Monday, July 7, 2025
The Owasso Planning Commission met in regular session on Monday, July 7, 2025, in the Council Chambers
at Old Central, 109 North Birch Street, Owasso, Oklahoma per the Notice of Public Meeting filed Friday,
December 13, 2024; and the agenda filed in the office of the City Clerk and posted at Owasso City Hall,
200 South Main Street, at 5:00 pm on Tuesday, July 1, 2025.
1. Call to Order - Mr. Smith called the meeting to order at 6:00 p.m.
2. Flag Salute - Mr. Smith led the flag salute.
3. Roll Call - A quorum was declared present.

8. Consideration and appropriate action relating to a planned unit development (OPUD 25-01) and
rezoning (OZ 25-01) from Downtown Mixed (DM) and Public Facility (PF) to Downtown Mixed (DM)
zoning, with an OPUD 25-01 Overlay, on approximately 1.83 +/- acres, located at 103 West Broadway
Street, within the Downtown Overlay District
Wendy Kramer presented the item, recommending approval. There were no comments from the
audience. Mr. Vines moved, seconded by Mrs. Lewis, to recommend approval to the City Council,
subject to the following Technical Advisory Committee comments:
PUD Text/Exhibits:
■ Title Page: Remove slash ("/") before "25-01 " in OZ case number
■ Page 4, Section VI: Add language that final access points will be determined during site plan
review
■ Page 4, Section VII & Page 5, Table 2: Note all on -street parking will be public

Alexa Beemer presented the item, recommending approval. There were no comments from the
audience. Mrs. Lewis moved, seconded by Mr. Cook, to recommend approval to the City Council,
subject to the following Technical Advisory Committee comment:
■ Rezoning is contingent on approval of a minor variance to reduce the minimum frontage required
within an Industrial Light (IL) zoning district

10. Consideration and appropriate action relating to a combined preliminary and final plat proposing
a commercial development on approximately 2.49 acres +/-, located at 11428 North 129th East
Avenue, zoned Commercial Shopping (CS)
Mr. Cook recused from the discussion and consideration and left the chambers at 6:17 p.m. Alexa Beemer
presented the item, recommending approval. There were no comments from the audience. Mrs. Lewis
moved, seconded by Mr. Smith, to approve the preliminary plat, subject to the following Technical
Advisory Committee comments:
Prelim/Final Plat Faces:
■ Show curb -cuts across North 129th East Avenue
■ Label width of North 129th East Avenue
■ Label building setbacks per Section 6.5 of the Owasso Zoning Code
■ Consider widening the northernmost access point to 40' wide
■ Option to reduce all perimeter utility easements to 17.5', except for the 20' Rural Water District
water line easement (WL/E)
■ Drainage easements (D/Es) are referenced in Deed of Dedication (DoD) but not shown; add
locations to plat face
■ Shift southernmost access to the south property line or provide a Mutual Access Easement (MAE)
for future joint access

activity for June 2025.
12. Report on items from the June 18, 2025 Technical Advisory Committee (TAC) Meeting - Brian
Dempster reported on a right-of-way closure and lot combination (OLC 25-01) for property located
northwest of the northwest corner of West Broadway Street and North Main Street and a site plan
review for Mercy Regional EMS, located at 11428 North 129t" East Avenue.

BACKGROUND:
The Community Development Department received a request for the annexation and rezoning of
property located on the northern portion of 405 West 2nd Avenue. The subject property is
approximately 3.85 acres in size and is currently zoned Agriculture (AG) within Tulsa County. Upon
annexation, the applicant is requesting the property be brought into Owasso City Limits as Industrial
Light (IL) via accompanying rezoning request (OZ 25-05).

ANALYSIS:
• The subject property represents a portion of a larger 5-acre lot.
o The southern portion of this 5-acre lot, totaling 1.019 acres, is already a part of the
corporate limits of the City of Owasso and was recently rezoned to IL via Ordinance
1236.
o The subject property constitutes the northern portion of this 5-acre tract.
• The subject property is contiguous with City limits along the southern, eastern, and western
boundaries of the property.
• Typically, property is assigned a zoning of Agriculture (AG) by default upon annexation. The
applicant can also request the property retain the County's corresponding zoning designation
under the Owasso Zoning Code, or seek a concurrent rezoning based on what the GrOwasso
2035 Land Use Master Plan prescribes.
o In this case, the applicant is requesting that the subject property be annexed and
assigned a zoning of IL, via a concurrent rezoning request.
• The GrOwasso 2035 Land Use Master Plan identifies the subject property for future
"Industrial/Regional Employment" uses.
o As such, assigning a zoning of IL to the subject property upon annexation is consistent
with the long-range vision for the property laid out in the Master Plan.
• The property is currently unplatted; the property will be required to be platted prior to the
issuance of any building permits regarding new construction on the property.

• The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to
the property.
• Any development that occurs on the subject property shall adhere to all development, zoning,
and engineering requirements of the City of Owasso.

TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this item at their regular meeting on July 16, 2025.
No comments were made concerning this item.
RECOMMENDATION:
In developing a recommendation, staff evaluated Oklahoma State Statute, Title 11, Chapter 1, Part 1,
Article XXI, Section 21-101 and Section 1.4.3 of the Owasso Zoning Code. Following this evaluation, staff
concluded that the subject annexation and rezoning requests meet all of the legal requirements for
approval.
As such, staff recommends approval of annexation request OA 25-03 and concurrent rezoning request
OZ 25-05, annexing the subject property into Owasso City Limits with an assigned zoning of Industrial
Light (IL).

THIS MUTUAL ACCESS EASEMENT is made and entered this )OVI.day of January
RECITALS:
Evergreen Coffee Holdings LLC, an Oklahoma limited liability company is the owner in fee
of a tract of land located in Tulsa County, Oklahoma, referred to herein as "Tract One" and
described as follows:
A Twenty-nine (29) foot wide tract of land located in Lot Thirteen (13) of Block
Five (5) in HALE ACRES, according to the Recorded Plat No. 2695, City of
Owasso, Tulsa County, State of Oklahoma; being more particularly described as
follows:
COMMENCING at the SE corner of Lot 13, Block 5, HALE ACRES; THENCE
S 88°44'23"W along the south line of said Lot 13 a distance of 20.00 feet to the
POINT OF BEGINNING being on the present right-of-way of North Garnett
Road; THENCE S 88°44'23"W along the south line of said Lot 13 a distance of
210.00 feet; THENCE N 01°24'58"W a distance of 29.00 feet; THENCE N
88°44'23"E a distance of 210.00 feet to said present right-of-way of North Garnett
Road; THENCE S 01°24'58"E along said present right-of-way a distance of
29.00 feet to the POINT OF BEGINNING.

Evergreen Coffee Holdings LLC, an Oklahoma limited liability company is the owner in fee

Lot Thirteen (13) of Block Five (5) in HALE ACRES, City of Owasso, Tulsa
County, State of Oklahoma, according to the Recorded Plat No. 2695.
NOW, THEREFORE in consideration of Ten Dollars ($10.00) and other good and
valuable consideration, Evergreen Coffee Holdings LLC, an Oklahoma limited liability company,
hereby grants unto the Public, a mutual access easement and right-of-way over and across "Tract
One" for the purpose of ingress and egress.
WHEREAS, said Easement described herein as "Tract One" and shown on Exhibit A
attached hereto and made a part hereof, shall attach and become appurtenant to "Tract Two".
This document shall be construed according to the Iaws of the State of Oklahoma. In the
event any provision contained herein is finally determined to be invalid or unenforceable, such
invalidity or unenforceability shall not affect the other provisions hereof which can be given effect

to be severable.
