Call to Order- Mr. Miller called the meeting to order at 6:05 p.m. 2. Flag Salute- Mr. Miller led the flag salute. 3. Roll Call - A quorum was declared present. Presentation of the Character Trait of Determination Wendy Kramer presented the character trait for the month of June. 5. Consideration and appropriate action relating to the minutes of the May 13, 2024, Regular Meeting Mr. Miller moved, seconded by Dr. Balthrop, to approve the minutes as presented. YEA: Cook, Balthrop, Miller NAY: None Motion carried: 3 -0 6. Consideration and appropriation action relating to a Specific Use Permit application (SUP 24 -01) for a proposed auto maintenance use (carwash facility) on approximately 1.95 acres + / -, located at 7659 North 1291h East Avenue, zoned Commercial Shopping (CS) Wendy Kramer presented the item, recommending approval. Six citizens addressed the Commission. Mr. Miller moved, seconded by Mr. Cook, to recommend approval of the specific use permit to the City Council, subject to the following Technical Advisory Committee comments: Conceptual Site Plan: • Label address as provided by City Staff • Add note confirming adherence to the Owasso Noise Ordinance regarding decibel levels • Label total northern setback distance from property line to building edge • Label total eastern setback distance from property line to building edge • Add note specifying that vegetation along the northern and eastern property lines must be evergreen, with a minimum mature height of 8 feet and planted at a minimum height of 4 feet • Clarify location of vacuum stalls; note that northern -most row of parking may not have vacuums • Label width of drive aisles • Dumpsters need to be moved south as far as site access allows and labeled with screening detail • Label proposed ground signage location; all signage is handled via a separate permit application • Label access point dimensions with separation from property lines for staff verification with platted Limits of Access • Label required ADA parking stalls, and ADA - accessible path to main building • Show 8 -foot opaque screening fence along northern property line, and a 6 -foot opaque screening fence along the eastern property line • Add note that all lighting will be full cut - off /shielded • Add note that all mechanical and vacuum - associated equipment will be screened • Label required bike rack Other Requirements: • Specify whether the use is solely a carwash or a combination of a carwash and mechanic's shop • Specify hours of operation Owasso Planning Commission June 10th, 2024 Page 2 Specify the type of carwash tunnel: are vehicles placed on a track and rolled through, or do they remain stationary within the tunnel? Consideration and appropriate action relating to a final plat request for Owasso 7, a proposed commercial subdivision on approximately 2.30 acres + / -, located near the northeastern corner of the intersection of East 961h Street North and North Garnett Road, zoned Commercial General (CG), and within the US -169 Overlay District Wendy Kramer presented the item, recommending approval. There were no comments from the audience. Mr. Miller moved, seconded by Dr. Balthrop, to recommend approval of the final plat to the City Council, subject to the following Technical Advisory Committee comments: Deed of Dedication (DoD): • Add certificate of final plat approval signature section, for City approval signatures • Section 11 -change `planning' to `planting' • Section 11 - add standard landscape language "No alteration to approved landscape plans shall be permitted without approval from the Community Development Department." • Paragraph B.5 - for clarity, remove the reference to maintaining detention /retention • Paragraph K - specify that detention is provided by the "Garnett Regional Detention Facility" • Paragraph J - reword to encompass future adjacent lots as well suggested language: "All lots (including future adjoining lots under separate plat) shall have..." Consideration and appropriate action relating to a final plat request for Silo at Smith Farm, a proposed residential single - family subdivision on approximately 13.47 acres + / -, located near the southeastern corner of the intersection of East 961h Street North and North Garnett Road, zoned Residential Neighborhood Mixed (RNX) and Commercial Shopping (CS), under Owasso Planned Unit Development OPUD 21 -02, and within the US -169 Overlay District Alexa Beemer presented the item, recommending approval. A representative for the developer addressed the commission. The subject property is approximately 4.55 acres in size and is currently zoned Agriculture (AG) within Tulsa County. Upon annexation, the applicant is requesting the property be brought into Owasso City Limits as Commercial Shopping (CS) via accompanying rezoning request (OZ 24 -01). The subject property is located north of 10800 N 137th E Ave, Owasso, OK 74055 (Tulsa Technology Campus). SUBJECT PROPERTY /PROJECT DATA Property Size 51.41 acres +/- Land Use Master Plan Commercial & Transitional Current Zoning Commercial Shopping (CS)& Residential Multi - Family (RM) Proposed Use Mixed Use (Commercial, Office, Multi - Family) Proposed Lots /Blocks 4 Lots, 2 Blocks Within a PUD? Yes; OPUD 21 -01 Within an Overlay District? Yes; US -169 Overlay District Water Provider Washington County Rural Water District #3 Streets Private Applicable Paybacks /Fees Storm Siren Fee ($50.00 per acre) Elm Creek Extended Sanitary Sewer Relief Payback Area ($1,580.00 per acre) ANALYSIS The subject property was annexed into Owasso City Limits in November of 2001 (Ord. 692) . • Section 2.3.5 of the Owasso Subdivision Regulations states that any preliminary plat not receiving subsequent final plat approval within one (1) year shall be considered null and void. The preliminary plat for the subject property was originally approved in July of 2022. An extension was requested by the applicant and was granted in writing by City Staff, extending the expiration date of the preliminary plat approval to January 11, 2024. However, the applicant did not secure final plat approval for the subject property within the extension timeline; because of this, the approval for the preliminary plat for this subject property lapsed. As such, the applicant is now requesting the preliminary plat be reconsidered by the Owasso Planning Commission, so they may begin work on the final plat of the subject property. Page 2 Preliminary Plat- Redbud Village • The proposed Preliminary Plat for Redbud Village consists of four (4) Lots on two (2) Blocks. o All of the proposed lots as depicted on this Plat meet the bulk and area requirements stipulated in the Owasso Zoning Code for CS and RM -zoned property. They also meet the bulk and area requirements outlined in OPUD 21 -01. • There will be three (3) points of access for this subdivision, all off of North 137th East Avenue. o All points of access meet the separation requirements as stipulated in the Owasso Zoning Code. • The subject plat depicts a total of five (5) Reserve Areas. o Reserve Area "A" will encompass the private streets seen within this proposed development. o Reserve Areas "B" and "C" will act as Storm Water Detention Facilities and general utility easements. o Reserve Area "D" will serve as a landscape buffer and a general utility easement. o Reserve Area "E" will serve as a landscape buffer for the adjacent residential uses to the east of the subject property. • The City of Owasso will provide police, fire, ambulance, and sanitary sewer services to the property. • Washington County Rural Water District #3 will provide water services to the property. • Perimeter and interior utility easements are shown on the Plat, and will allow utility companies adequate access to service the subdivision • Any further development that occurs on the subject property shall adhere to all development, zoning, and engineering requirements of the City of Owasso. The PUD Minor Amendment is attached to this memo. • This is a two (2) lot, one (1) block combined preliminary/final plat for a commercial development. o The proposed lots as depicted on this plat meet the bulk and area requirements stipulated in both the Owasso Zoning Code for CG -zoned property and the OPUD 06 -04 document. • Section 2.1.2 of the Owasso Subdivision Regulations states that, in certain situations, the separate preliminary platting requirements can be waived by the Community Development Department and the both the preliminary and final plats can be taken for consideration at the same time. 0 As such, this item represents a combined preliminary /final plat for the property. I - V REAL Fowl. • REAL Character • REAL CwmunRy FROM: Brian Dempster Director of Community Development SUBJECT: REVISED PUD Minor Amendment- Lakes at Bailey Ranch (OPUD 06 -04) Future Edwards Development DATE: May 14, 2024 BACKGROUND: The Community Development Department received a revised request for a Minor PUD (Planned Unit Development) Amendment to OPUD 06 -04, also known as the Lakes at Bailey Ranch PUD that was approved by City Council in 2006 as an amendment to the original Lakes at Bailey Ranch PUD 01 -02. A previous minor amendment, reducing the rear setback requirement from fifty feet (50') to twenty -five feet (25'), was approved on April 16, 2024. This revised request is for a further amendment to the rear yard setback requirements called out in the Lakes at Bailey Ranch PUD document, for property near the southwest corner of 1061h Street and Garnett Road (plat of survey attached). ANALYSIS: The underlying zoning on the property is Commercial General (CG), which was approved with OPUD 06 -04 in 2006. The request for a Minor Amendment to the PUD concerns the requirements stated in the lakes at Bailey Ranch PUD document that commercially -zoned property shall have a fifty foot (50') rear yard setback. This amendment would further reduce the minimum rear yard setback to zero feet (0'). This minor amendment would reflect the current setback requirements outlined in the Chapter 6 of the Owasso Zoning Code for property that is zoned CG, as there is no setback requirement for rear yards when CG -zoned property abuts other CG -zoned properties. The amendment should not increase the maximum density of development stipulated in the PUD document. Three previous minor amendments were approved within this PUD - two in in 2021 (to reduce the front and rear setbacks on nearby properties) and one in 2024 (to reduce the rear setback on this subject property) . The applicant is requesting a revised minor amendment to the setback requirements to accommodate a proposed medical office building. The GrOwasso Land Use Master Plan identifies this property for future commercial uses, and an office building is one such appropriate use. The large setback requirements would make it difficult for the applicant to develop their property as they intend to due to the width of the lot being small; requiring a large rear setback on said lot presents a challenge in terms of available developable area. Further, the surrounding parcels are all commercially - zoned, and therefore do not need to be buffered from the applicant's property in the same way that single- family residential development would need to be buffered. Because of this, the fifty (50) setbacks on the rear of the property can be deemed excessive. For the reasons listed above, Staff is in support of this applicant's pursuit of a Minor PUD Amendment to the rear yard setback requirements stipulated in OPUD 06 -04.
