6. Consideration and appropriate action relating to a request for Council approval of the Consent
Agenda. All matters listed under "Consent" are considered by the City Council to be routine
and will be enacted by one motion. Any Councilor may, however, remove an item from the
Consent Agenda by request. A motion to adopt the Consent Agenda is non - debatable.

8. Consideration and appropriate action relating to a request for Council to award a bid for the
Main Street Improvement Project.

Staff will recommend Council award the bid to Crossland Heavy Construction of Tulsa,
Oklahoma in the amount of $851,019.61 in order to construct various improvements including
streetscaping and street signage along Main Street between East 76th Street North and E. P
Street North.
9. Consideration and appropriate action relating to a request for Council approval of two
amendments to the Engineering Design Criteria, Construction Standards and Standard Details,
Agreement for Urban Engineering Services.

Staff will recommend Council approve amendments to the Agreement for Urban Engineering
Services as required by the Engineering Design Criteria as follows: formally changing the text
of the Agreement to include rate and fee adjustments approved by Council on May 1, 2007
and outlined in Ordinance No. 892; and, to revise the requirements for Design Engineers to
maintain Professional Liability Insurance.
10. Consideration and appropriate action authorizing the City Manager to enter into contractual
agreements in excess of $25,000 with one or more vendors for the sole purpose of removing
and disposing of tree and limb debris created as a result of the ice storm that occurred between
December 8 -12, 2007, and directing the City Manager to report all such contracts and their
individual amounts to the City Council within 24 hours of their execution.

limit, with one or more vendors for the sole purpose of removing and disposing of tree and

Tuesday, December 4, 2007
The Owasso City Council met in regular session on Tuesday, December 4, 2007 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 5:00 p.m. on Friday, November 30, 2007.
ITEM 1. CALL TO ORDER
Mayor Cataudella called the meeting to order at 6:30 p.m.

The invocation was offered by Rickey Hayes, Director of Economic Development.

ITEM 6. PRESENTATION OF THE EMPLOYEE OF THE MONTH
Mr. Ray introduced to the Council, Officer Howard Smith, a member of the City's Police
Department, as Employee of the Month for December, 2007.
ITEM 7. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF THE CONSENT AGENDA
A. Approval of Minutes of the November 20, 2007 Regular Meeting.
B. Approval of Claims.
C. Approval of a request from Public Service Company of Oklahoma to expand
their existing easement across a portion of the Bailey Ranch Golf Course, by
including an additional 5,558 square feet located near the tee box on hole
number 10 to the putting green on hole number eighteen.
Ms. Kimball moved, seconded by Mr. Bonebrake, to approve the Consent Agenda with claims
totaling $105,919.66, Healthcare self - insurance claims totaling $43,718.85 and payroll claims
totaling $367,443.91.

ITEM 8. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL TO AWARD A CONSTRUCTION CONTRACT
FOR PHASE I OF THE NORTH GARNETT ROAD REGIONAL DETENTION
PROJECT
Mr. Nurre presented the item and recommended Council award the bid for the construction of the
North Garnett Regional Detention (Phase I) — 60" Storm Sewer to McGuire Bros. Construction,
Sapulpa, OK, in the amount of $145,930.00. Mr. Bonebrake moved for Council to award the
contract as recommended. Motion was seconded by Ms. Kimball.

BACKGROUND:
In October of 2002, the City of Owasso applied for a grant through FEMA and the Oklahoma
Department of Emergency Management in order to receive funds for the purpose of developing a
multi - hazard mitigation plan. The City was notified in December of 2003 that the grant was
awarded in the amount of $20,800.
During the timeframe between October 2002 and December 2003, the City applied for, and
received, an additional grant for the development of an Emergency Operations Plan. The grant
amount for that project was $14,285 and the Emergency Operations Plan was approved and
adopted by the City Council in December 2003. A portion of the Emergency Operations Plan,
Annex T, recommended that the City of Owasso further develop a multi- hazard mitigation plan
upon receipt of the grant funding.
In 2004, a team consisting of city staff, business leaders, organization representatives, citizens,
and INCOG staff conducted a series of meetings to write a multi - hazard mitigation plan for the
Owasso community. The plan was designed to mitigate the effects of natural hazards and
disasters that Owasso could face on any given day. The plan identifies hazards inherent within
any city in Oklahoma, followed by measures that can be taken to minimize the effects upon
citizens. The Owasso City Council approved Resolution No. 2004 -15, adopting the Multi -
Hazard Mitigation Plan on August 17, 2004. A copy of the original staff memorandum
regarding the Hazard Mitigation Plan is attached for your information and review. The plan was
then forwarded to FEMA for their approval.
FEMA APPROVAL:
In November of 2007, after over three years, FEMA has approved the plan pending a re- adoption
of the Multi - Hazard Mitigation Plan by the City Council. FEMA has made minor changes to the
submittal by expanding narratives involving some of the definitions of hazards found in the plan,
amending language to make the plan more federally universal, and added a few new projects for
Owasso to consider. Those projects included the encouragement for the construction of safe
rooms in schools and the addition of building fire breaks to reduce the destructiveness of wild
fires.

Staff has reviewed the changes made to the plan by FEMA and has found that there is nothing in
any of the changes that would adversely effect the City or the community. The new projects that
FEMA added actually enhance the plan document.
Resolution No. 2007 -14, attached for your information and review, would once again adopt the
Mutli- Hazard Mitigation Plan as amended by FEMA.
RECOMMENDATION:
Staff recommends Council adopt Resolution No. 2007 -14, a resolution allowing for formal
Council re- adoption of the Multi - Hazard Mitigation Plan as amended by FEMA.

PURPOSE OF THE PLAN:
The purpose of the plan is as follows:
• Assess the ongoing hazard mitigation activities in the City of Owasso.
• Outline the planning process used by the City of Owasso in completing the multi - hazard
mitigation plan
• Identify and assess the hazards that may pose a threat to citizens and property
• Evaluate mitigation measures that should be undertaken to protect citizens and property
• Outline a strategy for implementation
• Plan maintenance and adoption
EXAMPLES OF A HAZARDS AND MITIGATION:
Hazards, as they are discussed in the plan document, consist of all natural hazards deemed to be
a threat to citizens of Owasso, as well as hazardous- materials events. Mitigation involves the
development of a plan or schedule to address those hazards. Both short term and long term
hazard mitigation opportunities are addressed. For example, an identified hazard can be the need
to update the storm siren system, improve the knowledge and training of all city employees to
enable them to provide CPR care in the event of a disaster, or supply NOAA weather radios to
all local government buildings, schools, and critical facilities. The mitigation plan would
identify the departments involved, the time -frame, and the funding needed to address those
needs.
DEVELOPMENT OF THE PLAN:
Surveys were utilized by the committee to obtain public input regarding those hazards that the
community felt was important. The surveys were available at City Hall and the Owasso Public
Library. Additionally, the surveys were also published in the Owasso Reporter and were made
available online through the City's website. The survey period was approximately 45 days.
Utilizing the results from the survey, the committee was able to develop a "Top 20" list of
hazardous mitigation projects. This list was further broken down to provide an action plan for
the 10 highest ranking mitigation projects. This list and action plan is included in Chapter 5 of
the plan and will be utilized for budgetary and planning purposes.
In order for the plan to be adopted by the City of Owasso, a public hearing is required to be
conducted. Following the public hearing, staff has listed the adoption of Resolution No. 2004 -15
as an action item in order to adopt the plan, providing there is not a significant amount of public
comment.
FUNDING:
As previously referenced, the funding for this project is available through a grant from the
FEMA and the Oklahoma Department of Emergency Management. While the City has been
notified that we have received the grant, the funds have not been transmitted at this time. Upon
receiving the actual funds, a supplemental appropriation increasing both revenues and
expenditures in the Emergency Preparedness budget will be necessary.

BACKGROUND:
Pursuant to the provisions of the Owasso City Charter governing the election of City Council
members, "the Council shall take action by Resolution to call any necessary Ward Elections ". In
2008, such election is required for Wards 3 and 4, each for a three year term.
The staff has prepared Resolution No. 2007 -15 which, if approved by the City Council, calls for
an election to be conducted for Wards 3 and 4. In addition, the proposed resolution identifies the
process to be followed in order to meet all legal requirements and allows for proper notification
to the Tulsa County and Rogers County Election Boards. Please note that the purpose of
requesting City Council action at this time is to allow for the required notice (such requirement
set at sixty days prior to the election process) to the Tulsa County Election Board.
The filing period for interested candidates will be February 4, 5, and 6, 2008. All candidates
must file a Declaration of Candidacy with the Tulsa County Election Board between the hours of
8:00 AM and 5:00 PM on either of these dates. Only qualified electors who reside within the
Ward for at least six months prior to filing a declaration of candidacy shall be qualified to hold
the office of Council Member for that Ward.
The primary election is set by the City Charter and will be held on March 4, 2008. All registered
voters residing within the city limits of the City of Owasso may vote in the election. Should one
of the candidates not receive the majority of all votes cast for a particular Ward, a general
election will be called. The general election, if necessary, will be held on April 1, 2008.
The elected Councilors will be sworn into office at the May 6, 2008 regular meeting of the City
Council.
RECOMMENDATION:
Staff recommends Council adoption of Resolution No. 2007 -15, calling for an election to be
conducted for the purposes of electing City Council representation for Wards 3 and 4.

BACKGROUND:
The subject roadway is located southwest of the intersection of East 106th Street North and North
Garnett Road (see Attachment A). Design for the roadway was reviewed and approved by
Public Works Engineering personnel in September 2006.
FINAL INSPECTIONS:
Final inspection for the roadway was conducted on December 7, 2007. All items identified at the
final inspection requiring correction to meet city standards have been completed. The
construction contractor has provided the required two -year maintenance bond for the
improvements (see Attachment B).
RECOMMENDATION:
Staff recommends Council acceptance of the East 103rd Street Roadway Improvements.

BACKGROUND:
The FY 2007 -08 Budget included matching CDBG funding for construction of a handicapped
restroom to be located adjacent to the Splash Pad at Rayola Park. Included as a portion of that
project was funding to provide improvements to the sidewalks leading to the restroom. A total
of $58,696 was budgeted in the Park Department Fund in order to match the CDBG grant of the
same amount.
In October, the Parks Department began the process of advertising for bids in order to provide
the Rayola Park restroom. The bid packet was developed with a base bid specification. The base
bid included the installation of a handicapped accessible restroom at Rayola Park, a restroom
which would match the existing restrooms located at both the Elm Creek Park and the Skate
Park.
A mandatory pre -bid meeting was conducted on November 21, 2007 and all bids were to be
received by November 30, 2007 at 10:30 AM. A total of four bid packets were obtained
following advertisement and a total of four companies attended the mandatory pre -bid meeting.
A total of four bids were submitted. A copy of the bid tally sheet is attached for your
information and review.
A review of the bids submitted indicates that all bids received were in compliance with
specifications. Staff is prepared to recommend award of the restroom and sidewalk to Builders
Unlimited of Tulsa, Oklahoma as they were the qualifying low bidder at $76,742. Builders
Unlimited has previously constructed two identical restrooms within the City of Owasso.
FUNDING:
Funds for the restroom and sidewalk improvements were included within the Park Department
budget in the amount of $58,696. The total project funding, combined with the CDBG grant, is
$117,392.
RECOMMENDATION:
Staff recommends Council award the construction of the restroom and sidewalk improvements at
Rayola Park to Builders Unlimited in the amount of $76,742.

BACKGROUND:
As part of the Vision 2025 Downtown /Neighborhood Rehabilitation Program, Tulsa County
voters endorsed a $1.1 million expenditure to promote community beautification and economic
vitality in the Owasso Downtown area. The proposal — which is in accordance with the Owasso
Downtown Development Plan (2001) — calls for the removal of overhead utilities, construction of
streetscaping and signage along Main Street between East 76"' Street North and 3rd Street North.
Design documents for the portion of the project involving the construction of streetscaping and
the installation of ornamental lighting and signs were completed on June 6, 2007 and public
advertisements were published in the Owasso Reporter. Bids were received and publicly opened
on July 9, 2007, with a single bid submitted by Sherwood Construction, Catoosa, OK in the
amount of $990,031.00. On August 21, 2007 Council rejected the single bid and directed that
this project be re -bid.
A Notice to Bidders was published in the Owasso Reporter on October 16, 2007 and October 23,
2007. Facsimile notifications were sent directly to approximately twenty local contractors along
with notices submitted to three plan rooms. A mandatory pre -bid meeting was held on
November 6, 2007, with seven (7) contractors in attendance.
EVALUATION OF BIDS:
Bids were received and publicly opened on November 16, 2007. Bids were received by
Crossland Heavy Construction, Inc. for $851,019.61 and Keystone Services, Inc. for
$981,799.25. Cobb Engineering evaluated the bids and has submitted their recommendation
(Attachment A). Cobb Engineering also tabulated both bids against the engineer's estimate of
$721,711.45 (Attachment B) and the bids were found to contain no errors.
PROJECT FUNDING:
The remaining funding for a majority of this project has been allocated by Vision 2025 in the
amount of approximately $644,000. In order to completely fund the total contract price of
$851,019.61, staff is recommending supplemental funding be allocated from the Hotel/Motel
Tax Fund in the amount of $200,000. Additionally, supplemental funding in the amount of
$100,000 is recommended to be utilized from the Capital Improvements Fund to cover the
remaining costs of the contract and provide for contingency funding.
RECOMMENDATION:
Staff recommends Council award the Main Street Improvements contract to Crossland Heavy
Construction, Incorporated of Tulsa, Oklahoma in the amount of $851,019.61.

SUBJECT: PROPOSED REVISIONS TO THE ENGINEERING DESIGN CRITERIA,
CONSTRUCTION STANDARDS AND STANDARD DETAILS
DATE: December 13, 2007
BACKGROUND:
In May 2005, Council approved Ordinance No. 812 amending the City of Owasso Code of
Ordinances and adopting the Engineering Design Criteria, Construction Standards and Standard
Details. These Criteria and Standards establish general guidelines and minimum standards to aid
in the design and construction of water, sanitary sewer, streets and stormwater system
infrastructure and enable the City of Owasso to effectively manage the design and construction
of this infrastructure according to comprehensive, systematic and technologically sound
procedures.
The anticipation of possible changes, revisions and updates was inherent in the development of
the Criteria and Standards. Section 0111 -B of the Criteria provides for the following procedures
for implementing changes:
— The Public Works Department Standardization Committee, chaired by the Public Works
Director, will evaluate proposed changes and distribute recommendations to City Staff.
— City Staff will evaluate each proposed change for further consideration.
— Public notice will be made of pending changes and comments solicited for those changes
warranting Staff recommendation for approval.
— City Staff will present recommended changes to the City Council for final approval.
— No approved changes to criteria and standards will be applied to projects for which initial
construction plans have been submitted.
PROPOSED CHANGES:
Section 0114.1 -B – Privately Financed Development - Qualifications for Professional Services –
requires all design engineers and land surveyors providing designs for infrastructure projects
within the City of Owasso to be licensed to practice by the Oklahoma State Board of Registration
for Professional Engineers. In order to facilitate a clear understanding between the City and the
design engineer /surveyor, the parties are required by this section to execute a contract for

engineering services. This document is included in the Design Criteria as Appendix B, Part H —
Agreement for Urban Engineering Services (Attachment A).
Staff proposes two changes to this agreement; the first based on prior action of the Council, the
second to facilitate the design of smaller infrastructure projects within the City's jurisdiction.
During its regularly scheduled meeting of May 1, 2007, Council approved Ordinance No.
892 formally approving rate and fee adjustments for services provided by the City of
Owasso and the Owasso Public Works Authority. One of these fee adjustments was to
raise the plan review fee from Fifty Dollars ($50.00) to One Hundred Dollars ($100.00)
per plan sheet submitted. Provision for these fees is described in Article 4 of the
Agreement for Urban Engineering Services. Staff recommends changing the text of the
Agreement to reflect the adjustments made by Council in Ordinance No. 892.
2. Current wording of Article 6 of the Agreement and Section 1.01 of the Standard
Specifications for Urban Engineering eering Services (General Provisions - Insurance and
Indemnity) requires the Design Engineer to maintain Professional Liability Insurance in
limits not less than One Million Dollars ($1,000,000.00). The purpose of this provision is
to limit or mitigate the City's risk relative to negligent acts, errors or omissions arising
out of professional services performed by the Design Engineer for the Project's public
infrastructure improvements. While many development projects within the City of
Owasso incorporate infrastructure improvements valued at $1,000,000 or more, there are
others for which the currently required limits of liability exceed the value of the
improvements but for which the design services of a Registered Professional Engineer are
required.
In order to alleviate this discrepancy, Staff has investigated the feasibility of allowing a
reduction in the limits of liability for this insurance based on the size of the project or the
value of the public improvements. While many communities in the surrounding area
maintain a single, fixed limit of liability for this insurance, others provide for a stepped
schedule based on project cost. Staff proposes the following schedule:

as best representing the interests of the City while balancing the interests of the design
and development communities.
For the purposes of this requirement, "Project Cost" is defined as the cost of all
engineering responsibilities and professional services as defined by the Standard
Engineering Design Criteria, Construction
Standards and Standard Details

Specifications for Engineering Services, as well as the cost of all labor and materials to
be furnished for the construction of the proposed public improvements for the Project.
The actual cost of these improvements is not yet known during the initial phases of the
Project when the agreement is signed. Staff proposes, as a part of this revision, to require
an Engineer's Estimate of Probable Project Cost, as an attachment to the agreement, in
order to establish the required extent of liability.
Staff believes allowing a stepped schedule relating the limits of Professional Liability
Insurance to the cost of the proposed project will help to create a more flexible
relationship between the Developer and the Design Engineer while continuing to require
an appropriate level of responsibility for professional duties and standards of care.
RECOMMENDATION:
Staff recommends approval of the described revisions to the Engineering Design Criteria,
Construction Standards and Standard Details, Agreement for Urban Engineering Services
(Appendix B, Part II).

AGREEMENT FOR URBAN ENGINEERING SERVICES
THIS AGREEMENT, entered into by and between the CITY OF OWASSO,
OKLAHOMA, a municipal corporation, hereinafter called "City" and
hereinafter called "Design
Engineer ".
WITNESSETH:
WHEREAS, the Design Engineer has been employed by the
Owner/Developer /Subdivider of the herein described real property to prepare all project
plans and specifications and to provide certain engineering services during the
construction of the hereinafter sometimes referred to as the "Project ", upon easements
and rights -of -ways to be owned or controlled by the City; and
WHEREAS, the Design Engineer is desirous of obtaining the review (and approval)
of the plans and specifications for said project by the City of Owasso Public Works
Department; and
WHEREAS, the City is willing to review the plans and specifications prepared by
the Design Engineer under the hereinafter described terms and conditions.
NOW, THEREFORE, in consideration of the foregoing and in consideration of the
hereinafter set forth promises and covenants, the parties hereto mutually agree as
follows, to -wit;

which shall be located on the following described tract of land:
2. The Design Engineer shall, in conformity with the provisions of the City's
Standard Specifications for Urban Engineering Services, including the City's
current Design Criteria, which are hereby incorporated and made a part of this
Contract by reference, prepare project plans, specifications, and other
engineering documents as may be necessary for the proper construction of the
project improvement, and shall perform all construction layout surveys, and
staking and periodic general construction supervision on the project
improvements as they are constructed by the Owner and his Contractor.
3. The City shall review (and approve) the project plans, specifications, and other
engineering documents for the construction of the project improvements
prepared and submitted to the City by the Design Engineer.
4. The Design Engineer shall compensate the City for reviewing (and approving)
plans and specifications for the project at the rate of One Hundred Dollars
($100.00) for each plan sheet submitted (other than plan sheet Standard
Drawings of the City of Owasso or of the Oklahoma Department of

Transportation), except that the minimum charge for each project shall be One
Hundred -fifty Dollars ($150.00). Payment shall be due and payable upon
presentation of the plans and specifications for the project for review by the
City. PFPI plan review and permit fees are waived for governmental entities.
No fees shall be collected by the City of Owasso on any public work or
improvement performed by or for any city, county, state, or federal
governmental entity; provided however, that this exemption shall not constitute
waiver of any ordinance requiring the issuance of such permits, and it shall
apply only to such permits issued directly to the governmental entity involved.
5. The Design Engineer hereby covenants that he slice is a Registered Professional
Engineer in the State of Oklahoma at the time of execution of this Contract, and
should the Design Engineer cease to be a Registered Professional Engineer
prior to completing performance of the terms and conditions of this Contract,
the Design Engineer shall immediately notify the City and shall engage a
Registered Professional 1 _ngineer acceptable to the City to complete
performance of the promises and covenants contained herein.
6. The Design Engineer further covenants and agrees that he; slic maintains and is

Project Cost shall be defined. as the cost of all engineering responsibilities
and professional services defined by these specifications as well as the cost
of all labor and inaterials to be furnished ill constriction of' the proposed

part of this contract, an Engineer's Estin-iate of Probable Project Cost,
signed and sealed by the Design Engineer, in order to esta.blisli the required
e:xteni of liability.
Certificates of Professional Liability insurance shall be submitted on the
anniversary dates thereof, showing that coverage is maintained in
continuous force and effect for a period of three (3) years following final
acceptance of the project by the City of Owasso. Said Certificates shall
further provide that such insurance will not be cancelled by the insurer
without the insurer first giving the City ten (10) days written notice of
cancellation.
1.02 PLANS AND RECORDS
The City shall, upon request, provide the Engineer with one copy of any
preliminary plans, photographs, reports, calculations, topographic surveys,
utility location plats and other pertinent public records currently in
possession of the City and applicable to the work, provided the City is
reimbursed for any cost of reproduction by Engineer.
1.03 OWNERSHIP OF THE WORK
The Design Engineer shall furnish the City with copies of data, field notes
and studies utilized as instruments of service if requested for reproduction by
City.
1.04 TRANSFERS
The Design Engineer shall not assign, sublet or transfer any interest in the
work covered by this Engineering Agreement without the prior written
consent of the City. The consent to assign or sublet any portion of work
shall not relieve the Design Engineer from his primary responsibility for the
performance of that portion of the work so transferred.
1.05 REVIEWS AND ACCEPTANCES
All preliminary and detailed designs, plans, specifications, estimates and
other documents prepared by the Design Engineer shall be subject to Review
and acceptance by the City.

No acceptance shall relieve the Design engineer of his professional
responsibility or obligation to correct any defects or errors in his work at his
own expense.
1.06 APPEARANCES AND CONFERENCES
The Design Engineer shall provide adequate representation at design
conferences as may be requested by City in connection with the work or the
proj ect.
The Design Engineer shall confer with the City at any time with respect to
interpretation of plans, correction of errors and omissions, and preparation of
such additional drawings or specifications as may be required as the work
and project progresses.
1.07 PENALTIES
In the event the Design Engineer fails to comply with any of the provisions
of the Agreement for Urban Engineering Services, the Engineering
Department shall not consider entering into any subsequent agreements with
the Design Engineer.
SECTION 2 — CONSTRUCTION CONTRACT PLANS
2.01 GENERAL PURPOSE, REQUIREMENTS AND OBJECTIVES
The Construction Contract Plans shall provide the City with adequate general
plans, design details, construction specifications, and related documents from
which contractor may construct the Project.
A preliminary plan which approval is necessary before the actual Construction
Contract Plans are developed shall, in general, resolve all fundamental location
and design problems and delineate them in such a manner as to permit the
preparation of final detailed Construction Contract Plans.
2.02 EXISTING INFORMATION AND DATA
The Design Engineer shall:
a. Provide all professional services necessary to evaluate and coordinate
existing information and date which will be necessary in the preparation
of detailed Construction Contract Plans.

b. Develop new information and refine existing information and data to
current status to comply with the requirements of these Specifications.
c. Secure appropriate current City written approval of the proposed
preliminary plan development criteria and procedure.
2.03 CONSTRUCTION CONTRACT PLANS
The Design Engineer shall:
a. Prepare detailed Construction Contract Plans, in both horizontal and
vertical dimensions, properly dimensioned, showing all existing
topographical features, surface and subsurface facilities as determined
by field surveys or as verified by utility or facility owners. These plans
shall be prepared in accordance with current design practices of the City
and shall include title sheets, typical sections, general notes and
summaries of quantities. The lists of quantities shall be separated as may
be required for meeting financing requirements and properly symboled in
accordance with the Standard Construction and Material Specifications.
Plan and profile showing alignment and grade with locations of right of
way lines shall also be included. Plans shall be accompanied by such
other documents as may be required, and they shall also conform with the
requirements of applicable portions of the City's Construction and
Material Specifications, Design Criteria, Standard Construction
Drawings, Specification for Subsurface Investigations and Man
preparation procedures and other directives of instruction of the City.
b. Provide, in connection with utilities, the following:
Each affected company with an early notification concerning
contemplated work and furnish each company approved preliminary
plans. Arrangements shall be made with each affected company for a
plan showing it's existing and proposed facilities in relation to the
existing and proposed construction and submit each plan to the City for
approval. The Design Engineer shall, when instructed, incorporated utility
revision plans in the construction plans, and shall secure from the utility
company a detailed estimate of its cost for making changes prepared in
accordance with the requirements of the City.
c. Prepare off -site right -of -way plans and descriptions, or bring to current
status existing property map and right -of -way plan of descriptions, all in
conformance with the requirements set forth in these Specifications and
other instructions issued by the City. More specifically, the Design
Engineer, in developing the right -of -way plan shall:

1. Prepare a preliminary right -of way plan for field review and
approval immediately following approval of alignment and
profile showing centerline of survey, estimated construction
limits, property lines, parcel numbers, ownership of
record, recommended right -of -way limits and existing right -of-
way limits. The preliminary right -of -way plans shall be prepared
to a scale of one (1) inch equals one hundred (100) feet. In
congested or urban subdivided area where one hundred (100) foot
scale is unsuitable, the right -of -way plans shall be prepared to a
scale of one (1) inch equals twenty (20) feet. The preliminary
plans may be a print of pencil tracings appropriately marked to
avoid confusion with the final right -of -way plans
2. The final right -of -way plan shall be developed concurrently with
the detailed Construction Contract Plan, and shall be completed
with prints thereof submitted ten (10) days prior to the Field and
Office Check. The property map and summary of additional
right -of -way required shall be a part of the final right -of -way
plan. Property lines are to be determined and shown on the plan
accurately enough that a proper legal description can be written
there from without reference to other material. In addition, the
right -of -way plan shall show the beginning and end of project,
match lines and numbers of matching sheets. (To facilitate use of
the right -of -way plan independently from the other sections of the
Construction Contract Plan, right -of -way plan sheet numbers a
separate series of numbers for sheets comprising the right -of -way
plan proper.) When prints or reproducible tracings of right -of-
way plans are furnished separately, they shall include the
Construction Plan title sheet, showing vicinity map and legend of
symbols used. Final right -of -way plans shall reflect the latest
information available, all plan revisions, and all approved
changes in right -of —way to be acquired.
Legal descriptions shall be prepared for all remaining parcels
of property to be acquired and submitted concurrently with the
final right -of -way plans.
The Design Engineer, shall, upon request, prepare appropriate
plats in accordance with the foregoing.
d. The Design Engineer shall submit the final plans to the City for review,
together with is recommendations regarding final acceptance, as
follows:

1. Plans, elevations and details, unless otherwise specified, shall be
presented on sheets twenty -two (22) inches by thirty -four (34) inches
in overall size developed at appropriate scale showing all horizontal
and vertical information in sufficient detail to permit construction
staking on the ground and to indicate and delineate all details
necessary for the construction of the complete facility by a
construction contractor.
2. The required number of copies of the completed Construction
Contract and other necessary documents shall be assembled and
presented, and necessary personnel familiar with each design phase or
detail shall be assigned to accompany and consult with City upon
field Office Conference at times designated by the City.
3. All Changes and modifications required by the City as a result of
Field and Office Conferences shall be made, and acceptable
reproducible tracings of the detailed construction Contract Plans and
other necessary documents shall be delivered to the city.
4. All things required shall be submitted to the City with a transmittal
letter providing a brief narrative summary of the pertinent facts
concerning the development of the Project. The letter shall advise the
city of any special or unusual features of design or construct ion of the
Project.
2.04 CITY'S OBLIGATION
The City shall review all of the Engineer's submissions and transmit to the
Design Engineer the dates of acceptance for all submissions, or, if a
submission is not acceptable, a statement of the changes to be incorporated
prior to acceptance thereof. City response shall be within 10 working days
of receipt.
SECTION 3 — CONSTRUCTION SUPERVISION
3.01 GENERAL PURPOSE, REQUIREMENTS AND OBJECTIVES
The purpose of supervision of construction by the Design Engineer is to
assure that the Project shall be constructed in a good and workmanlike
manner and in accordance with the plans, specifications and other contract
documents.

It shall be the Design Engineer's obligation to achieve this purpose and his
obligation shall include, but not be limited to, the matters set forth in these
specifications.
3.02 ENGINEER'S SUPERVISORY OBLIGATIONS
The Design Engineer shall perform the following in connection with the
construction:
a. Construction layout surveys and consultation and advise during
construction.
b. Visits to the site of the construction at such frequent intervals as may
be necessary, during construction but a minimum of weekly visits or
as required by the Engineer.
C. Review and check, following the award of a construction contract, the
shop drawings of installed equipment, structural agreements and
erection plans for each structure designed by the Engineer. Such
checking shall verify the conformance of shop drawings with design
drawings.
d. Preparation of supplementary detailed drawings, together with
specifications pertaining thereto when required.
e. Providing contract drawings as necessary to show the work as actually
constructed by furnishing the City a set of "Record" drawings on
computer disc (AutoCad format compatible with City software), mylar
reproducibles and two sets of blackline drawings.
f. Assistance to the City in start-up and testing of installed equipment.
g. Certification of "Record" quantities.
h. Accompany representative of the City in the Final Inspection of the
project.
Submit any soils analysis reports as required before or during
construction.
J . Provided all staking for control of alignment and grade necessary for
the satisfactory construction of the project and additional staking as
required by the Engineer.

3.03 CHANGE ORDERS DURING THE COURSE OF CONSTRUCTION
a. If during the course of construction it becomes necessary to change the
detailed plan of construction due to unforeseen obstructions, conflict with
other utilities, other agencies or circumstances, or conditions not
anticipated prior to the award of the Construction Contract, the Engineer
shall prepare the necessary Change Orders and Revised Plans in order to
effect the necessary changes in construction.
b. The Design Engineer, during the course of Preparation of necessary
Change Orders, shall coordinate the revised plans with all affected
agencies or firms on which original coordinated approval was secured in
these specifications prior to approval by the City of the necessary Change
Order.
c. The Design Engineer shall carry out the necessary negotiations with the
Construction Contractor prior to presentation to the City of the Change
Order for approval. Following approval by the Construction Contractor,
The Design Engineer shall present same to the City in accordance with the
established procedures for approval of the original Construction Contract
as covered in those specifications.

AUTHORIZATION FOR CITY MANAGER TO EXCEED SPENDING
LIMIT OF $25,000

BACKGROUND:
As a result of the recent ice storm event, staff has been exploring opportunities to address the
related storm debris. On a short term basis, staff has opened a storm debris drop -off site at the
south entrance of the Owasso Sports Park located on E. 106` Street North, between Mingo and
Garnett Roads. This facility will be open 7 -days a week through December 22, 2007 from 9:00
AM to 5:00 PM. This will allow citizens who have the means and desire to remove storm
related debris from their property immediately. The facility will re -open on December 26, 2007
and stay open until such time that storm debris deliveries are of a manageable quantity and can be
resume at the Owasso Recycle Center.
On a long term basis however, it is evident that the volume of debris as well as the inability for
many citizens to remove it is debilitating. Beginning Wednesday, December 12, 2007, staff
initiated discussions with contractors regarding debris removal on a citywide basis. Contracting
this type of work has become common in cities experiencing this type of weather event, as well
as following tornadoes or hurricanes. There are both national and local (state) contractors that
have experience in this type of debris removal.
The scale of this type of event will result in a need to expend funds well in excess of the City
Manager' s spending authority, in fact the total figure could be as much as eight times that
amount. With that in mind, staff is requesting the Council authorize the City Manager to enter
into contractual agreements with one or possibly more vendors for the removal and disposal of
tree and limb debris from the ice storm.
If this action is taken by the Council, staff would then solicit at least three (3) sealed quotes for
this service. There would be no advertising requirement necessary or minimum time frame.
Staff would solicit the quotes based on a unit price (for example - cost per cubic yard of debris).
Upon opening and evaluating the quotes, the City Manager could then enter into a contract for
this purpose. Citizens of Owasso would then be notified of this action and be provided
information regarding the clean -up process (schedule, bringing storm debris to the curb for pick-
up, etc.)
Please note that a supplemental appropriation would be necessary at the conclusion of the storm
debris removal process. As you can imagine, staff is still working on the details of such a
program and dditional information regarding it may be presented on Tuesday evening.
RECOMMENDATION:
Staff recommends Council authorization for the City Manager to enter into contractual
agreements with one or more vendors for the removal and disposal or tree and limb debris
created as a result of the ice storm, such contracts to be exempt from the $25,000 spending
limitation.
