NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT TO WIT: SECTION 1. A tract of land located in the Southeast Quarter of the Northeast Quarter, and the Northeast Quarter of the Southeast Quarter of Section 13, Township 21 North, Range 13 East of the Indian Meridian, Tulsa County, Oklahoma, more particularly described as follows: Commencing at the East '/4 Corner of said Section 13; thence S88031'49"W - 50.00 feet to a point on the West right of way line of N. 97fh E. Ave., the Point of Beginning; thence along West line S00055'38"E - 147.73 feet; thence N60037'02"W - 472.69 feet to the East boundary line of the AT&SF Railroad ROW; thence along the said East line N 14008'40"E - 161.02 feet; thence departing said East line N89004' 17"E - 366.21 feet to a point on said West line; thence along said West line S00055'38"E - 246.32 feet to the Point of Beginning, containing 108,879.21 square feet, or 2.50 acres, more or less, is removed from the PUD Overlay (OPUD 23-06) as previously established under City Ordinance #1215 in October 2023. The Concept Plan and Statement of Intent outlined in the OPUD 23-06 document shall be considered null and void and shall no longer govern any development of the described property. SECTION 2. All ordinances or parts of ordinances, in conflict with this ordinance are hereby repealed to the extent of the conflict only. SECTION 3. If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. SECTION 4. The subject property, located at 10094 North 97th East Avenue, is approximately 2.50 +/- acres and is zoned Residential Neighborhood Mixed (RNX) under OPUD 23-06. The abandonment is proposed to allow development of a single-family neighborhood on the property. A concurrent plat vacation request has also been submitted to vacate the final plat of Corrigan Glen. ANALYSIS • The subject property was annexed into Owasso City Limits in 2015 (Ordinance 1053). • OPUD 23-06 was approved by the Owasso City Council in October of 2023 (Ordinance 1215). The PUD allowed for the construction of 3 quadplexes, and its development standards were written exclusively to accommodate multi -family development. -•—The applicant - now intends to shift from the approved multi -family quadplex development to a single-family neighborhood. o To facilitate this proposed change, the applicant is requesting abandonment of OPUD 23-06 and a return to the base zoning of RNX. o No change to the base zoning is requested, as RNX allows single-family uses by right. o A concurrent request has also been submitted to vacate the Corrigan Glen final plat. If approved, the applicant intends to replat the property to subdivide it into individual single-family lots. Approval of the PUD abandonment would render all development standards within the OPUD 23-06 document null and void, and those regulations would no longer govern the development of the property. Page 2 PUD Abandonment- OPUD 23-06 • The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to the property. • Any development on the subject property must comply with all development, zoning, and engineering requirements of the City of Owasso. RECOMMENDATION In developing a recommendation, staff evaluated the PUD abandonment on the criteria outlined in Oklahoma State Statute Title 11, Chapter 1, Part 1, Article XLIII. Following this evaluation, staff concluded that the request meets all legal requirements for approval. As such, staff recommends adoption of Ordinance 1244, to abandon OPUD 23-06.
