The subject property is located south of the southwestern corner of the intersection of East 106th Street North and North Garnett Road. The PUD Minor Amendment is attached to this memo. • This is a two (2) lot, one (1) block combined preliminary/final plat for a commercial development. o The proposed lots as depicted on this plat meet the bulk and area requirements stipulated in both the Owasso Zoning Code for CG -zoned property and the OPUD 06 -04 document. • The preliminary plat for this property will be reviewed by Planning Commission, concurrent with this final plat request, at their regularly scheduled meeting on July 8, 2024. • There will be two (2) points of access for this subdivision, both off of North Garnett Road. o These access points do meet the separation requirements from each other outlined in the Owasso Zoning Code and align with the newly - constructed medians contained within Garnett Road, Final Plat- Clarity Holdings Page 2 o The plat face also depicts a mutual access easement (MAE) running parallel with Garnett Road, along the frontage of the two proposed lots. Said MAE will connect the subject property to the adjacent vacant lots to the north and south. • Detention and drainage will be provided for via a proposed detention pond, to be located just to the west of the subject property. • Perimeter and interior utility easements are shown on the plat, allowing utility companies adequate access to service the subdivision. • The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to the property. • Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements. P M /lOrt Al4N[ R .Op99p Xr IX[ m aC, Clarity Holdings nNE¢S, vma FROM: Brian Dempster Director of Community Development SUBJECT: REVISED PUD Minor Amendment— Lakes at Bailey Ranch (OPUD 06 -04) Future Edwards Development DATE: May 14, 2024 BACKGROUND: The Community Development Department received a revised request for a Minor PUD (Planned Unit Development) Amendment to OPUD 06 -04, also known as the Lakes at Bailey Ranch PUD that was approved by City Council in 2006 as an amendment to the original Lakes at Bailey Ranch PUD O1 -02. A previous minor amendment, reducing the rear setback requirement from fifty feet (50') to twenty -five feet (25'), was approved on April 16, 2024. This revised request is for a further amendment to the rear yard setback requirements called out in the Lakes at Bailey Ranch PUD document, for property near the southwest corner of 1061h Street and Garnett Road (plat of survey attached). ANALYSIS: The underlying zoning on the property is Commercial General (CG), which was approved with OPUD 06 -04 in 2006. The request for a Minor Amendment to the PUD concerns the requirements stated in the Lakes at Bailey Ranch PUD document that commercially -zoned property shall have a fifty foot (50') rear yard setback. This amendment would further reduce the minimum rear yard setback to zero feet (0'). This minor amendment would reflect the current setback requirements outlined in the Chapter 6 of the Owasso Zoning Code for property that is zoned CG, as there is no setback requirement for rear yards when CG -zoned property abuts other CG -zoned properties. The amendment should not increase the maximum density of development stipulated in the PUD document. Three previous minor amendments were approved within this PUD - two in in 2021 (to reduce the front and rear setbacks on nearby properties) and one in 2024 (to reduce the rear setback on this subject property). The applicant is requesting a revised minor amendment to the setback requirements to accommodate a proposed medical office building. The GrOwasso Land Use Master Plan identifies this property for future commercial uses, and an office building is one such appropriate use. The large setback requirements would make it difficult for the applicant to develop their property as they intend to due to the width of the lot being small; requiring a large rear setback on said lot presents a challenge in terms of available developable area. Further, the surrounding parcels are all commercially - zoned, and therefore do not need to be buffered from the applicant's property in the same way that single - family residential development would need to be buffered. Because of this, the fifty (50) setbacks on the rear of the property can be deemed excessive. For the reasons listed above, Staff is in support of this applicant's pursuit of a Minor PUD Amendment to the rear yard setback requirements stipulated in OPUD 06 -04. Stevens, Director of Managerial Services SUBJECT: Declaring a Vacancy -City Council Ward 1 DATE: July 3, 2024 BACKGROUND City Councilor Kelly Lewis submitted notice that she will be vacating the Ward 1 seat effective July 17, 2024. Section 2 -10 of the City's Charter provides authority for the remaining City Council members, by a majority vote, to appoint a successor to fill the unexpired term or until a successor is elected. The three -year term for Ward 1 will expire in 2027. Therefore, an eligible person can be appointed by the City Council to fill the seat until the next available election, where a candidate will then be elected by voters to complete the remainder of the term. PROCESS: The City Council adopted a policy in 1993 for filling vacancies within its membership. The process Is summarized as: • Vacancy is declared by receipt of a resignation letter or by vote of the remaining Council members • Council votes to publish the notice of vacancy in a local newspaper and establishes 10- day acceptance period for receiving "letters of interest" from eligible candidates. The notice must also identify the timeline for City Council action to fill the vacant seat • Letters are received by the City Clerk and copies provided to the remaining City Councilors • Within 15 days of closing the acceptance period, the City Council shall either act to appoint a successor or continue the matter until the next regularly scheduled Council meeting or to a date specific for action • Upon action, the successor will take the oath of office and be seated immediately as a member of the City Council INTERESTED CANDIDATES: To be eligible for consideration, a person must be a registered voter and live within the boundaries of Ward 1.
