Call to Order - Mr. Ramey called the meeting to order at 6:00 pm. 2. Roll Call - A quorum was declared present. PRESENT: ABSENT: STAFF: Chair -Joe Ramey Alexa Beemer, Planning Manager Vice Chair - Jim Bausch (in (9 6:02) Wendy Kramer, City Planner Board Member - Kyle Davis Cyndi Townsend, Recording Secretary Board Member - Heather Cunningham Julie Lombardi, City Attorney Board Member - Dean Knoten 3. Consideration and appropriate action relating to the minutes of the January 28, 2025, Regular Meeting Mr. Davis moved, seconded by Mr. Knoten, to approve the Minutes as presented. YEA: Davis, Cunningham, Knoten, Ramey NAY: None Motion carried: 4-0 *Jim Bausch entered the meeting at 6:02 pm* 4. Consideration and appropriate action relating to a special exception request (OBOA 25-02) to allow for the construction of an accessory structure in excess of five (500) hundred square feet on property located at 10612 East 961h Place North, zoned Residential Single Family (RS-3) Alexa Beemer presented the item, recommending approval. Three audience members spoke. After discussion, Mr. Bausch moved, seconded by Mr. Davis, to approve the special exception OBOA 25-02, as recommended. YEA: Davis NAY: Knoten, Cunningham, Ramey, Bausch Motion denied: 1-4 5. Consideration and appropriate action relating to a special exception request (OBOA 25-03) to allow for the construction of an accessory structure in excess of five (500) hundred square feet and a variance request to allow for the reduction of the minimum required setback for accessory structures on property located at 1602 North Atlanta Street, zoned Residential Single Family (RS-3) Alexa Beemer presented the item, recommending approval of the special exception request and denial of the variance request. Staff received one written comment, and no comments were made from the audience. After discussion, Mr. Ramey moved, seconded by Mrs. Cunningham, to approve the special exception request OBOA 25-03, as recommended. YEA: Davis, Ramey, Bausch, Knoten, Cunningham NAY: None Motion carried: 5-0 Then Mr. Bausch moved, seconded by Mrs. Cunningham, to approve the variance request OBOA 25-03. Consideration and appropriate action relating to a special exception request (OBOA 25-01) to allow for the construction of an accessory structure in excess of five (500) hundred square feet on property located at 12703 East 771h Circle North, zoned Residential Single Family (RS-3) Wendy Kramer presented the item. Five audience members spoke. After discussion, Mr. Davis moved, seconded by Mr. Bausch, to approve the special exception request OBOA 25-01, with the condition that the applicant apply for the permit within 10 days and complete the work within 180 days. R Communi0 ty TO: The Owasso Board of Adjustment FROM: Alexa Beemer, AICP, Planning Manager SUBJECT: OBOA 25-04 - Special Exception - 11410 North 109th East Avenue DATE: May 23, 2025 BACKGROUND: The Community Development Department received a request for a Special Exception to allow for the construction of single-family dwelling not otherwise allowed within the Residential Mobile Home Park (RMH) zoning district. The subject property is located at 11410 North 109th East Avenue, further described as Lot 3, Block 4, Hale Acres 2nd. SUBJECT PROPERTY/PROJECT DATA: Property Size 0.25 acres +/- Current Zoning Residential Mobile Home Park (RMH) Within an Overlay District? No Within a PUD? No Proposed Structure Single -Family Detached Dwelling (+/- 4,000 square feet) Lots/Blocks Lot 3, Block 4, Hale Acres 2nd Water Provider City of Owasso Sewer Provider City of Owasso APPROVAL PROCESS: According to Appendix B, Article XV, Section 4 of the Owasso Zoning Code: "The Board of Adjustment shall hold the public hearing and, upon the concurring vote of three (3) members, may grant the Special Exception after finding that the Special Exception will be in harmony with the spirit and intent of the Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. The Board, in granting a Special Exception, shall prescribe appropriate conditions and safeguards and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached." A building permit for the proposed structure must be issued within one (1) year of the date of approval, or the special exception shall be considered void unless the BOA has approved an extension. ANALYSIS: • Per Section 4.4.5 of the Owasso Zoning Code, the only residential use allowed within the RMH designation is a mobile home. o The applicant has requested a Special Exception in order to build a four -thousand (4,000) square foot detached single-family dwelling unit. The applicant has indicated the structure will be constructed in the "barndominium" style, and will be permanent in nature. o To the best of staff's knowledge, the proposed structure does not meet the definition of a "mobile home" seen within the Owasso Zoning Code. • According to the information supplied by the applicant, the proposed structure would be approximately forty (40) feet long by ten (10) feet wide by twenty-eight (28) feet tall. • The proposed structure would be setback fifty (50) feet from the eastern (front) property line, ten (10) feet from the northern and southern (side) properties lines, and thirty (30) feet from the western (rear) property line. o This does appear to meet the setback requirements for individual RMH-zoned lots, as outlined in Table 4.10 of the Owasso Zoning Code. • Based on the site plan provided by the applicant, the proposed structure does not appear to encroach on any platted utility easements. • Letters containing notification of this case were mailed to all property owners within three hundred (300) feet of the subject property, and notification was also posted in the newspaper in accordance with State Statute. o At of the time of the writing of this memo, staff has received one phone call from an adjacent neighbor who has concerns about the structure. Should the Special Exception be approved, a building permit will be required for the proposed structure. Any development that occurs on the subject property shall adhere to all other applicable development, zoning, and engineering requirements of the City of Owasso.
