Call to Order - Mayor/Chair Alvin Fruga called the meeting to order at 6:30pm. 2. Invocation - The Invocation was offered by Pastor Don Cason of Hope Chapel Foursquare Church. 3. Flag Salute - JJ Dossett led the flag salute. 4. Presentation of the Character Trait of Sincerity - Andrew Rankin presented the character trait for May. 5. Oath of Office for Councilors -Elect - Cody Walter (Ward 1) and Chad Balthrop (Ward 5) Julie Lombardi administered the Oath of Office for Ward 1, City Councilor/Trustee Cody Walter and Ward 5, City Councilor/Trustee Chad Balthrop. 6. Roll Call - A quorum was declared present. Mr. Dunn moved, seconded by Mr. Walter, to elect Alvin Fruga to serve as Mayor/OPWA Chair/OPGA Chair. YEA: Balthrop, Dunn, Loving, Walter, Fruga NAY: None Motion carried: 5-0 8. Consideration and appropriate action relating to the election of Vice Mayor/OPWA Vice Chair/OPGA Vice Chair Mayor/Chair Alvin Fruga called for a nomination for the positions of Vice Mayor/Vice Chair. YEA: Balthrop, Dunn, Loving, Walter, Fruga NAY: None Motion carried: 5-0 10. Consideration and appropriate action relating to items removed from the Consent Agenda - None 11. Citizen request to address the City Council regarding a proposed ordinance related to dead trees Todd Rickert addressed the City Council regarding interest in establishing a dead tree ordinance, referencing a similar ordinance in place in the City of Tulsa. 12. City Council consideration and appropriate action relating to the purchase of supplemental vehicle equipment Jason Woodruff presented the item, recommending approval of the supplemental purchase from Visual Force Inc., of Catoosa, Oklahoma, in the amount of $14,659.32, and authorization for payment. There were no comments from the audience. Following discussion, Mr. Walter moved, seconded by Mr. Dunn, to approve the purchase and authorize payment, as recommended. YEA: Balthrop, Dunn, Loving, Walter, Fruga NAY: None Motion carried: 5-0 13. City Council consideration and appropriate action relating to an agreement for design services for the Owasso Sports Park Renovation Project Larry Langford presented the item, recommending approval of a professional services agreement with GH2 Architects of Tulsa, Oklahoma, in an amount not to exceed $60,000.00 and authorization to execute the necessary documents. There were no comments from the audience. Following discussion, Mr. Dunn moved, seconded by Mr. Walter, to approve the agreement and authorize execution of documents, as recommended. YEA: Balthrop, Dunn, Loving, Walter, Fruga NAY: None Motion carried: 5-0 14. OPWA consideration and appropriate action relating to a Small Business Enhancement Agreement for Development Project Assistance in the Owasso Redbud District Project Plan, Tax Increment Financing District No. 1 Carly Novozinsky presented the item, recommending approval and execution of the agreement with Team TRI, LLC, and authorization for payment in the amount of $1,529.53 for landscape and signage improvements located at 105 W 3rd Avenue. There were no comments from the audience. Following discussion, Mr. Loving moved, seconded by Mr. Walter, to approve the agreement, authorize execution of documents and payment, as recommended. YEA: Balthrop, Loving, Walter, Fruga NAY: None ABSTAIN: Dunn Motion carried: 4-1 15. Presentation of the monthly Project Status Report Roger Stevens presented the item and discussion was held. 16. Report from City Manager Chris Garrett recognized Dr. Chad Balthrop for his eight years of service on the Owasso Planning Commission; he also provided a report on the recent Owasso Cares Day event and expressed appreciation for the volunteers who participated. Discussion relating to a request to close utility easements and a portion of a storm drainage easement located within 9311 North Garnett Road and 9331 North Garnett Road in Smith Farm Village Wendy Kramer presented the item and discussion was held. It was explained this item will be placed on the May 20, 2025, City Council agenda for consideration and action. 7. Discussion relating to a request for annexation (OA 25-01) of approximately 20 acres located west of North 1081h East Avenue and east of the Owasso Sports Park South parking lot and rezoning request (OZ 25-02) from Agricultural (AG) to Public Facilities (PF) Alexa Beemer presented the item and discussion was held. It was explained this item will be placed on the May 20, 2025, City Council agenda for consideration and action. 8. Mr. Dunn moved, second by Mr. Balthrop to enter into executive session, as recommended. At 7:17 pm, Dr. Balthrop exited Executive Session At 7:19 pm, Dr. Balthrop returned to Executive Session. At 7:35 pm, Chris Garrett entered Executive Session. At 8:06 pm, Chris Garrett exited Executive Session. At 8:15 pm, Chris Garrett entered Executive Session. This fund covers the cost of claims and administrative fees associated with health, dental, and vision coverage, with funding provided by premiums paid by employees and departments. Self -Insurance means that, instead of paying premiums to an external insurance company, the City pays claims directly through a third -party administrator. This approach enables the City to retain any unspent budgeted funds. To manage risk, the City carries Stop Loss coverage, which limits liability for any single individual. If a claim exceeds the Stop Loss limit, the excess costs are covered by the Stop Loss carrier. Effective July 1, 2024, the City transitioned its Stop Loss coverage from AETNA to Sun Life, resulting in $400,000 in premium savings. With this transition,. the City is required to pay the full amount of all claims upfront, with reimbursement for claims that exceed the Stop Loss limit. These reimbursements are credited to the Healthcare Self -Insurance Fund as revenue. A budget amendment is required to account for the increased expenditures associated with claims that surpass the Stop Loss threshold. STOP LOSS REIMBURSEMENT RECEIVED: The City has received Stop Loss reimbursements in the amount $555,481.04. This amount has been credited to the 'reimbursements and refunds" line item in the Healthcare Self -Insurance Fund. A budget amendment is required to allocate these funds for future claims expenditures. RECOMMENDATION: Staff recommends approval of a budget amendment in the Healthcare Self -Insurance Fund, increasing appropriation for expenditures by $555,481.04. The donation is part of the Cherokee Nation's initiative to be good partners within the community by aiding worthwhile causes that provide valuable services to the community and Cherokee Nation citizens. If approved, the donated funding will be utilized to support fire department operations. RECOMMENDATION: Staff recommends acceptance of the donation from the Cherokee Nation, and approval of a budget amendment increasing the estimate of revenues and the appropriation for expenditures in the Half -Penny Sales Tax Fund by $3,500.00. The easement lies within property located at 9331 North Garnett Road, Owasso, Oklahoma. CLOSURE OF A 10' UTILITY EASEMENT A total of 2,450 square feet of the 10' utility easement on Lot 1, Block 8, Smith Farm Village, Blocks 7, 8, 9, 10 & 11 (Plat #7018). The easement lies within property located at 9311 North Garnett Road, Owasso, Oklahoma. CLOSURE OF A PORTION OF A 25' STORM DRAINAGE EASEMENT A total of 5,783 square feet of the 25' storm drainage easement (Document # 2007101848) on Lots 1 and 2, Block 8, Smith Farm Village, Blocks 7, 8, 9, 10 & 1 1(Plat #7018). The portion of the easement to be closed lies within property located at 9311 and 9331 North Garnett Road, Owasso, Oklahoma. ANALYSIS: • The Smith Farm Village, Blocks 7, 8, 9, 10 & 11 final plat was approved by Owasso City Council in December of 2021 and subsequently filed with Tulsa County in February of 2022. • Following the filing of the final plat, the shared lot lines between all three lots present within Block 8 of this development were reconfigured via two approved lot line adjustments (OLLA 24- 03 and OLLA 25-01). These adjustments were requested by the developer to accommodate changes in the lot configurations that were unforeseen at the time of platting. As such, the developer has requested the closure of the two above -mentioned subject utility easements as they are no longer located along the perimeters of the newly configured lots and will inhibit the placement of structures on said lots. Pending approval of this closure request, the developer intends to file two (2) new 10' utility easements by separate instrument, in coordination with the Public Works Department. These proposed new utility easements will line up with the revised shared lot line created via OLLA 25-01 and will act as standard perimeter utility easements. The subject stormwater drainage easement was originally dedicated in 2007 (Document # 2007101848) via separate instrument, prior to the approval and filing of the Smith Farm Village, Blocks 7, 8, 9, 10 & 11 final plat. o As a part of the ongoing development in this area, the developer has relocated and re -engineered the stormwater drainage infrastructure that services the subject properties. o Following this relocation, the existing stormwater drainage easement is no longer necessary since its purpose is accommodated elsewhere. The developer has thus Easement Closure - Smith Farm Village Block 8 Page 2 requested the closure of this portion of said stormwater easement to be able to reclaim more buildable space within the lot located at 9311 North Garnett Road. All required notices were sent to all franchise holders and utility companies. The City of Owasso Public Works Department was also contacted regarding the closing of these easements and indicated there should be no impacts to future utilities or stormwater drainage. o Staff has not been notified that the closure of these easements would negatively impact any utility companies. Upon City Council action to close the easements, the applicant is advised to take these items to District Court and file for vacation of the subject easements, which will completely remove them from the books. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee (TAC) reviewed this item at their regular meeting on April 16, 2025. The following comments were made concerning these easement closure requests: • Public Works- Coordinate with Public Works to review proposed new utility easements prior to filing with Tulsa County • AT&T- No facilities in the proposed closures; service is provided from the south side of East 93rd Place North • PSO- Coordinate with PSO regarding ongoing utility line relocation RECOMMENDATIONS: In developing a recommendation, staff evaluated the easement closure requests on the criteria outlined in Chapter 8 of the Owasso Subdivision Regulations. Following this evaluation, staff concluded that the subject easement closure requests meet all of the legal requirements for approval. To combat the problem, as part of the Fair and Accurate Credit Transactions Act of 2003 (the FACT Act), the Federal Trade Commission and several other federal agencies have issued rules requiring creditors (including municipalities under certain circumstances) to develop, adopt and implement written Identity Theft Prevention Programs. The Programs were required to be in place by May 1, 2009. The rules are often referred to as RED FLAG requirements and apply to financial institutions and municipalities that provide utility services and/or other services for which payment is made in arrears. It is the provision of services on a deferred payment basis that makes a municipality a "creditor" as defined under Red Flags. ACTION TAKEN: The City of Owasso adopted Resolution No. 2009-03 to help protect identity theft and fight theft of customer account information, and provide procedures that identify, detect, and respond to possible signals of identity theft known as Red Flags. As a result, the following list of security enhancements are enforced to ensure the security of customer information: 1) Only allow for applications for service to be made in person; 2) Verify the identification of existing customers if they request information in person, via telephone, via facsimile, or via e-mail. 3) Verify identification of existing customers when requesting to transfer service, change account status, change mailing address, or to terminate service; 4) Verify proof of ownership/lease agreement; 5) Require proper identification when a customer presents a Credit or Debit Card for payment if the name is on the card is different from the name on the utility account. ANNUAL REPORT: Red Flag procedures were reviewed in April 2025. No breach of confidential customer personal identifying information or suspected identity theft was detected over the past year.
