Call to Order - Dr. Balthrop called the meeting to order at 6:00 p.m. 2. Flag Salute - Dr. Balthrop led the flag salute. 3. Roll Call - A quorum was declared present. Consideration and appropriate action relating to a request to vacate the Cornerstone Hardware filed final plat and replat as Cornerstone Hardware Amended on approximately 6.55 +/- acres, located at 11550 North 1291h East Avenue, zoned Commercial Shopping (CS) Alexa Beemer presented the item, recommending approval. There were no comments from the audience. Mrs. Lewis moved, seconded by Mr. Smith, to recommend approval for vacating the plat to the City Council. The subject property is located at 10596 North Owasso Expressway, near the southwestern corner of the intersection of East 106t" Street North and North Owasso Expressway. Water Provider Washington County Rural Water District #3 Applicable Paybacks N/A (already platted) Assessed at Platting) ANALYSIS: • The subject property was annexed into Owasso City Limits with Ordinance 633 in 2000 and is platted as Lot 1, Block 1 Caffeine Corner Addition. • A SUP is required in certain zoning districts for uses or structures that may be considered more intense than what is allowed by right, through the City of Owasso's Zoning Code. • Per the Owasso Zoning Code an automotive repair and maintenance facility is allowed, with an SUP, in the CS zoning district and within the US-169 Overlay District. o Thus, an SUP is needed for the proposed use on this property, as it is zoned CS and is within the US-169 Overlay District. • The GrOwasso 2035 Land Use Master Plan identifies the subject property for future commercial uses. o All surrounding parcels immediately adjacent to the subject property are also identified for future commercial uses on the Plan, and have been zoned commercially. • The applicant has worked with staff to design the site and new structure in an appropriate manner that conforms to the design requirements of the Zoning Code and minimizes the impacts on adjacent properties. SUP 25-01 Page 2 o The proposed automotive repair shop will be a six (6) bay structure, composed of brick veneer and EFIS, thus meeting the fapade requirements for commercial structures seen within Chapter 1 1 of the Owasso Zoning Code. o The applicant has indicated that there will be no outdoor storage of cars and/or merchandise of any kind on the site; therefore, there are no additional screening fencing required per Chapter 19 of the Owasso Zoning Code. o The conceptual site plan shows a dense landscaping bed along the western property line, with three (3) additional large trees than what is required by Code. All landscaping requirements outlined in Chapter 19 of the Owasso Zoning Code will have to be met. o As indicated on the conceptual site plan, the applicant intends to install only wall -pack lighting fixtures on the building only. All lighting will have to comply with Chapter 20 of the Owasso Zoning Code. o The applicant has indicated that they are aware of the Owasso Noise Ordinance, and will comply with such, per a note on the conceptual site plan. o The dumpsters for the site will be located on the far southwestern corner of the property and will be fully screened, per Chapter 19 of the Owasso Zoning Code. The main purpose of the SUP requirement is to ensure the development does not impose any negative direct impacts to adjoining properties and that the proposed use works in harmony within the context of the area. o The subject property is situated along an emerging commercial corridor, with two similar auto -related uses already in existence in the area. As such, staff has determined that a land use such as an auto repair facility may be appropriate within this emerging commercial corridor, if the correct controls are utilized with an SUP. • Any further development that occurs on the subject property shall adhere to all development, zoning, and engineering requirements of the City of Owasso. SUP 25-01 Page 3 RECOMMENDATION: In developing a recommendation, staff evaluated the SUP on the criteria outlined in Section 16.1.7 of the Owasso Zoning Code. Following this evaluation, staff concluded that the SUP request meets all of the legal requirements for approval. As such, staff recommends approval of SUP 25-01, subject to TAC Comments. There will be three (3) points of access for this subdivision. o One point of access will be off of East 86t" Street North, and will contain a large landscaped entrance area. o The remaining two points of access will both be off of North 161It East Avenue. The Plat depicts four (4) Reserve Areas, denoted as "A", "B", "C", and "D". The applicant intends to apply for a review of a Letter of Map Revision- Based on Fill (LOMR-F) with the Federal Emergency Management Agency (FEMA). During this process, FEMA reviews the applicant's placement of fill material on -site and confirms whether or not said site has been elevated out of what is commonly known as the 100-Year Floodplain. Approval of the LOMR-F would signify FEMA's consent that the site has been elevated enough to be outside of the floodplain and would legally and officially changes the floodplain boundaries on the property. o Until a filed LOMR-F is procured, the City of Owasso's Floodplain Administrator has enacted a moratorium on building permits for lots adjacent to the floodplain. Perimeter and interior utility easements are shown on the Plat allowing utility companies adequate access to service the subdivision. There are also landscape easements depicted along the perimeters of the subject property, to house required fencing and signage. The City of Owasso will provide police, fire, ambulance, and sanitary sewer services to the property. The Rogers County Rural Water District #3 will provide water services. Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements. The information contained below does not cover all restrictions or all situations and does not give consent to a third party's use of GRDA's ROW. These restrictions are subject to change at any time and without any notice. Prior to making any additions or alterations to property on which a ROW is located, the landowner should contact GRDA for permission. THE STATEMENTS BELOW ARE GUIDELINES ONLY, AND ARE NOT A WAIVER OF ANY RIGHTS OR INTERESTS IN THE RIGHTS OF WAY POSSESSED BY GRDA. 1. The following are not allowed in GRDA's ROW: a. Structures, buildings, manufactured homes, mobile homes and trailers, satellite signal receiver systems, swimming pools (and any associated equipment and decking), graves, bill- boards, dumpsters, signs, wells, septic systems or storage tanks and systems (whether above or below ground), refuse of any type, flammable material, building material, wrecked or disabled vehicles and all other objects (whether above or below ground) which may, in GRDA's opinion, interfere in any way with the electric transmission ROW or the ingress and egress along the ROW, are not allowed within the ROW. b. Transformers, telephone/cable pedestals (and associated equipment), fire hydrants man- holes, water valves, water meters and backflow preventers are not allowed within the ROW. 2. Fences shall not be attached to poles or towers. Fences shall not exceed 10 feet in height and shall be installed at least 25 feet from poles, towers and guy anchors. Fences shall not parallel the centerline within the ROW but may cross from one side to the other. If a fence crosses the ROW, a gate at least 16 feet wide at each crossing shall be installed by the property owner, per GRDAs specifications, to allow GRDA free access at all times to GRDA equipment. 3. Landowner must contact GRDA at 918-825-0280 at least 3 business days prior to any ground distur- bance and obtain written approval before grading or filling on the ROW. Grading (cuts or fill) shall be no closer than 25 feet from a pole or tower leg or any other GRDA structure or equipment and the slope shall not exceed 4:1 (four feet run to one foot rise or fall) on the ROW. Grading or filling within the ROW or near a structure, which will prevent free equipment/vehicle access, or creates ground to conductor clearance violations, will not be permit- ted. Sedimentation control, including approved re -vegetation, is required. 4. Streets, roads, driveways, sewer lines, water lines, and other utility lines, or any underground facilities shall not be located within 25 feet of GRDAs supporting structures. 5. Any drainage feature that allows water to pond, causes erosion, directs storm water toward the ROW, or limits access to or around a structure is prohibited. 6. No excavation within 25 feet of GRDAs structures, including but not limited to poles, guy anchors or other appurtenances shall be permitted. Contact GRDA at 918-825-0280 at least 3 business days prior to any planned excavations of any type on new and/or existing installations. The "Call OKIE"' "One Call" and "811" programs do not notify GRDA of planned excavations as our transmission lines are overhead, not underground. 7. Any approved underground facility placed within GRDAs ROW shall have a tracer/locating wire and shall be clearly marked above ground. 8. No tall growing species of vegetation, including trees, may be planted within the GRDA ROW. Grasses or crops may be planted, however, any vegetation impeding the maintenance of GRDAs ROW shall be subject to removal without reimbursement to the property owner. 9. GRDA does not object to parking within the ROW, provided that: a. A barrier, sufficient to withstand a 15 mph vehicular impact, shall be erected by the party constructing the parking area to protect the pole, tower or guy anchor. The barrier shall be located in such a manner as to restrict the nearest part of a parked vehicle to no nearer than 5 feet from the structure. b. Any access areas, entrances, or exits shall cross (from one side to the other) the ROW at or near right angles to the centerline, and shall not pass within 25 feet of any structure. Parking lot entrances/exits may not create an intersection within the ROW. c. Lighting structures shall not be installed within GRDAs right of way. d. Signs and other attachments to GRDA structures are prohibited. The GRDA reserves the right to remove anything within GRDAs ROW which interferes with or is inconsistent with GRDAs use of its ROW. Removal of property interfering or inconsistent with GRDAs use of its ROW shall be at the expense of the landowner and/or installer along with any costs incurred by GRDA to restore the ROW.
