The Stormwater Fund and the Owasso Public Works Authority (OPWA) began operating at a loss in fiscal year 2014, necessitating the implementation of a 5-year utility rate plan in 2016 (extended by City Council in 2021) to restore fund balances and address the following: • Depletion of the OPWA and Stormwater Fund balances • Rising operational costs • Funding for necessary capital infrastructure, including an upgrade of the wastewater treatment plant. The revenue increases in this plan were computed based on both assumptions regarding annual increased costs of labor and materials, and annual increased cost of water purchased from the Tulsa Metropolitan Utility Authority (TMUA). The rate structure was designed to enable the City to develop a long-term capital plan and enable commercial and residential customers to budget for the upcoming changes. In order to maintain a healthy fund balance that is capable of sustaining operations and providing uninterrupted service to customers, the City reviews the differences in actual costs versus projected costs each year, while also monitoring ongoing capital needs. 3 Where are we now? Water purchase costs from the Tulsa Metropolitan Utility Authority (TMUA) seem to have stabilized, but the future is unknown. • Prior to the implementation of the 5-year rate plan in fiscal year 2016, the rate charged to the City by TMUA had increased by 58% over the previous 9 years. • Since the implementation of the 5-year rate plan, the rate has increased 1.7%. • TMUA can increase the rate charged to the City at any time. 2. Various major capital improvement projects have been funded by OPWA in recent years. • Wastewater Treatment Plant Expansion - $24.3 million • Ranch Creek Sewer Interceptor Upgrade - $6.2 million • Coffee Creek Sewer Lift Station Upgrade - $5.5 million • 11 Th Street Force Main Upgrade - $3.0 million • New Public Works Facility Engineering - $2.8 million • Elm Creek Interceptor Upgrade - $2.0 million • Morrow Sewer Extension - $1.6 million • Various Water Projects - $1.5 million • Owasso Market Gravity Sewer Line - $1.0 million • Recycle Center Expansion & Equipment - $930,000 • Refuse Truck Purchase - $380,000 3. Construction costs have escalated substantially over recent years, causing the need for additional funding. • Since 2020, the material cost for a 6-inch water line has increased 152%. The material cost for an 8-inch water line has increased 178%. 4. Operational costs have also increased significantly in recent years. • OPWA labor costs have increased 25% from FY2020 to FY2024. • In 2020, an automated refuse truck cost $310,000, compared to $400,000 in 2024. • Since 2023, the cost to replace an average residential water meter has increased 22%. 4 Where are we now? 5. To continue providing the current level of service to our citizens, the following major capital improvements and purchases, totaling approximately $28 million, are needed within the next five years: • Three Lakes Drainage Improvements - $5.3 million • Regional Detention Pond - $4.0 million • Hale Acres Stormwater Improvements - $3.2 million • Country Estates Stormwater Improvements - $3.0 million • Steed Addition Wastewater Collection System Rehab - $3.0 million • Refurbishment of Wastewater Treatment Plant Clarifiers - $2.5 million • Other Water projects - $1.9 million • Hillside Wastewater Collection System Rehab - $1.5 million • Purchase of Refuse Trucks and Roll -Off Containers - $1.4 million • Wastewater Collection Projects - $1.1 million • Purchase of Service Trucks & Equipment- $0.6 million • Replacement of U.V. System at the Wastewater Treatment Plant - $0.5 million 6. Current utility fees will not enable the funding of these much -needed capital projects. Even by spreading the cost of these projects over multiple years through debt financing, additional revenues will be needed to fund the required debt service. 5 Major Considerations in Making Utility Rate Recommendations Some of the more important factors affecting future utility rate requirements are listed below: 1. Estimated 5% annual growth in operating costs. 2. Annual increases in labor costs. 3. Continued growth in residential and commercial customers. 4. Potential increases in the water rate charged by TUMA. 5. Increased debt service payments needed to fund the capital projects to maintain current water, sewer, refuse, and stormwater services and to increase capacity for growth in population. b. FY 2025 projected based on budget. From fiscal year 2007 through fiscal year 2016, revenues increased 59% while operating expenses increased 85%. As a result, operations began operating at a loss beginning with fiscal year 2014, and unrestricted reserves were substantially depleted. Due to the implementation of the five-year utility rate plan, the OPWA unrestricted net position has increased, enabling the City to go forward with much -needed infrastructure improvements over the next five years. The revenues in fiscal years 2021- 2024 exceeded expenses largely due to the timing of expenditures for large, on -going infrastructure projects. Additional capital projects are needed to address our growing population and to continue providing quality services to our citizens. In fiscal year 2024, an $8.33 million loan was issued to fund the upgrades of the Ranch Creek Interceptor, the 117th Force Main, and the Elm Creek Interceptor. The payments for this loan are included above. The bulk of the reimbursable debt, such as for the new Public Works Facility, Fire Station #4, and other City capital projects, is funded by the third penny sales tax for capital improvements and is excluded from the graph above. 19 Water System OPWA currently purchases all of its treated water on a wholesale basis from the Tulsa Metropolitan Utility Authority (TMUA). OPWA is billed monthly by TMUA under a "sole source" contract. TMUA annually reviews and adjusts the price of water to all customers, including OPWA. The most recent adjustment was a 1.7% increase effective October 2017, bringing the rate charged by TMUA to OPWA, as of October 1, 2024, to $3.50 per thousand gallons on a uniform rate structure. Currently, Owasso has no other alternate source of water, such as its own back-up water treatment system or a connection to another neighboring water system. The Owasso Public Works Authority has experienced a 7% growth in the number of water customers over the past ten years. 0 Water Consumption Water consumption is largely driven by weather conditions and number of customers. The chart below presents water consumption information for the past ten fiscal years. Customer billings are calculated by adding the tier usage rates per thousand gallons to the monthly base rate. Current rates were effective October 2024. Rates for customers outside City limits have been established by OPWA Resolution to be 20% greater than rates for customers inside City limits. The system consists of a collection system, eight lift stations, and a wastewater treatment plant at 600 S. Main. The easement lies within property located at 9331 North Garnett Road, Owasso, Oklahoma, CLOSURE OF A 10' UTILITY EASEMENT A total of 2,450 square feet of the 10' utility easement on Lot 1, Block 8, Smith Farm Village, Blocks 7, 8, 9, 10 & 1 1(Plat #7018). The easement lies within property located at 9311 North Garnett Road, Owasso, Oklahoma. CLOSURE OF A PORTION OF A 25' STORM DRAINAGE EASEMENT A total of 5,783 square feet of the 25' storm drainage easement (Document # 2007101848) on Lots 1 and 2, Block 8, Smith Farm Village, Blocks 7, 8, 9, 10 & 1 1 (Plat #7018). The portion of the easement to be closed lies within property located at 9311 and 9331 North Garnett Road, Owasso, Oklahoma. ANALYSIS: • The Smith Farm Village, Blocks 7, 8, 9, 10 & 11 final plat was approved by Owasso City Council in December of 2021 and subsequently filed with Tulsa County in February of 2022. • Following the filing of the final plat, the shared lot lines between all three lots present within Block 8 of this development were reconfigured via two approved lot line adjustments (OLLA 24- 03 and OLLA 25-01). These adjustments were requested by the developer to accommodate changes in the lot configurations that were unforeseen at the time of platting. o As such, the developer has requested the closure of the two above -mentioned subject utility easements as they are no longer located along the perimeters of the newly configured lots and will inhibit the placement of structures on said lots. o Pending approval of this closure request, the developer intends to file two (2) new 10' utility easements by separate instrument, in coordination with the Public Works Department. These proposed new utility easements will line up with the revised shared lot line created via OLLA 25-01 and will act as standard perimeter utility easements. • The subject stormwater drainage easement was originally dedicated in 2007 (Document # 2007101848) via separate instrument, prior to the approval and filing of the Smith Farm Village, Blocks 7, 8, 9, 10 & 11 final plat. As a part of the ongoing development in this area, the developer has relocated and re -engineered the stormwater drainage infrastructure that services the subject properties. Following this relocation, the existing stormwater drainage easement is no longer necessary since its purpose is accommodated elsewhere. The developer has thus Easement Closure -Smith Farm Village Block 8 Page 2 requested the closure of this portion of said stormwater easement to be able to reclaim more buildable space within the lot located at 9311 North Garnett Road. • All required notices were sent to all franchise holders and utility companies. The City of Owasso Public Works Department was also contacted regarding the closing of these easements and indicated there should be no impacts to future utilities or stormwater drainage. Staff has not been notified that the closure of these easements would negatively impact any utility companies. Upon City Council action to close the easements, the applicant is advised to take these items to District Court and file for vacation of the subject easements, which will completely remove them from the books. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee (TAC) reviewed this item at their regular meeting on April 16, 2025. Stevens, Director of Managerial Services SUBJECT: Citizen Board and Committees Appointments DATE: May 8, 2025 BACKGROUND: To continue citizen participation and City staff involvement on the various boards, committees, trusts, and commissions, an item has been placed on the May Worksession agenda to discuss the annual appointment process. This memorandum provides background information for each board or committee and identifies terms that are vacant or set to expire on June 30th. AUDIT COMMITTEE - This committee oversees the audit of financial statements, ensures the auditor is independent of city management, and reviews internal controls and policies: five voting members and two non -voting ex-officio members (City Manager and Finance Director). Except for the City Council Representative, who serves a one-year term, appointments are for three-year terms: Paul Loving (Seat 1, City Council Representative) Nick Sokolosky (Seat 5, Banker) In accordance with the City Ordinance, Seat No. 1 shall be held by a City Councilor serving the second year of their three-year term. Councilors Alvin Fruga and Cody Walter are eligible for this committee. BOARD OF ADJUSTMENT - This is a quasi-judicial body to decide cases relating to zoning variances and appeals of the Building Inspector's interpretation of the building codes. Appeals of decisions made by this board must be taken to the District Court, Five citizen members and appointments are for three-year terms: Jim Bausch (At Large) Kyle Davis (At Large) CAPITAL IMPROVEMENTS COMMITTEE - This committee reviews capital improvement project requests proposed to be funded by the third -penny sales tax and Vision for Owasso 55/100ths sales tax. This committee is comprised of citizens, representatives of other boards and commissions, and city staff. Appointments are for one-year terms: Doug Bonebrake (City Council Representative) Jason Drake (At Large) Lyndell Dunn (City Council Representative) Jim Hunter (At Large) David Smith (Planning Commission Representative) Rob Haskins (At Large) Dirk Thomas (OEDA Representative) Kent Inouye (At Large) Jeff Davis (At Large) Keith Whitfield (At Large) OWASSO ECONOMIC DEVELOPMENT AUTHORITY - The duties of this authority are to plan, implement, and promote projects and programs that will directly benefit the economic well- being of the community. The seven Trustees include five members At Large, one representative of the Chamber of Commerce, and one City Councilor. Except for the Chamber and the City Council Representative serving one-year terms, member appointments are for five-year terms: David Chorney (At Large) Chelsea Feary (Chamber Representative) Alvin Fruga (Council Representative) B&C Appointments Page 2 PERSONNEL BOARD - This board meets when there is business to be addressed relating to appeals of personnel decisions made by the City Manager. Meetings are called by the Chair when a petition from a City employee is received in the Office of the City Clerk per the Personnel Policy Manual. Appointments are for three-year terms: Kristin Duggins (At Large) PLANNING COMMISSION - The purpose of this commission is to review and recommend to the City Council actions relating to zoning, platting, subdivision construction, annexation, commercial site plans, and other related planning functions. Appointments are for three-year terms: Kelly Lewis (At Large) Brian Cook (At Large) Chad Balthrop (At Large) —term expires 2026 INCOG TRANSPORTATION POLICY COMMITTEE - This regional transportation committee facilitates a cooperative effort with federal, state, and local governments and other transportation agencies to assess the area's transportation requirements. Appointments to the committee are for one-year terms: Doug Bonebrake (City Council Representative) Chris Garrett (City Manager, Alternate) INCOG TRANSPORTATION TECHNICAL COMMITTEE - This committee works closely with the INCOG Transportation Policy Committee to develop comprehensive, multi -modal plans that address the transportation needs and goals of the region. Appointments to the committee are for one-year terms: Roger Stevens (Public Works) Dwayne Henderson (Public Works, Alternate) REGIONAL METROPOLITAN UTILITY AUTHORITY - The Authority is a joint venture of Tulsa, Broken Arrow, Owasso, Jenks, and Bixby. The purpose of the Authority is to fund regional municipality utility efforts. Appointments to the Authority are for one-year terms: Travis Blundell (Assistant Public Works Director) Dwayne Henderson (City Engineer) TO: The Honorable Mayor and City Council FROM: Michele Dempster, Senior Director SUBJECT: General Liability/Property Self -Insurance Fund and Reimbursements DATE: May 8, 2025 BACKGROUND: In 2003, the City Council approved a policy establishing the General Liability/Property Self - Insurance Fund to self -insure general liability and vehicle collision risks. The fund also covers premiums to fully insure property and vehicles valued over $175,000. Financing for the fund is provided through billings to the General Fund and OPWA. With being self -insured, instead of paying premiums to an insurance carrier, the City pays for general liability claims directly, such as torts and lawsuits that may be filed against the City. Additionally, the City self -insures for state -required vehicle collision coverage. Which means when an accident is caused by a City employee, the cost of repairing or replacing the other drivers vehicle is covered through the Self -Insurance Fund. In both cases, any budgeted funds not spent on claims remain with the City. The fund is also used as a pass -through for vehicle accidents where a City vehicle is damaged due to the fault of a non -employee, as well as for property claims that are covered under the City's property insurance policy. Typically, reimbursements, whether from another driver's insurance or from the City's property insurance carrier, are recorded as revenue under "Reimbursements and Refunds." These funds then roll over into the Fund's balance in the following fiscal year. NEW PROCESS: Staff proposes aligning the reimbursement process with that of the Healthcare Self -Insurance Fund. Upon receipt of reimbursements, staff will place an item on the City Council consent agenda requesting approval of a budget amendment to increase both revenues and expenditures in the General Liability/Property Self -Insurance Fund by the amount received. The reimbursement revenue will offset the cost of the related expenditure, whether for vehicle or property repairs, and make those funds available for any additional claims during the current fiscal year.
