To request an accommodation due to a disability, contact the City Clerk by phone 918-376-1502 or by email to istevens@citvofowasso. com OWASSO BOARD OF ADJUSTMENT MINUTES OF REGULAR MEETING TUESDAY, October 28, 2025 The Owasso Board of Adjustment met in regular session on Tuesday, October 28, 2025, in the Council Chambers at Old Central, 109 North Birch Street, Owasso, Oklahoma, per the Notice of Public Meeting filed Friday, December 13, 2024; and the agenda filed in the office of the City Clerk and posted at City Hall, 200 South Main Street, at 5:00 pm on Tuesday, October 21, 2025. 1. Call to Order- Mr. Davis called the meeting to order at 6:00 pm. 2. Roll Call - A quorum was declared present. PRESENT: ABSENT: STAFF: Chair- Kyle Davis Board Member- Dean Knoten Brian Dempster, Community Dev. Director Vice Chair- Heather Cunningham Wendy Kramer, City Planner Board Member -Jim Bausch Cyndi Townsend, Recording Secretary Board Member -Joe Ramey 3. Consideration and appropriate action relating to the minutes of the July 22, 2025, Regular Meeting Mr. Bausch moved, seconded by Mr. Davis, to approve the Minutes as presented. YEA: Ramey, Davis, Cunningham, Bausch NAY: None Motion carried: 4-0 4. Consideration and appropriate action relating to a request for a special exception (OBOA 25-08) to allow for the construction of an accessory structure exceeding the maximum allowed square footage in a Residential Single Family (RS-3) zoning district, for property approximately 0.25 acres +/-, located at 8732 North 121St East Avenue Wendy Kramer presented the item, recommending approval. There were no comments from the audience. After discussion, Mr. Bausch moved, seconded by Mr. Ramey, to approve the special exception OBOA 25-08, as recommended. YEA: Bausch, Davis, Ramey, Cunningham, NAY: None Motion carried: 4-0 and the meeting adjourned at 6:07 p.m. Cyndi Townsend, Recording Secretary Item #1 OReople •REAL Character •R_EA L C0 ommunity TO: The Owasso Board of Adjustment FROM: Alexa Beemer, AICP, Planning Manager SUBJECT: OBOA 25-10 - Special Exception - 8304 North 991h East Avenue DATE: November 17, 2025 BACKGROUND: The Community Development Department received a request for a Special Exception to construct an accessory structure exceeding the maximum allowed square footage in the Residential Single -Family (RS-3) district. The property, located at 8304 North 99th East Avenue, is legally described as Lot Two (2), Block Three (3), The Summit at Southern Links. SUBJECT PROPERTY/PROJECT DATA: Property Size 0.67 acres +/- Current Zoning Residential Single -Family (RS-3) Within an Overlay District? No Within a PUD? Yes; OPUD 9 Proposed Structure Detached Garage (approx. 600 sq ft total) Lots/Blocks Lot 2, Block 3, The Summit at Southern Links Water Provider City of Owasso Sewer Provider City of Owasso APPROVAL PROCESS: Per Appendix B, Article XV, Section 4 of the Owasso Zoning Code: "The Board of Adjustment shall hold the public hearing and, upon the concurring vote of 3 members, may grant the Special Exception after finding that the Special Exception will be in harmony with the spirit and intent of the Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. The Board, in granting a Special Exception, shall prescribe appropriate conditions and safeguards and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached." A building permit for the proposed structure must be issued within 1 year of approval, or the Special Exception becomes void unless an extension is approved by the BOA. ANALYSIS: • The 0.67-acre property is zoned RS-3. • The applicant requests a Special Exception to construct a 600 sq ft detached garage. c The Owasso Zoning Code requires BOA approval for accessory structures over 500 sq ft in size within an RS-3 district. • Per the applicant, the proposed structure measures 20' x 30' with a height of 18.5', and will be located in the northwest portion of the rear/side yard. • Per the Owasso Zoning Code, accessory structures over 15 ft in height must be set back at least 10 ft from property lines. o The applicant proposes a setback of 12 ft. from the west property line and 45 ft. from the north property line; all other setbacks are met. • The proposed structure shall be placed outside the front setback and does not appear to violate rear yard coverage maximums set by the Owasso Zoning Code (max 20% coverage). • The applicant's survey confirms no encroachment on platted utility easements, ensuring no detriment to public welfare. • Public notice was mailed to all property owners within 300 ft and published in the newspaper, per State Statute. o No comments or objections were received as of this report. In conclusion, Staff finds the request consistent with the intent of the Owasso Zoning Code and not injurious to the neighborhood.
