Call to Order- Mr. Miller called the meeting to order at 6:00 p.m. 2. Flag Salute - Mr. Miller led the flag salute. 3. Roll Call - A quorum was declared present. Presentation of the Character Trait of Creativity Alexa Beemer presented the character trait for the month of August. 5. Consideration and appropriate action relating to the minutes of the July 8, 2024, Regular Meeting Mr. Miller moved, seconded by Dr. Balthrop, to approve the minutes as presented. Consideration and appropriate action relating to a combined preliminary and final plat request for Corrigan Glen, proposing a multi -family residential subdivision on approximately 2.50 acres +/-, located at 10094 North 97th East Avenue, and is zoned Residential Neighborhood Mixed (RNX) under OPUD 23-06 Alexa Beemer presented the item, recommending approval. There were no comments from the audience. Mr. Miller moved, seconded by Mr. Smith, to approve the preliminary plat, subject to the following Technical Advisory Committee comments: Preliminary/Final Plat Face: ■ Remove "proposed" from "Kelly Acres" name north of the subject property ■ Add Kelly Acres plat to the location map ■ Show full widths of all existing adjacent streets ■ Consider relocating the southern access point due to a conflict with an existing utility pole, shown below: L11 L ,T__, ■ Keep topography on preliminary plat face; remove from final plat face ■ Change notations "W/E" and "SS/E" to "U/E" ■ Clearly mark detention easement location on plat using visual indicators ■ Clarify notes 11 & 12 on plat ■ Bold property lines for emphasis ■ Enlarge the plat drawing to clearly show all dashed lines easements, setbacks, etc. ■ Remove building and setback lines from the plat for clarity ■ Change "CL" notation to "Section Line" along North 97th East Avenue Owasso Planning Commission August 12, 2024 Page 2 ■ Remove pavement boundaries along North 97t" East Avenue ■ The site has two separate drainage basins - the detention easement shown on the plat only covers one basin, and any detention design must prevent increased runoff in both basins; additional easements may be needed based on the civil site design Linear Open Drainage Easements (OD/Es) along northern and southern boundaries may not be needed, depending on the detention design Deed of Dedication (DoD): ■ Remove "overland" from drainage easement sections and clarify maintenance responsibilities explicitly ■ Include specified landscaping language from final plat checklist ■ Correct 'Section IV' to 'Section III' ■ Replace all references of "Palmer 4-Plex" to "Corrigan Glen" ■ Clarify single or multiple ownership structure; remove plural references if single ownership is confirmed ■ Add language specifying the dedication and maintenance requirements for the fence and landscape easements (FL/E) ■ Remove "Homeowners Association" and "Reserve Area" refences as they are not on the plat face ■ Paragraph 1 C title mentions "Storm Sewer", but does not include corresponding section ■ Paragraph 1 E should clarify that the singular owner of the lot is responsible for maintaining stormwater facilities handling development runoff, while stormwater facilities managing offsite runoff should be publicly maintained ■ Paragraph 1 F incorrectly implies involvement of different homebuilders in roof drain requirements; the owner/developer and Engineer are responsible for designing and constructing a runoff collection system to direct water to the detention pond Other Requirements: ■ Submit civil plans to Public Works if they have not been submitted yet ■ The "Ranch Creek Interceptor Sewer Payback Area" fee of $610.33 per acre and the "Storm Siren Payback Fee" of $50.00 per acre are both due before filing the approved final plat YEA: Smith, Vines, Balthrop, Cook, Miller NAY: None Motion carried: 5-0 Mr. Miller then moved, seconded by Mr. Smith, to recommend approval of the final plat to the City Council, subject to the aforementioned Technical Advisory Committee comments. Report on items from the July 17, 2024 Technical Advisory Committee (TAC) Meeting - Brian Dempster provided an update on the annexation and rezoning of 9727 East 1 16t" Street North and reported on the site plan for Worth Audiology Clinic at 11033 East 103rd Street North. 9. Report from Planning Commissioners - Tim Miller announced his resignation, and that this will be his final Planning Commission meeting. 10. New Business - None 11. The subject property is approximately 2.56 acres in size and is currently zoned Agriculture Residential Single -Family, Rural Development (AG-R) within Tulsa County. Upon annexation, the applicant is requesting the property be brought into Owasso City Limits as Commercial Shopping (CS) via accompanying rezoning request (OZ 24-03). No Water Provider City of Owasso Applicable Paybacks/Fees Assessed at Permittin Storm Siren Fee ($50.00 per acre) ANALYSIS: • The subject property is contiguous with City limits on the southern boundary of the property. o Per Oklahoma State Statute, Title 11, Section 1 1-21-102, any territory separated by an intervening strip less than four (4) rods (which is equivalent to 66 feet) wide is considered "adjacent or contiguous to the municipality." o Considering this, the subject property is contiguous as it is separated from Owasso City Limits on its southern boundary by a strip of right-of-way that is twenty-five (25) feet wide. • Typically, property is assigned a zoning of Agriculture (AG) by default upon annexation. The applicant can also request the property retain the County's corresponding zoning designation under the Owasso Zoning Code, or seek a concurrent rezoning based on what the GrOwasso 2035 Land Use Master Plan prescribes. o In this case, the applicant is requesting that the subject property be annexed and assigned a zoning of CS, via a concurrent rezoning request. • The GrOwasso 2035 Land Use Master Plan identifies the subject property for future "Commercial" uses. o As such, assigning a zoning of CS to the subject property upon annexation is consistent with the long-range vision for the property laid out in the Master Plan. • The subject property is currently unplatted, but will be required to go through the platting processes prior to issuance of any commercial building permit(s). RECOMMENDATION: In developing a recommendation, staff evaluated Oklahoma State Statute, Title 11, Chapter 1, Part 1, Article XXI, Section 21-101 and Section 1.4.3 of the Owasso Zoning Code. Following this evaluation, staff concluded that the subject annexation and rezoning requests meet all of the legal requirements for approval. As such, staff recommends approval of annexation request OA 24-03 and concurrent rezoning request OZ 24-03, annexing the subject property into Owasso City Limits with an assigned zoning of Commercial Shopping (CS), subject to TAC comments. The subject property is located at the southeastern corner of East 106th Street North and North Garnett Road and is addressed as 11328 East 106th Street North. SUBJECT PROPERTY/PROJECT DATA: Property Size 1.46 acres +/- Land Use Master Plan Commercial Current Zoning Commercial Shopping (CS) Proposed Use Automotive Repair and Maintenance- Carwash Within a PUD? No Within an Overlay District? No Water Provider City of Owasso Sanitary Sewer Provider City of Owasso Applicable Paybacks/Fees (Assessed at Platting) Meadowcrest Relief Sewer Payback Area ($867.00 per acre) Ranch Creek Interceptor Sewer Payback Area ($610.33 per acre) Storm Siren Fee ($50 per acre) ANALYSIS: • The subject property was annexed into Owasso City Limits in July of 2024 (Ordinance 1221). • A SUP is required in certain zoning districts for uses or structures that may be considered more intense than what is allowed by right, through the City of Owasso's Zoning Code. • A carwash facility falls under the "automotive repair and maintenance" use category outlined in Table 6.1 of the Owasso Zoning Code. In the CS zoning district, any "automotive repair and maintenance" facility is allowed with an SUP. o Thus, an SUP is needed for a carwash on this property, as it is zoned CS. • The GrOwasso 2035 Land Use Master Plan identifies the subject property for future commercial uses. o All surrounding parcels immediately adjacent to the subject property are also identified for future commercial uses. Page 2 SUP 24-02 • The applicant has worked with staff to design the site and new structure in an appropriate manner that conforms to the design requirements of the Zoning Code. o The proposed car was will be a 6-bay structure, composed of EIFS and concrete masonry block, thus meeting the fapade requirements for commercial structures seen within Chapter 11 of the Owasso Zoning Code. ■ Phase 1 will construct four (4) bays. Phase 2 will be comprised of the remaining two (2) bays. o According to the conceptual site plan, the proposed structure is oriented with the wash bays oriented east/west. The site plan also shows eight (8) vacuum stalls, all be located on the south side of the carwash, abutting vacant commercial property. o The proposed structure appears to meet all setback requirements for CS -zoned properties, as outlined in Chapter 6 of the Owasso Zoning Code. o The conceptual site plan shows landscaping beds along all four sides of the subject property. All landscaping requirements outlined in Chapter 19 of the Owasso Zoning Code will have to be met. Screening fences are not required along the boundaries of this subject property, as all of the surrounding parcels are also commercially -zoned. o As indicated on the conceptual site plan, the applicant intends to install lighting immediately adjacent to the proposed building, adjacent to the internal drive aisle. All lighting will have to comply with Chapter 20 of the Owasso Zoning Code. o The applicant has indicated that the noise levels put out by the carwash will not exceed the allowed decibels per the adopted Owasso Noise Ordinance. ■ While the car wash will be operational twenty-four (24) hours per day, the applicant has indicated that cars remain stationary within the bays while in use. Therefore, the doors will remain closed during the night operation hours of 9:OOpm to 7:OOam, to further dampen any noise from the dryer blowers. o The dumpsters for the site will be located on the southwestern corner of the property and will be fully screened, per Chapter 19 of the Owasso Zoning Code.
