TUESDAY, DECEMBER 3, 2024
The Owasso City Council met in regular session on Tuesday, December 3, 2024, in the Council Chambers
at Old Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting filed Friday, December
8, 2023; and the Agenda filed in the office of the City Clerk and posted at City Hall, 200 South Main Street,
at 12:00 pm on Wednesday, November 27, 2024.
1. Call to Order -Mayor Alvin Fruga called the meeting to order at 6:30pm.
2. Invocation - The Invocation was offered by Matt Thomason of First Church Owasso.
3. Flag Salute - Councilor Bonebrake led the flag salute.
4. Roll Call - A quorum was declared present.

S. Presentation of Character Trait of Trustworthiness - Michele Dempster presented the character trait for
the month of December.
6. Consideration and appropriate action relating to the Consent Agenda. (All matters listed under
"Consent" are considered by the City Council to be routine and will be enacted by one motion. Any
Councilor may, however, remove an item from the Consent Agenda by request. A motion to adopt the
Consent Agenda is non -debatable.)

C. Approve a budget amendment in the Healthcare Self -Insurance Fund, increasing the
appropriation for expenditures by $50,982.81, following receipt of a stop loss reimbursement
D. Accept the Justice Assistance Grant, authorize the execution of the grant contract with the
Oklahoma Attorney General's Office, and approve a budget amendment in the Half -Penny
Sales Tax Fund (Police) increasing the estimated revenue and the appropriation for
expenditures by $9,600.00
E. Declare the 2019 Ford F150 (VIN 1 FTEW 1 E59KKC42419) as surplus to the needs of the City and
authorize disposal of the vehicle
F. Declare the 2013 Chevrolet Tahoe (VIN I GNLC2E03DR156633) as surplus to the needs of the
City and authorize disposal of the vehicle
G. Declaring the 2016 Dodge Charger (VIN IGNLC2E03DR156633) as surplus to the needs of
the City and authorize disposal of the vehicle
H. Accept the public infrastructure of a concrete sidewalk along East 96th Street North and
North 97th East Avenue, two approaches, potable waterlines, stormwater piping, and a
sanitary sewer manhole for Twill at Bailey Creek .
I. Accept the Fire Station No. 1 and Fire Station No. 2 Renovation Projects and authorize final
payment to Limestone Construction, Inc., of Owasso, Oklahoma, in the amount of
$92,321.95
Mr. Bonebrake moved, seconded by Mr. Loving, to approve the Consent Agenda as presented, with
claims totaling $767,588.50

8. Consideration and appropriate action relating to the purchase and implementation of an upgrade to
the City's existing Enterprise Resource Planning (ERP) Software
Steve Tibbles presented the item, recommending authorization to purchase an upgrade of the City's
ERP software in the amount of $387,193.75 with Central Square Technologies, LLC of Lake Mary, Florida,
and authorization to execute all necessary documents. There were no comments from the audience.
After discussion, Mr. Walter moved, seconded by Mr. Bonebrake, to authorize the purchase and
execute documents, as recommended.
YEA: Bonebrake, Loving, Walter, Fruga
NAY: None
Motion carried: 4-0
9. Consideration and appropriate action relating to the purchase of right-of-way for the East 96th Street
North and North 145th East Avenue Intersection Improvement Project
Roger Stevens presented the item, recommending authorization for payment of $1,026,000.00 for the
acquisition of right-of-way and compensation for damages located at 9732 North 1451h East Avenue
with $513,000.00 payable to the Charles W. Helscel Revocable Trust and $513,000.00 payable to the
Charlotte Helscel Revocable Trust. There were no comments from the audience. After discussion, Mr.
Bonebrake moved, seconded by Mr. Loving, to authorize payment, as recommended.

10, Consideration and appropriate action relating to the purchase of right-of-way for the East 96th Street
North and North 145th East Avenue Intersection Improvement Project
Roger Stevens presented the item, recommending authorization for payment of $139,200.00 to Tyann
Development Company, LLC for the acquisition of right-of-way and compensation for damages
located at the southwest corner of East 96th Street North and North 145th East Avenue. There were no
comments from the audience. Mr. Bonebrake moved, seconded by Mr. Walter, to authorize payment,
as recommended.

11. Presentation of the monthly Public Works Project Status Report -Roger Stevens presented the item and
discussion was held.
12. Report from City Manager - Chris Garrett reported on previous and upcoming city events.

14. Report from City Councilors - Mayor Fruga recognized police officer, Johntay Malone.

The Owasso City Council, Owasso Public Works Authority (OPWA), and Owasso Public Golf Authority
(OPGA) met in a joint regular meeting on Tuesday, December 10, 2024, in the Council Chambers at Old
Central, 109 North Birch Street, Owasso, Oklahoma, per the Notice of Public Meeting filed Friday, December
8, 2023; and the Agenda filed in the office of the City Clerk and posted at City Hall, 200 South Main Street,
at 12:00 pm on Friday, December 6, 2024.

BACKGROUND:
In 2004, the City Council approved a policy establishing the Healthcare Self -Insurance Fund for
employee health, dental, and vision insurance. This fund covers the cost of claims and
administrative fees associated with health, dental, and vision coverage, with funding provided by
premiums paid by employees and departments.
Self -Insurance means that, instead of paying premiums to an external insurance company, the
City pays claims directly through a third -party administrator. This approach enables the City to
retain any unspent budgeted funds. To manage risk, the City carries Stop Loss coverage, which
limits liability for any single individual. If a claim exceeds the Stop Loss limit, the excess costs are
covered by the Stop Loss carrier.
Effective July 1, 2024, the City transitioned its Stop Loss coverage from AETNA to Sun Life, resulting
in $400,000 in premium savings. With this transition, the City is required to pay the full amount of all
claims upfront, with reimbursement for claims that exceed the Stop Loss limit.
These reimbursements are credited to the Healthcare Self -Insurance Fund as revenue. A budget
amendment is required to account for the increased expenditures associated with claims that
surpass the Stop Loss threshold.
STOP LOSS REIMBURSEMENTS RECEIVED:
The City has received a Stop Loss reimbursement of $10,942.45. This amount has been credited to
the "reimbursements and refunds" line item in the Healthcare Self -Insurance Fund. A budget
amendment is required to allocate these funds for future claims expenditures.

BACKGROUND:
The subject commercial development is located at 10100 North Garnett Road. Public
infrastructure improvements consist of a fire hydrant relocation and fire line.
FINAL INSPECTIONS:
Final inspections for the infrastructure components were completed in December 2024, by the
Public Works Department. All standards for acceptance have been met. Additionally, the
construction contractor has supplied the necessary two-year maintenance bond.
RECOMMENDATION:
Staff recommends acceptance of the public infrastructure improvements at First Christian Church
of Owasso.

AN ORDINANCE RELATING TO PART 4, ANIMALS, OF THE CODE OF
ORDINANCES, CITY OF OWASSO, ADDING IN PART, AMENDING IN PART, AND
REPEALING IN PART, VARIOUS SECTIONS; ESTABLISHING AN EFFECTIVE
DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA:
ARTICLE A — GENERAL PROVISIONS
SECTION ONE (1): Section 4-101 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 4-101
The following words and phrases when used in this Part 4 shall have the meanings prescribed in
this section except in those cases where the context clearly indicates a different meaning:
Adequate Shelter means a structure or area of structural soundness with three (3) sides, a
waterproof roof, solid floor, adequate bedding material, positioned to allow for protection from
north and west winds, proper ventilation, and which is suitable for the species, age, condition, size,
and type of animal which is safe and protects each animal from injury, precipitation, direct
sunlight, adverse effects of extreme heat or cold, enables the animal to be clean and dry, and is 6"
longer than the animal, nose to tail, and 6" taller than the head of the animal while standing,
allowing for retention of the animal's body heat. Wildlife, livestock, and other non -domesticated
animals normally residing outdoors shall only be required to have appropriate shelter from extreme
weather through natural or artificial means available to it to protect the animal.
Altered Animal means an animal that has been spayed or neutered. Neutered means a process
performed by a veterinarian or other person authorized by law which removes the reproductive
organs of any male animal. Spayed means a process performed by a veterinarian or other person
authorized by law, which removes the reproductive organs of any female animal.
Animal Control Officer means the person or persons employed by the City in the Police
Department under the control and supervision of the Chief of Police as the officer or officers in
charge with the duty of enforcing the provisions of this Part 4 and others relating to the control of
animals, to include commissioned police officers.
Animal Shelter means any premises officially designated and operated by the City, including the
actual premises where animals are regularly kept, or places where the Chief of Police may
designate for the purpose of keeping or impounding stray, neglected, abused or seized animals and
provide adequate care. The Animal Shelter may also include facilities to provide for animal
adoptions, education, citizen involvement, and spaying or neutering of animals.
Animal Welfare Group means a 501(c)(3) non-profit organization which is registered and
approved by the Police Chief of the City of Owasso of a designee and has a purpose to provide for
the welfare and/or protection of animals. The registration may be revoked if any member has a
record of cruelty to animals, is under eighteen (18) years of age, owns animals which are in
violation of any requirements of this Part 4, refuses to comply with the adoption requirements of
the City, has released two or more animals to the custody of the City, lacks adequate housing
and/or fencing to contain the animals, or has a conviction in Municipal Court for violation of this
Part 4.
At Heel means an animal within a radius of ten (10) feet of the owner and obedient to the owner's
commends.
At Large means an animal that is (1) off the premises of its owner and not securely and physically
restrained by means of a harness, leash, or other device designed to restrain such animal; or (2) not
confined on the premises of the owner or at heel on those premises.
Commercial Kennel means any business or establishment, whether operated separately or in
connection with another business or establishment that keeps, boards, sells, shows, and/or trains
dogs and/or cats for profit, except for an Animal Hospital.
Confined on the Premises means the condition in which an animal is secured and physically kept,
restrained, restricted or contained on and within the premises of the owner by means of walls,
fences, leashes or other devices designed to contain the animal at all times.
Dangerous Animal Dog means an animal a dog whose behavior, temperament, size, or any
combination thereof, when considered under the totality of the circumstances, including the nature
of the surrounding area, constitutes a reasonable risk of injuring a human or animal or damaging
personal or real property. That behavior includes, but is not limited to, anal a dog biting, or
attacking, or attempting to attack a human or another animal. However, this definition shall not
apply to any animal that has been subject to provocation or if the victim has been trespassing as
set forth in the Code of Ordinances.
Feral Cat means a cat that was either born in the wild or has reverted to a wild state due to
abandonment or lack of domestication and has no owner. Any feral cat which has been captured
and neutered or spayed and returned to the wild shall continue to be classified as a feral animal.
Foster Home means any premises owned by an individual who works under the direction of an
approved Animal Welfare Group registered with the City who will take in stray or unowned dogs
and/or cats, or other animals, for the purpose of providing temporary care up to six (6) months for
each animal. A temporary care extension may be requested and granted for up to an additional
three (3) months for an animal if there is proof of a documented medical condition that requires
the extended temporary housing or indefinitely for an elderly dog or cat if recommended by a
veterinarian.
Livestock means cattle, sheep, horses, goats, donkeys, mules, and other domestic animals
ordinarily raised or used on a farm.
Nuisance Animal means an animal that (1) Damages the property of anyone other than its owner;
(2) Habitually prowls around, on, or over any premises not the property of its owner to the frequent
annoyance of the owner or occupant of those premises: (3) Habitually overturns any garbage can
or other container; (4) Chases or kills any domesticated animal or domesticated bird; (5) Annoys
or disturbs any person by loud and frequent barking, howling, yelping, or causes noise in an
excessive, continuous or untimely fashion/manner so as to interfere with the reasonable use and
enjoyment of neighboring private premises; (6) Habitually or repeatedly chases, snaps at, or barks
at pedestrians, joggers, bicycles, or vehicles; (7) Disturbs the rights of, threatens the safety of, or
injures a member of the general public.
Owner means any person, firm, or corporation owning or keeping an animal, the occupant of any
premises on which an animal remains and provides food or water regularly for the animal or regular
or ongoing non -emergency medical care for a period of seven (7) days or more or is identified by
a City pet license or microchip registration.
Rescue Organization means any facility operated by a 501(c)(3) non-profit Animal Welfare Group
where dogs and/or cats, or other animals are kept and are provided temporary housing for an animal
for up to one (1) year and up to an additional six (6) months if there is documented proof of a
condition that requires the extended temporary housing and care for the purpose of placing them
into a permanent home.
Service Animal means a dog or miniature horse that has been individually trained to do work or
perform tasks for the benefit of an individual with a disability, including an individual with a
disability, including a physical, sensory; psychiatric, intellectual, or other mental disability. The
Americans with Disabilities Act(ADA) rules provide that other animals, whether wild or domestic,
do not qualify as service animals. -Dogs that are not trained to perform tasks that mitigate the
effects of a disability, including dogs that are purely for emotional support, are not service animals.
Unprovoked means an act of aggression towards an animal or human that occurs without apparent
cause, reason, prompting or motivation.
SECTION TWO (2):- Section 4-102 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-102 ANIMALS NOT TO BE AT LARGE
A. It shall be unlawful for any person to knowingly or unknowingly permit their dog to be at
large anywhere within the City limits. Any dog so found may be impounded and/or the owner
cited by the City.
B. It shall be unlawful for any person to knowingly or unknowingly permit their cat to be at
large unless the cat is altered and current on its vaccinations as required by this Part 4.
C. It shall be unlawful for any person to knowingly or unknowingly permit their fowl or other
animal to be at large anywhere within the City limits.
SECTION THREE (3): Section 4-103 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-103 TURNING ANIMALS AT LARGE UNLAWFUL
It shall be unlawful for any person to open any enclosure in which any animal is confined as
required by ordinance so as to turn the animal at large, or in any manner to turn the animal at large.
SECTION FOUR (4): Section 4-104 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-104 SWINE NOT TO BE KEPT IN THE CITY
It is unlawful for any person to keep swine, a hog, pig or boar within the City except in an enclosure
awaiting immediate transportation.
SECTION FIVE (5): Section 4-105 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-105 LIVESTOCK WHICH MAY KEPT
A. It is unlawful to keep or maintain livestock in the Owasso city limits except as provided in
this section.
B. Any livestock shall be kept, maintained, or stabled in a fenced enclosure which shall be no
less than one and half (1.5) acre in size. Livestock maintained and utilized for an educational
purposeadministered by an educational facility or institution that is accredited by the State of
Oklahoma shall not be subject to the restrictions below establishing the number of livestock that
may be maintained based upon the size of the fenced enclosure.
C. One livestock animal may be maintained for each 1.5 acres within the fenced enclosure.
D. The owner or person in charge of livestock maintained in a fenced enclosure shall provide
fences or barriers of such height and sufficient strength as may be necessary to prevent escape.
All enclosed structures used for housing livestock shall be set back a minimum of fifty (50) feet
from adjoining residentially or agriculturally zoned property. This provision shall not apply if a
dwelling unit is constructed to encroach upon an existing livestock use, except that such livestock
use may no longer expand toward the newly established dwelling. This provision is not applicable
when livestock are maintained and utilized for an educational purpose administered by an
educational facility or institution that is accredited by the State of Oklahoma.
E. The owner or person in charge of premises where livestock is maintained shall maintain
such premises in a sanitary condition not offensive or dangerous to the public and must clean or
cause to be cleaned the premises each day and remove and dispose of all trash, refuse, rubbish and
animal excrement each day an animal is kept penned or contained in or upon such premises.
SECTION SIX (6): Section 4-106 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 4-106 KEEPING OF CHICKENS
Chickens, which includes laying hens, may be kept in all residential areas so long as all of the
following conditions are met:
a. Chickens shall be maintained on land upon which the owner or occupant resides.
b. No more than six (6) chickens or laying hens and ten (10) chicks are allowed per parcel.
C. Roosters are not allowed.
d. Chickens shall be kept within a designated chicken coop and chicken run unless supervised
and contained within a fenced yard.
e. The chicken coop and chicken run shall be located in the rear or backyard of a residential
property. No part of a chicken coop or chicken run shall be located in the front yard.
f. The chicken coop and chicken run shall be attached and shall be set back no less than ten
feet (10') from the side property line and no less than ten feet (10') from the rear property line.
The chicken coop and chicken run shall be set back no less than twenty-five feet (25') from any
dwelling unit other than the owner's. Moveable chicken enclosures are permitted so long as they
meet the setbacks indicated in this section.
g. During daylight hours, chickens shall have access to a chicken run and a chicken coop.
h. From dusk until dawn, chickens shall be kept within the chicken coop as protection from
predators.
i. Chicken coops and chicken runs shall be predatory resistant.
j. The outside opening of any, enclosuresshall be screened to prevent the spread of disease
by flies and vermin.
k. Water shall be provided onsite and accessible to chickens at all times.
1. Chicken enclosures shall be cleaned regularly to prevent an accumulation of food, fecal
matter, or nesting material from creating a nuisance or condition due to odor, vermin, debris, or
decay.
in. Outdoor slaughter of chickens is prohibited.
n. Electrical and heat sources for chicken structures shall comply with the City's building
codes.
SECTION SEVEN (7): Section 4-107 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-107 NUMBER OF DOGS AND CATS ALLOWED
It is unlawful for any person to harbor or keep more than three (3) dogs and three (3) cats. This
limitation shall not be applicable to any litter of puppies or kittens for a period of ninety (90) days

from birth if the puppies or kittens are born to any adult dog or cat permanently maintained on
such premises.
SECTION EIGHT (8): Section 4-108 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-108 ADEQUATE SHELTER AND TETHERING
A. It shall be unlawful for the owner or person in charge of any dog or cat to fail to provide
adequate shelter as the term is defined herein.
B. It shall be unlawful for the owner of any dog to keep or maintain the animal on a tie -out,
tether, picket, or similar device consisting of a rope, cable, or other type of tether without access
to water and shelter. It shall be unlawful for the owner of any dog to keep or maintain the animal
on a tie -out, tether, picket, or similar device in such a way as to subject the animal to entanglement
that could cause the animal any injury or clear discomfort.
SECTION NINE (9): Section 4-109 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-109 SANITATION AND ANIMAL EXCREMENT
A. All owners or persons having charge or control of any premises where the keeping of dogs
or cats are permitted shall pick up and remove daily from the area within or upon which such dogs
and cats are kept or maintained all animal excrement and shall thereupon place or cause same to
be placed in an enclosed, fly -proof container. The owner shall further prevent any offensive,
disagreeable or noxious smell, stench or odor to arise from such area within or upon which any
dog or cats may be kept or maintained. Upon failure to comply with the provisions of this section,
the keeping of dogs or cats and the area within which they are confined or restrained shall
constitute a nuisance.
B. It shall be unlawful for any person to allow an animal within their control to defecate on
public or private property, other than that of the owner, unless such person shall immediately
remove the excrement deposited by the animal in a sanitary method.
SECTION TEN (10): Section 4-110 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-110 REGISTRATION OF RESCUE ORGANIZATIONS, ANIMAL
WELFARE GROUPS, AND FOSTER HOMES
All rescue organizations, welfare groups, and foster homes shall apply for and receive a permit
from the City prior to beginning operations. Applications shall be submitted in writing to the
Owasso Animal Shelter. The Police Chief or a designee and the Aliifflal Sh shall notify the
applicant in writing of their acceptance or denial for a permit within thirty (30) days of the
application. The total number of animals allowed by a rescue permit holder or foster home shall
be no more than a maximum of four (4) dogs or six (6) cats. The total number of dogs and cats
may not be combined. The Chief of Police or a designee may revoke the permit of a rescue
organization, welfare group, or foster home for any reason and at any time to ensure proper care
for the animals housed or to ensure the health and safety of Owasso citizens.
SECTION ELEVEN (11): Section 4-111 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-111 RESERVED
SECTION TWELVE (12): Section 4-112 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-112 FEES AND CHARGES
A. The City Council by motion or resolution shall determine the fees to be charged for the
care, disposition, and impoundment of animals. Fees may include, but not be limited to
impoundment, room and board, sterilization, special equipment or services, veterinary care,
quarantine and impoundment of animals that injure humans or are suspected to have rabies,
relinquishment, dead animal disposal, licensing, and others as deemed appropriate.
B Any person redeeming an impounded animal shall pay the required fees to the Animal
Control eer. City.
SECTION THIRTEEN (13): ` Section 4-113 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-113 ANIMAL CONTROL OFFICERS AUTHORIZED TO INSPECT
The Animal Control Officers are specifically authorized, upon complaint of any person or their
own initiative, shall inspect any structure or place where an animal is kept and may issue any such

SECTION SEVENTEEN (17): Section 4-117 of the Code of Ordinances of the City of

A. All reptiles held as pets shall be contained within secure habitats capable of preventing
escape.
B. It shall be unlawful for any person to knowingly and intentionally harbor, possess, or keep
large reptiles, such as snakes, or lizards that are capable of exceeding forty (40) pounds at an adult
age on any lot, or any venomous reptile on any premises or in any structure.
C. Any species of reptile not indigenous to the State of Oklahoma shall not be released or
abandoned by their owners and/or handlers in the City of Owasso.
SECTION EIGHTEEN (18): Section 4-118 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-118 PROHIBITION ON KEEPING WILD AND EXOTIC ANIMALS
It shall be unlawful for any person to keep, harbor, maintain or have in his/her possession or under
his/her control within the City, any venomous reptile or other wild animal, insect, or other exotic
animal not generally recognized to be domesticated or which, because of size, vicious nature or
any other characteristic. The provisions of this Section shall not apply to veterinarians harboring
such animals for purposes or providing professional medical treatment; provided that, all animals
kept pursuant to this exception shall be confined in quarters so constructed and maintained as to
prevent escape.

SECTION TWENTY-ONE (21): Section 4-121 of the Code of Ordinances of the City of

The owner of every in -tact dog or cat shall annually register the in -tact dog or cat by giving the
animal control officer the name and address of the owner, the name, breed, color and sex of the
animal, as well as the date of vaccination and by whom vaccinated, and such other reasonable
information as the animal control officer may request. Each permit issued shall be effective for a
period of one or three years, at the option of the owner. It shall be issued upon payment of all
required fees and verification of rabies vaccination sufficient to immunize for the entire permit
period. Voluntarily licensing stations operated by a 501(c)(3) nonprofits or veterinarians may
retain $4.00 of the pet licensing fees with the remainder of such fee amounts to be remitted to the
City. Persons exempted firom the provisions of this Section are those who have obtained a written
certification from a licensed veterinarian that it is necessary to postpone or preclude an animal
firom being spayed or neutered.
SECTION TWENTY-TWO (22): Section 4-122 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-122 PROHIBITION OF DOGS AND CATS IN CERTAIN AREAS
Regulations pertaining to the prohibition and exceptions of live animals on the premises of a food
establishment as set forth in the Oklahoma Administrative Code shall be enforceable as if set out
in full. Persons exempted from the provisions of this Section are those who have Service Animals
as defined herein.

An animal shelter is hereby established under the jurisdiction of the police department. It shall be
under the immediate control of the animal control officers or of such other person as may be
officially designated. The person in charge of the shelter shall provide proper sustenance for all
animals impounded and shall treat them in a humane manner
SECTION TWENTY-SEVEN (27): Section 4-131 of the Code of Ordinances of the City
of Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-131 AUTHORITY OF ANIMAL CONTROL OFFICERS
A. Animal Control Officers:
1. May seize and impound any animal found at large in violation of any provision of
ordinances of the city;
2. May enter upon the property, yard, enclosure, garage or shed, of the owner or other private
premises to take such animal into custody, whether in the immediate presence of the owner or
custodian or otherwise as provided;
3. May seize and impound any abandoned animal, any animal required to be licensed by this
Part 4, any dangerous dog, any animal which is a nuisance and any animal suspected to be afflicted
with rabies.
B. Animal Control Officers are empowered and authorized to enforce all aspects of this Part
4. Further, they are authorized and empowered to issue citations to any person in violation of the
Part 4.
SECTION TWENTY-EIGHT (28)i Section 4-132 of the Code of Ordinances of the City
of Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-132 ANIMALS TO BE IMPOUNDED
A. Animals which are taken into custody as provided in this section, shall be subject to humane
disposition by adoption, donation, euthanasia, transfer to an animal welfare group, an animal
rescue group, or other animal welfare facility, or other reasonable disposition by an Animal
Control Officer after three (3) days have elapsed after taking the animal into custody, not to include
Sundays and city holidays, provided the animal is not redeemed or claimed as provided in this Part
4. A description of the animal, the location and date the animal was taken into custody, the
deadline for the animal to be claimed, and date of availability for adoption shall be available in the
Owasso Animal Shelter for viewing by all interested person. Impoundment kittens and puppies
which enter the shelter in groups of three (3) or more and are under four (4) months of age without
a known owner or mother may, at the discretion of the shelter staff, be exempted from any required
hold times prior to their release. No live animals shall be released or sold to any facility for
educational, scientific, and/or medical research.
B. If the owner is identifiable by tag, microchip, city records, or other means, an Animal
Control Officer shall notify the owner at the address on the registration, tag, microchip, city records

or other means, that the animal is in custody and will be subject to disposition if not timely claimed
as provided in this Section.
C. Notice may be given to the owner or may be left at the owner's address with any member
of the family over fourteen (14) years of age. If no person can be contacted at the address, a
certified letter will be sent to the address by the Owasso Animal Shelter. If no response is received
from the owner within seven (7) days not to include Sundays and City holidays, from the date that
contact is made at the owner's address or the certified letter is mailed, the animal shall become the
property of the City of Owasso and will be subject to disposition as provided in this Part 4.
D. Any feral, sick or injured animal as would ordinarily require the animal's destFaetion
humane euthanization or treatment by a veterinarian, the Police Chief or designee may order its
destruetion humane euthanization if the ownership of such animal cannot be determined within a
reasonable period of time. Provided that, no animal suspected of being rabid or otherwise diseased
shall be destroyed until such destruction is recommended by the Police Chief or designee.
E. Should it be determined that the owner of an impounded animal is experiencing a situation
that prohibits him or her from reclaiming or arranging the release of the animal in a timely and
reasonable manner, the Police Chief or designee may seek an order from a judge of competent
jurisdiction for the release of the animal into the care and custody of the Animal Shelter or to a
responsible party in order that the highest level of long-term care and safety of the animal may be
provided for.
F. Animals in the custody of the Animal Shelter or partnering organizations as part of a Trap
Neuter Return (TNR) program or a return to field program may be returned to their original
location in accordance with common program standards. Further, cats trapped from identified
feral colonies and placed in the custody of the Animal Shelter who have no identifiable owner
may, after necessary holding times, alterations, examinations, and vaccinations be returned to their
original location at the direction of the Police Chief or designee.
SECTION TWENTY-NINE (29): Section 4-133 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-133 OWNER RELINQUISHMENT OF DOGS AND CATS.
The Animal Shelter shall accept any dog or cat from within the City limits that the owner desires
to release to the Shelter. The owner shall sign a release form vesting all rights and title to the dog
or cat to the Animal Shelter. All dogs or cats relinquished will be screened for placement into the
adoption program or for transfer to another animal welfare rescue, animal welfare group, or animal
welfare facility. If the dog or cat is not acceptable for placement into the adoption program or
determined not to be transferable for any reason, including, but not limited to disease, injury, or
illness, available space in the Shelter, and temperament, then the dog or cat may be euthanized.
SECTION THIRTY (30): Section 4-134 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:

SECTION 4-134 REDEMPTION OF ANIMALS
An owner of an impounded animal may redeem the animal prior to its disposition as provided for
herein by paying the required fees, providing satisfactory proof of ownership, and meeting any
other requirements which may be prescribed in this Part 4. An animal confined for rabies
observation or other infectious disease may not be reclaimed until the animal control officer
authorizes the release or until the observation period is over.
SECTION THIRTY-ONE (31): Section 4-135 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-135 ABANDONMENT OF CATS AND DOGS; REPORTING OF FOUND
ANIMALS.
A. No person shall abandon or desert their dog or cat or permit such animal to become a stray.
Any dog or cat found at large not wearing any tag indicating proof of current vaccination against
rabies, having a microchip, or that the owner is a City resident, shall be presumed abandoned, and
will be impounded by the City.
B. Any person who takes possession of, keeps or harbors an animal that reasonably appears
to be at large or stray shall make notification to the Animal Shelter within twenty-four (24) hours.
Such notification shall include a complete and accurate description of the animal, when and where
it was located, where it is being housed, and contact information for the reporting person. The
person reporting the animal shall additionally ensure that the animal is scanned for a microchip or
inspected for identifying markings by an animal shelter, medical provider, or rescue group.
SECTION THIRTY-TWO (32): Section 4-136 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-136 REFUSAL OF ADOPTION
Adoption or sale may be refused to anyone the Police Chief determines meets one (1) or more of
the following: (1) Has a record of cruelty to animals; (2) Is under eighteen (18) years of age; (3)
Has committed acts of harassment to animals; (4) Owns other animals which are in violation of
any requirement of this Part 4; (5) Refuses to comply with adoption requirements; (6) Has released
two (2) or more animals to the Animal Shelter in the preceding twelve (12) months; (7) Lacks
adequate housing and/or fencing to contain the animal(s); or (8) Has a conviction in Municipal
Court for any violation of this Part 4.
SECTION THIRTY-THREE (33): Section 4-137 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:

SECTION 4-138 UNLAWFUL ENTRY; INTERFERENCE WITH AN OFFICER
No unauthorized person shall:
a. Break or attempt to break open the shelter or take or let any animal therefrom;
b. Take or attempt to take from any officer or employee of the city any animal taken into
custody as provided by this chapter; or
C. In any manner interfere with or hinder an officer or employee in the discharge of his duties
relating to the taking into custody and impounding of animals as provided in this chapter.
SECTION THIRTY-FIVE (35): Section 4-140 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows
SECTION 4-140 CRUELTY TO ANIMALS
A. No person shall willfully or maliciously: (1) torture, cruelly beat, injure, maim, mutilate,
or unjustly destroy or kill any animal; (2) Deprive any animal in subjugation or captivity of food
generally accepted as being nutritious, potable drinking water, or adequate shelter; (3) Unjustly
administer any poison or noxious drug or substance to any animal; (4) Unjustly expose any drug
or substance with the intent that the same shall be taken by animal, whether such animal be the
property of that owner or another person.
B. It shall be unlawful for any person to leave any animal in any standing or parked vehicle,
box, container or other situation without providing for adequate ventilation nor shall a person allow
an animal to be exposed to extreme temperature while contained in a vehicle, box, container, or
other situation which would likely cause distress; harm or death to the animal.
C. It shall be unlawful for any person to intentionally torment, harass, throw objects at,
verbally or physically confront any animal, whether confined or unconfined, in a manner to cause
unjustified agitation or injury to the animal.
D. It shall be unlawful for any person to cause an animal to be overloaded or forced to work
in a manner unsuitable to its species, breed, condition, or health so as to cause injury to the animal.
E. It shall be unlawful for ;any person to fail to provide or to deprive any animal in their
possession, care or control, reasonable medical or necessary veterinary care if the animal is sick,
diseased, and/or injured.
F. It shall be unlawful to participate in, assist with, sell transport, or otherwise allow any
animal to be provided to another person as a promotional item, prize to be given away at any event,
festival, carnival, or parade.
G. Animal Control Officers or Police Officers are hereby authorized to remove, impound or
take possession of any animal which has been treated in violation of this Section.

City. Animal Welfare Groups registered with and approved by the City are exempt from the
provisions of this Section when conductingadoption events on property not owned by the group
with authorization from the property owner.

A. Every person owning, possessing, harboring or keeping within the City any dog or cat over
the age of six (6) months shall cause the animal to be surgically spayed or neutered, unless a
licensed veterinarian has certified, in writing, that it is necessary to postpone or preclude an animal
from being spayed or neutered. If a licensed veterinarian has so certified, any person who owns,
possesses, harbors or keeps a dog or cat over the age of six (6) months within the city shall keep
such documentation readily available and shall promptly provide it to Animal Control Officers or
other city officials upon request.
B. A rebuttable presumption that a dog or cat has not been spayed or neutered is established
in the event the owner of a dog or cal over the age of six (6) months is unable to produce
documentation of spay or neuter. In such event, an animal control officer shall issue a citation to
the owner requiring that the dog or cat be spayed or neutered within thirty (30) days. Failure to do
so will result in issuance of additional citations. Persons excepted from this Section are those who
obtain an In -Tact Permit for the dog or cat from the City as provided herein.
C. No dog or cat may be released for adoption from the City Animal Shelter unless said animal
has been surgically spayed or neutered. Animals exempt from this Section are those in which a
licensed veterinarian designated by the City of Owasso has determined that the animal is at risk of

death or other serious medical condition if spay or neuter surgery is performed or are too you110 to
be spayed or neutered and arrangements are made for the animal to be spayed or neutered within
a set period of time.

SECTION 4-170 QUARANTINE OF ANIMALS FOR OBSERVATION
A. When any animal capable of carrying or transmitting rabies or other disease bites or
otherwise injures a person or is suspected of having rabies, such animal shall be quarantined as
directed in the Oklahoma State Department of Health, Zoonotic Disease Control Rules pursuant

to the authority contained in the Oklahoma State Statutes. At the discretion of the Animal Control
Officer, animals may be quarantined on the premises of the owner or at a veterinary hospital of the
owner's choice at the owner's expense.
B. K-9 animals belonging to or used by a law enforcement agency are exempt from the
requirements within this chapter, including quarantine procedures, during such time as the animal
is under the direction of a K-9 handler or routine veterinary care.
C. It shall be unlawful to refuse to confine an animal that has bitten a person or other animal.
Each day that a violation or failure to comply exists shall constitute a separate offense.
SECTION FIFTY-SEVEN (57): Section 4-171 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-171 NOTIFICATION OF ANIMALS SUSPECTED OF BEING RABID
When an animal under quarantine has been diagnosed as being rabid or is suspected of having
rabies by a licensed veterinarian and dies while under such observation,the veterinarian shall
immediately notify the Oklahoma State Department of Health Acute Disease Service
Epidemiologist.

No person shall, without knowledge and consent of the owner, possess for more than twenty-four
(24) hours, any animal that that person does not own without first reporting first reporting such
possession to the Animal Control Officer, giving his or her name, address, and telephone number,
a true and correct description of the animal and the circumstances under which the animal came
into his or her possession. Persons bringing stray animals to be surrendered to the City Animal
Shelter must provide proof of residency within the City limits of Owasso.
SECTION SIXTY-THREE (63): Section 4-183 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-183 PRACTITIONERS AND CLINICS TO REPORT ANIMAL BITES
A. It shall be the duty of every attending practitioner, licensed to practice medicine,
osteopathic medicine or veterinary medicine, and of any other person knowing of or in attendance
on a case involving an animal bite to report that bite to the animal control officer, police
department, or the county health department within four (4) hours of his or her first knowledge or
attendance.
B. It shall be the duty of every clinic or hospital which has knowledge of a case involving an
animal bite to report that case to the animal control officer, police department, or county health
department within four (4) hours of its first knowledge thereof.
SECTION SIXTY-FOUR (64): Section 4-184 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby amended to read as follows:
SECTION 4-184 IMPOUNDMENT DUE TO EMERGENCY
A. If an animal is impounded as a result of a fire, medical emergency, hospitalization, custody
arrest or other situation rendering the owner or person in possession of the animal temporarily
incapable of caring for the animal, the animal may be impounded by a Police Officer or Animal
Control Officer and impounded of the City Animal Shelter.
B. If possible, the City will notify the owner or person in possession of the animal's location
and the conditions under which the animals may be released. The animal will be held for a period
of five (5) days excluding weekends and City holidays. If the animal has not
been claimed by the owner, person possessing the animal or a designee of the owner or possessor
within r net), six (96) heuFs five (5) days excluding weekends and City holidays, the animal will
become the property of the City of Owasso and may be placed for adoption, transferred to an
animal rescue organization or humanely euthanized. Owners or other persons possessing animals
under these circumstances set forth above shall not be subject to impound or daily care fees for the
animal.
SECTION SIXTY-FIVE (65): Article B of Part 4 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby added to read as follows:

who obtain a permit as provided by in Section 4-194.
SECTION SIXTY-SEVEN (6 ): Section 4-191 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby added to read as follows:
SECTION 4-191 CONFINEMENT/IMPOUNDMENT

SECTION 4-192 AUTHORITY TO SEIZE A DANGEROUS A4I,DOG
In addition to any other authority or procedure authorized by this Part 4 or by any other law, the
Animal Control Officer, Police Chief, or designee shall have the authority to immediately seize
any animal dog when there is cause to believe that an anin;al it is dangerous or poses a serious
threat to public safety under the totality of the circumstances. It shall be unlawful for any person
owning, keeping, possessing or otherwise maintaining an-anixral a dog declared to be dangerous
to refuse to immediately surrender the animal to an Animal Control Officer, the Police Chief or
designee.
SECTION SIXTY-NINE (69): Section 4-193 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby added to read as follows:
SECTION 4-193 HEARING AND ADJUDICATION
A. If, after a citation is issued alleging an animal is a dangerous Animal dog as set forth in this
Part 4, the owner does not appear at the hearing, the animal dog shall be deemed abandoned and
subject to disposition in the discretion of the Police Chief or Designee.
B. The Municipal Court Judge, upon presentation of all evidence at the hearing and upon a
finding that the animal is a dangerous animaldog, may: (1) Allow the animal dog to remain within

the City limits under restrictions as may be ordered; (2) Order the removal of the aiiixal dog from
the City limits; or (3) Order the destruction of the animal dog.
C. Upon a second conviction for possession of a dangerous ar3irnal dog without a permit or
for a second conviction for violating any of the provisions contained in Article B of Part 4 of the
Code of Ordinances, the Municipal Court Judge may order destruction of the animal dog.
SECTION SEVENTY (70): Section 4-194 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 4-194 DANGEROUS AAIM-AL DOG PERMIT REQUIRED
It is unlawful for an owner to have a dangerous dog without certificate of registration issued under
this section. This section shall not apply to dogs used by law enforcement officials for police
work. The Animal Control Officer shall issue a certificate of registration to the owner of a
dangerous anheal dog if the owner presents to the City sufficient evidence of the following:
a. A proper enclosure to confine a dangerous dog and the posting of the premises with a
clearly visible warning sign that there is a dangerous dog on the property. A proper enclosure
means the secure confinement within an occupied house or residence, in a securely enclosed and
locked pen or kennel, structures that have secure sides and a top or, in lieu of a top, walls at least
eight (8) feet in height and at least eight (8) feet taller than any internal structure; and
b. A policy of liability insurance, such as homeowner's insurance, or surety bond, issued by
an insurer qualified the Oklahoma Statutes in the amount of not less than One Hundred Thousand
Dollars ($100,000.00) insuring the owner for any personal injuries inflicted by the dangerous dog.
SECTION SEVENTY-ONE (71): Section 4-195 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby added to read as follows:
SECTION 4-195 DANGEROUS ANIMA L DOG, MUZZLE AND RESTRAINT
A. It is unlawful for an owner of a dangerous dog to permit the dog to be outside a proper
enclosure, unless the dog is muzzled and restrained by a substantial chain or leash and remains
under the physical restraint of a responsible person over sixteen (16) years of age. The muzzle
shall be made in a manner that will not cause injury to the dog or interfere with its vision or
respiration, but shall prevent it from biting any person or animal.
B. Dogs shall not be declared dangerous if the threat, injury, or damage was sustained by a
person who, at the time, was committing a willful trespass or other tort upon the premises occupied
by the owner of the dog, or was tormenting, abusing, or assaulting the dog or has, in the past, been
observed or reported to have tormented, abused, or assaulted the dog or was committing or
attempting to commit a crime.
SECTION SEVENTY-TWO (72): Section 4-196 of the Code of Ordinances of the City of
Owasso, Oklahoma, is hereby added to read as follows:

SECTION 4-196 ANIMAL BITES
A. It shall be unlawful for the owner, harborer, possessor, or keeper of an animal to negligently
allow or maintain any animal where it could bite a human unless the animal has been subjected to
provocation, or unless the victim has been trespassing.
B. It shall be unlawful for the owner, harborer, possessor, or keeper of an animal to negligently
allow or maintain any animal where it could bite, attack or kill another animal unless the animal
has been subjected to provocation or attack by another animal.
SECTION SEVENTY-THREE (73): Section 4-197 of the Code of Ordinances of the City
of Owasso, Oklahoma, is hereby added to read as follows:
SECTION 4-197 NUISANCE ANIMALS
It is unlawful for any person to own, keep, possess, or harbor within the city any animal that is a
nuisance as defined herein.

SECTION 4-200 PENALTY
A. Except as provided in subsection B of this section, any person, firm or corporation who
violates any ordinance or provision of this Part 4 or who violates or refuses or neglects to carry
out any reasonable order made by the w..,,'n er Chief of Police or designee pursuant to this
chapter, shall, upon conviction thereof, be fined in an amount not to exceed $500.00, plus fees and
costs.
B. Any person, firm or corporation who violates Sections 4-138, 4-140, 4-170, 4-190, 4-191,
4-194, 4-195, and 4-196 of this Part 4, shall, upon conviction thereof, be fined in an amount not to
exceed $750.00, plus fees and costs, or imprisoned for a term not to exceed sixty (60) days.
C. The penalties provided for herein shall be in addition to other remedies of the city and
aggrieved persons and shall not be construed as exclusive.
SECTION SEVENTY-SIX (76): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid, or ineffective, the
remaining portion shall not be affected, but shall remain in full force and effect.

SECTION SEVENTY-SEVEN (77): CODIFICATION
This ordinance shall be codified in Part Four (4), Animal Regulations, of the Owasso Code of
Ordinances.
SECTION SEVENTY-EIGHT (78): REPEALER
That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby
expressly repealed.
SECTION SEVENTY-NINE (79): FILING OF ORDINANCE
That there be filed in the office of the County Clerk of Tulsa County, Oklahoma, a true and correct
copy of this Ordinance.
SECTION EIGHTY (80): DECLARING AN EFFECTIVE DATE

The Community Development Department received a Planned Unit Development (PUD) application
for lst Street Lofts, a proposed multi -family development located at 207 West lst Street, near the
northwestern corner of the intersection of North Atlanta Street and West 1:t Street. The subject property
is approximately 0.33 acres in size and is currently zoned Residential Multi -Family (RM) within the
Downtown Overlay District.

CONCEPT OF A PUD:
• A PUD is a development concept that allows for greater creativity and flexibility than typically
allowed under traditional zoning and planning practices.
o For example, PUDs often allow developers to place different zonings and land uses in
close proximity to each other.
o Developers may also have more flexibility in certain aspects of development, such as
lot width requirements and building height limitations, which can be more restrictive in
standard zoning districts.
• A PUD should not be considered as a tool to circumvent the City's Zoning Code and
Subdivision Regulations. All aspects of the PUD application are subject to public comment as
well as consideration and approval from the Community Development Department, the
Owasso Technical Advisory Committee, the Owasso Planning Commission, and the Owasso
City Council.

GROWASSO 2035 LAND USE MASTER PLAN CONSISTENCY:

which represents an area targeted for future higher density housing uses,. including multi -family
uses, so the proposed development is in keeping with the uses called out for this location.

ANALYSIS:
• The conceptual development plan submitted for OPUD 24-02 states that the applicant intends
to construct one (1) two-story apartment building, containing up to twelve (12) units.
o The proposed maximum density of the 0.33-acre subject tract is thirty-six (36) dwelling
units per acre (DU/Ac).
• Per Section 10.12.17 of the Owasso Zoning Code, a PUD overlay is required for all multi -family
developments in excess of six (6) dwelling units within the Downtown Overlay District.
• The conceptual development plan limits the proposed development to one (1) curb cut off of
West I st Street.
o This property is currently platted and therefore access point(s) locations) will be
reviewed at the site plan process as a replat is not required for this property for this
proposed configuration.
• Per the OPUD 24-02 document, a screening fence will be required to be located adjacent to
any single-family uses, in order to adequately screen the subject property from said lower -
intensity residential uses.
• The OPUD 24-02 document proposes one (1) six-foot monument sign to be allowed in the
development. Otherwise, all signs shall conform to Chapter 18 of the Owasso Zoning Code.
• The conceptual site layout within the OPUD 24-02 document shows an internal private parking
lot east of the proposed building. Further, the OPUD document also states public parking will
be constructed along West I st Street.
a A fully detailed landscape plan will be required to be submitted for City staff approval
at the time of site plan review for development. All landscaping and parking will be
required to meet the requirements identified in the Owasso Zoning Code.
• The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to

• Any development that occurs on the subject property shall adhere to all development, zoning,
and engineering requirements of the City of Owasso.

PUD INTENT -
We are requesting a PUD overlay for this development to accommodate a proposed density
exceeding six residential units on the property, with plans for up to 12 units.
PROPOSED LAND USE:
Multifamily residential. Density: 12 total units on 0.33 acres, for a total gross density of 36
dwelling units per acre.
DEVELOPMENT CONCEPT:
The 1st St Lofts are a proposed Planned Unit Development (PUD) consisting of 0.33 acres in
Owasso, Oklahoma. The property is located west of the intersection of W. 1st Street and N.
Atlanta St. The site is generally characterized by relatively flat terrain. There is currently no
floodplain located onsite, according to the FEMA Floodplain Maps. The site will be controlled
with localized drainage structures to control the stormwater onsite in the post -developed
conditions. Soil types found on -site are typical for the area and create no unusual
development problems that are not commonly encountered in most other area
developments. Overall, this site has excellent development possibilities due to its gentle
terrain.
The 1st ST Lofts will feature a 12-unit single -owner apartment building within the allotted area

parking. The development is consistent with the surrounding properties, with duplex and
condo buildings in the immediate area. This PUD will help make the subject property feasible
for this development, allowing for densities but continuing the neighborhood feel within the

LANDSCAPE REQUIREMENTS:
The landscape concept Is Intended to achieve unity throughout the PUD as well as provide an
attractive view of the project from the surrounding streets and neighborhoods to achieve
continuity throughout the PUD, all landscaping must adhere to Chapter 19 of the Owasso
Building Code.
SCREENING AND BUFFERING:
Areas abutting developments outside of this PUD that are single-family In use will require some
screening barrier between properties. Fences shall consist of wood, concrete, decorative metal,
and/or masonry materials to match the building. Chain link fencing of any kind Is not allowed. All
screening must adhere to Chapter 19 of the Owasso Building Code.
PARKING•
2 Public parking spaces will be constructed along the 1st Street roadway easement for additional

SIGNAGE•
The Development proposes one 6-foot monument sign shallow be allowed in the development,
and its location and placement will be determined at the time of site plan review. Except as note(
herein, all signs shall conform to the current Owasso Sign Ordinance of the Owasso Zoning Code
(chapter 18).
Signage must be backlit or have lights pointed directly. at the sign. No video signage will be

SUBJECT: Resolution 2024-08: FY 2025-2026 Transportation Alternatives Program & Carbon
Reduction Program Grant
DATE: December 13, 2024
BACKGROUND:
The Transportation Alternatives Program (TAP) and Carbon Reduction Program (CRP) constitute a
grant program of the Federal Highway Administration (FHWA). As this is a FHWA grant, each state is
apportioned a certain amount of money that their respective Departments of Transportation can
allocate to county, local, and Tribal governments as they see fit. ODOT chose to retain a portion of
this funding for their own grant process; the rest was distributed among regional agencies, such as
Indian Nations Council of Government (INCOG), to be administered as they saw fit.
INCOG anticipates receiving approximately$13.5 million in these grant funds forfiscal year2025-2026.
Said funds are being made available for eligible entities within the Tulsa Metro Area, under the
Infrastructure Investment and Jobs Act (IIJA), via a grant application administered by INCOG. This
grant provides funding for a variety of transportation projects that prioritize safety, comfort, and
connectivity to destinations for all people who use the street network, with an emphasis on projects
that serve vulnerable populations, prioritize alternative transportation methods like pedestrian and
bicycle infrastructure, provide safe routes to schools, preserve historically -significant transportation
infrastructure, or assist in environmental mitigation and vegetation management activities. The City
of Owasso, for the FY 2025-2026, is choosing to focus on a project that would help strengthen the
City's pedestrian infrastructure grid.
A previous TAP grant application was submitted through ODOT in May of 2024, identifying the some
sidewalk connectivity project discussed within this memo; the City of Owasso was not chosen to
receive funding from ODOT. As such, the City is now seeking funding via INCOG for the some selected
project.
ANTICIPATED FUNDING:
In November 2024, INCOG provided information to city staff regarding the FY 2025-2026
Transportation Alternatives & Carbon Reduction Program (TAP/CRP) application. City staff has
drafted responses to the required application questions, as well as supplemental materials like a
budget summary, aerial maps, and letter of support. The application packet must be completed
and submitted to INCOG no laterthan January 17, 2025, for funding requests to be considered during
this grant application cycle.
Of the approximately $13.5 million allocated to INCOG, the City of Owasso anticipates applying for
a total of approximately $1.55 million via two separate applications (Priority 1 Project Request=
$556,202, Priority 2 Project Request= $1,001,854). This grant is competitive, so there is no guarantee
that the City's proposed projects will be funded, even if an application is submitted to INCOG.
The grant does require a local match of at least twenty -percent (20%) of the total project cost. Staff
anticipates this match funding being available in the Half -Penny Fund.

PROPOSED FY 2025-2026 PROJECTS:
The funding provided by this INCOG TAP/CRP Grant, if awarded, is proposed to be used to engage
in a major sidewalk connectivity initiative whereby current gaps in the City's pedestrian network may
be filled. The City proposes to construct multi -use -trail sidewalks (10 feet in width) along select arterial
and collector roads and standard ADA-accessible sidewalks (4 feet in width) along select local roads.
Specifically, the City is proposing to construct a total of six (6) new sidewalk segments, for a total of
8,230 linear feet of new sidewalk. Grant funding for these 6 sidewalk segments would be applied for
via two separate grant applications to INCOG, to hopefully increase the City's chances of getting at
least one project funded.
Said proposed sidewalks would provide an increase in the total amount of safe travel routes seen
within the City for pedestrian and bicyclists, specifically. Further, this proposed sidewalk connectivity
initiative is anticipated to benefit pedestrians in Owasso by helping to connect a number of existing
neighborhoods with adjacent services and points of interest- to include adjacent schools, parks, and
commercial areas where daily needs of residents may be met.
The six (6) proposed sidewalk segments that the City of Owasso is seeking funding for are as follows:
• Priority Proiect 1
o Segment # 1- North side of East 76th Street North, running west from the service road
(North Owasso Expressway) to approximately South Cedar Street (750 linear feet [LF],
5' wide)
o Segment #2- East side of the service road (North Owasso Expressway), running north
from East 86th Street North to East 90th Street North (2,420 LF, 5' wide)
• Priority Proiect 2
o Segment #1- West side of North 102nd East Avenue, running north from East 96th
Street North to East 97th Street North (410 LF, 4' wide)
o Segment #2- North side of East 77th Place North, running east from North 123rd East
Avenue for approximately (800 LF, 4' wide) linear feet
o Segment #3- East side of North 129th East Avenue, running north from the
northeastern corner of East I I6th Street North and North 129th East Avenue (approx.
300 LF, 10' wide AND 150 LF, 5' wide
o Segment #4- West side of North 97th East Avenue (Mingo Road), running north from
the PSO substation to East 89th Street North and continuing along the north and south
sides of East 89th Street North until the eastern -most entrance to the Bailey Golf Course
(3,400LF, 4' wide)
The total anticipated cost of all six proposed sidewalk projects is $2,404,485.98. Priority Project 1 would
have a total cost of $858,364.50, while Priority Project 2 would have a total cost of $1,546,121.00. The
City is seeking a total of $1,558,056.00 in grant funding, meaning the City would supplement these
TAP/CRP funds, if awarded, with an additional total expenditure of $846,431 from the Half -Penny
Fund. This match amount would constitute 35%of the total projects' costs, exceeding the 20%funding
match requirement seen for this grant.
INCOG is anticipating announcing final project selections and grant awards in April 2025.
RECOMMENDATION:
Staff recommends approval of Resolution 2024-08, authorizing the submittal of two applications
identifying the aforementioned six (6) proposed sidewalk segments as the City's preferred projects
for INCOG's FY 2025-2026 TAP/CRP grant funding cycle, and authorization to execute all related
documents necessary to fulfill the program grant requirements.

WHEREAS, Transportation Alternatives Program and Carbon Reduction Program funds
have been made available for transportation improvements within the Tulsa Transportation
Management Area; and,
WHEREAS, the engineer's preliminary estimate of total cost is $2,404,485.98, split across two
separate projects costing $858,364.50 and $1,546,121.48 respectively, and Federal participation
under the terms of the federal law, IIJA Act, relating to Transportation Alternatives Program and/or
Carbon Reduction Program funds are hereby requested for funding of sixty-five percent (65%) of
the two projects' costs; and,
WHEREAS, the City of Owasso proposes to use the Half -Penny Fund for the balance of the
project costs and agrees to provide for satisfactory maintenance after completion, and to furnish
the necessary right-of-way clear and unobstructed; and,
WHEREAS, City of Owasso has required matching funds available and further agrees to
deposit with the Oklahoma Department of Transportation (ODOT) said matching funds within thirty
(30) days after authorization by the Federal Highway Administration, prior to project letting by
ODOT.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA,
that, to wit:
Section 1. The City of Owasso, Oklahoma, has selected two sidewalk connectivity projects for the
Transportation Alternatives Program/Carbon Reduction Program funds in the total amount of
$1,558,056, across two separate applications requesting $556,202 and $1,001,854 respectively, set
forth by Infrastructure Investment and Jobs Act (IIJA) and as outlined in ODOT's transportation
alternatives program guidance & application packet for Fiscal Year 2025-2026; and,
Section 2. INCOG is requested to program this project into the Transportation Improvement
Program for the Tulsa Transportation Management Area if this project is selected for funding; and,
Section 3. Upon inclusion in the Program, the Oklahoma Transportation Commission is requested
to concur in the programming and selection of this project and to submit the same to the Federal

BACKGROUND:
• During the November and December Worksessions, staff presented a proposed
amendment to the current ambulance service fee as it relates to multi -family residential
properties.
• The ambulance service fee covers emergency medical ambulance services at no
additional charge above payment from an insurer, if any.
• Currently,. some residents living in individual units of multi -family residential dwellings are not
assessed the monthly ambulance service fee and would incur an emergency medical
service charge based on the existing fee schedule of thirteen hundred dollars ($1,300.00)
per response, plus fifteen dollars ($15.00) per loaded mile.
• These residents may subscribe to the ambulance service for a fee of forty-eight dollars
($48.00) paid annually. Of the estimated three -thousand nine -hundred and eighty-two
(3,982) multi -family residential units, there are thirteen (13) unit subscribers to the
ambulance service.
• In an effort to reduce the financial hardship of our residents living in multi -family residential
dwellings, when faced with pre -hospital medical emergencies, and to secure funding for
the ambulance services provided, staff has drafted an ordinance change to include multi-
family dwelling units in the ambulance service fee.

C AMBULANCE SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF OWASSO,
OKLAHOMA, AMENDING IN PART VARIOUS SECTIONS, ESTABLISHING AN EFFECTIVE DATE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT, TO WIT:
SECTION ONE (1): Section 13-230 of the Code of Ordinances of the City of Owasso,
Oklahoma, shall be amended to read as follows:
SECTION 13-230 DEFINITIONS
The following terms when used in this chapter shall have the following meanings:
"ADVANCE LIFE SUPPORT" means the provision by an emergency medical provider of
advanced emergency medical care services which:
a) Exceed the level of basic life support as defined in the Emergency Medical
Service Improvement Act, Section 330.71 through 330.83 of Title 63 O.S. of
the Oklahoma State Statutes;
b) Include the use of sophisticated transportation vehicles and equipment and
telemetry communications;
c) Are staffed by advanced -level certified emergency medical technicians;
and
d) Are capable of providing onsite, pre -hospital, and inner -hospital mobile
intensive care in conjunction with specialized critical care units in
emergency departments in appropriately staffed healthcare facilities within
the State of Oklahoma;
"AMBULANCE" means any ground vehicle designated and equipped to transport and
provide emergency medical patient care to one or more acutely ill or injured persons,
such ground vehicle at all times meeting the requirements as set forth under the provisions
of Section Two (2) Subsection Three (3) of the Rules and Regulations of the Emergency
Medical Services Division, Oklahoma State Department of Health promulgated under the
"Emergency Medical Service Improvement Act", Sections 330.71 et seq. of Title 63 of the
Oklahoma State Statutes;
"AMBULANCE SERVICE" means the transport component of an emergency medical service
system possessing vehicles designed specifically for transport of the critically injured and
the sudden illness patient, equipped with life -supporting supplies and equipment as
defined under the provisions of the Emergency Medical Service Improvement Act, Section
330.71 through Section 330.83 of Title 63 of the Oklahoma State Statutes, to sustain the
patient at the scene and in route to a hospital. Further, such shall be construed and
interpreted to include personnel trained in emergency procedures, as defined in the
afore -referenced act, and capable of stabilizing the patient at the scene and maintaining
that stable condition while transporting the patient;
"EMERGENCY PATIENT" means an individual who is acutely ill, injured or otherwise
incapacitated or helpless and who requires emergency medical services;
"EMERGENCY TRANSFER" means the movement of an actually ill or injured patient from the
scene to a healthcare facility (pre -hospital), or the movement of an acutely ill or injured
patient from one healthcare facility to another healthcare facility (inter -facility), and
"LONG TERM CARE FACILITIES" include nursing homes, skilled nursing facilities, residential
care homes, assisted living centers, continuum of care homes (which include an assisted
living center and a nursing facility) and Intermediate Care Facilities for Individuals with
Intellectual Disabilities (ICF/IID) as licensed by the State Health Department.
"NON -EMERGENCY TRANSFER" means the movement of any patient in an ambulance
other than an emergency transfer.
SECTION TWO (2): Section 13-234 of the Code of Ordinances of the City of Owasso,
Oklahoma, shall be amended to read as follows:
SECTION 13-234 PERSONS SERVED
A. Subject to the limitations set forth below, the emergency medical service to be
provided in the areas above referenced shall be provided at no charge above the
payment from an insurer under a policy of insurance, if any, providing coverage to the
following persons:
(1) Residents of the city residing within single-family dwellings and multi -family
dwellings, as defined under the zoning code of the city, whether same be
permanent structures or movable manufactured housing, as well as all
household members, both temporary and permanent, thereof;
(2) Persons residing within areas outside the corporate limits of the city, but
within the area included within Section 13-233, as well as all household
members, both temporary and permanent, who subscribe to the
ambulance service and pay the designated subscription fee; and
(3) Any other person within the designated area set forth in Section 13-233 in
need of emergency medical service for payment of the actual cost of the
service.
B. No person, residing outside the area of service as set forth in Section 13-233, shall be
allowed to participate in the subscription service provided for in this section.
SECTION THREE (3): Section 13-236 of the Code of Ordinances of the City of Owasso,
Oklahoma, shall be amended to read as follows:
SECTION 13-236 FUNDING FOR AMBULANCE SERVICE
A. For areas within the corporate limits of the city receiving water service from the city
or areas within the corporate limits of the city receiving only sanitary sewer service from
the city, a water rate increase or a sewer rate increase, respectively, is established as
follows:
(1) For every single-family residence, whether some is permanent or movable
manufactured housing, multi -family dwelling, commercial, or industrial
establishment, as defined under the zoning code of the city, there is hereby a
fee of Four Dollars ($4.00) per month per residence or establishment above -
referenced, to be charged and collected on a monthly basis by the Owasso

Public Works Authority as in the case of existing water, sewer and other utility
charges.
(2) Multi -family residential properties shall be charged a fee of Four Dollars ($4.00)
per month per occupied residential living unit:
a. There is a rebuttable presumption that eighty-five percent (85%) of the
total number of residential living units served by city utilities are
occupied. The number of presumed residential units shall be rounded
down, but to not less than one.
b. On or before March 31s1 of each year, or upon request, Multi -family
property owners shall provide to the City of Owasso the total number of
residential living units occupied, which shall be used to determine the
monthly calculation as outlined in 13-236 A(2).
c. Multi -family residential property owners failing to comply, or fraudulently
representing the number of living units occupied, may be deemed guilty
of a misdemeanor punishable by a fine of not more than seven hundred
and fifty dollars ($750.00).
B. For residents within Long -Term Care Facilities within the service area as referenced in
Section 13-233 and desirous of subscribing to the ambulance service for the benefit of the
person may do so upon the payment of a subscription fee of Forty-eight Dollars ($48.00)
per year.
C. For residents residing in areas outside the corporate limits, but within the service area
as referenced in Section 13-233, desirous of subscribing to the ambulance service for the
benefit of the person or the person's household members, whether same be temporary or
permanent, may do so upon the payment of a subscription fee of Seven Dollars ($7.00)
per month if such person is connected to the Owasso water and/or sewer system, or Eighty-
four Dollars ($84.00) per year if such person is not connected to the Owasso water and/or
sewer system.
SECTION FOUR (4): REPEALER
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed
to the extent of the conflict only.
SECTION FIVE (5): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective,
the remaining portion shall not be affected but shall remain in full force and effect.
SECTION SIX (6): DECLARING AN EFFECTIVE DATE
The provisions of this ordinance shall become effective thirty (30) days from the date of
final passage as provided by state law.
SECTION SEVEN (7): CODIFICATION
The City of Owasso Code of Ordinances is hereby amended as shown above and codified
in Part 13, Chapter 2, Sections 13-230, 13-234, and 13-236.

BACKGROUND:
In City of Owasso Ordinance Section 13-236 - Funding for Ambulance Service, there is a
four dollar ($4.00) per month ambulance service fee collected by Owasso Public Works
Authority. Eighty-five percent (85%) of the fees collected are utilized for operating
expenses and fifteen percent (15%) are used for capital expenses. The ambulance service
fee is assessed to single family residences, movable manufactured housing, multi -family
dwellings, and commercial or industrial establishments, as defined under the zoning code
of the city.
• The ambulance service fee covers emergency medical ambulance services at no
additional charge in excess of payment from an insurer, if any.
• Currently, residents living in individual units of multi -family residential dwellings are not
assessed a monthly ambulance service fee and would incur an emergency medical
service charge based on the existing fee schedule of thirteen hundred dollars ($1,300.00)
per response, plus fifteen dollars ($15.00) per loaded mile.
• These residents may subscribe to the ambulance service for a fee of forty-eight dollars
($48.00) paid annually. However, this subscription is underutilized and residents incur the
cost that insurance does not pay, or the entire cost, if uninsured. Often, billing for these
services is not recovered.
• Of the estimated three -thousand nine -hundred and eighty-two (3,982) multi -family
residential units, there are thirteen (13)unit subscribers to the ambulance service.
• In an effort to reduce the financial hardship of our residents living in multi -family residential
dwellings, when faced with pre -hospital medical emergencies, and to secure funding for
the ambulance services provided, staff is proposing an ordinance change to include multi-
family dwelling units in the ambulance service fee.
• An Item has been placed on the November work session agenda for additional discussion.
PROPOSED AMENDMENT:
Staff is proposing to amend the ordinance language to authorize the Owasso Public Works
Authority to collect the ambulance service fee from the multi -family residential properties, based
on the four dollars ($4.00) per -month per -unit increasing estimated funding in the ambulance
service fund by $13,538.00 per month.

Staff surveyed each property for unit occupancy and determined these properties are 95%
occupied. Utilizing apartment population density of 2.33 per unit, staff estimates multi -family
residential population in the City of Owasso 8,814.15.
Staff sought input from the multi -family dwelling owners and managers in our area and received
nine (9) replies. Six (6) replies did not want to see the fee added to their utility bill and requested
that it remain optional for the tenants to pay on their own. Three (3) replies are in support of
including tenants in the ambulance service fee.
COMPARISON TO OTHER CITIES:
Staff looked at other Tulsa area cities for comparison. Tulsa Ambulance Service Emergency
Medical Services Authority (EMSA) is a Public Trust that has other funding options and also
contracts with other smaller cities to provide ambulance services. EMSA utilizes an opt -out
program, where a fee of $5.45 is charged and residents must opt -out in writing to the city if they
do not want to pay the fee.
The City of Skiatook and Collinsville both have higher rates. Collinsville is at $10.00 and Skiatook at
$7.00 a month. They do not require apartments to pay the ambulance fee.
The City of Broken Arrow and the City of Bixby are more closely comparable. Broken Arrow
ambulance service fee is at $6.45 and Bixby at $7.50 a month. Both, by city ordinance, include
apartment units in the ambulance service fee.
The City of Broken Arrow and Bixby also include a rebuttable presumptive language for the total
number of living units occupied. Broken Arrow established seventy percent (70%) and Bixby eighty-
five percent (85%), presuming the total number of residential living units are occupied to
formulate the fee.

qualifications for the City to become film -friendly certified. One key requirement for certification
is the establishment of a film permit. To prepare for this, staff researched film permits used by peer
communities across the state. The proposed film permit would:
• Guide city staff when filmmakers request to film in public parks, trails, or other areas
that might involve road or sidewalk closures, the use of large or extensive props,
explosives, or coordination with city personnel and resources.
• Provide a comprehensive method for recording logistical intake information,
including details about production insurance, filming locations, specifics of the shoot,
and any city services or approvals needed.
• Grant authority to the City Manager to establish additional rules and regulations for
the permitting process as needed, ensuring flexibility and responsiveness to various
production requirements.
• Establish a fee schedule.
This permit will streamline communication between filmmakers and the city, ensuring efficient
coordination and safety for all parties involved.
PROPOSED ORDINANCE AND RESOLUTION:
Based on the discussions during the Worksession meetings, an ordinance creating the Film
Production Permit and a Resolution establishing the schedule of related fees is presented for City
Council consideration and action.
RECOMMENDATION:
Staff recommends adoption of Ordinance 1229, creating a Film Production Permit.
Staff further recommends approval of Resolution 2024 - 09 establishing a fee schedule related to
the Film Permit.

The Oklahoma Film + Music Office was founded in 1979, and oversees the "Oklahoma Film Friendly
Community Program," which helps communities promote themselves to the state's growing
entertainment industry. Securing the "Film Friendly" designation places a city within the Oklahoma
Film + Music Office's online directory, enhancing its visibility to filmmakers and encouraging them
to shoot in a community, including at notable sites such as the state-of-the-art Cherokee Film
Studio on HWY 20. Film certification can also boost local economic activity as filmmakers stay in
local hotels, and shop, dine, and enjoy recreational activities.
Currently, over 30 cities in Oklahoma have earned Film Friendly Certification, including
neighboring communities such as Tulsa, Sapulpa, Jenks, Broken Arrow, Claremore, and Collinsville.
To apply for the State's Film Friendly Certification, a city must:
o Designate at least two "Film Friendly Liaisons"
o Submit photos and information of 12 unique possible filming locations in the

ECONOMIC IMPACT OF FILM INDUSTRY:
Over the last decade, the industry has experienced steady growth in both employment and
wages. In 2014, the industry supported 466 part-time and full-time jobs. By 2023, that number had
increased to 7,652jobs. Wages followed a similar trend, rising from $1.8 million in 2014 to $58 million
in 2023, with a peak of $75.8 million in 2021. According to the Oklahoma Municipal League of
Cities, filming a movie can generate an average of $50,000 per day for a city through increased
patronage of hotels, restaurants, hardware stores, and other local businesses.

The Hotel Tax Fund was established to promote economic development, culture, and tourism
Within the City of Owasso. The Hotel Tax Fund is funded through a 5% excise tax on hotel and
motel room rentals in the City-3%is designated for Economic Development, and 2%is designated
to fund the Owasso Strong Neighborhood Initiative.
As of June 30, 2024, the 3% portion of the Hotel Tax Fund had a fund balance of $2.6 million. These
funds are available for Economic Development purposes.
At the December 12, 2024, Owasso Economic Development Authority meeting, Trustees voted
unanimously to recommend the purchase of 20 acres of land adjacent to the Owasso Sports Park
South through the Hotel Tax Fund.
RECOMMENDATION:
Staff recommends approval of a budget amendment in the Hotel Tax Fund Economic
Development Department increasing the appropriation for expenditures by $600,000.

the amount of $600,000.

Funding is available in the Hotel Tax Fund.
OEDA:
The Owasso Economic Development Authority met Thursday, December 12, 2024, and voted to
recommend the land purchase to the Owasso City Council utilizing the Hotel Tax Fund.
RECOMMENDATION:
Staff recommends authorization for payment of $600,000.00 to Narcomey Land Company, LLC
for the acquisition of additional land for the Owasso Sports Park.
