SUBJECT: RESOLUTION NO. 2007 -13, CALLING FOR A COUNCIL WARD
ELECTION

BACKGROUND:
Pursuant to the provisions of the Owasso City Charter governing the election of City Council
members, "the Council shall take action by Resolution to call any necessary Ward Elections ". In
2008, such election is required for Wards 3 and 4, each for a three year term.
The staff has prepared Resolution No. 2007 -13 which, if approved by the City Council, calls for
an election to be conducted for Wards 3 and 4. In addition, the proposed resolution identifies the
process to be followed in order to meet all legal requirements and allows for proper notification
to the Tulsa County and Rogers County Election Boards. Please note, that the purpose of
requesting City Council action at this time is to allow for the required notice (such requirement
set at sixty days prior to the election process) to the Tulsa County Election Board.
The filing period for interested candidates will be February 4, 5, and 6, 2008. All candidates
must file a Declaration of Candidacy with the Tulsa County Election Board between the hours of
8:00 AM and 5:00 PM on either of these dates. Only qualified electors who reside within the
Ward for at least six months prior to filing a declaration of candidacy shall be qualified to hold
the office of Council Member for that Ward.
The primary election is set by the City Charter and will be held on March 4, 2008. All registered
voters residing within the city limits of the City of Owasso may vote in the election. Should one
of the candidates not receive the majority of all votes cast for a particular Ward, a general
election will be called. The general election, if necessary, will be held on April 1, 2008.
The elected Councilors will be sworn into office at the May 6, 2008 regular meeting of the City
Council.
RECOMMENDATION:
Staff intends to place an action item on the November 20, 2007 Council agenda adopting
Resolution No. 2007 -13, calling for an election to be conducted for the purposes of electing City
Council representation for Wards 3 and 4.

SUBJECT: CITY ORDINANCES RELATED TO WILD & EXOTIC ANIMALS

BACKGROUND:
Currently, the Owasso City Ordinances restrict the possession of Wild and Exotic
Animals under Section 4 -118. Under this Section the majority, if not all, wild animals
native to the State of Oklahoma are unlawful to possess by persons within the City
Limits. There are no exemptions to this section for Wildlife Rehabilitators.
On September 10, 2007, a citizen called Owasso Animal Control to register a complaint
relating to a residence located at 8695 N 125th E. Ave. The complaint was in regards to
several Deer in the citizen's backyard. Research into the complaint revealed that resident,
Mrs. Chaney Haley, is licensed by the State of Oklahoma as a Wildlife Rehabilitator.
Persons who hold this license are allowed by the State to possess wild animals for the
purpose helping them recover from illness, injury, or animals that are young and have
been displaced from their mothers.
During the course of trying to resolve the complaint, staff spoke with the complainant
and Mrs. Haley on several occasions. The complainant alleges that he has complained on
Mrs. Haley in the past and the City of Owasso has always sided with him. Mrs. Haley
acknowledges that she knew about the ordinances but thought they had been changed
several years ago to exempt rehabilitators.
Past practice in dealing with complaints from citizens is to enforce existing ordinances;
therefore, Mrs. Haley was told she was no longer able to keep wild animals within the
City of Owasso. Mrs. Haley has requested that the City of Owasso amend its current
ordinances to provide an exemption for Wildlife Rehabilitators.
COMMENTS:
Department staff recognizes the important role that Wildlife Rehabilitators play in
helping animals in distress. Balancing this role with the needs of Owasso citizens is
important. The question as to whether or not Wildlife Rehabilitators should be allowed to
operate within the City of Owasso is complicated. It could be argued that citizens move
into the City Limits to take advantage of the conveniences of shopping, school, medical
facilities, and other community resources. In addition to these resources, citizens often
cite the benefits of police protection, code enforcement, and fire protection. Owasso
citizens benefit from many protections that citizens who live in the "county" do not.
Examples would be trash burning, livestock, shooting firearms, fireworks, and many
other quality of life and health issues. The complainant in the above referenced complaint
commented that he did not move into a neighborhood to have to smell deer feces and that
his property value was being affected by the presence of deer and animal cages in his
neighbors yard.
It is important to point out that the Wildlife Rehabilitator in question only takes care of
deer and raccoons. It is possible that changing the ordinances would allow for the
possession of skunks, bears, bobcats, possums, beavers, armadillos, coyotes and various
other animals, birds, and reptiles.
In addition to the issues cited above, there is an additional concern as it relates to
changing the existing ordinances. Department staff believes that a complete evaluation is
needed of the Animal Control Ordinances. There are several areas within the ordinances
that may need revision. It may be the best use of the staff's time to address the ordinances
in a comprehensive manner to ensure continuity of all Animal Control Ordinances.
Further, staff believes that any changes should be done in a systematic planned approach.
RECOMMENDATION:
Staff recommends that no changes be made to the current ordinances and that the
Department's strategic plan establish a timeline for the revision of the Animal Control
Ordinances.

SUBJECT: REQUEST FOR SUPPLEMENTAL APPROPRIATION
FY 2007 -2008 STORM EVENT RECOVERY

BACKGROUND:
On Wednesday evening October 17, 2007, a severe storm struck portions of the City of Owasso.
The storm caused significant damage to portions of Original Town, Elm Creek and Three Lakes
including considerable tree damage throughout the City.
Public Works crews from multiple divisions performed cleanup operations for twelve days
following the event. This cleanup event required the purchase of seven (7) additional chainsaws,
chains, and bar oil to facilitate effective and efficient cleanup operations.
Based on an evaluation of year -to -date expenditures for the Stormwater /Vegetation Division, a
supplemental appropriation in the amount of $3,420.00 is necessary to address an existing
funding deficiency created by the procurement of the necessary debris removal equipment.
FUNDING:
Adequate funding is available in the General Fund reserves to fund the supplemental
appropriation in the amount of $3,420.00.
RECOMMENDATION:
Unless there are concerns expressed by Council at the worksession, staff intends to recommend
Council approval of a Supplemental Appropriation in the amount of $3,420.00 for unanticipated
expenditures related to FY 2007 -2008 storm management activities at the November 20, 2007
regular meeting of the City Council.

SUBJECT: FY 2007 -2008 CIP STREET REHABILATION PROGRAM
BID AWARD

BACKGROUND:
Included in the FY 2007 -2008 Budget, the Capital Improvements Fund allows for the
expenditure of $1 million for the repair and/or resurfacing of residential and non - residential
roadways throughout the City. An additional $165,000 will be obtained from remaining funds in
the FY 06 -07 program. Rehabilitation sites have been evaluated and selected based on a
comprehensive assessment of roadway conditions. The selection process was aimed at
maximizing return on investment by increasing roadway lifecycle and minimizing future
maintenance costs while enhancing overall roadway driving conditions and public safety. On
July 17, 2007, the City Council approved the FY 2007 -2008 Street Rehabilitation Program repair
site priorities. The cost estimate for the construction of the repair site priorities was anticipated
to be approximately $1.2 million.
Upon approval of the site priorities, the Engineering Division began to complete bid documents.
The bid documents outlined the work to be completed in Part I of the rehabilitation program.
Part I includes pavement repair, including removal, disposal and replacement of existing
pavement as well as concrete curb and gutter replacement for those projects identified as needing
complete repair and the asphalt overlay provided by an Interlocal Agreement with Tulsa County.
Projects included in Part I are shown in Attachment A.
Part II of the rehabilitation program includes the paving and/or resurfacing of approximately five
lane -miles (or 7,000 tons of asphalt) of roadway surface. On September 18, 2007, the City
Council approved an Interlocal Agreement between the City of Owasso and Tulsa County for
paving assistance as part of the FY 2007 -2008 Street Rehabilitation Program. This Agreement
will allow for the use of Tulsa County labor and equipment with material purchased by the City
of Owasso. Projects associated with this agreement are also shown in Attachment A. The
provisions of this Agreement include:
■ The City of Owasso shall provide all required materials;
Tulsa County shall provide all necessary labor and equipment to complete the
prof ects; and
FY 2007 -2008 Street Rehabilitation Program
■ Duration of the Agreement shall be for a period equal to the time necessary to
complete the projects.
As mentioned above, one of the provisions of this Interlocal Agreement includes that all
materials shall be furnished by the City of Owasso. Thus, Part II materials and costs include the
following:
■ Asphalt Material $180,000
■ Paving Fabric $ 85,000
■ Traffic Control $ 20,000
■ Striping 30,000
Total $315,000
ANALYSIS OF BIDS:
A Notice to Bidders for the work to be performed in Part I of the FY 2007 -08 Street
Rehabilitation Program was published in the Owasso Reporter on October 4, 2007 and October
11, 2007. Facsimile notifications were sent directly to numerous local contractors on October 23,
2007. A mandatory pre -bid meeting was held on October 25, 2007 with five (5) contractors
present. Bids were publicly opened on November 5, 2007 with one (1) contractor submitting the
following bid:
Becco Contractors, Inc. (Tulsa) $ 826,098
As a result of the combined cost of Part I and II totaling $1,141,098, the three (3) alternate bids
will not be recommended for award. A complete tabulation of unit prices and alternate bids is
included as Attachment B.
PROJECT FUNDING:
Funds for this project in the amount of $1,000,000 are included in the FY 07 -08 Capital
Improvements Fund. An additional $165,000 will be obtained from remaining funding in the FY
06 -07 program.
RECOMMENDATION:
Unless concerns are expressed by the Council, staff intends to recommend award of Part I of the
FY07 -08 CIP Street Rehabilitation Program contract to Becco Contractors, Inc. of Tulsa, OK in
the amount of $826,098 at the November 20, 2007 regular meeting.

SUBJECT: PROPOSED ORDINANCE PROHIBITING SMOKING IN CITY PARKS
DATE: November 13, 2007
BACKGROUND:
On July 17, 2007, the Owasso City Council passed Ordinance No.897 entitled "Smoking and
Tobacco," and Ordinance No. 898, "Smoking in Certain Public Places Prohibited." The City of
Owasso followed the national and statewide trend in enacting these ordinances. Increasingly,
municipalities have sought to bolster and strengthen State laws prohibiting smoking in certain
places and restricting access to tobacco products by juveniles. Adoption of ordinances of this
type increase the State law's enforceability and effectiveness, reduce the amount of time and
money which must be expended by law enforcement to prevent these types of offenses, and are
indicative of the City's strong support of State laws which seek to protect juveniles from using or
possessing tobacco products, and to protect all citizens from being subjected to "second -hand"
smoke against their will.
The proposed ordinance, "Prohibiting Smoking in City Parks" is the next logical step in the City
of Owasso's ongoing effort to protect the City's youth from exposure to cigarette smoke and the
use of tobacco products. This measure is intended to protect children and families from exposure
to secondhand smoke and the use of other tobacco products in the City's parks. This ordinance
would operate to prevent the use of all tobacco products in all City owned parks, the Skate Park,
and the restrooms and parking lots at each of those facilities.
DISCUSSION OF PROPOSED ORDINANCE:
Chapter 9, Part 10, Section 10 -913 "Prohibiting Smoking in City Parks"
This ordinance, unlike its predecessors Ordinances No. 897 and No. 898 which prevented
smoking in public buildings and banned the sale of tobacco products to minors, is not precisely
mirrored in State statutes. However, effective November 1, 2007, the Oklahoma Legislature
passed 210. S. §1 -1523 which prohibits the use of lighted tobacco products in any zoo within the
state. This statute specifically includes all areas within a zoo, both indoor and outdoor. Several
municipalities within Oklahoma have opted to follow the State's lead on this issue and consider
enacting ordinances which also prevent smoking or the use of tobacco in public areas where the
public is likely to be present. Although none of these municipalities have yet enacted an
ordinance of this type to staff's knowledge, it is likely that a number of cities and towns will do
so in the coming months. Currently, the City of Muskogee does have an ordinance which
prohibits smoking at a city owned water park which is partially located outdoors. Staff is
unaware of any other similar ordinances.
Adoption of the proposed ordinance accomplishes several objectives. First, it protects children,
families and other individuals from ingesting secondhand smoke in the City's parks, and further
prevents youth at impressionable ages from exposure to the use of tobacco products. The
previous ordinances adopted by the City have evidenced Owasso's unwavering commitment to
eradicate the use of tobacco products by youth to the greatest extent possible, and enactment of
this proposed ordinance significantly furthers that objective.
RECOMMENDATION:
The staff intends to recommend City Council approval of the proposed ordinance.

PROPOSED ORDINANCE
AN ORDINANCE RELATING TO PART 10, OFFENSES AND CRIMES,
CHAPTER 9, SMOKING AND TOBACCO, OF THE CODE OF
ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA, AMENDING
SAME BY PROHIBITING THE USE OF TOBACCO IN CITY PARKS;
PENALTIES FOR VIOLATIONS.
THIS ORDINANCE AMENDS PART 10 OF THE CITY OF THE OWASSO
CODE OF ORDINANCES BY CREATING SECTION 10 -913, TOBACCO USE
IN CITY PARKS PROHIBITED.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, THAT, TO -WIT:
SECTION ONE (1): Part 10, Offenses and Crimes, Chapter 9, Smoking and Tobacco, of the
Code of Ordinances of the City of Owasso, Oklahoma, shall be amended by providing and codifying
as follows:
SECTION TWO (2):
SECTION 10 -913 TOBACCO USE IN CITY PARKS PROHIBITED
A. The use of tobacco is a public nuisance, dangerous to public health and harmful to children,
therefore the use of tobacco in any form is hereby prohibited in all City owned parks. The use of
tobacco in any form shall also be prohibited in and around all public restrooms located in City owned
parks, and in and around all parking lots adjacent to City owned parks. This ordinance specifically
includes and bans the use of tobacco products at the City of Owasso Skate Park.
B. Any person who knowingly violates this section is guilty of a misdemeanor, and upon conviction
thereof shall be punished by imposition of a fine of not less than TEN DOLLARS ($10.00) nor more
than TWO HUNDRED DOLLARS ($200.00), excluding costs, fees, and assessments.
SECTION THREE (3): REPEALER
All ordinances or parts of ordinances, in conflict with this amended ordinance are hereby repealed to
the extent of the conflict only.
SECTION FOUR (4): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the
remaining portion shall not be affected but shall remain in full force and effect.
SECTION FIVE (5): DECLARING AN EFFECTIVE DATE
The provisions of this ordinance shall become effective thirty (30) days from the date of final
passage as provided by state law.
SECTION SIX (6): CODIFICATION
The City of Owasso Code of Ordinances is hereby amended by creating an ordinance to be codified
in Part 10, Chapter 9, as section 10 -913, "Tobacco Use in City Parks Prohibited."

SUBJECT: DEVELOPMENT OF A BUILDING PERMIT APPLICATION FEE
DATE: November 8, 2007
BACKGROUND:
In April of this year following a comprehensive review of service rates and charges
assessed by the City of Owasso, the City Council adopted several new fees assessed by
the Parks, Cemetery, Community Center, Community Development, Animal Control,
Police, Fire, and Public Works Departments.
At that time, one of the fees discussed but not brought to the City Council for discussion
was the development of a Building Permit Application Fee. The idea behind the
proposed fee was to assess a fee of $100 in order to cover the costs incurred during the
review and approval process involved with a building permit. The proposal was not
brought to the City Council for discussion because there was disagreement by staff
regarding the relevance and appropriate nature of this type of fee.
RECENT DEVELOPMENTS:
The Community Development Department has recently been experiencing a marked
increase in the number of issued building permits that are later requested by the building
permit applicant to be refunded and voided. As a result, associated costs with the permit
review and issuance process are not covered by the existing fees charged for building
permits. Instead, the entire cost of this process is then incurred by the City of Owasso.
In order to address this problem, a Building Permit Application Fee is being proposed by
staff.
CURRENT PROPOSAL:
The solution currently being proposed by staff is actually a modification of the original
Building Permit Application Fee. The proposal allows for a $100 Building Permit
Application Fee to be assessed and collected at the time of building permit application. If
a permit is issued, the final permit fee would be reduced by $100 at the time of issuance
as a result of a credit for the $100 Building Permit Application Fee. Therefore, no overall
increase in cost would be experienced by the builder /applicant.
However, in the event that the permit is issued and paid for by the builder /applicant and
then later cancelled at their request, all fees would be refunded with the exception of the
$100 Building Permit Application Fee. Additionally, in the event that the permit is
issued and never "picked up" by the applicant, the City would retain the $100 from the
proposed Building Permit Application Fee.
This proposal would address the need for the city to ensure its costs associated with the
review and issuance of a permit are collected, while also potentially acting as a deterrent
to the builder /applicant from applying for a permit when, perhaps, they are not ready to
do so or before financing is secured by the eventual owner.
REQUESTED ACTION:
If the Council is agreeable to the proposed Building Permit Application Fee as outlined
above, the fee may be adopted by a simple motion of the Council to do so at a regular
meeting. Additionally, should the fee be approved, staff would then notify the building
community of this change in the application process.
RECOMMENDATION:
If there are no concerns expressed by the Council following review and discussion at the
November 13, 2007 Work Session, staff will place this item on the November 20, 2007
City Council agenda for action. Additionally, staff would recommend that the proposed
Building Permit Application Fee be effective January 1, 2008 in order to allow for
notification to the building community.

SUBJECT: PROPOSED CARRYOVER BUDGET
DATE: November 9, 2007
BACKGROUND:
In 1993, the City Council adopted a "Carryover Budget Policy." Each year since then, the City
Council has approved a "carryover" supplemental appropriation. A "carryover" budget is a
concept wherein a department's budgeted, but unexpended, funds from one fiscal year may be re-
budgeted (appropriated) to the next fiscal year. The goal of a carryover budget is to encourage
economy and efficiency in the use of public funds.
Traditional public sector budgets "reward" the expenditure of all of the funds under a manager's
control and justify an increasing level of appropriations in subsequent fiscal years. In using this
traditional philosophy, efforts to be efficient and save money often are "rewarded" by a reduction
in future budgets. The carryover budget promotes a philosophy of "save and invest it" rather than
"spend it or lose it." Managers who save money from last year's budget have been rewarded by
the possibility of a carryover appropriation to the new fiscal year budget.
GENERAL FUND - The approved FY 2007 -08 budget included a projected available fund balance
for July 1, 2007 of $2,520,000 in the General Fund. That estimate was based on certain
assumptions about revenues and spending that would occur through the end of the fiscal year. The
actual beginning fund balance for fiscal 2007 -08 was $3,690,000 or $1,190,000 greater than the
original estimate. Most of that difference is due to open contracts and projects incomplete at the
fiscal year end. On August 8, the City Council approved a supplemental appropriation of
$599,928 in the General Fund for the fiscal year end open contracts. The remaining $590,072
difference in the fund balance is the basis for funding the carryover budget supplement in the
General Fund.
The requests recommended for the carryover appropriation in ten departments of the General Fund
total $200,714. The schedule of General Fund recommendations is attached.
STORMWATER MANAGEMENT FUND — $59,488 is available for carryover appropriation in
the Stormwater Management Fund. The recommended request is for $48,388 for the Ranch Creek
crossing project and other drainage project improvements.
REQUESTS:
Staff will request City Council approval of carryover supplemental appropriations in the General
Fund for $200,714 and the Stormwater Management Fund for $48,388.

SUPPORT
Funding for City & County Roads — Support an initiative to return a half -
cent of the state sales tax generated by cities and counties for construction
and repair of roads and bridges. Small cities will be guaranteed at least
$3000. Rebates step up to $7000 based on the amount of sales tax
generated in the city or county.
REAP Funding — Support increase in appropriations to the Rural Economic
Action Program to at least $22 mil. INCOG will receive a full share if
funding reaches $17.5 mil.
Medical Costs incurred by Jail Authority — Support efforts to remove the jail
as the first payor on inmate medical costs and thereby enable hospitals to
seek reimbursement from Medicare /Medicaid.
Supports efforts to correct Transportation Funding Mechanism to remove
the trigger that limits funding for state roads and bridges to funding
generated by the growth in the state's economy.
INI TIATE
Reform of Citizen Lawsuit Procedure (Qui Tam actions) - Initiate a change
statute that allows taxpayer lawsuits from a minimum of 10 residents to a
number equal to 10% of the voters who voted in the preceding general
election. A similar requirement already exists for grand juries and initiative
petitions.
Funding for the Gilcrease Expressway — Initiate action to add the Gilcrease
Expressway to the list of possible Oklahoma Transportation Authority
construction projects.
