuance of a certificate of occupancy (C /O)
• Note indicating that the owner is responsible for the survival of all plan material and will replace
any dead plant material
• Note that all trees must be installed at least five (5) feet from any water or sanitary sewer line
Elevations:
■ Currently exceeding metal fagade allowance on all buildings
Other Requirements:
• Final Plat filing required before site plan approval
• Provide outdoor lighting plan
