Call to Order - Mayor Alvin Fruga called the meeting to order at 6:30 pm. 2. Invocation - The Invocation was offered by Pastor Mike Benson of Discovery Church. 3. Flag Salute - J.J. Discussion relating to proposed amendments to Part 4, ANIMALS, of the Owasso Code of Ordinances Beth Anne Childs presented the item and discussion was held. Consideration and appropriate action relating to the Cherokee Nation Public Safety Partners Grant and a budget amendment in the Half -Penny Sales Tax Fund David Hurst presented the item, recommending acceptance of the grant and approval of the budget amendment increasing the estimate of revenues and the appropriations for expenditures in the Fire Department by $50,000.00. There were no comments from the audience. After discussion, Mr. Dunn moved, seconded by Ms. Lewis, to accept the grant and approve the budget amendment, as recommended. Consideration and appropriate action relating to a lease agreement for the replacement of various ZOLL Emergency Medical Equipment David Hurst presented the item, recommending approval of the ZOLL One Program Master Lease Agreement between the City of Owasso and ZOLL Medical Corporation of Chelmsford, Massachusetts, in an amount not to exceed $19,917.40 monthly, contingent upon annual appropriations by the City Council, and authorization to execute all necessary documents. There were no comments from the audience. After discussion, Mr. Loving moved, seconded by Mr. Dunn, to approve the agreement and authorize execution of documents, as recommended. Report from City Manager Chris Garrett reported on the Public Works Department's beautification program, various upcoming City events, and acknowledged the City's Comprehensive Annual Financial Report qualifying for the Government Finance Officers Association Certificate of Achievement for Excellence in Financial Reporting. 13. Report from City Councilors Council Lewis announced she is moving outside the boundaries of Ward 1 and will be vacating her City Council seat effective July 17, 2024. 15. Consideration and appropriate action relating to the publication of a Notice of Vacancy on the City Council in Ward t, following the resignation of Councilor Kelly Lewis, formalizing the process for accepting letters of interest from eligible candidates to fill the vacant seat Juliann Stevens presented the item. To be eligible for retirement benefits through OkMRF an employee must have a minimum of five years of employment. Once an employee has five years of service the employee is considered vested and upon leaving employment with the City has three options depending upon age. 1. Normal Retirement is available to a vested employee age 65 or older, or age 62 with thirty years of service. 2. Early Retirement is available to a vested employee between ages 55 and 65. 3. Deferred Retirement is available to a vested employee under the age of 65. Deferred Retirement allows an employee to "defer" retirement benefits until a future date, at which time the employee would begin receiving monthly retirement benefits. July 26, 2024, will be the last day of employment for Ronald Easterling, Public Works Department. Mr. Easterling has been a participant in the OkMRF retirement plan while employed with the City since September 2016. Mr. Easterling is vested and has applied for, and meets the prerequisites for Normal Retirement. August 1, 2024 will be the last day of employment for Ronald Thompson, Public Works Department. A previous minor amendment, reducing the rear setback requirement from fifty feet (50') to twenty -five feet (25'), was approved on April 16, 2024. This revised request is for a further amendment to the rear yard setback requirements called out in the Lakes at Bailey Ranch PUD document, for property near the southwest corner of 1061h Street and Garnett Road (plat of survey attached). ANALYSIS: The underlying zoning on the property is Commercial General (CG), which was approved with OPUD 06 -04 in 2006. The request for a Minor Amendment to the PUD concerns the requirements stated in the Lakes at Bailey Ranch PUD document that commercially -zoned property shall have a fifty foot (50') rear yard setback. This amendment would further reduce the minimum rear yard setback to zero feet (0'). This minor amendment would reflect the current setback requirements outlined in the Chapter 6 of the Owasso Zoning Code for property that is zoned CG, as there is no setback requirement for rear yards when CG -zoned property abuts other CG -zoned properties. The amendment should not increase the maximum density of development stipulated in the PUD document. Three previous minor amendments were approved within this PUD - two in in 2021 (to reduce the front and rear setbacks on nearby properties) and one in 2024 (to reduce the rear setback on this subject property) . The applicant is requesting a revised minor amendment to the setback requirements to accommodate a proposed medical office building. The GrOwasso Land Use Master Plan identifies this property for future commercial uses, and an office building is one such appropriate use. The large setback requirements would make it difficult for the applicant to develop their property as they intend to due to the width of the lot being small; requiring a large rear setback on said lot presents a challenge in terms of available developable area. Further, the surrounding parcels are all commercially- zoned, and therefore do not need to be buffered from the applicant's property in the some way that single family residential development would need to be buffered. Because of this, the fifty (50) setbacks on the rear of the property can be deemed excessive. For the reasons listed above, Staff is in support of this applicant's pursuit of a Minor PUD Amendment to the rear yard setback requirements stipulated in OPUD 06-04.
