9. Consideration and appropriate action relating to Ordinance 1244, approving the abandonment of
Owasso Planned Unit Development, OPUD 23-06, containing approximately 2.50 acres located at 10094

10. Consideration and appropriate action relating to Ordinance 1245, approving the rezoning of
approximately 1.136 acres located north of the northeast corner of East 86th Street North and North 145th
East Avenue from Residential Multi -Family (RM) to Commercial Shopping (CS), as referenced in
application OZ 26-01

11. Consideration and appropriate action relating to a Final Plat for Lot 3 of Block 2 of Bailey Ranch
Commercial, a proposed commercial subdivision on approximately 4.068 acres, zoned Commercial

North 1101h East Avenue intersection

MINUTES OF REGULAR MEETING
TUESDAY, FEBRUARY 3, 2026
The Owasso City Council met in regular session on Tuesday, February 3, 2026, in the Council Chambers at
Old Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting filed Friday, December
11, 2025; and the Agenda filed in the office of the City Clerk and posted at City Hall, 200 South Main Street,
at 10:00 am on Friday, January 30, 2026.
1. Call to Order -Mayor Alvin Fruga called the meeting to order at 6:30pm.
2. Invocation - The Invocation was offered by Groups Pastor Brad Aylor of First Baptist Church of Owasso.
3. Flag Salute -Councilor Jamie Dunn led the flag salute.

4. Roll Call - A quorum was declared present.

5. Presentation of Character Trait Tolerance - Councilor Chad Balthrop presented the character trait for
February.
6. Consideration and appropriate action relating to the Consent Agenda. (All matters listed under
"Consent" are considered by the City Council to be routine and will be enacted by one motion. Any
Councilor may, however, remove an item from the Consent Agenda by request. A motion to adopt the
Consent Agenda is non -debatable.)

C. Approve Normal Retirement Benefits for Jerry Fowler
D. Accept public infrastructure of two fire line connections, a fire hydrant, and 70 sq ft of
sidewalk located at 9281 North Garnett Road (Planet Fitness)
E. Declare three (3) traffic signal poles and mast arms as surplus to the needs of the City and
authorize their disposal through transfer to Tulsa County
Mr. Loving moved, seconded by Mr. Walter, to approve the Consent Agenda as presented, with claims
totaling $2,482,396.56.

B. Presentation of the Owasso Strong Neighborhood Initiative Annual Report - Jerry Fowler presented the
item. Discussion was held.

9. Consideration and appropriate action relating to Resolution 2026-01, amending the Capital
Improvement Fund project eligibility list to include the East 86rh Street North Widening from Garnett Road
to North 119rh East Avenue Project and remove various completed projects
JJ Dossett presented the item, recommending approval of Resolution 2026-01. There were no
comments from the audience. Following discussion, Mr. Walter moved, seconded by Mr. Loving, to
approve Resolution 2026-01, as recommended.

10. Consideration and appropriate action relating to an amendment to the Agreement for Engineering
Services with Meshek and Associates, LLC, of Tulsa, Oklahoma, for the Smithview Channel and Rayola
Park Detention Pond Improvement Project
Daniel Dearing presented the item, recommending approval of Amendment No. 2 to the Agreement
for additional survey work, in the amount of $7,800.00, and authorization to execute all necessary
documents. There were no comments from the audience. Following discussion, Mr. Loving moved,
seconded by Mr. Balthrop to approve Amendment No. 2 and authorize execution of documents, as
recommended.

11. Consideration and appropriate action relating to an agreement for engineering design services for the
Lakeridge Estates Drainage Improvement Project
Daniel Dearing presented the item, recommending approval of an Agreement for Engineering Services
with WSB, LLC, of Minneapolis, Minnesota, in the amount of $67,500.00, and authorization to execute all
necessary documents. There were no comments from the audience. Following discussion, Mr. Walter
moved, seconded by Mr. Balthrop, to approve the agreement and authorize execution of documents,
as recommended.

12, Presentation of the monthly Project Status Report - Roger Stevens presented the item and discussion
was held.
13. Report from City Manager - Chris Garrett reported on the City Flag Project, inspired by Owasso resident
Holden Foyil. The project will be on display at City Hall and during City Council meetings for public
viewing and comment through March 6, 2026.
14. Report from City Attorney - None
15. Report from City Councilors - Alvin Fruga commented on the Flag Project.

(OPGA) met in a joint regular meeting on Tuesday, February 10, 2026, in the Council Chambers at Old
Central, 109 North Birch Street, Owasso, Oklahoma, per the Notice of Public Meeting filed Thursday,
December 11, 2025; and the Agenda filed in the office of the City Clerk and posted at City Hall, 200 South
Main Street, at 5:30 pm on Thursday, February 5, 2026.

Recommendation for Contract Award - East 1161h Street & Mingo Road Grading
Project

BACKGROUND:
• In 2020, the City purchased land along 116th & Mingo from Cornerstone Center Inc. (Seller).
• The Seller retained 8.95 acres.
• As a part of the Contract for Purchase under Paragraph 12, the City was to use dirt
excavated on the purchased property to place fill on Seller's retained property in order to
remove the property from the floodplain while not impacting the floodway.
• In October 2024, construction broke ground for the new Public Works facility.
• In 2025, during construction of the Public Works site the excavated material was stored and
stockpiled.
• Public Works Engineering staff studied the floodplain and prepared a proposed floodplain
exhibit based on feasibility and floodway considerations.
• In July 2025, Public Works Administration met with the Seller and discussed the project and
proposed floodplain boundary. The Seller signed a temporary access agreement for the
project to allow for any access for surveying, clearing and dirt work.
• Engineering staff began surveying and preparing design plans for where and how the dirt
should be placed.
SOLICITATION OF BIDS:
In December 2025, City Engineering staff completed final bid documents and published
advertisements in accordance with state statutes. A mandatory pre -bid meeting was held on
January 7, 2026, with eleven different construction and supply companies represented. Bids were
opened on January 15, 2026, with a total of seven contractors submitting bids.
City Engineering staff completed a Bid Tabulation, showing the bid amounts and engineering

Ground Level, LLC provided the lowest bid in the amount of $199,981.50, which is below the
engineering estimate. Included in the project is a project allowance of $30,000.00 should the final
project cost require additional scope of work unforeseen at the time of bidding.

RECOMMENDATION:
Staff recommends awarding the construction contract to Ground Level, LLC of Adair, Oklahoma, in
the amount of $199,981.50, and authorization to execute all necessary documents.

CONTRACT FOR PURCHASE AND SALE OF REAL PROPERTY
THIS CONTRACT is made and entered into by and between CORNERSTONE
CENTER, INC., an Oklahoma corporation ("Seller'), whose address is P. O. Box 572,
Owasso, Oklahoma 74055 and CITY OF OWASSO ('Purchaser'), whose address is
200 South Main, Owasso, Oklahoma 74055.
WHEREAS, Seller owns the real property and all improvements thereon
referenced on Exhibit "A" attached hereto as the (a) 14.64 acre tract and (b) the 48.26
acre tract, but specifically excluding the 8.95 acre tract and the unlabeled tract (the legal
description of the property will be determined by survey and is referred to herein as the
"Property") (acreage numbers are for reference only);

the Purchaser desires to acquire the Property from Seller.
NOW, THEREFORE; in consideration of the mutual promises and agreements
herein contained, and other good and valuable consideration, the receipt and sufficiency
of which are hereby acknowledged, the parties agree as follows:
1. Sale and Purchase. Subject to the terms and conditions hereinafter set
forth, Seller agrees to sell and convey to Purchaser, and Purchaser agrees to buy and
acquire, the Property.
2. Purchase Price. The total purchase price of the Property is $1,500,000,
to be paid by Purchaser to Seiler as hereinafter provided.
3. Title. Within twenty (20) days after the execution of this Contract and
approval by the Owasso City Council, Seiler shall provide Purchaser an abstract of title
certified to within twenty days of delivery thereof showing a marketable title to the
Property, subject only to reserved or previously severed mineral interests, easements,
mineral leases, rights -of -way and building and use restrictions of record. Purchaser
shall have ten (10) days after receipt of such abstract in which to have the abstract
examined and fumish Seller notice in writing of any objections thqreto. No matter shall
be construed as a valid objection to title under this Contract unless it is so construed
under the "Real Estate Title Examination Standards" of the Oklahoma Bar Association,
where applicable. In case of valid objections to the title, Seller shall have ninety (90)
days or such additional time as may be agreed to in writing by both parties to satisfy
such objections. In the event the title cannot be perfected and is not insurable, or the
Seller is unwilling to satisfy any objections to title, this Contract shall be of no further
force and effect; provided, however, Purchaser may elect to purchase the Property with
any defects in title, without further liability on the part of Seller.
4. Taxes and Prorations. Seller shall pay in full: (i) all special assessments
against the Property upon the date of closing, whether or not payable in installments,
and (ii) all taxes other than general ad valorem taxes for the current year, wfiich are a
lien on the Property on the Closing Date. General ad valorem taxes for the calendar
year in which the closing occurs shall be prorated between Seller and Purchaser as of
the Closing Date provided that, if the amount of such taxes has not then been fixed, the
proration shall be based upon the rate of levy for the previous calendar year.
5. Risk of Loss. Until the Closing Date, risk of loss to the Property, ordinary
wear and tear excepted, shall be upon Seller; after the Closing Date, all risk of loss with
respect to the Property shall be upon Purchaser.
6. Closing. If Seller's title to the Property is found to be good and
marketable as provided above, or if all defects in said title are timely cured by Seller, a
closing of the purchase and sale herein provided shall be held on such date as the
parties may mutually agree, but in any event no later than April 1, 2020 (the "Closing
Date"). The closing will be held at Investors Title & Escrow, or such other place as the
parties may mutually agree. Any closing fee required by any insured or professional
closing agent shall be split between Seller and Purchaser.
7. Payment. The purchase price for the Property shall be paid by Purchaser
to Seller as follows: the entire purchase price (after prorations) to be paid in cash by
Purchaser to Seller on the Closing Date.
8. Deliveries at Closing. At the closing:
(a) Seller will deliver a special warranty deed conveying the Property to the
Purchaser;
(b) Purchaser will make the cash payment due to Seller described in paragraph 7
above; and
(c) The parties will execute and deliver (1) a closing statement evidencing their
agreement with the computations of and adjustments to the purchase price
and make any payments in accordance therewith, and (2) such other and
further documents as may be necessary to effect the transaction
contemplated herein.
9, bocumentary Stamps. Seller will pay all Oklahoma documentary stamps
which are due and payable in connection with the transaction provided for herein.
10. Possession/Early Occupancy. The sale and purchase provided for
herein shall be effective as of, and possession of the Property, shall be surrendered by
Seller to Purchaser on the Closing Date after the closing. Prior to closing, Purchaser
may enter the Property and perform any and all of the following improvements:
(a) clear and grub all or any portion of the Property;
(b) remove beaver dams;
(c) transport and store fill dirt on the Property; and
(d) remove fill dirt from the 100 year flood plain on the Property
and place it in the 100 year flood plain portion of Sellers
Property labeled on Exhibit A as the 8.95 acre tract and the
tract in the northwest corner of the Exhibit with no acreage
noted (collectively "Seller's Retained Land".)
11. Default. If, while Seiler is not in default with respect to any of its
obligations hereunder, Purchaser fails or defaults in performance of any of its
obligations hereunder and such failure or default continues for more than five (5) days
after notice thereof by Seller to the Purchaser, Seller may, at its sole option, cancel and
terminate this Contract by written notice to the Purchaser.
12. Seller's Retained Land. As part of the consideration for this transaction,
Purchaser agrees that (1) once a water retention area is completed on the Property, any
water retention/detention that might otherwise be required when Seller's Retained Land
is developed, shall be accommodated by the retention area on the Property without any
fee or cost to Seller or the owner/developer of Seller's Retained Land, and (2) to the
extent of the. dirt produced from the development of the retention pond by the
Seller on the Property, such dirt shall be deposited in the 100 year flood plain portion of
Seller's Retained Land to the extent necessary to remove all of Seller's Retained Land
from the 100 year flood plain (but not the existing floodway portion.)
13. Notice. All notices given hereunder will be in writing and will be delivered
or mailed by first class mail, return receipt requested, proper postage prepaid,
addressed to the respective addresses set forth herein. The address of any party
hereto may be changed by written notice to the other party in the manner hereinabove
described. Except as otherwise provided herein, all such notices will be deemed to
have been given when delivered or mailed as aforesaid by return receipt.
14. No Modification. This Contract may not be altered, changed or amended
except by an instrument in writing signed by the parties hereto. This instrument
contains the entire agreement of the parties hereto with respect to the transactions
covered hereby and supersedes all other agreements between the parties, oral or
written, relating to the subject matter hereof.
15. Governing Law. This Contract and all of its provisions shall be construed
in accordance with and governed by the laws of the State of Oklahoma.
16. Binding Effect. This Contract shall be binding upon the heirs,
administrators, executors, successors and assigns of the parties hereto and the
beneficiaries of the Seller's trust.
17. Headings. The descriptive headings of the paragraphs in this Contract
are solely for convenience and shalt not be relied upon in construing any provisions
hereof.
9 8. Non -Waiver. The failure of any party hereto in any one or more instances
to insist upon strict performance of any of the terms of this Contract shall not be
construed as a waiver or relinquishment of the right to assert or rely upon such terms on
any future occasion.

ARTICLE 2. ENGINEER

connection with the completion of the Work in accordance with the Contract Documents.
ARTICLE 3. CONTRACT TIME
3.1 The Work will be substantially completed within Sixty (60) calendar days from the
date of Notice to Proceed; and completed and ready for final payment in accordance with the
General Conditions within Ninety (90) calendar days from the date of Notice to Proceed, which
will be on or before
3.2 Liquidated Damages. OWNER and CONTRACTOR recognize that time is of the
essence of this Agreement and that OWNER will suffer financial loss if the Work is not
substantially complete within the time specified in paragraph 3.1 above, plus any extensions
thereof allowed in accordance with the General Conditions. They also recognize the delays,
expense and difficulties involved in proving in a legal or arbitration proceeding the actual loss
suffered by OWNER, if the Work is any such proof. OWNER and CONTRACTOR agree that
as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER Five

Hundred Dollars ($500.00) for each consecutive calendar day that expires after the time specified
in paragraph 3.1 for substantial completion until the Work is substantially complete. After
Substantial Completion, if CONTRACTOR shall neglect, refuse or fail to complete the
remaining Work within the time specified in paragraph 3.1 for completion and readiness for final
payment or any proper extension thereof granted by OWNER, CONTRACTOR shall pay
OWNER Five Hundred Dollars ($500.00) for each consecutive calendar day that expires after
the time specified in paragraph 3.1 for completion and readiness for final payment.
ARTICLE 4. CONTRACT PRICE
4.1 OWNER shall pay CONTRACTOR for performance of the Work in accordance with
the Contract Documents in current funds the amount agreed upon in CONTRACTOR'S bid.
4.2 CONTRACTOR understands that the estimated quantities are not guaranteed and that
the determination of actual quantities and their classification is to be made by the OWNER at the
time of application for payment.
4.3 CONTRACT AMOUNT: Contract amount is Nine One Hundred Ninety -Nine Thousand
Hundred Eighty -One and Fifty Cents ($ 199,981.50 ).
ARTICLE 5. PAYMENT PROCEDURES
CONTRACTOR shall submit Applications for Payment in accordance with the General
Conditions on the Pay Estimate Forms included as Exhibit "A" to this Agreement. Applications
for Payment will be processed by OWNER as provided in the General Conditions.
5.1 Progress Payments. OWNER shall make progress payments on account of the
Contract Price on the basis of CONTRACTOR's Applications for Payment in accordance with
the City of Owasso's Payment Schedule included as Exhibit "B" to this Agreement during
construction as provided below. All progress payments will be on the basis of the progress of the
Work.
5.1.1 Progress payments shall not exceed an amount equal to 95% of the WORK
completed until such time as CONTRACTOR shall complete in excess of fifty percent (50010) of
the contract amount.
5.1.2 Upon completion in excess of fifty percent (50%) of the total contract amount,
OWNER shall pay an amount sufficient to increase total payments to CONTRACTOR to 97.5%
of the Contract Price, less such amounts as OWNER shall determine in accordance with the
General Conditions, provided that OWNER has determined that satisfactory progress is being
made, and upon approval by the Surety.
5.2 Final Payment. Upon final completion and acceptance of the Work in accordance
with the General Conditions, OWNER shall pay the Contract Price.
ARTICLE 6. CONTRACTOR'S REPRESENTATIONS

In order to induce OWNER to enter into this Agreement, CONTRACTOR makes the following
representations:
6.1 CONTRACTOR has familiarized himself/herself with the nature and extent of
Contract Documents, Work, locality, and with all local conditions and federal, state and local
laws, ordinances, rules and regulations that in any manner may affect cost, progress or
performance of the Work.
6.2 CONTRACTOR has studied carefully all reports or explorations and tests of
subsurface conditions at or contiguous to the site and all drawings of physical conditions in or
relating to existing surface or subsurface structures at or contiguous to the site (except
underground facilities) which have been identified in the Supplementary Conditions as provided
in the General Conditions. Contractor accepts the determination set forth in the General
Conditions of the extent of the "technical data" contained in such reports and drawings upon
which Contractor is entitled to rely. Contractor acknowledges that such reports and drawings are
not Contract Documents and may not be complete for Contractor's purposes. Contractor
acknowledges that Owner and Engineer do not assume responsibility for the accuracy or
completeness of information and data shown or indicated in the Contract Documents with
respect to underground facilities at or continuous to the site. Contractor has obtained and
carefully studied (or assume responsibility for having done so) all such additional supplementary
examinations, investigations, explorations, tests, studies and data concerning conditions (surface,
subsurface and underground facilities) at or contiguous to the site or otherwise which may affect
cost, progress, performance or furnishing of the Work or which relate to any aspect of the means,
methods, techniques, sequences and procedures of construction to be employed by Contractor,
and safety precautions and programs incident thereto. Contractor does not consider that any
additional examinations, investigations, explorations, tests, studies, or data are necessary for the
performance and furnishing of the Work at the Contract Price, within the Contract Times and in
accordance with the other terms and conditions of the Contract Documents.
6.3 CONTRACTOR has made or caused to be made examinations, investigations, tests
and studies of such reports and related data in addition to those referred to in paragraph 6.2 as
(s)he deems necessary for the performance of the Work at the Contract price, within the Contract
Time and in accordance with the other terms and conditions of the Contract Documents; and no
additional examinations, investigations, tests, reports or similar data are or will be required by
CONTRACTOR for such purposes.
6.4 CONTRACTOR has reviewed and checked all information and data shown or
indicated on the Contract Documents with respect to existing Underground Facilities at or
contiguous to the site and assumes responsibility for the accurate location of said Underground
Facilities. No additional examinations, investigations, explorations, tests, reports, studies or
similar information or data in respect of said Underground Facilities are or will be required by
CONTRACTOR in order to perform and furnish the Work at the Contract Price within the
Contract Time and in accordance with the other terms and conditions of the Contract Documents,
including the General Conditions.
6.5 CONTRACTOR has correlated the results of all such observations, examinations,
investigations, tests, reports and data with the terms and conditions of the Contract Documents.

6.6 CONTRACTOR has given OWNER written notice of all conflicts, errors or
discrepancies that he has discovered in the Contract Documents, and the written resolution
thereof by OWNER is acceptable to CONTRACTOR.
6.7 CONTRACTOR has obligated himself/herself to the OWNER to be responsible for
the workmanship, labor and materials used in the project for two (2) years after the project has
been accepted by the OWNER.
6.8 CONTRACTOR understands that (s)he will be exempt from all sales tax on materials
and other items necessary for the completion of the project. The OWNER has issued him a
Certification of Tax Exempt Project enclosed as Exhibit "C" of this Agreement.
ARTICLE 7. CONTRACT DOCUMENTS
The Contract Documents which comprise the entire agreement between OWNER and
CONTRACTOR are attached to this Agreement, made a part hereof, and consist of the

8.2 No assignment by a party hereto of any rights under or interests in the Contract
Documents will be binding on another party hereto without the written consent of the party
sought to be bound; and specifically, but without limitation, monies that may become due and
monies that are due may not be assigned without such consent (except to the extent that the
effect of this restriction may be limited by law) and unless specifically stated to the contrary in
any written consent to an assignment, no assignment will release or discharge the assignor from
any duty or responsibility under the Contract Documents.
8.3 OWNER and CONTRACTOR each binds himself/herself, his/her partners,
successors, assigns, and legal representatives to the other party hereto, his/her partners,
successors, assigns and legal representatives in respect to all covenants, agreements and
obligations contained in the Contract Documents.
8.4 The Agreement (or remaining portions thereof) should continue in effect, be valid and
binding upon both parties even if a provision or part of the Contract Documents should be held
void or unenforceable by law.

BACKGROUND:
The Community Development Department received an application for review and approval of
a final plat vacation for Corrigan Glen. The subject property, located at 10094 North 971h East
Avenue, is approximately 2.50 +/- acres and is zoned Residential Neighborhood Mixed (RNX)
under OPUD 23-06. The purpose of the plat vacation is to prepare the property for a future replat
that would subdivide the site to accommodate proposed single-family homes. A concurrent
PUD Abandonment request, to abandon OPUD 23-06, has also been submitted for the subject
property.

ANALYSIS:
• The subject property was annexed into Owasso City Limits in 2015 (Ordinance 1053).
• The original final plat for Corrigan Glen was approved by the Owasso City Council in
September of 2024 and filed with Tulsa County Clerk's Office in November of 2024 (Plat
#7172).
o The original plat consisted of 1 Lot on 1 Block, to accommodate 3 quadplexes, as
approved under OPUD 23-06.
• The applicant now proposes to shift from the approved multi -family quadplex
development to a single-family residential neighborhood.
To facilitate this proposed change, the applicant is requesting a plat vacation. If
the vacation is approved, the applicant intends to follow up with a replat of the
subject property, effectively subdividing the property into individual single-family
lots.
The applicant has also submitted a concurrent request to abandon OPUD 23-06
and revert the zoning on the property to the base zoning of RNX.
• Approval of the plat vacation would void the original final plat, eliminating all associated
easements, dedications, access limits, and lot lines.

PLANNING COMMISSION:
The Owasso Planning Commission voted 5-0 to recommend approval of this item at their
regularly scheduled meeting on February 9, 2026.
RECOMMENDATION
In developing a recommendation, staff evaluated the plat vacation on the criteria outlined in
Section 1.6 of the Owasso Subdivision Regulations and Oklahoma State Statute Title 11, Chapter
1, Part 1, Article XLII. Following this evaluation, staff concluded that the request meets all legal
requirements for approval.

BACKGROUND:
The Community Development Department received an application to abandon the previously
approved OPUD 23-06. The subject property, located at 10094 North 971h East Avenue, is
approximately 2.50 +/- acres and is zoned Residential Neighborhood Mixed (RNX) under OPUD
23-06. The abandonment is proposed to allow development of a single-family neighborhood on
the property. A concurrent plat vacation request has also been submitted to vacate the final
plat of Corrigan Glen.

ANALYSIS
• The subject property was annexed into Owasso City Limits in 2015 (Ordinance 1053).
• OPUD 23-06 was approved by the Owasso City Council in October of 2023 (Ordinance
1215). The PUD allowed for the construction of 3 quadplexes, and its development
standards were written exclusively to accommodate multi -family development.
• The applicant now intends to shift from the approved multi -family quadplex
development to a single-family neighborhood.
o To facilitate this proposed change, the applicant is requesting abandonment of
OPUD 23-06 and a return to the base zoning of RNX.
o No change to the base zoning is requested, as RNX allows single-family uses by
right.
o A concurrent request has also been submitted to vacate the Corrigan Glen final
plat. If approved, the applicant intends to replat the property to subdivide it into
individual single-family lots.
• Approval of the PUD abandonment would render all development standards within the
OPUD 23-06 document null and void, and those regulations would no longer govern the
development of the property.

PLANNING COMMISSION:
The Owasso Planning Commission voted 5-0 to recommend approval of this item at their
regularly scheduled meeting on February 9, 2026.
RECOMMENDATION
In developing a recommendation, staff evaluated the PUD abandonment on the criteria
outlined in Oklahoma State Statute Title 11, Chapter 1, Part 1, Article XLIII. Following this
evaluation, staff concluded that the request meets all legal requirements for approval.
As such, staff recommends adoption of Ordinance 1244, to abandon OPUD 23-06.

AN ORDINANCE ABANDONING A PLANNED UNIT DEVELOPMENT AS
REFERENCED IN APPLICATION OPUD 23-06 AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WHEREAS, public hearings have been held regarding the request to abandon a
planned unit development on the property described below; and,
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for or against the requested abandonment of
planned unit development OPUD 23-06.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, THAT TO WIT:
SECTION 1.
A tract of land located in the Southeast Quarter of the Northeast Quarter, and the
Northeast Quarter of the Southeast Quarter of Section 13, Township 21 North, Range
13 East of the Indian Meridian, Tulsa County, Oklahoma, more particularly
described as follows:
Commencing at the East 1/4 Corner of said Section 13; thence S88031'49"W - 50.00
feet to a point on the West right of way line of N. 971h E. Ave., the Point of Beginning;
thence along West line S00055'38"E - 147.73 feet; thence N60037'02"W - 472.69 feet

the remaining portion shall not be affected but shall remain in full force and effect.
SECTION 4.
The provisions of this ordinance shall become effective thirty (30) days from the date of
final passage as provided by state law.

The Owasso Planning Commission voted 5-0 to recommend approval of this item at their
regularly scheduled meeting on February 9, 2026.
RECOMMENDATION
In developing a recommendation, staff evaluated the final plat on the criteria outlined in
Section 2.4 of the Owasso Subdivision Regulations. Following this evaluation, staff concluded that
the subject plat meets all legal requirements for approval.

BACKGROUND:
The City of Owasso is currently in the process of acquiring private property along East 961h Street
North as public right-of-way (ROW) and perpetual drainage easement in accordance with the
East 961h Street North Widening from North 134fh East Avenue to North 145th East Avenue.
Parcel No. 10.1 for permanent right-of-way for approximately 5,601 sq ft and Parcel 10.2 for
perpetual drainage easement for approximately 3,156 sq ff are located at 13610 East 96th Street
North and are owned by the Bear Creek Trust, dated July 14, 2015. A final offer by the City of
Owasso was sent to the landowner in the amount of $31,000.00 for Parcel 10.1 and Parcel 10.2.
This offer was not accepted; therefore, it is necessary to condemn the property.
Based upon the foregoing, it has become apparent that condemnation is the sole mechanism
available to the City to obtain the necessary easements on the parcels. The right-of-way and
perpetual drainage easement in question will be utilized for a public purpose; a condemnation
action is both warranted and appropriate. Staff submits that a Resolution of Necessity
authorizing the filing and prosecution of a condemnation action is appropriate and required to
obtain the land needed from the property owner..
RECOMMENDATION -
Staff recommends approval of Resolution 2026-02, authorizing the filing and prosecution of a
condemnation action to obtain the necessary right-of-way and easement from the Bear Creek
Trust, dated July 14, 2015, property described therein.

THE NECESSITY OF INSTITUTING AND PROSECUTING CONDEMNATION PROCEDURES TO
OBTAIN PROPERTY LOCATED AT 13610 EAST 96fh STREET NORTH, OWASSO, OKLAHOMA,

WHEREAS: The City of Owasso, by and through officers and agents thereof, has
endeavored to purchase certain property from the Bear Creek Trust, dated July 14, 2015,
with the following legal description:
Parcel 10.1:
A portion of the Northwest 1/4 of Section 21, Township 21 North, Range 14 East, Tulsa
County, State of Oklahoma, being more particularly described as follows.
Commencing at the Northeast corner of said Northwest 1/4; thence a distance of
378.38 feet, on a bearing of S88032'48"W, being the basis of bearings for this
description, along the North line of said Northwest 1/4; thence a distance of 33.00
feet to the Northeast corner of the Parent Parcel described in document number
2023028677 as filed with the Tulsa County Clerk's Office, on a bearing of SOl027'121,
to a point on the Southerly Present Right-of-way line for E 96th Street N, said line
being 33.00 feet South and parallel with the North line of said Northwest 1/4, also
being the Point of Beginning; thence SO1027'11"E, along the East line of said Parent
Parcel, a distance of 17.00 feet to a point being 50.00 South of said North line; thence
S88°32'48"W, parallel to said North line, a distance of 329.45 feet to a point on the

safety and to facilitate the widening of East 961h Street North from North 134th East Avenue

made a bona fide, good faith offer to the Bear Creek Trust, dated July 14, 2015, to
purchase the land referenced above; and
WHEREAS: The Bear Creek Trust, dated July 14, 2015, has declined such offer of
payment by the City of Owasso; and
WHEREAS: As provided under the Constitution and Statutes of the State of
Oklahoma, it is necessary for the City of Owasso to condemn the property referenced
above in the interest of public safety and for the widening of East 96'h Street North from
North 134th East Avenue to North 145th East Avenue.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, THAT: It being necessary for public safety, the officers and agents of the
City of Owasso, Oklahoma, are hereby authorized to initiate, and prosecute to the
conclusion thereof, condemnation proceedings against Bear Creek Trust, dated July 14,
2015, which has declined such offer of payment by the City of Owasso.
